Recommendation:
By minute motion, waive further reading and adopt Resolution No. _____, approving
Tract Map 33854.
Discussion:
Tract 33854 is located east of Highway 74 and south of Indian Hills Way within the Canyons at
Bighorn Development. This map is a re-subdivision of seven residential lots and two expansion
lots of Tract 25296-7 to six residential lots and two expansion lots. The tentative map was
approved by the Planning Commission on September 20, 2005 as Resolution No. 2352.
Those conditions of approval related to the map have been satisfied. Bighorn Development is in
the process of having Verizon and Edison abandon their defunct easements along the relative side
lot lines of Tract 25296-7. New easements will be created to the satisfaction of the utility
companies by separate instruments. This map conforms to the requirements of the Subdivision
Map Act and City ordinances.
Staff recommends adopting the attached Resolution for the approval of the subject map.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING THE FINAL SUBDIVISION MAP
OF TRACT NO. 33854.
BE IT HEREBY RESOLVED, by the City Council of Palm Desert,
California, as follows:
(1) The Final Subdivision Map of Tract 33854, City of Palm Desert,
California is hereby approved as the official subdivision map of said
tract, subject to conditions of the Tentative Map.
(2) The City Engineer is directed to process the Final Map for recording
upon receipt of the payment of all fees.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT
MAP SUBDIVIDING SEVEN (7) CUSTOM LOTS WITHIN THE
CAPIYONS AT BIGHORN INTO SIX (6) CUSTOM LOTS. SUBJECT
PROPERTY IS LOCATED AT 1006-1018 CAUHILLA FALLS (APN:
652-330-001, 652-330-002, 652-330-003, 652-330-017, 652-320-017,
652-320-002, 652-320-003)
CASE NO. TT33854
WHEREAS, the Planning Commission of the City of Palm Desert, California, did
on the 20T" day of September, 2005, hold a duly noticed public hearing to consider the
request by Bighorn Development, LLC, for approval of the above noted; and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality AcY',
Resolution No. 05-52, in that the Director of Community Development has determined
that this project is a Class 5 categorical exemption for the purposes of CEQA; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to justify approval of the
said request:
1. The proposed tract map is consistent with the proposed general plan
designation of low density residential.
2. That the design or improvement of the proposed subdivision is consistent
with applicable general and specific plans.
3. That the site is physically suitable for the type of development.
4. That the site is physically suitable for the proposed density of development.
5. The design of the subdivision or the proposed improvements are not likely
to cause substantial environmental damage or substantial and avoidable
injury to fish, wildlife or their habitat.
6. The design of the subdivision will be in compiiance with applicable health,
safety and building codes. The site can be served by respective utilities, will
provide adequate traffic circulation and is designed in compliance with all
city codes.
7. All subdivision improvements will not conflict with any public easements.

not impact solar access to adjacent praperties or the subject property. All
single-family homes shall be reviewed and approved by the City prior to
construction.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, Califomia, as follows:
1. That the above recitations are true and correct and constitute the findings of
the Commission in this case.
2. That approval of Tentative Tract Map No. 33854 is hereby granted, subject
to conditions attached.

CONDITIONS OF APPROVAL
CASE NO. TT 33854
Department of Communitv Develoqment:
1. The development of the property shall conform substantially with exhibits on file
with the department of community development, as modified by the following
conditions.
2. Construction of a portion of said project shall commence within one year from the
date of finai approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may
be in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Sunline Transit Authority
Evidence of said permit or clearance from the above agencies shall be presented
to the department of building and safety at the time of issuance of a building
permit for the use contemplated herewith.
5. All sidewalk plans shall be reviewed and approved by the Department of Public
Works.
6. All onsite utilities shall be underground.
7. Applicant agrees to maintain the landscaping required to be installed pursuant to
these conditions. Applicant will enter into an agreement to maintain said
landscaping for the life of the project, which agreement shall be notarized and
which agreement shall be recorded. It is the specific intent of the parties that this

condition and agreement run with the land and bind successors and assigns. The
final landscape plan shall include a long-term maintenance program specifying
among other matters appropriate watering times, fertilization and pruning for
various times of the year for the specific materials to be planted, as well as periodic
replacement of materials. All to be consistent with the Property Maintenance
Ordinance (Ordinance No. 801) and the approved landscape plan.
8. The project shall be subject to all applicable fees at time of issuance of
building permits including, but not limited to, Art in Public Places, Fringe-
Toed Lizard, TUMF, School Mitigation and Housing Mitigation fees.
Department of Pubiic Works:
GENERAL
1. Landscaping maintenance of any common areas shall be provided by the homeowners
association. Landscape treatment shall be water efficient in nature and shall be in
accordance with the City of Palm Desert landscape design standards. Applicant shall
be responsible for executing a declaration of Conditions, Covenants and Restrictions,
which deciaration shall be approved by the City of Palm Desert and recorded with the
County Recorder. The declaration shall specify: (a) the applicant shall oversee the
formation of a property owners association; (b) the property owners association shall be
formed prior to the recordation of the Map; and (c) the aforementioned landscaping
shall be the responsibility of the property owners association. Landscaping plans shall
be submitted for review simultaneously with grading plans.
2. A complete preliminary soils investigation, conducted by a registered soils engineer,
shall be submitted to, and approved by, the Department of Public Works prior to the
issuance of a grading permit.
BONDS AND FEE3
3. A standard inspection fee shall be paid prior to issuance of grading permits.
DESIGN PLANS
4. Complete grading and improvement plans and specifications on electronic files shall be
submitted to the Director of Public Works for checking and approval prior to issuance of
any permits.

5. Improvement plans for utility systems shall be approved by the respective provider or
service districts with "as-builY' plans submitted to the Department of Public Works p�ior
to project final. Utility easements shall be relocated to accommodate new lot lines.
6. Compfete tract map shall be submitted as required by ordinance to the Director of
Public Works for checking and approval prior to the issuance of any permits.
7. Pad elevations, as shown on the tentative map are subject to review and modification in
accordance with Chapter 26 of the Palm Desert Municipal Code.
REQUIREQ CONSTRUCT{ON
8. All public and private improvements shali be inspected by the Department of
Public Works.
9. Applicant shail comply with provisions of Palm Desert Municipal Code Section 24.12,
Fugitive Dust Control as wett as Section 2420, Stormwater Management and Discharge
Control.
10. Prior to the start of construction, the applicant shall submit satisfactory evidence to the
Director of Public Works of intended compliance with the National Pollutant Discharge
Elimination System (NPDES) Generai Construction Permit for storm water discharges
associated with construction. Deve{oper must contact Riverside County Flood Controf
District for informational materials.
Riverside Countv Fire Department:
1. All buildings shall be accessible by an all-weather roadway extending to within 150' of
all portions of the exterior walls of the first story. The roadway shalf be not less than
24' of unobstructed width and 13'6" of vertical c4earance. Where parallel parking is
allowed, the roadway shall be 36' wide with parking on both sides, 32' wide with
parking on one side. Dead-end roads in excess of 150' shall be provided with a
minimum 45' radius turn around (55' in industrial developments).
2. The required water system including fire hydrants shall be installed and accepted by
the appropriate water agency prior to any combustibie building material being placed
on an individual lot. Three sets of water plans are to be submitted to the Fire
Marshal O�ce.

3. The applicant or developer shall prepare and submit to the Fire Marshal Office for
approval, a site plan designating required fire lanes with appropriate lane painting
and signs.
4. Blue dot retro-reflectors shail be placed in the street eight (8") from centeriine to the
side that the fire hydrant is on, to identify hydrant locations.
