$20,600, Contract No. C-21740;
2. Authorize the expenditure of $20,600 and appropriation of funds from Account
No. 236-4195-454-3090;
3. Appropriate a 10% contingency in the amount of $2,260; and
4. Authorize the Mayor to sign the contract documents
Discussion:
At its meeting of December 9, 2004, City Council authorized staff to call for Requests for
Proposals for subject contract. Staff estimated that the consulting costs would be
$75,000.
The two proposals received are:
1. Hilton Farnkopf and Hobson (HFH), LLC of Newport Beach, California submitted
a proposal in the amount of $65,500
2. Huls Environmental Management, Inc. of Covina, California submitted a proposal
in the amount of $20,600.
Both firms are well qualified and have extensive experience in the solid waste and
recycling field. HFH and Huls have performed work for various organizations within the
Coachella Valley.

As reflected above, the bids are quite different in cost. Staff was concerned that Huls
(the low bidder) would not be able to perform activities as outlined within the RFP. A
meeting with the representatives of Huls was conducted on March 16 to discuss its
process and costs to perform the activities as outlined within the RFP, and they assured
the City that it would be able to perform all identified activities at the cost stated.
Through this meeting and contact with references, staff feels confident that Huls will be
able to perform under the contract.
The objective is to have the consultant assist staff in the following:
- Identify programs and services that further expand the City's recycling efforts
within the business and residential areas
- Identify gaps in services
- Conduct surveys
- Compile data for analysis
- Contact top 40 businesses regarding recycling programs
- Conduct waste audits
- Conduct survey/assess residential and commercial recycling programs and
services to develop recycling information including volumes, participation rates,
and weekly setout rates
This information would be used to develop program improvements for individual
businesses, organizations, and Citywide activities. It will also assist to identify and
target areas with low participation rates. Staff, Waste Management, and the consultant
will work together to perform activities and improve recycling efforts within Palm Desert.
Staff recommends that the City Council award the consulting contract to Huls
Environmental Management, Inc., in the amount of $20,600, approve a 10%
contingency in the amount of $2,260, and appropriate funds.

AGREEMENT
THIS AGREEMENT is made and entered into in the City of Palm Desert on this
day of, 2005, by and between, THE CITY OF PALM DESERT, a municipal corporation,
hereinafter referred to as "CITY" and Huls Environmental Management, hereinafter
referred to as "CONTRACTOR".
WITNESSETH:
WHEREAS, on September11, 2001, CITY requested quotes from six (6) potential
vendors to remove and replace flooring at the Portola Community Center per
specifications; and
WHEREAS, pursuant to said invitation, CONTRACTOR submitted a quote, which was
accepted by CITY for said services.
NOW, THEREFORE, in consideration of their mutual promises, obligations, and
covenants hereinafter contained, the parties hereto agree as follows:
(1) TERM. The term of this Agreement shall be 180 days form execution or
such later date as may be agreed between parties.
(2) CITY'S OBLIGATION. CONTRACTOR shall be paid in the manner set forth
in the proposal, as accepted by City, subject to such additions and deductions as may
be made pursuant to the contract documents and applicable Law.
(3) CONTRACTOR'S OBLIGATIONS. For, and in consideration of the
payments and agreements hereinbefore mentioned to be made, and performed by
CITY, CONTRACTOR agrees with CITY to furnish the services and to do everything
required by this Agreement and the said specifications.
(4) INSURANCE. Contractor agrees to obtain and maintain the insurance
policy and coverage as specified in the contract documents.
(5) AMENDMENTS. Any amendment, modification, or variation from the terms of
this Agreement shall be in writing and shall be effective only upon approval by the City
Council of the CITY.
(6) TERMINATION. Either party may terminate the contract with thirty, (30) days
written notice for any reason.

