I. BACKGROUND A. July 15, 2005 CUP 04-13 Approval: After considering testimony at several public hearings, on July 14, 2005 the City Council approved CUP 04-13 to allow the expansion of the Sacred Heart Elementary School and construction of new parking lots north of the existing church. The approval included a condition calling for additional redlining on both sides of Deep Canyon Road. Public Works condition of approval no. 26 reads: Public Works Department staff shall report back to the City Council with a recommendation on whether the west side of Deep Canyon Road can and should be redlined north of the master plan site in order to reduce noise impacts from on -street parking on homes abutting the west side of Deep Canyon Road. B. October 13, 2005 City Engineer's Report The October 13, 2005 report of the City Engineer (copy attached) recommended that the City Council defer redlining additional additional segments of Deep Canyon Road until after construction of the new parking lots is completed. The requirement to eliminate the street parking is based on the availability of adequate parking spaces in the new parking lots. If additional segments of Deep Canyon Road are redlined now, then worshipers attending weekend services who cannot find on -site- parking will be forced to park deeper into nearby residential neighborhoods on public streets such as Moss Rose Drive, Day Lily Circle, Coral Bells Circle, Lavendar Way, Buttonwood Drive, Silk Tree Lane, Gazania Place, Myrsine Avenue, Florine Avenue, Aster Drive, Velardo Drive and Erin Street. Until the new Sacred Heart Church parking lots are completed in 2006, we recommend that the Council defer redlining of additional segments of Deep Canyon Road to prevent the loss of critical off -site parking spaces for Sacred Heart Church worshippers 2 Staff Report Sacred Heart Master Plan CUP 04-13 Page 3 December 8, 2005 C. October 13, 2005 City Council Decision Ordering Additional Redlining of Curbing on Both Sides of Deep Canyon Road After considering public testimony, the City Council ordered staff to redline additional segments on both sides of Deep Canyon Road. Father Howard Lincoln, who in addition to being pastor of Sacred Heart Church is also the public relations spokesman for the entire Diocese of San Bernardino, was unexpectedly delayed in attending the October 13, 2005 Council meeting. Thus, he was unable to offer public testimony prior to the City Council's decision. D. November 4, 2005 Letter by Father Howard A. Lincoln Father Howard A. Lincoln submitted a letter dated November 4, 2005 (copy attached) to the City Manager requesting that the City Council reconsider its October 13, 2005 decision, which ordered the immediate redlining of additional segments of Deep Canyon Road. E. November 17, 2005 Special City Council Meeting to Reconsider At the November 17, 2005 the City Council meeting, the Council directed Father Lincoln to meet with nearby residents Thomas W. McCutchen and Norman Eastwood to try and resolve their concerns regarding on -street parking on Deep Canyon Road. By Minute Motion, the Council directed 4- 1, with Councilman Spiegel voting no, that consideration of an amended time line for the previously approved red -curbing along Deep Canyon Road be taken up at the regular City Council meeting of December 8, 2005. On November 23, 2005, staff mailed public hearing notices to all property owners within a 300-foot radius of the Sacred Heart Church Master Plan site. At the time this staff report was written, Sacred Heart Church's attorney, Mr. Michael B. Rover, was trying to schedule a meeting with Mr. Thomas W. McCutchen and Mr. Norman Eastwood. Copies of Mr. Rover's November 29, 2005 letters to Mr. McCutchen and Mr. Eastwood are attached. Mr. Rover also contacted Mr. McCutchen and Mr. Eastwood by telephone. 3 Staff Report Sacred Heart Master Plan CUP 04-13 Page 4 December 8, 2005 Conclusion: Until the new Sacred Heart Church parking lots are completed in 2006, we recommend that the Council defer redlining of additional segments of Deep Canyon Road to prevent the loss of critical off -site parking spaces for Sacred Heart Church worshippers, especially during the peak season. CONSIDERATION OF THE INSTALLATION OF ADDITIONAL PARKING RESTRICTIONS ON DEEP CANYON ROAD, NORTH OF FRED WARING DRIVE (Continued from the meeting of September 22, 2005). Mr. Greenwood stated that staff was asked to look at parking restrictions on Deep Canyon Road associated with the expansion of Sacred Heart Church and School. He said staff had performed the review and conducted a sight line safety analysis —where cars can safely park on the curb and not block visibility of cars exiting the driveways. He went on to say that earlier today staff met with Sacred Heart representatives, and they were asking for a continuance of this item in order to work out additional details. He pointed 15 MINUTES REGULAR PALM DESERT CITY COUNCIL MEETING OCTOBER 13, 2005 out that the staff recommendation was to only implement the red -curbing after the expansion of the church and school has occurred. Councilmember Benson thought when this was first discussed, the east side was going to be red -curbed, and the west side would not because of the entrance to the church; and people who have difficulty walking might want to come from that side. She didn't see how the west side blocked anyone's view. Mr. Greenwood responded that there was a sight line analysis in the staff report that shows how those cars blocked the sight line. Councilmember Benson disagreed; Deep Canyon