COLEMAN, REDEVELOPMENT/HOUSING FINANCE MANAGER APRIL 28, 2005 AGREEMENTS WITH CAPITAL REALTY ANALYSTS FOR SECTION 29 ASSESSMENT DISTRICT AND RETENTION BASIN PROPERTY By Minute Motion, that the City Council: 1) Approve the agreement with Capital Realty Analysts for appraisal services in the amount of $40,000 for the property associated with the formation of the Section 29 Assessment District; 2) Approve the agreement with Capital Realty Analysts in the amount of $4,500 for appraisal services for the property needed for a retention basin for the Section 29 Assessment District; and 3) Authorize the Mayor to execute the agreement. Funds are available in Account No. 610-0000-228-2100. Executive Summanr: Approval and execution of these agreements for services is necessary in establishing appraisals for both the assessment district and to purchase property within the district necessary for a retention basin. Funds for this agreement are provided by the developers within the proposed assessment district. Discussion: On November 18, 2004, the City Council approved the Deposit and Reimbursement Agreement with Ponderosa Homes II, Inc. for the reimbursement of costs associated with the formation of an assessment district for construction of public improvements. The District is located in a northwest section of the City with Monterey Avenue to the west, Gerald Ford Drive to the south, Portola Avenue to the east, and Avenue 35 to the north. The proposed District is approximately 300 acres and includes six property owners. The proposed District includes property owned by the McLeod Family Trust, Lowes Corporation, The Sares- Regis Group, Rillington Communities, and Ponderosa Homes II, Inc., and the Noble Company. Staff Report Approval of an Agreement to Provide Appraisal Services with Capital Realty Analysts Page 2 of 2 April 28, 2005 The public improvements to be funded by the District include street improvements on Monterey Avenue, Gerald Ford Drive, Gateway Drive, Dinah Shore, Portola and others. The District will also fund storm drain improvements, water main improvements, sewer improvements, and will relocate utility poles. An appraisal is necessary to establish the aggregate property values within the district in order to issue bonds, should the City Council authorize both the formation of the district and bonds to be issued. An appraisal is also necessary to establish the purchase price of property within the district which is necessary for a retention basin. Staff requested proposals from six firms and received three proposals. The three firms were deemed qualified and submitted proposals in the following amounts: Firm Assessment District Retention Basin DMD Appraisals, Inc. $ 95,000 $10,000 Mason & Mason 45,000 7,000 Capital Realty Analysts 40,000 4,500 Capital Realty Analysts submitted a responsive proposal with the lowest price to perform the appraisal. This is a local Palm Desert firm with extensive knowledge of this real estate market. Staff is recommending this firm be utilized to perform the appraisals with the concurrence of the developers. The agreement will be paid from the $50,000 deposit the Ponderosa Homes II, Inc. has given to the City that has been placed in trust to be used for purposes such as this. Submitted By: Dennis M.