following: (a) The Agreement; (b) The Notice Inviting Quotes; (c) The Quote
Terms and Conditions; (d) The Specifications; (e) The Proposal; (f) Addenda No. (s)
None :(g) Any additional or supplemental specifications, instructions or notices issued
in accordance with provisions of the Contract Documents. All of said Documents
presently in existence are by this reference incorporated herein as if here set forth in full
and upon proper insurance of their documents they shall likewise be deemed
incorporated.
(8) NOTICE. All written notices to the parties hereto shall be sent by United
States mail, postage prepaid by registered or certified mail addressed as follows:

(9) LITIGATION COSTS. In the event, an action is filed by either party, to
enforce any rights or obligations under this Agreement, the prevailing party shall be
entitled to recover reasonable attorney's fees and court costs, in addition to any other
relief granted by the court.
(10) AUTHORITY TO EXECUTE AGREEMENT. Both CITY and CONTRACTOR
do covenant that each individual executing this Agreement, on behalf of each party is a
person duly authorized.

Dear Mr. Kohn,
Thank you for considering the technical and price proposal of Huls Environmental
Management, LLC (Huts Environmental). Our firm is a full service environmental
management limited liability company (LLC) located in the City of Covina in Los Angeles
County, but in close proximity to Coachella Valley. In fact, Huls Environmental has
worked with many of the communities of Coachella Valley through our contract with
Verizon Communications in which we are responsible for coordinating annual telephone
book recycling drives with the many school districts located in your and nearby
jurisdictions.
We invite your close scrutiny of our proposal, and look forward to a favorable reception
by the City. We are fully capable of undertaking the work in the timely fashion
stipulated. As requested, we are providing herein three references, our cost proposal, a
technical scope of work, and all associated forms. We also meet all insurance
requirements as stipulated in the RFP.

PROPOSAL
1. Compilation of data related to residential and commercial recycling. Data will be
gathered through research and surveys with results to include: the type of collection
(manual, automated, semi -automated, backyard), size of container (bin or cart),
participation and setout numbers/rates for residential and commercial accounts in Palm
Desert. The data will be shown in monthly and annual totals. The final report will
include a summary of all recycling data and recommendations to improve, expand or
add programs and recycling services within the City of Palm Desert. The City expects
the data and all associated reports within 90 days of a notice to proceed.
2. Performing waste assessments of the top 40 commercial waste generators within the
City of Palm Desert. Waste assessments will include a complete analysis of the waste
stream, current recycling and disposal methods/activities and recommendations for
additional waste reduction. The recommendations will be made in the form of a waste
reduction plan for each business assessed and will include an implementation schedule.
The City expects the data and all associated reports within 180 days of a notice to
proceed.
Note: The City of Palm Desert will provide "in conjunction with" the Franchise Waste Company
access to all available information and data necessary to perform the work. City staff will also
assist Consultant with contacting the 40 commercial businesses chosen for waste assessments.

SCOPE OF WORK
Introduction
As we understand the project specifications, the City of Palm Desert (City) is motivated
to continue its fine efforts to increase recycling. The motivation comes from the fact that
the City is experiencing extensive, rapid growth and desires to maintain diversion above
the 50% mandate of AB 939. To further this effort, staff developed an RFP for recycling
services. The objective is to have a consultant function as an extension of staff and
complete residential and commercial surveys, gather data and perform analysis of the
data, perform commercial waste assessments, and draft a final report with
recommendations to the City designed to improve or expand recycling and diversion
programs. Huls Environmental can perform this function in an exemplary and cost-
effective manner as it has done for literally dozens of jurisdictions in Southern
California. In the following sections, we provide our price proposal, technical response,
and qualifications.
Price Proposal
Our total proposed price is $20,600. This includes both tasks as identified by the City of
Palm Desert as detailed below.
Compilation of data related to residential and commercial recycling is estimated to cost
$10,600. Data will be gathered through research and surveys. The final report will
include a summary of all recycling data and recommendations to improve, expand or
add programs and recycling services within the City of Palm Desert.
Waste audits are estimated to cost $250 each, with a total of 40 completed
assessments, for a subtotal of $10,000. Waste assessments will include a complete
analysis of the waste stream, current recycling and disposal methods/activities and
recommendations for additional waste reduction. The recommendations will be made in
the form of a waste reduction plan for each business assessed, and will include an
implementation schedule.
Schedule
The data and all associated reports related to compilation of data task within 90 days of
a notice to proceed. This means that all survey and survey reduction and analysis will
be completed and submitted within the 90 days.
The City expects the waste assessment reports to be completed and submitted within
180 days of a notice to proceed. This means that all research and analytical activities
will be completed with the 180 days.
Both tasks will start concurrently with the receipt of a notice to proceed from the City.