was a collector street, and she didn't think it was necessary to paint the whole thing red. Mr. Greenwood added that residents directly north of the church and school requested red -curbing on the west side. Mayor Pro Tern Ferguson observed that the item had now been on the agenda twice, and the church has asked for a continuance each time. He asked whether or not the church was opposed to the City putting this off until after the master plan is done. Mr. Greenwood replied he didn't think they were opposed to putting it off until afterward; they were somewhat opposed to red -lining it at all. He affirmed that it was staffs intent to red -curb after construction was complete, not before it was started. He offered that additional analysis could also be performed when construction was complete. MR. MIKE ROVER, Attorney for Sacred Heart and President of its School Board, said Sacred Heart's position was that it was opposed to red -lining on the west side of Deep Canyon. Additionally, he said they received the "Driver's Line of Sight„ study during a meeting with Mr. Greenwood this afternoon and discussed the possibility of taking a little more time to look at the basis for the results of the study with their traffic engineer. He stated they were not opposed to postponing it, understanding that staffs recommendation initially was to implement the red -curbing at the time construction was completed so that the new parking spots on site would accommodate some of those issues on Deep Canyon. Mr. Greenwood responded that staff felt the 200+ additional parking spaces should more than accommodate the cars that now park on Deep Canyon. In further response, he said he firmly believed that red -curbing is needed the entire frontage of the Sacred Heart School but that it could wait until the construction is done to do it. Although, he agreed that it could be looked at 16 MINUTES REGULAR PALM DESERT CITY COUNCIL MEETING OCTOBER 13, 2005 again and brought back to the City Council once the construction was complete. Councilman Spiegel asked Mr. Rover about the empty buildings issue that was raised earlier in this meeting. MR. ROVER answered that the Fire Department had done some training exercises there, and he believed the fence around La Paz Villas had gone up this week. He said they planned to start demolition of the buildings next week, as soon as they were permitted to do so. He went on to ask for further clarification of today's agenda item, as he understood that it called for approval of red -lining at a future date. He said if that was the case, they would be opposed to it. However, if the proposal was to just simply review it at a later date, they would not be. MR. NORM EASTWOOD, 74-474 Myrsine Avenue, Palm Desert, stated he thought this issue came out of the recommendation to approve the project at Sacred Heart, and it was left to be answered. He noted that 140 local residents submitted a petition asking for red -lining on Deep Canyon, and the City's engineering staff agrees that it is the right thing to do. He pointed out that Father Lincoln had said his problem was having people park in the parking lot instead of on the street; red -lining will solve that problem for him. He went on to say that one of the requisites for the project was to have on - site parking for all vehicles that could go to the site, and there are 686 parking places, which more than accommodates any of the vehicle capacity of the people for the church. Further, he thought the matter was continued so that Father Lincoln could be present and a decision would be made; however, if a decision wasn't made soon, another year or two could go by before anyone came back to look at the problem. He noted that during the July 14 Meeting, Councilman Kelly expressed concern with on -street parking for the residents who are north of the property and felt that red -lining there would help them. He agreed and added that the Golf Cart Lane that runs here should also be taken into account. He also believed there was adequate handicapped parking on site, leaving no reason to park on Deep Canyon. He closed by stating that he'd counted six accidents in this area and urged the City Council to resolve this serious issue. MR. TOM McCUTCHEN, 24 Via Cielo Azul, Palm Desert, commented that there were currently approximately 430 paved parking spots on the church campus now. With the additional 262 paved spaces that have been approved in the recent master plan expansion, it would make a total of 686, and he added that they'd been told the sports field will provide overflow parking of another 200 spaces. He said the church's capacity is 1,400, and if it and the lot were full, it would mean each car brought less than two people. Therefore, he felt there was more than adequate parking when the expansion is completed. He said the local residents were certainly 17 MINUTES REGULAR PALM DESERT CITY COUNCIL MEETING OCTOBER 13, 2005 reasonable; but they would love to have it red -lined today to help alleviate some of the problems now that the season was starting again. Although, he noted that all summer long cars were parked on both sides of the street, especially the west side —all the way down to Buttonwood —and the parking lot was half empty. He felt one of the reasons parishioners parked along Deep Canyon and Florine is that the church still hasn't addressed the ingress/egress problem, which residents had asked to be considered as part of the master plan, but it's never been ultimately decided. He believed having designated one-way driveways