Resolution No. 05- 03 Recommendation: Waive further reading and adopt Resolution No. 05-03 , requesting an extension of the maximum hours (960) of employment after retirement for the Interim Director of Human Resources pursuant to Government Code Section 21221(h) Discussion: Last summer, when the City's regular full-time Human Resources Director resigned, the City's Executive Management team decided to attempt to identify and appoint an Interim Human Resources Director from the ranks of the recently retired. It identified Duane K. Munson, who had recently retired into the CaIPERS system from the City of Commerce. An employment agreement was successfully negotiated between the City and Mr. Munson, and this agreement was approved by the City Council in July, 2004. The CalPERS system allows for a retired employee to work in a governmental agency for up to 960 hours in any calendar year. Because Mr. Munson began last summer, the City experienced no problem with the number of hours prior to the end of 2004; however, for 2005, the 960 hours will be consumed by mid -June. In an effort to continue the services of Mr. Munson, staff is recommending that the City Council adopt the attached resolution CITY COUNCIL STAFF REPORT RE: EXTENSION OF MAXIMUM HOURS OF EMPLOYMENT AFTER RETIREMENT FOR INTERIM HUMAN RESOURCES DIRECTOR APRIL 14, 2005 requesting that PERS approve a one-time extension for an additional 920 hours. This will carry Mr. Munson through the month of December, 2005. Mr. Munson has been very proactive in the review of the City's Human Resources Department. His accomplishments include the adoption of the Personnel Ordinance, the fine-tuning of the City's employee evaluation process, the development of a program of interaction with all employees which has significantly improved morale, and the development of an increased employee training and development effort. Mr. Munson has been successful in stabilizing the personnel issues within the City. There are several issues at the forefront which the City needs to address in a timely and cohesive manner. These include a look at the City's recruitment process, classification program, succession planning, and compensation program. Mr. Munson provides the necessary skills and experience to assist the City in addressing the personnel challenges of the future. The City of Palm Desert needs to be proactive in this effort to make sure that the future will hold the necessary policies, procedures, and programs to keep the City in a leadership position. The programs mentioned above include taking a look at the staffing of the Human Resources Department and how to best fill positions and still meet the ultimate needs of the City. This review has been initiated, and recommendations will be provided as part of the proposed budget for Fiscal Year 2005/06. Q TEGA City Manager RESOLUTION NO. 05-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, REQUESTING AN EXTENSION OF THE MAXIMUM HOURS (960) OF EMPLOYMENT AFTER RETIREMENT FOR THE INTERIM DIRECTOR OF HUMAN RESOURCES PURSUANT TO GOVERNMENT CODE SECTION 21221(h) WHEREAS, the California Public Employee's Retirement System (Cal PERS) administers the retirement program for all contracting agencies in compliance with the Government Code; and WHEREAS, retirees may be employed by one or more agencies in the Cal PERS system for a total of 960 hours in any calendar year; and WHEREAS, an agency may request an extension of the 960-hour rule in a calendar year for the following reasons: • During an emergency to prevent stoppage of public business; or • Because the retired employee has skills needed in performing work of a limited duration; and WHEREAS, the City of Palm Desert requests an extension of 920 hours (through December, 2005) in order to employ an Interim Human Resources Director, Duane K. Munson, until such time as the City can complete the development and transition of Human Resources leadership to a regular full-time employee of the City of Palm Desert. NOW, THEREFORE, the City Council of the City of Palm Desert, California, does hereby authorize the City Manager to request Cal PERS to extend the maximum hours (960 of employment after retirement pursuant to Government Code Section 21221(h) for the Interim Director of Human Resources, Mr. Duane K.
