I. RECOMMENDATION:
By Minute Motion:
(1) Authorize the submittal of the Household Hazardous Waste Grant Application for
FY 2005/06;
(2) Waive further reading and adopt Resolution No. 05-31
(3) Appropriate $568,220 from Account No. 236-4195-454-3090.
II. Executive Summarv:
The City and Waste Management of the Desert have been operating the Household
Hazardous Waste (HHW) Facility since 2002. Grant funds have been utilized to offset
the cost of operation until 2005. The City and Waste Management have expended over
$14,000 each in 2005 to continue the operation. The current application is for the FY
2005/06 period and extends from August, 2005, to March, 2008. If the application is
approved by the State, the facility will continue to operate free of charge to residents.
However, if the application is not approved, the City will have to decide whether or not
to continue funding the facility free of charge (out of the recycling account) to residents
or initiate a fee. The agreement between the City and Waste Management is that both
organizations will expend up to $25,000 each.
III. Backqround:
The HHW Facility opened in March of 2002. The City initially received two grants to
start up the operation. Since that time, grant funds have been utilized for the continued
operation, until this year (2005). The existing annual operating costs of the facility have
been in the $100,000 plus range. Now that grant funds have all been expended and
there is a significant increase in participation, it is anticipated that the cost to operate
the facility could be anywhere from $125,000 to $150,000 each year.

The focus of the grant application for FY 2005/06 is for new facilities, expansion of
programs at existing facilities, and education campaigns. The grant term is for three
years (2005 to 2008) and is paid on a reimbursement basis. Therefore, the City will
need to appropriate funds to cover the potential grant award. The application will
request a budget of $568,220 to cover the three-year grant period. The proposed
budget will cover cost to continue the existing operation as well as the proposed
expansion and education campaign.
The City plans to focus on two of the areas identified within the Grant Summary and
Guidelines. The two areas involve program expansion and an education campaign.
The goal is to expand the facility to accept disposal for small business (small quantity
generators) within Palm Desert; expand the types of materials that are currently
accepted to include universal waste (keyboards, printers), electronic waste (computer
monitors, televisions), sharps (needles); and to create an education campaign to
increase awareness and target those residents who are unfamiliar with the program.
Staff will be considering this program as part of the Recycle Binney Campaign.
Staff is currently working to complete the application, which is due to the California
Integrated Waste Management Board by 3:00 p.m. on April 15, 2005. Therefore, staff
requests City Council authorize staff to submit the application to CIWMB, adoption of
the Resolution, and appropriation of funds.

RESOLUTION NO. 05-31
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT AUTHORIZING USED
OIL AND HOUSEHOLD HAZARDOUS WASTE
GRANT APPLICATIONS TO THE CALIFORNIA
INTEGRATED WASTE MANAGEMENT
BOARD.
WHEREAS, the people of the State of California have enacted the California Oil
Recycling Enhancement Act that provides funds to cities and counties for establishing and
maintaining local used oil collection programs that encourage recycling or appropriate
disposal of used oil; and
WHEREAS, the people of the State of California have enacted Assembly Bill 1220
(Eastin, 1993) that provides grants to local governments to establish and implement waste
diversion and separation programs to prevent disposal of hazardous waste, including
household hazardous waste (HHW) in solid waste landfills; and
WHEREAS, The California Integrated Waste Management Board has been
delegated the responsibility for the administration of these programs within the State,
setting up necessary procedures governing application by cities and counties under these
programs; and
WHEREAS, the City of Palm Desert intends to apply for used oil and household
hazardous waste grants to fund various waste diversion projects in the future; and
WHEREAS, The City of Palm Desert will enter into agreements with the State of
California for development of the projects.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Palm Desert, California authorizes the following:
1. Authorizes the submittal of grant applications to the California Integrated
Waste Management Board for all available grants under the California Oil Recycling
Enhancement Act and all available HHW grants under the California Integrated Waste
Management Act for the period of June 1, 2006 through March 31, 2011; and

2. The Assistant City Manger of Community Services Sheila R. Gilligan, or a
designee, is hereby authorized and empowered to execute in the name of the City of Palm
Desert all necessary applications, contracts, payment requests, agreements, and
amendments hereto for the purposes of securing grant funds and to implement and carry
out the purposes specified in the grant application.
PASSED, APPROVED, and ADOPTED at a regular meeting of the City Council
of the City of Palm Desert held on this 1 th day of April, 2005, by the following vote, to
