Staff Recommendation:
That the City Council adopt Resolution No. 05-9 approving PP 04-30,
including building height exception, subject to conditions.
Executive Summary:
Bedrosian Ceramic Tile and Stone proposes to construct a single story
52,164 square foot warehouse/showroom building on the north side of Dinah
Shore Drive, approximately 1,450 feet east of Monterey Avenue.

The main building section height is 30 feet, which is necessary to
accommodate interior function (movement of large panels). The raised entry
areas (36 feet maximum) create architectural interest in the roof line.
November 9, 2004, the ARC unanimously granted preliminary approval of
the building architecture including the height exception.
December 7, 2004, the Planning Commission unanimously 5-0
recommended approval of Precise Plan 04-30, including the height
exception.
Background:
PROPERTY DESCRIPTION
The property is a vacant 3.33-acre lot on the north side of Dinah Shore Drive
approximately 1,450 feet east of Monterey Avenue. The site slopes slightly
from south to north and is bounded on the north by the future storm channel
and the railroad.
ZONING AND GENERAL PLAN DESIGNATION
The property is zoned SI (service industrial) and designated I -BP
(industrial/business park) in the General Plan.

Project Description:
The project is a single story 52,164 square foot warehouse/showroom building
which will house Bedrosian Ceramic Tile and Stone.

ARCHITECTURE
The contemporary project architecture includes raised parapets to vary the roof
line, architectural projections, raised entry areas, cobalt blue inset ceramic tile,
copper map color slate panels, and gold harvest slate which when combined
create an interesting and acceptable architectural statement.
The raised entry areas (36 feet maximum) create architectural interest in the
roof line. The main building height remains at 30 feet which is needed to
accommodate interior movement of large panels. The 36-foot high entry parapet
elements will require specific approval by City Council.
November 9, 2004 ARC unanimously granted preliminary approval to the
building architecture.
ACCESS AND PARKING
The site plan has been designed to provide two shared access points to Dinah
Shore Drive. Two-way traffic will circulate around the perimeter of the site.
Parking for 137 vehicles is provided on all four sides of the building.
Code requires a minimum of 98 + 13 = 111 parking spaces (i.e., 49,017
square feet @ 2 spaces per 1,000 square feet, plus the 3,147 square feet of
retail in excess of 20% @ 4/1,000 square feet).

Analysis:
The project complies with code requirements for the SI district, except for the
height of the entry elements which require approval by the City Council.
The project as designed will result in an attractive architectural appearance and
will complement other buildings approved for the area.
CEQA Review:
The project is a Class 32 Categorical Exemption for purposes of CEQA and no
further review is necessary.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF
DESIGN FOR CONSTRUCTION OF A 52,164 SQUARE FOOT
SHOWROOM/WAREHOUSE BUILDING AND HEIGHT EXCEPTION
ON LOT 35, PM 24255, 73-550 DINAH SHORE DRIVE.

WHEREAS, the City Council of the City of Palm Desert, California, did on the 13th
day of January, 2005, hold a duly noticed public hearing to consider a request by
DEVELOPMENT RESOURCE CONSULTANTS ON BEHALF OF BEDROSIAN CERAMIC TILE
AND STONE for approval of the above noted project; and
WHEREAS, the Planning Commission of the City of Palm Desert, California, by its
Resolution No. 2311 has recommended approval of Case No. 04-30; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 04-106," in that the Director of Community Development has determined that the
project is a Class 32 Categorical Exemption; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said City Council did find
the following facts and reasons to exist to justify granting approval of said precise plan of
design and height exception:
1. The precise plan is well designed with quality architecture.
2. The precise plan complies with zoning ordinance requirements, except for
building height.
3. The design of the precise plan will not substantially depreciate property values
nor be materially injurious to the properties or improvements in the vicinity.
4. The precise plan will not unreasonably interfere with the use and enjoyment
of the property in the vicinity by the occupants thereof for lawful purposes.
5. The precise plan will not endanger the public peace, health, safety or general
welfare.
6. The height exception is necessary in order to maintain interior function within
the building and achieve quality exterior architecture.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert,
California, as follows:
1. That the above recitations are true and correct and constitute the findings of
the City Council in this case.
2. That approval of Case No. PP 04-30 and a height exception are hereby
approved, subject to attached conditions.

