HomeMy WebLinkAboutRes 05-108 GPA 05-01RESOLUTION NO. 05-108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO THE GENERAL PLAN LAND USE ELEMENT DESIGNATING 13 LOTS ON THE WEST SIDE OF PORTOLA AVENUE, SOUTH OF FRED WARING DRIVE, AS DELINEATED ON EXHIBIT "A" ATTACHED, RESIDENTIAL LOW (R-L) 0-4 DWELLING UNITS PER ACRE AND REMOVING OFFICE PROFESSIONAL (C-OP)/MEDIUM DENSITY RESIDENTIAL (R-M) 4-10 UNITS PER ACRE AS A PERMITTED USE. CASE NO. GPA 05-01: WHEREAS, the City Council of the City of Palm Desert, Califomia, did on the 10 to day of November, 2005, hold a duly noticed public hearing to a consider a request by the CITY OF PALM DESERT for the above mentioned; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the Califomia Environmental Quality Act, Resolution No.05-52," in that the Director of Community Development has determined that the project will not have a significant impact on the environment and was previously accessed in the General Plan EIR approved March 15, 2004; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts and reasons to exist to justify approval of the General Plan Amendment: 1. That Low Density Residential 0-4 units per acre is the most compatible long- term land use with Portola Avenue and the low -density residential neighborhood to the west. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, Califomia, as follows: 1. That the above recitations are true and correct and constitute the findings of the City Council in this case. 2. That General Plan Amendment 05-01 (attached hereto as Exhibit A) is hereby approved. We truly hope you have an opportunity to read this letter, realizing the abundance of correspondence you receive, because we feel it may answer one of the main questions you asked in the last council meeting after the public comments portion of the meeting: Where are the property owners on Portola and what is their opinion regarding removing Office Professional (C-OP) from the City's General Plan for 13 lots on the west side of Portola Avenue between Fred Waring and De Anza Way? We hope this information will help you justify adopting Resolution #05-108 on your December 8, 2005 agenda. We cannot account for every lot, but as owners in the La Palma Village neighborhood for the past 30 years, we can speak about more than half of the thirteen lots. Actually, you have heard from several Portola property owners who favor R-1 zoning. Perhaps the biggest opponent of changing the existing R-1 zoning is Ming Lowe. She owns the home on the southwest corner of Portola and Catalina. She has led the charge against any zoning except R-1 with letters, phone calls, and visual aids. Hopefully, you will remember her colorful map showing how the area would look if C-OP is allowed to stand on the General Plan - a tiny island of commercial in a sea of residential. It does not seem to make sense for these 13 lots to be zoned commercial. Unfortunately, Ming Lowe had to go out of town on business for three months. She delayed her trip, so she could attend the September 6, 2005, Planning Commission meeting, but she was not yet back for the last council meeting. Paul Bowie owns the home south of Ming's. He has attended previous meetings and has spoken in favor of maintaining R-1 zoning. Gus and Marie Diaz are the couple who purchased the 3 properties that Chris McFadden owned, on the northwest corner of Portola and Catalina. They live in the large corner house and their daughter and son-in-law are occupying the home north of that on Portola. Already, the Diaz family has made numerous improvements that certainly make their large home a much nicer residential property. Our house is immediately to the west of theirs and we appreciate the work they have done painting, fixing and landscaping their new home. It certainly appears that they plan to use their properties for R-1 homes and apparently, they have written a letter supporting such zoning. They also own the flag lot behind these two homes. As you know the City of Palm Desert owns 2 lots in the area being considered. If they are blighted as described in the Local Section of today's Desert Sun, they should be cleaned and perhaps, considered for conversion to a mini -park oasis. Charles Moreno's elderly mother and aunt live on the northwest comer of Portola and De Anza. He has attended a couple meetings and spoken in favor of keeping R-1, residential zoning. During conversations with us, he has stated the same stance. Another property lies west of Mr. Moreno's mother on De Anza and has no access to Portola. In summary, you as a council have probably heard more from adjacent neighbors than from the Portola property owners obviously, because there are more of us, but if you review the council notes and the letters you have received, those Portola owners have not been silent. We know owners of six of the lots are happy with the existing R-1 zoning, the City owns two lots and another home is not bordered by Portola. Unfortunately, we will be out of town this Thursday and unable to attend the December 8, City Council meeting to share our views in person, but in our absence we urge you to waive further reading and adopt Resolution #05-108 as stated on your agenda.