Below, we present our proposed methodology and estimated timelines to accomplish
the work.
Proposed Methodoloav
Task 1 Conduct surveys, compile and reduce data, assess and recommend
improvements, expansions, and/or additions to the City's diversion
system
Huls Environmental will conduct a comprehensive recycling and residual disposal
survey that will meet the needs of the City of Palm Desert. New data will be gathered
and tabulated to ensure the accuracy of existing data and project diversion and disposal
in the residential and commercial sectors.
For the residential sector, we are aware of the presence of gated communities. One
aspect that can be studied is the participation of these communities along with the tract
home, condos and town home, and mobile home components of the single-family
sector.

PROPOSAL TO CITY OF PALM DESERT
To do this survey, we will first stratify the residential sector based on local demographic
data. We will identify a representative sample of homes/neighborhoods to survey from
relevant populations as indicated above. For gated communities and any enclosed
residential areas, we will obtain permission from homeowner associations or other
tenant groups to conduct our survey. Once we have identified our samples, we will set
aside one month to conduct the survey at each sampling location. The reason to do this
is that the industry standard to assess participation is how many set outs in one month
time. Typically, nearly all residents who do participate will do so within one month. We
will also select a month, prior to summer, when all or a majority of residents should be
present. In addition, we will coordinate our selection of sample locations in consultation
with the hauler, who may suggest specific routes for inspection.
In our survey protocol, our team will travel ahead of the collection vehicle on the day of
refuse and recycling collection to assess the following per home:
• How many total containers set out?
• Recycling containers set out?
• Green waste containers set out?
• How full are the containers?
• Is there contamination of the recycling and green waste containers?
We will perform this survey on consecutive weeks for the one -month period to gain a full
measure of participation from surveyed residents. Upon completion of this survey, we
will extrapolate the results to the entire population. We expect to obtain certain results
from this survey. Besides set out and participation rates, we will be able to assess
contamination levels, quantify the volume of trash, recyclables and green wastes, and
identify the need for additional promotion, education, and outreach.
In addition, we will review the diversion reports of the hauler for the weeks in question.
We will compare the set out statistics reported by the hauler and the amount of
contamination and recycling reportedly collected with our data. Any discrepancies or
irregularities will be discussed with the City and identified in our final report.
For the commercial sector, Huls Environmental will perform an "Integrity Waste Survey"
(IWS). The IWS focuses on efficient use of bins, containers, cans, carts and other
recycling and solid waste receptacles utilized by residential and commercial customers.
Huls Environmental personnel will accurately assess the capacity of the receptacles
used and the volume used for recycling and solid waste. Simply put, Huls
Environmental determines "how full' containers are, in gallons or cubic yards, prior to
collection by the franchised hauler. Two important factors are determined by this
process; 1) how efficiently the containers are utilized; and 2) if there is adequate
opportunity to increase recycling and reduce costs using existing containers. This is
particularly important for businesses wishing to recycle while reducing service levels,
thereby reducing service costs overall.

