Recommendation:
1. That the City of Palm Desert hold a public hearing on the proposed
sale of the property commonly known as APN 618-490-025 located
near Miriam Way, Palm Desert, to the owner of the adjacent property.
2. That the City Council adopt Resolution No. as-1°approving the sale
of the subject ten -acre parcel (APN 618-490-025) to the owner of the
adjacent property.
EXECUTIVE SUMMARY:
Approval of the staff recommendation will permit disposal of a surplus parcel of
undeveloped land at a price equivalent to fair market value. Rejection of the staff
recommendation will leave the City with a parcel of land that is not accessible by road and
for which no use has been identified.
DISCUSSION:
Since March 1994, the City of Palm Desert and Riverside County have jointly owned a ten -
acre parcel located north of the intersection of Dinah Shore Drive and Miriam Way. The
parcel is bounded on the north by the Southern Pacific Railroad, and was intended to be
used as a site for a future multi -modal station. The parcel is not presently accessible by
road.
Plans for construction of a multi -modal station have been obviated by plans to situate such
a station to the west on property made available by the Agua Caliente Band of Indians.

Neither the City nor the County has identified any alternative use for the subject property.
In recognition of such, the County sold their 50% interest in the parcel to the City of Palm
Desert in December 2004.
The City has received an offer to purchase the parcel by the owner of APN 618-490-028,
which parcel bounds the subject parcel on two sides. The offering price was determined
to represent fair market value by verification of recent sales prices for undeveloped parcels
in the immediate vicinity of the subject parcel.
As required by law, notice of a public hearing on the proposed sale of the Property was
published once a week for two successive weeks in the Desert Sun, a local newspaper of
general circulation.
Staff recommends that the City Council hold a public hearing on the proposed sale of the
Property and approve the sale of the Property at this meeting.

RESOLUTION NO. 05-10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, FOLLOWING A PUBLIC HEARING, APPROVING AND
AUTHORIZING THE SALE OF PROPERTY OWNED BY THE CITY,
APPROXIMATELY TEN (10) ACRES IN THE SOUTHWEST CORNER OF THE
RAILROAD TRACKS AND EXTENSION OF MIRIAM WAY
WHEREAS, the City Council intends to sell a parcel of property located in the City of
Palm Desert, California, after appropriate notice of its intention to sell a parcel of property
located in the City of Palm Desert, generally described as Assessor's Parcel No. 618-490-025, a
parcel of approximately 10 acres at the southwest corner of the railroad tracks and extension of
Miriam Way; and
WHEREAS, the public hearing was conducted with regard to that intention at 4:00 p.m. on
the 13th day of January, 2005, in the Council Chamber, 73-510 Fred Waring Drive, Palm Desert,
California, and that said hearing heard anyone desiring to address to the sale of said property.
NOW, THEREFORE, the City Council of the City of Palm Desert, California,
DOES HEREBY DETERMINE, ORDER, and RESOLVE, as follows:
The City Council certifies that this property is no longer necessary for public use.
The City of Palm Desert, after public hearing, determines to sell and transfer the
property owned by the City of approximately ten (10) acres at southwest corner of
railroad tracks and extension of Miriam Way for an appropriate amount to
compensate the City, and does hereby authorize the City Manager to affect such
transaction after approval and ratification of the terms thereof by the City Council.
PASSED, APPROVED and ADOPTED at the regular meeting of the Palm Desert
City Council held on the 13th day of January, 2005, by the following vote, to wit:
