Recommendation:
By minute motion, approve the use of Orange Coast Title
Company, of San Bernardino, for the title reports necessary for
right-of-way needs in conjunction with the Fred Waring Drive
Widening Project (654-01).
On January 9, 2003, City Council approved a Reimbursement Agreement
between Coachella Valley Association of Governments (CVAG), the City of
Indian Wells, and the City of Palm Desert for the design engineering services for
the widening of Fred Waring Drive to six lanes from Phyllis Jackson to
Washington Street. Phase I of this project is currently under construction. Phase
II is in the final stages of design. As a part of this project a soundwall is to be
built, as part of the mitigation measures, addressing the projected increase in
noise level.
To ensure that the soundwall construction and roadway improvements are
placed within designated right -of way, title reports are necessary for properties
between California Avenue and Washington Street on the north side of Fred
Waring Drive. Additionally, when the roadway improvements are completed, any
right-of-way areas to the north of the soundwall will revert to the individual
property owners. Therefore, vested title ownership must be verified to complete
the required documents.

Staff contacted the following companies, described the City need and requested
rate schedules:
TICOR Title Company
Orange Coast Title Company
Chicago Title Company
First American Title Company
Palm Desert, California
Palm Desert, California

Palm Desert, California
Only Chicago Title Company and Orange Coast Title Company responded. The
rates were comparable, as the Insurance Commission regulates these fees.
Standard fees are based upon the property value as it relates to the issuance of
a Title Insurance Policy. Orange Coast Title Company expressed interest in
preparing just the necessary Preliminary Title Report, and is willing to perform
the task for the ninety-seven (97) properties in question within the necessary time
frame. They would reduce their normal rate to $400.00 per report.
Therefore, staff recommends that City Council, approve the use of Orange
Coast Title Company, of San Bernardino, for the title reports necessary for
right-of-way needs in conjunction with the Fred Waring Drive Widening
Project (654-01).