PROPOSAL TO CITY OF PALM DESERT
We plan to develop and conduct our survey by going "door to door" among all
businesses that we believe contribute significant amounts of waste to the disposal
stream. This includes hotels, restaurants, food stores, construction sites, resorts and
golf courses as a minimum. During this process, we will not only assess the amount of
waste but allow us to select the 40 businesses we will plan to conduct detailed waste
assessments in Task 2.
At the completion of the surveying and analysis, Huls Environmental will prepare a
comprehensive report that will integrate all data, compare existing and new data,
implement quality control and cross-checks, and make defensible findings within 90
days of Authorization to Proceed:
• The set -out and participation rates for residential and commercial customers
• Existing diversion in residential and commercial sectors
• Percentage of recyclable materials, by type, currently being recycled
• Materials identified as being recycled and those which are not
• Service collection type used, by percentage, for both sectors
• Types of recycling programs used and their effectiveness
• Volume of containers utilized for recycling vs. solid waste disposal
• Recommended steps to improve recycling for residents and businesses
• Economic incentives for business customers generating recyclable materials
• Diversion increase estimated by implementation of recommended programs
In all subtasks associated with Task 1, Huls Environmental will work closely with the
City's franchised hauler in gather existing and new data required by the RFP.
In addition to the requirements of the RFP for data shown in monthly and annual totals,
Huls Environmental will also submit data in quarterly totals to determine any seasonal
fluctuations in recycling and solid waste disposal. The final report will be discussed with
City staff to determine next course of action. Huls Environmental will assist City in
"action steps" identified at the completion of Task I.
Task 2 Perform waste assessments of the top 40 commercial waste generators
In keeping with our proprietary method of commercial waste assessment as discussed
in our qualifications, we shall conduct no less than 40 waste assessments at identified
commercial waste generators. We understand that certain information will be made
available from the hauler and that the City will help to identify the top 40 firms. We also
expect to use information from Task 1 to help us identify the likely candidates. However,
we can provide some preliminary suggestions on targets at this proposal stage.
First, Palm Desert is advertised as a vacation destination. The area is replete with
hotels, resorts, restaurants, golf courses, retail, and ancillary services. A review of the
CIWMB web site disclosed a profile of the business sector in the City by tons disposed:

The major businesses in the City are likely to be retail trade -restaurants (27% of total
business waste), retail trade -other (e.g., department stores and shopping centers that
contribute over 12% of total business waste), services -hotels (e.g., resorts and lodging
that generate 7.7%), retail trade -food stores (e.g., markets about 5%), and construction
(C&D projects that generate about 7%). Altogether, these source types contribute
about 60% of all business sector waste in the City. As a consequence, any waste
assessments will have to focus on these specific business groupings if significant
diversion is desired. A review of the City's website showed the following specific
examples:

• 14 shopping plazas
• One Eleven Town Center
• The Gardens on El Paseo (200,000 sq ft mall)

We have performed waste stream analysis and business recycling for over 30

For instance, in the City of Bell, Huls Environmental is currently working on a waste stream
analysis for a large company that produces grout. They are disposing of large amounts of
the spent inert material to the tune of nearly $100,000 per year. Huls Environmental has
found a likely market for the waste, and is negotiating the recovery of the material at a
price that will save nearly 80% of the cost for the account.
As part of a citywide waste auditing program in the City of Duarte, our staff conducted a
waste audit at City of Hope Medical Research Center, the largest generator in the City.
Not only did we set up cardboard, wastepaper, and CRV recycling, but through our efforts
institutional recycling was established for plastics and other materials. The Center
received one of the California Integrated Waste Management Board's "Statewide Top Ten
WRAP Winners" in 2004 as a result of our efforts. Furthermore, we wrote a winning
competitive grant in the amount of $65,000 for the City of Hope to the Department of
Conservation to implement a public venue recycling program throughout.the campus. This
was later matched with another $10,000 from the City of Duarte to augment the DOC
grant.
In Rancho Cucamonga, Huls Environmental has been evaluating multifamily complexes in
the City for the past six months. As a result of the waste stream analyses, Huls
Environmental has devised up to four potential programs for implementation. These
include switching a portion of the trash bins for recycling bins, installing 96 gallon
automated carts at all enclosures, conducting collection events on a monthly basis, and
conducting weekly collection at a single complex location. The systems are currently
being implemented with the full support of the management company and Trammel Crow
Properties the property owner.
Previously, Huls Environmental investigated the feasibility of establishing plastic shrink
wrap recycling routes in Rancho Cucamonga as well. This project stemmed from a series