CONDITIONS OF APPROVAL

Department of Community Development:
1. The development of the property shall conform substantially with exhibits on file with the
Department of Community Development, as modified by the following conditions:
2. Construction of a portion of said project shall commence within one year from the date
of final approval unless an extension of time is granted; otherwise, said approval shall
become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the restrictions and
limitations set forth herein which are in addition to all municipal ordinances and state and
federal statues now in force, or which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use contemplated by this
approval, the applicant shall first obtain permit and/or clearance from the following
agencies:
Coachella Valley Water District
Palm Desert Architectural Review Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall be presented to the
department of building and safety at the time of issuance of a building permit for the use
contemplated herewith.
5. Access to trash/service areas shall be placed so as not to conflict with parking areas.
Said placement shall be approved by applicable waste company and Department of
Community Development and shall include a recycling program.
6. Applicant agrees to maintain the landscaping required to be installed pursuant to these
conditions. Applicant will enter into an agreement to maintain said landscaping for the life
of the project, which agreement shall be notarized and which agreement shall be
recorded. It is the specific intent of the parties that this condition and agreement run with
the land and bind successors and assigns. The final landscape plan shall include a long-
term maintenance program specifying among other matters appropriate watering times,
fertilization and pruning for various times of the year for the specific materials to be

planted, as well as periodic replacement of materials. All to be consistent with the
Property Maintenance Ordinance (Ordinance No. 801) and the approved landscape plan.
7. A detailed parking lot and building lighting plan shall be submitted to staff for
approval, subject to applicable lighting standards, plan to be prepared by a qualified
lighting engineer.
8. That the applicant obtain approval of the City Council of the roof elements in excess
of 30 feet in height.
Department of Public Works:
1. Project shall retain nuisance waters on -site.
2. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79-
55, shall be paid prior to issuance of a grading permit.
3. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF). Payment
of said fees shall be at the time of building permit issuance.
4. A complete preliminary soils investigation, conducted by a registered soils engineer, shall
be submitted to and approved by the Department of Public Works prior to the issuance
of the grading permit.
5. All public and private improvements shall be inspected by the Department of Public
Works and a standard inspection fee shall be paid prior to issuance of grading permits.
6. Any and all offsite improvements shall be preceded by the approval of plans and the
issuance of valid encroachment permits by the Department of Public Works, and shall be
completed prior to issuance of any certificate of occupancy for the project.
7 As required under Palm Desert Municipal Code Section 26.28, and in accordance with
Sections 26.40 and 26.44, complete improvement plans and specifications shall be
submitted to the Director of Public Works for checking and approval before construction
of any improvements is commenced. Offsite improvement plans to be approved by the
Public Works Department and a surety posted to guarantee the installation of all required
offsite improvements prior to permit issuance.
8. Landscape installation on the property frontages, as well as on -site, shall be drought
tolerant in nature and maintenance shall be provided by the property owner.

9. Applicant shall comply with the provisions of Municipal Code Section 24.12, Fugitive Dust
Control and Section 24.20, Stormwater Management and Discharge Control.
10. In accordance with Palm Desert Municipal Section 26.44, complete grading plans/site
improvement plans and specifications shall be submitted to the Director of Public Works
for checking and approval prior to the issuance of any permits. Preliminary landscape
plans shall be submitted for review concurrently with grading plans.
11. Proposed building pad elevations are subject to review and modification in accordance
with Chapter 27 of the Palm Desert Municipal Code.
12. Full public improvements, as required by Sections 26.40 and 26.44 of the Palm Desert
Municipal Code, shall be installed in accordance with applicable City standards and the
City's Circulation Network, including the following:
• Deceleration lane required on Dinah Shore Drive at the westerly driveway.
• 8' meandering sidewalk required on Dinah Shore Drive.
Rights -of -way necessary for the installation of the above referenced improvements shall
be conveyed to the City prior to the issuance of any permits associated with this project.
13. Size, number and location of driveways shall be to the specifications of the Department
of Public Works with two driveway approaches permitted to serve this property.
Westernmost driveway shall be moved west to be shared with the property to the west.
14. Reciprocal access easements required with properties to the east and west.
15. Driveway throats, with no openings at least 75' as measured from the curbline of Dinah
Shore Drive, are required for the driveways providing access to the project, or as
approved by the City Engineer.
16. Where adjacent, the project shall line the sides of the mid valley channel with cement in
accordance with specifications from PM 24255, or as approved by the City Engineer.
Riverside County Fire Department:
1. With respect to the conditions of approval regarding the above referenced project, the
Fire Department recommends the following fire protection measures be provided in
accordance with City Municipal Codes, appropriate NFPA Standards, CFC, and CBC
and/or recognized fire protection standards.

