Recommendation:
By minute motion, approve street sweeping services by CleanStreet for the State
Highways in Palm Desert at a reimbursement rate of $21.75 per curb mile.
Discussion:
The City of Palm Desert has a maintenance agreement with the California State Transportation
Department (CalTrans) to provide weekly sweeping for 14.7 curb miles of the portion of state
highways located within the boundaries of the City of Palm Desert. These roadways are also in
the Regional Street Sweeping Program administered by CVAG and they have contracted with
CleanStreet for this work at the rate of $28.60 per curb mile.
Since the City has the ability to be reimbursed from CalTrans at the rate of $21.75 per curb mile,
we will pay CleanStreet the reimbursement rate and CVAG will cover the balance of $6.85 from
the regional sweeping program funds. The attached memorandum of understanding
memorializes this payment process between all entities. The purpose of this arrangement is to
have other outside funds contribute to the overall regional sweeping program for PM-10
mitigation, allowing the limited federal funding to last longer.
CleanStreet is also the contractor for Palm Desert's citywide biweekly street sweeping program.

MEMORANDUM OF UNDERSTANDING
REGARDING REIMBURSEMENT OF DIFFERENTIAL
FOR STREET SWEEPING OF STATE HIGHWAYS
WITH THE CITY OF PALM DESERT

This Memorandum of Understanding (MOU) is made and entered into by and between the
Coachella Valley Association of Governments (CVAG) and the City of Palm Desert.
The purpose of this MOU is to documentthe parties' understanding of and responsibilities for
the reimbursement of funds forthe street sweeping of State Highways in the Coachella Valley
for those jurisdictions holding street sweeping agreements with Caltrans for those State
highways.
BACKGROUND
The Regional PM 10 Street Sweeping Program covers the portion of the State Highways that
run through the Coachella Valley. The following jurisdictions hold maintenance agreements
with Caltrans to provide sweeping services on the State Highways: Palm Springs, Palm
Desert, Indian Wells and Indio.
The rate of reimbursement from Caltrans varies per jurisdiction but has been determined to
be less than the curb mile cost for sweeping services in the regional program provided by
CleanStreet; per agreement with CVAG dated April 24, 2004.
PROCEDURES
CleanStreet shall invoice the City of Palm Desert for sweeping services on the State
Highways. The City of Palm Desert shall pay CleanStreet in the amount that is covered under
their Caltrans reimbursement agreement.
CleanStreet shall then invoice CVAG forthe difference between the amount the City of Palm
Desert pay (Caltrans reimbursement) and the curb mile rate established in CVAG's contract
with CleanStreet for providing regional sweeping.
In addition to an invoice forthe difference, CleanStreet shall provide CVAG with a copy of the
invoice submitted to the City of Palm Desert and a copy of the jurisdiction's remittance.
In order for CVAG to remit or cover the exceeded reimbursable rate from Caltrans, the City
of Palm Desert shall provide CVAG with a copy of their current contractwtt rCattransmibich

CVAG shall track the process to prevent duplicate reimbursement.

CANCELLATION CLAUSE
This MOU shall continue in effect until or unless the funding source (Congestion Mitigation Air
Quality) is discontinued, or the Coachella Valley PM10 Program, as administered by CVAG,
shall be discontinued or CVAG, for whatever reason, is dissolved or otherwise disbanded,
whichever shall occur sooner.