for in and out would help, since there are only 30 minutes between each of the total of eight masses on Saturday night and on Sunday, and there are 300-600 cars coming and going at the same time. He felt the City Council's request that the church hire an off -duty police officer during the season (November - May) will help. He said the other reason residents want red -lining on both sides of Deep Canyon is that once the parish hall is built, it will be used until 10:00 p.m. Sunday through Friday nights and until 11:00 p.m. on Saturdays. All the homes along Deep Canyon have their bedrooms typically on the streetside, and they were concerned about the disturbance with cars starting, car doors slamming, and people saying their goodbyes. Therefore, he said they strongly support Mr. Greenwood's recommendation for red -lining both sides of Deep Canyon from Fred Waring all the way to the curb at Magnesia Falls and encouraged the decision be made tonight. MR. ROVER reiterated that he understood that the red -curbing would be done at some point when the project is either nearing or at completion, approximately 12 months from now. He said approving it tonight would not expedite the red -lining of Deep Canyon on either side. Additionally, he wanted to point out that the church was not expanding; only the school was being expanded. He cautioned that if tonight's decision is for red -lining all along Deep Canyon at some point in the future, it will force parking onto Moss Rose and Florine, etc. Since he'd only obtained the line of sight study earlier this afternoon, he again asked for additional time for their traffic engineer to review it, as his Supplemental Traffic Report No. 2 was in direct contradiction. He apologized for Father Lincoln's attendance, as he thought he was planning to be present by this time. Councilman Kelly said given the hours of testimony that had been received in this matter, he advocated immediate red -lining for the east side of Deep Canyon as well as the west side north of the church property, leaving the curb in front of the church property for parking. Councilman Kelly moved to, by Minute Motion, approve immediate red -curbing on the east side of Deep Canyon Road and for portions north of the Sacred Heart property line. Motion was seconded by Benson and carried by 4-0 vote, with Crites ABSENT. 18 CITY OF PALM DESERT PUBLIC WORKS DEPARTMENT STAFF REPORT REQUEST: Consider Installation of Additional On -Street Parking Restrictions on Deep Canyon Road, North of Fred Waring Drive SUBMITTED BY: Mark Greenwood, P.E., City Engineer DATE: October 13, 2005 CONTENTS: Line Of Site Exhibit Vicinity Map Recommendation: By minute motion, concur with staffs recommendation to install additional on -street parking restrictions on Deep Canyon Road after implementation of the Sacred Heart Church Master Plan. Discussion: At the July 14, 2005 meeting City Council directed staff to review parking conditions on Deep Canyon Road and to consider the need for any additional on -street parking restrictions. Staff has conducted the review and recommends the restriction of on -street (curbside) parking along the entire frontage on both sides of Deep Canyon Road north of Fred Waring Drive after the proposed on -site parking facilities are constructed by Sacred Heart Church Master Plan. As documented in the Sacred Heart Church and School Master Plan traffic study and subsequent addenda, the existing paved parking spaces available on -site at Sacred Heart Church are unable to meet the parking demand during periods of high attendance. Curb parking along Deep Canyon Road currently provides additional spaces for the overflow parking demand. Implementation of the Master Plan will increase the parking supply and will accommodate the vehicles that currently park along Deep Canyon Road. The removal of on -street parking along Deep Canyon Road prior to implementation of the Sacred Heart Church Master Plan is not recommended. '^24 i It "tip'10, r._ •�, �, . klo /(� }, RESOLUTION NO.05-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING AN APPEAL AND AFFIRMING PLANNING COMMISSION APPROVAL OF CUP 04-13 FOR A MASTER PLAN FOR THE SACRED HEART CHURCH AND THE SACRED HEART GRADE SCHOOL TO ALLOW EXPANSION OF THE GRADE SCHOOL, CONSTRUCTION OF A PARISH HALL/GYMNASIUM, NEW PARKING LOTS, NEW PLAYFIELDS, AND A PRAYER ALCOVE. CASE NO. CUP 04-13 WHEREAS, the City Council of the City of Palm Desert, California, did on the 24th day of 'March, 2005, on the 28t' day of April, 2005, on the 23Id day of June, 2005, hold duly noticed public hearings, and further review on the 14t' day of July, 2005, to consider a request by THE ROMAN CATHOLIC BISHOP OF SAN BERNARDINO for the above mentioned; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act", Resolution No. 05-52, in that an initial study was prepared and concluded that the proposed project will not have a significant negative impact on the environment and staff has prepared a Mitigated Negative Declaration of Environmental Impact; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council finds the following facts and reasons to justify denying the appeal and affirming the Planning Commission approval of said conditional use permit: FINDINGS FOR APPROVAL OF A CONDITIONAL USE PERMIT: 1. That the proposed location of the conditional use is in accord with the objectives of zoning ordinance and the purpose of the district in which it is located. 2. That the proposed location of the conditional use and the conditions under which it will be operated or maintained will not be detrimental to the public, health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. 