of warehouse firm waste audits performed over two months that identified significant
quantities of recoverable plastics. Huls Environmental has worked closely with the firms
and with plastic recyclers who are currently negotiating for the free collection of the plastic
that shall be remade into plastic pallets overseas. We expect this project to be initiated
presently.
The Irvine Company has retained Huls Environmental through its affiliate company Div -
Con Environment to manage its complete waste stream generated by over 25 million
square feet of office and manufacturing premises in San Diego, Irvine, Los Angeles, and
San Jose. Huls Environmental has used its technical staff and a "squad" of trained interns
to assess bin service at over 92 separate properties. Based on the review, Huls
Environmental negotiated a successful agreement with the existing hauler to set up
recycling that will divert no less than 40% of currently disposed waste, and result in
significant cost savings to the Irvine Company. It is noted that Irvine Company pays Huls
Environmental for its consulting service through a percentage of the savings accrued from
the projects.
Diversion systems survev. design, and development.
Huls Environmental has conducted numerous benchmark studies for recycling related
programs. Not only has Huls Environmental conducted over a dozen Board -approved new
base year studies, but it has conducted several specialty studies for the purpose of
benchmarking key information for either development or monitoring of diversion efforts.
For instance, for Rancho Cucamonga, that City fell far below the diversion goal in 2000,
after having nearly achieved the diversion mandate in previous years. The City did not
anticipate such a situation and called upon Huls Environmental to investigate the reasons
why in 2002. Huls Environmental conducted a three weeklong disposal study at the local
transfer station/materials recovery facility. The study was organized on the basis of
commercial routes, waste streams, and materials. The study was able to clearly identify
the reasons for the shortfall of diversion, and recognize opportunities for diversion
development. As a result, programs in C&D debris recycling, illegal hauling, commercial
sector recycling, and education were launched over the next two years resulting in
significant progress toward the mandate.
In another instance, Huls Environmental conducted benchmarking studies for residential
and commercial waste disposal and recycling in Diamond Bar in and about 1999-2000.
The city did not have any viable program other than voluntary recycling, reflected in a low
diversion rate of below 20% in 1998. Fearful of possible sanctions from the Waste Board,
the City retained Huls Environmental to conduct benchmark studies and then facilitate a
six-month long task force to consider the findings and help develop a totally new waste
collection and recycling system. Huls Environmental conducted waste assessments at all
300 commercial accounts in the City, and conducted a detailed assessment of the
residential sector as well. This information was shared with the task force that was set up
by City Council. Over a six-month period, Huls Environmental facilitated the task force,
educating over 60 community representatives in the process, and culminating in their

selection of one of the more rigorous diversion programs in the state. The City enacted a
citywide disposal ban on recyclables (1999), a variable rate for both sectors (2000), and
rolled out their new system in late 2000. The City has adopted several other programs as
well based on the benchmark studies, resulting in a diversion rate rising from 25% in 1999
to 59% in 2002, and 57% in 2003. This is without any "cooking of the books" or other
phony means of counting diversion. Every ton of diversion identified by the AB 2494
calculator is new diversion and readily identifiable by the City through its monitoring
system set up as result of the Huls Environmental benchmark studies.

