Recommendation:
Waive further reading and adopt Resolution No. 05-21, for the cul-
de-sac closures of the Highway 74 Frontage Road at Shadow
Mountain Drive.
Discussion:
On October 14, 2004, staff recommended that the frontage road on Highway 74
at the Shadow Mountain Drive intersection become a closed cul-de-sac
intersection. Staff has made this recommendation based upon traffic safety and
traffic circulation patterns. The closures provide positive guidance to motorists
and improve the operation efficiency of the intersection.
At this meeting, on October 14, 2004, City Council approved the cul-de-sac
closure of the frontage road along Highway 74 at the Shadow Mountain Drive
intersection, in conjunction with the installation of the traffic signal at that location.
On February 10, 2005, public hearing was held for all persons interested in or
objecting to the proposed cul-de-sac closure along Highway 74 Frontage Road at
Shadow Mountain Drive, as shown on attached Exhibit "A".
The City Clerk published notice of said hearing in the Desert Sun, a newspaper
of general circulation, circulated in the City of Palm Desert, California twice, the

first date of publication being two (2) weeks before the date of the hearing, and
staff posted notice of such closure, as required by law, at least two (2) weeks
before the day set for the hearing.
Therefore, staff recommends that City Council waive further reading and
adopt Resolution No. 05-21, for the cul-de-sac closures of the Highway 74
Frontage Road at Shadow Mountain Drive.

RESOLUTION NO. 05-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, TO CREATE CUL-DE-SAC CLOSURES ALONG HIGHWAY 74
FRONTAGE ROAD AT THE SHADOW MOUNTAIN DRIVE TRAFFIC SIGNAL.
The City Council of the City of Palm Desert, California, does hereby DETERMINE,
ORDER AND RESOLVE as follows:
WHEREAS, the City Council of the City of Palm Desert intends to, and by this
resolution does, under California Vehicle Code section 21101, which authorizes local authorities to
adopt rules and regulations closing any highway to vehicular traffic when, in the opinion of the
legislative body having jurisdiction, the highway is no longer needed for vehicular traffic; and
WHEREAS, the City Council of the City of Palm Desert on the 10th day of February,
2005, held a public hearing as required by law, at which hearing all persons interested in or objecting
to the proposed cul-de-sac closure along Highway 74 Frontage Road at the Shadow Mountain Drive
Traffic Signal, were heard and said public hearing was duly and regularly closed; and
WHEREAS, the City Council of the City of Palm Desert considered such matter and
finds for the evidence submitted that the cul-de-sac closure along Highway 74 Frontage Road at the
Shadow Mountain Drive Traffic Signal, described in Exhibit "A", attached hereto and made a part of,
is no longer needed for vehicular traffic
NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES HERBY
RESOLVE AS FOLLOWS:
I
Cul-de-sac closures along Highway 74 Frontage Road at the Shadow Mountain Drive
Traffic Signal shall be created as described and as set forth in Exhibit "A", attached hereto.
II
That the City Clerk of the City of Palm Desert, California, shall cause a certified copy
of this resolution and order to be recorded in the Office of the County Recorder of Riverside County,
California.
PASSED, APPROVED, and ADOPTED by the City Council of the City of Palm Desert,
California, on this 10th day of February, 2005, by the following vote:
