Recommendation: Adopt Resolution No.04-122 approving tentative tract map No. 33195 subject to conditions. II. Executive Summary: This map will create 33 lots for financing and conveyance purposes. No new residential lots will be created. The lots created for the clubhouse and maintenance facility will allow financing of those improvements. The golf course lots will allow the future recordation of a conservation easement preserving the golf course as open space in perpetuity. III. Planning Commission Action: This map was presented to Planning Commission at its November 16, 2004 meeting. Staff will orally report on the commission action on this matter. IV. Background: A. History: Resolution No. 04-122 On June 24, 2004, the City Council approved Precise Plan 04-01 and TT 31836 adding 95 new residential lots into the Palm Desert Country Club area. B. Property Description: The property included in this map generally comprises the existing golf course property but also includes the clubhouse area and the new maintenance facility area. C. Zoning and Land Use: The golf course area is zoned O.S. (open space) with the residential lots zoned R1-9000 and the present driving range area zoned PR-6 (planned residential 6 units per acre). Map Description: This map has been drawn to comply with the provisions of code and in accordance with the previously approved precise plan. The map, which comprises 193.47 acres, will create 33 lots for financing and conveyance purposes. No new residential lots will be created. The Tots created for the clubhouse and maintenance facility will allow financing of those improvements. The golf course lots will allow the future recordation of a conservation easement preserving the golf course as open space in perpetuity. Required Findings for Approval: The required findings for approval of this map are contained in the draft resolution of approval. Environmental Review: The Director of Community Development has determined that the proposed map has been previously assessed as part of Precise Plan 04-01 and TT 31836. No further review is necessary. CASE NO. TT 33195 (RELATED TO PP 04-01 AND TT 31836) WHEREAS, the City Council of the City of Palm Desert, California, did on the 18th day of November 2004, hold a duly noticed public hearing to consider the request of PDCC Development, LLC for approval of the above described project; and WHEREAS, the Planning Commission by its resolution No. 04-122 recommended approval of TT 33195 subject to conditions; and has WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the Califomia Environmental Quality Act, Resolution No. 04-106" in that the Director of Community Development has determined that the project was reviewed as part of PP 04-01 and TT 31836 and no further environmental review is necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts and reasons to exist to justify approval of the tentative tract map: TENTATIVE TRACT MAP 1. That the proposed map is consistent with applicable general plan. 2. That the design or improvement of the proposed map is consistent with applicable general and specific plans. 3. That the site is physically suitable for the type of development. 4. That the site is physically suitable for the proposed density of development. 5. That the design of the tract map or the proposed improvements is not likely to cause substantial environmental damage or substantially and avoidably injure fish and wildlife or their habitat. 6. That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. PLANNING COMMISSION RESOLUTION NO. 04-122 8. That the size of the lots created is sufficient so as to not negatively impact any future passive or natural heating or cooling opportunities in the subdivision. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the City Council in this case. 2. That the City Council does hereby approve TT 33195 on file in the Department of Community Development, subject to conditions. The development of the property shall conform substantially with exhibits on file with the Department of Community Development, as modified by the following conditions. 2. Recordation of the map shall occur within two years of the date of this approval unless an extension of time is granted; otherwise, said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Written comments concerning all items covered by these public hearings shall be accepted up to the date of the each hearing.