J. Michael Huls — Principal and Project Director
Mr. Huls is the principal and the founder of Huls Environmental. He has consulted to
the World Bank and United Nations, the US EPA, the Chemical Manufacturers
Association, and Fortune 500 businesses such as IBM and Verizon. He was a founding
Board Member of the National Recycling Coalition in 1976, and was a co-founder of the
California Resource Recovery Association in 1974. He is currently listed in the national
directory published by Continental of Who's Who of Executives and Professionals.
Michael has directed and conducted several projects concerning enterprise fund
development, RFPs, hauler audits, and contract negotiation. Besides working on similar
projects while employed at other consulting companies, at Huls Environmental he has
conducted projects including development and ongoing management of the Integrated
Waste Management Fund for the City of Diamond Bar.
His role will be to lead the team in the project, providing overall technical direction and
client contact. He will supervise technical activities, personally review supporting data,
and develop study findings and recommendations. Mr. Huls will prepare and present
the final report to the City.
Sandy Costandi — Project Manager
Ms. Costandi is an adept project manager with over four years of experience in the field
of solid waste and recycling. She currently manages a number of significant projects for
Huls Environmental including (1) a multi -jurisdictional recycling implementation project
for Verizon involving over 50 communities in California, affecting more than 100 haulers,
and coordination of hundreds of media contacts, and (2) a C&D debris recycling and
reuse education project for the County of Los Angeles. Her role will be to manage the
team to effectively use its talents and resources given the short time frame afforded the
project.
Louis C. Ippolito — Project Engineer
Mr. Ippolito has been involved in recycling and solid waste since 1989. As an engineer for
Emcon Associates, Mr. Ippolito was responsible for the characterization of residential,
commercial and industrial waste streams for thirty-five (35) California cities in response to
the California Integrated Waste Management Act of 1989 (AB 939). Mr. Ippolito's expertise
can be described as "recycling and refuse economics."
After developing and implementing the first "bag and tag" curbside collection system for
the City of Hawthorne, Mr. Ippolito went on to design, develop and implement residential
and commercial recycling programs for twenty-two (22) California cities. His current
projects include developing and implementing curbside recycling programs for the cities of
Arvin and McFarland, California.

In the past year, Mr. Ippolito has written and successfully applied for $100,000 in DOC
grants, $57,000 in Used Oil grants and $275,000 in HHW grants for several cities. Mr.
Ippolito also designed and managed the first Commercial Commingled Recycling
Materials Recovery Facility in New Jersey and was involved in the analysis and financial
computations of two (2) southern California clean Materials Recovery Facilities. Mr.
Ippolito recently developed an RFP for the City of McFarland to solicit proposers for
implementation of a curbside recycling program.
Mr. Ippolito is well known for his role in conducting comprehensive financial audits for
municipalities. He has led audits in the cities of Carson, South Gate, Lynwood, Gardena,
EI Monte, and several other communities. His work over the past 10 years has led to the
recovery of nearly $10 million in underpayments, nonpayments, and missed payments of
franchise fees, AB 939 fees, and contractual services.

Huls Environmental is currently engaged with the City of Gardena on a variety of
projects. It has worked continuously since August of 2001. The City has had a very
difficult time with recalcitrant haulers and the burden of a compliance order that was
placed on the City prior to Huls Environmental's engagement. For the City, we
conducted an RFP process in 2001-02 to select up to four semi -exclusive haulers for
the commercial -industrial sector. This process was very fast paced; beginning in
September 2002 with a bidding process, and completed by the end of that calendar
year. All aspects were handled by Huls Environmental including publication of the RFP,
preparation of the agreements and RFP, review and evaluation, recommendations, and
coordination with staff and council. The project was performed within budget.
Huls Environmental has worked with the City to design, develop, and implement a
series of programs that range from hauler management to construction and demolition
waste recycling, to fund development. Huls Environmental is currently evaluating the
efforts of all haulers and their programs and is engaged in implementing a revised and
new diversion systems to address future programmatic requirements for AB 939
compliance and solid waste collection, processing and disposal. Even as this effort is
underway, we have to monitor and guide the progress of five haulers in implementation
of MRF processing, source separation, and C&D waste recycling. In addition, Huls
Environmental has developed in the past year mandatory ordinances for recycling of
commercial and C&D waste. In particular, we devised a funding mechanism for staff to
recoup its costs of monitoring and inspecting job sites and evaluating contractor
compliance with the C&D regulations.