3. That the proposed conditional use will comply with each of the applicable provisions of the zoning ordinance, except for approved variances or adjustments. 4. That the proposed conditional use complies with the goals, objectives and the policies of the City's general plan. RESOLUTION NO.05-53 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the City Council in this case. 2. That Conditional Use Permit 04-13 is hereby approved for a master plan for the sacred Heart Church and the Sacred Heart Grade School to allow expansion of the Grade School, installation of temporary classrooms, construction of a parish hall / gymnasium, new parking lots, new playfields and a prayer chapel subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert City Council, held on this 14th day of Jam, 2005, by the following vote, to wit: AYES: BENSON, FERGUSON, KELLY, SPIEGEL, and CRITES NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: HELLS D. The development of the property shall conform substantially with exhibits on file with the Department of Community Development, as modified by the following conditions. 2. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Review Commission City Fire Marshal Public Works Department Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 5. Applicant agrees to maintain the landscaping required to be installed pursuant to these conditions. Applicant will enter into an agreement to maintain said landscaping for the life of the project, which agreement shall be notarized and which agreement shall be recorded. It is the specific intent of the parties that this condition and agreement run with the land and bind successors and assigns. The final landscape plan shall include a long-term maintenance program specifying among other matters appropriate watering times, fertilization and pruning for various times of the year for the specific materials to be planted, as well as periodic replacement of materials. All to be consistent with the Property Maintenance Ordinance (Ordinance No. 801) and the approved landscape plan. 6. The project shall be subject to all applicable fees at time of issuance of building permits including, but not limited to, Art in Public Places, TUMF and School Mitigation fees. 3 RESOLUTION NO.05.53 7. The applicant shall construct an 8-foot high tan precision block wall along the westerly and northerly property lines adjacent to the new playfields. The height of the block wall may be reduced to 6 feet along the rear of adjacent residential lots where the property owner does not want an 8-foot high block wall constructed. 8. There shall be no stadium or flood light lighting for the playfields. Use of the playfields shall occur only during daylight hours, but in no case later than 9:OOPM. 9. Existing Sunday School and youth activities already occurring during weekend worship services may be relocated to the new parish hall. During worship services, the parish hall may also be used for incidental uses related to Sunday School. The parish hall, however, shall not be used to provide overflow seating for worship services. 10. All activities and use of the parish shall end by 10:00 p.m. on Sunday thru Friday and by 11 :00 p.m. on Saturday. 11. Use of an outdoor sound system shall be limited to during school hours, at an acceptable decibel level per the City's Noise Ordinance. The sound system shall only be used for emergency preparedness announcements and administrative school announcements. It shall not be used to broadcast sports events. 12. The maximum number of students enrolled at the Sacred Heart Elementary school (K-8) shall not exceed 540 students. The maximum number of students enrolled at the Sacred Heart pre-school shall not exceed 81. 13. The project shall to comply with the outdoor lighting requirements of Chapter 24.16 of the Palm Desert Municipal Code. Construction drawings submitted for the project shall include a lighting plan. All parking lot lighting be turned off by 10:00 p.m. on Sunday thru Friday and by 11 :00 p.m. on Saturday, or 15 minutes after the end of an evening activity, whichever occurs first. 14. The three existing residential duplex buildings at the north end of the master plan site shall remain and shall not be removed without prior approval by the City Council. 2 RESOLUTION NO.05-53 Department of Public Works: GENERAL REQUIREMENTS 1. All landscape maintenance on property frontages shall be performed by the church. 2. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to, and approved by, the Department of Public Works prior to the issuance of a grading permit. 3. All utilities shall be undergrounded. BONDS AND FEES 4. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code shall be paid prior to grading permit issuance. 5. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79-55, shall be paid prior to issuance of grading permit. 6. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF). Payment of said fees shall be at the time of building permit issuance. 7. A standard inspection fee shall be paid prior to issuance of grading permits. DESIGN REQUIREMENTS 8. Storm drain design and construction shall be contingent upon a drainage study prepared by a registered civil engineer that is reviewed and approved by the Department of Public Works prior to start of construction. 9. The new driveway shall have a 36' width, 25' retums to allow for a two-way exit. 10. Complete grading and improvement plans and specifications on electronic files shall be submitted to the Director of Public Works for checking and approval prior to issuance of any permits. 