REQUEST: Approve a Variance to Article 4.8.2 (C) of the Solid Waste
Franchise Agreement, Requiring the use of Alternative Fuel
Vehicles for Collection Services (contract C17230)

Recommendation:
By minute motion, approve a temporary six-month variance to Article 4.8.a. (C) of the
solid waste franchise agreement, requiring the use of alternative fuel vehicles for
collection services.
Discussion:
On Wednesday, July 26, 2005, there was a fire at the Waste Management facility on
Corporate Way destroying six natural gas driven trucks. The fire is still under
investigation but no interruption in service is anticipated. Waste Management has
borrowed diesel collection trucks from their sister companies, as no CNG vehicles were
available. District Manager Frank Orlett has indicated it may take 12 to 18 months to
secure new CNG vehicles from the manufacturer. Therefore, Waste Management is
requesting a variance to the franchise agreement requiring the use alternative fuel
vehicles for collection services. If Waste Management needs additional time beyond the
temporary six-month variance, it can submit another request.

On Wednesday, July 26, 2005, Waste Management of the Desert had a fire at our Palm Desert
facility consuming six (6) of our alternative fuel vehicles. The fire is currently under
investigation and no disruption of service is anticipated.
We are receiving additional equipment from our sister locations, however, we are not able to
secure alternative fuel vehicles from those sister companies.
Due to the uniqueness of these vehicles, it typically takes 12 to 18 months from the order date to
receive these kinds of trucks or any equipment of similar make up. Therefore, we are
respectfully requesting a variance to the alternative fuel requirement in our Franchise Agreement
between Waste Management of the Desert and the City of Palm Desert until June 2006, which
Will allow time to secure permanent replacement vehicles.