City AB 939 Compliance — Huls Environmental has acted as the City of Diamond Bar's
(DB) Integrated Environmental Services Coordinator since 1995. In this capacity, Huls
Environmental is responsible for DB's environmental compliance with all environmental
statutes including AB 939 and NPDES. Huls Environmental is currently administering
the solid waste permit and contracting system, and is coordinating and conducting
environmental outreach activities in the community. Current dollar amount is about
$15,000, but since inception, Huls Environmental has received and executed programs
for a cumulative fee of over $350,000.
Hauler Administration — The solid waste permit and contract system is of some
interest, as Huls Environmental has in the past administered and monitored the
activities of the two refuse haulers and several recyclers. Huls Environmental has been

responsible for review and evaluation of permit applications and re -permitting; diversion
activities; reporting; fees and financial requirements; insurance and liability; and
monitoring. The two haulers are exclusive contractors, with each responsible for one
sector, either bin -served customers (nonresidential) or barrel served customers
(residential). More recently, Huls Environmental has assisted the City's recycling
coordinator in these duties.
As part of its past duties, Huls Environmental has been responsible for development
and ongoing maintenance of the City's Integrated Waste Management Fund. This fund
is used for all City activities for NPDES including site inspections, enforcement and
education, and for AB 939, including street sweeping debris composting, public
education and outreach, HHW and a -waste management, grant management, hauler
management, and more. It had been the responsibility of Huls Environmental to monitor
the fund for liquidity, to identify and secure new funding sources, and plan monetary
expenditures annually.
RFP Process — In 1999, Huls Environmental was requested to develop and execute an
RFP process for selecting a refuse -service provider(s). Huls Environmental developed
an RFP, and a mechanism for evaluating responses including criteria and
specifications. Huls Environmental qualified the responding firms based on their
references and qualifications packages. Subsequently, Huls Environmental evaluated
the detailed bid packages from the qualified firms, comparing rates, pricing
assumptions, and justification. Subsequently, two firms were selected, each handling
exclusive fractions of the waste stream (i.e., residential and commercial). The City was
reimbursed $50,000 for the procurement process by the winning haulers.
System Feasibility and Project Development — Before the selection of the exclusive
contractors, Huls Environmental worked with City Council and staff to devise a new
solid waste ordinance that mandated recycling and waste prevention. The new
ordinance specified variable rates for both nonresidential and residential accounts,
banned the disposal of readily recyclable materials, and created incentives for recycling
and waste prevention activities. This was the basis of specifications for the competition.
To develop the ordinance and proposed system, Huls Environmental facilitated a
Council -select Task Force of community activists and representatives, whose charge
was to identify the future of solid waste management in the City and to make
recommendations to Council in July 1998. This Task Force concluded its investigation
in June after five months of study and meetings. Huls Environmental provided the
technical direction for the Task Force, and facilitated each meeting that were always
attended by no less than two Council Members as well as City Staff including the Public
Works Director and the City Manager. The cost for this component was about $10,000.

PROPOSAL TO CITY OF PALM DESERT
Contract Negotiations — Huls Environmental assisted the City in 2000 with
renegotiating its long-term contract with its service provider to add MRF processing of
residential waste, automation of its residential refuse collection, upgrading of its
voluntary manual green waste collection to automated status, inclusion of variable rates
for residential services, and transformation of MRF processing residue from the bin -
served accounts. By carefully auditing the performance and contract provisions of the
exclusive hauler, Huls Environmental was able to maintain residential rates at the same
level for the smaller of two types of automated carts, while commercial rates rose less
than three percent. Huls Environmental was hard pressed to develop such a favorable
negotiated outcome for the City since the hauler was only "bidding against itself." This
required Huls Environmental to carefully quantify the overall costs of the solid waste
system without the benefit of _any data from the hauler. We were able to document
savings from the discontinuation of the curbside recycling system, reduced operational
costs, and added value in the contract terms for the hauler since it was given an
additional four years.