11. Improvement plans for utility systems shall be approved by the respective provider or service districts with "as -built" plans submitted to the Department of Public Works prior to project final. Any and all offsite improvements shall be preceded by the approval of plans and the issuance of valid encroachment permits by the Department of Public Works. 13. All new landscape installation shall be drought tolerant in nature. 16. Landscape plans shall be submitted for review concurrently with grading plans. CONSTRUCTION REQUIREMENTS 17. All public and private improvements shall be inspected by the Department of Public Works and a standard inspection fee shall be paid prior to issuance of grading permits. No occupancy permit shall be granted until public improvements have been completed. 18. Prior to the start of construction, the applicant shall submit satisfactory evidence to the Director of Public Works of intended compliance with the National Pollutant Discharge Elimination System (NPDES) General Construction Permit for storm water discharges associated with construction. Developer must contact Riverside County Flood Control District for informational materials. 19. Applicant shall comply with provisions of Palm Desert Municipal Code Section 24.12, Fugitive Dust Control as well as Section 24.20, Storm Water Management and Discharge Control. OTHER REQUIREMENTS 20. The church shall monitor student pick-up/drop-off operations after master plan build -out and make modifications regarding grade classifications assigned to each pick-up/drop off area as the student mix changes per the project traffic study. 21. The Church shall not schedule any activities in the newly constructed buildings concurrently with scheduled religious services per the project traffic study. 0 RESOLUTION NO.05-53 22. The Church shall continue the weekday morning mass start time of 7:45AM. 23. At the discretion of the City of Palm Desert, additional mitigation shall be implemented in the following order. a. The church shall hire a traffic engineer to monitor traffic at points of ingress and egress at the project site during masses on Saturday, Sunday and weekday mornings, and during AM and PM peak hours at their elementary school and implement appropriate mitigation measures. b. Staggered school starts at least 45 minutes apart. 24. The applicant shall construct a right turn pocket on the north side of Fred Waring Drive between the pre-school building and the driveway to the church parking lot. 25. The applicant shall continue to monitor traffic during project build -out with consideration given to creating an access from Flodne Avenue and uniformed police officers hired as needed for traffic control during weekend worship services during the peak season (November to April). 26. Public Works Department staff shall report back to the City Council with a recommendation on whether the west side of Deep Canyon Road can and should be redlined north of the master plan site in order to reduce noise impacts from on - street parking on homes abutting the west side of Deep Canyon Road. Riverside Countv Fire Department: With respect to the conditions of approval regarding the above referenced project, the fire department recommends the following fire protection measures be provided in accordance with City Municipal Code, NFPA, UFC, and UBC or any recognized Fire Protection Standards: The Fire Department is required to set a minimum fire flow for the remodel or construction of all buildings per UFC article 87. 2. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual pressure must be available before any combustible material is placed on the job site. 3. Provide or show there exists a water system capable of providing a gpm flow of: 3000 gpm for commercial buildings. 4. The required fire flow shall be available from a wet barrel Super Hydrant(s) 4"x2-1 /2" x2-1 /2", located not less than 25 feet nor more than: 150 feet from any portion of a commercial building measured via vehicular travelway. 7 RESOLUTION NO.05-53 5. Water Plans must be approved by the Fire Marshal and include verification that the water system will produce the required fire flow. 6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings with a 3000 square foot total cumulative floor area. The Fire Marshal shall approve the locations of all post indicator valves and fire department connections. All valves and connections shall not be less than 25 feet from the building and within 50 feet of an approved hydrant. Exempted are one and two family dwellings. 7. There is also a continuous 6 to 8 foot high block well along the entire east side of Deep Canyon Road together with a 12 foot wide landscaped area and 8 foot sidewalk separating the residential properties from the roadway. My May 27, 2005 Supplemental Traffic Engineering Report provided trip generation forecasts for the multi-%nc:tkwW building. With up to 800 people attending a fund raising or other new event in the multi functional building, a maximum of SW total trips could occur in the evening after the PM peak bvft hours on the adjacent streets. It is likely that the vast majority of the 530 vehicles associated with these trips will park on site within the 686 paved parking spaces that will be provided by the Master Plan. For the current season, professional parking attendants resumed providing cilrectional parking assistance at the Church on November 5, 2005.