Commercial and Residential RFP Process — Huls Environmental is currently
managing the commercial and residential recycling and refuse collection RFP process
for the City of El Monte. This includes selection of haulers, recyclers for new franchises
in both sectors. Other duties include development and implementation of new recycling
programs for the commercial and residential waste streams. Education and outreach
programs are also being developed for residents and businesses to foster maximum
participation in the new recycling programs. Huls Environmental has been instrumental
in auditing the haulers for irregularities in fee payments and compliance performance
during 2004. While the exact terms of the fee recovery cannot be disclosed at this time
or the identity of the guilty parties, it can be stated that the public record shows a fee
recovery in excess of two million dollars.

Contract Negotiation — For the City of Azusa (Azusa), Huls Environmental implemented
a used oil opportunity grant, a household hazardous waste grant, three used oil block
grants, and helped to administer and implement Azusa's solid waste and AB 939 program.
Among Huls Environmental's accomplishments included successful negotiation of a long-
term agreement with a new franchise hauler that yielded over $1 million in complementary

waste prevention and recycling programs and City services. To support this effort, Huls
Environmental was required to audit the hauler for performance issues.

Solid Waste Consulting — Huls Environmental assisted the City to renegotiate its long-
term contract with Waste Management. Huls Environmental provided technical
assistance to the City in determining the validity of the hauler's proposed rates,
services, and activities. Huls Environmental helped to identify the appropriate levels of
fees, and assisted in the structuring of the new contract. Based on the assistance, the
City successfully launched its automated, three -container system including recyclables,
green waste, and refuse.

Compliance Evaluation — Huls Environmental has worked with the City to address AB
939 compliance issues since mid -year 2002. At that time, Huls Environmental
conducted an assessment of the City's AB 939 compliance status; a process that
yielded a number of program initiatives including C&D debris recycling, commercial
sector recycling, multi -family recycling, and an economic analysis of the commercial
sector rate structure that resulted in a redevelopment of the commercial sector rates to
allow for select load processing. Spreadsheets were developed that estimated likely
franchise fee impacts from the imposition of the new rate system and forecast the
likelihood that some generators might opt out of the select load processing by choosing
to source separate their wastes.
In partial fulfillment of its SB 1066 Time Extension, Rancho Cucamonga requested Huls
Environmental to devise a practical C&D waste recycling system. Huls Environmental
did that by crafting a citywide ordinance requiring developers and contractors to meet a
50% diversion requirement for all covered projects but excluding individual single-family
homes, and non -construction permits. A key facet of the system was a refundable
deposit requirement and a non-refundable fee for City services. Coupled with the
ordinance, Huls Environmental designed and prepared an application and reporting
forms for contractors to complete. Additionally, information about recycling outlets for a
variety of materials was published to help applicants identify likely markets for materials.

Huls recently produced through a subcontractor an instructional video for general
contractors and developers on the requirements of and means of complying with the

City's C&D waste diversion program. The video included a pre -production stage,
involving storyboards, scripts, and preliminary shoots, and was published in January
2004. Huls Environmental is also working currently on conducting onsite technical
audits of construction sites to assure conformance with C&D recycling requirements.
More recently, Huls Environmental is examining all solid waste disposed during the past
four years for discrepancies and reporting errors. This will likely reduce the City's
disposal liability and raise its diversion rate.

standards and code. We have never been cited for noncompliance and never had any
lost days to due accidents or safety infractions.