The Fire Department is required to set a minimum fire flow for the remodel or
construction of all commercial buildings per UFC article 87.
2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual operating pressure
must be available before any combustible material is placed on the job site.
3. Provide, or show there exists, a water system capable of providing a gpm flow of
3,000 gpm for commercial buildings.
4. The required fire flow shall be available from a wet barrel Super Hydrant(s) (4"x2-
1 /2"x2-1 /2"), located not less than 25' nor more than 150' from any portion of a
commercial building measured via vehicular travelway.
5. Water plans must be approved by the Fire Marshal and include verification that the
water system will produce the required fire flow.
6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings with a 3000
square foot total cumulative floor area. The fire Marshal shall approve the locations of
all post indicator valves and fire department connections. All valves and connections
shall not be less than 25' from the building within 50' of an approved hydrant. Exempted
are one and two family dwellings.
7 All valves controlling the water supply for automatic sprinkler systems and Water -flow
switches shall be monitored and alarmed per UBC chapter 9.
8. Install a fire alarm system as required by the UBC Chapter 3.
9. Install portable fire extinguishers per NFPA 10, but not less than one 2A10BC
extinguisher per 3,000 square feet and not over 75' walking distance. A "K" type fire
extinguisher is required in all commercial kitchens.
10. All buildings shall be accessible by an all-weather roadway extending to within 150'
of all portions of the exterior walls of the first story. The roadway shall be not less
than 24' of unobstructed width and 13'6" of vertical clearance. Where parallel
parking is required on both sides of the street, the roadway must be 36' wide and
32' wide with parking on one side. Dead-end roads in excess of 150' shall be
provided with a minimum 45' radius turn -around 55' in industrial developments.
1 1 . Whenever access into private property is controlled through use of gates, barriers or
other means, provisions shall be made to install a "Knox Box" key over -ride system

to allow for emergency vehicle access. Minimum gate width shall be 16" with a
minimum vertical clearance of 13'6".
12. This project may require licensing by a state or county agency; to facilitate plan
review the applicant shall prepare and submit to the Fire Marshal a letter of intent
detailing the proposed usage and occupancy type.
13. All buildings shall have illuminated addresses of a size approved by the City.
14. All fire sprinkler systems, fixed fire suppression systems and alarm plans must be
submitted separately to the Fire Marshal for approval prior to construction.
15. Conditions subject to change with adoption of new codes, ordinances, laws, or when
building permits are not obtained within 12 months.
16. All elevators shall be minimum gurney size.

Anyone who challenges any hearing matter in court may be limited to
raising only those issues he, she or someone else raised at the public
hearing described herein, or in written correspondence delivered to the
Planning Commission at, or prior to, the public hearing.
CHAIRPERSON JONATHAN advised the audience that Public Hearing Item F, Case No.
PM 31862, Indian Springs Ltd., Applicant, when the Commission got to that item on
the agenda in all likelihood, in part because of all the correspondence received and
staff needed time to analyze those comments and respond and possibly modify its
recommendation to the Planning Commission, in all likelihood it appeared that matter
would in fact be continued to the second meeting in January, January 18, 2005.
The matter was publicly noticed; therefore, public testimony would be heard if people
chose to speak in spite of the fact that it would be continued, and anyone who wished
to speak would have an opportunity to do so. The public hearing would be opened,
however, it was likely the matter would be continued; therefore, there would be an
opportunity for public testimony at the second meeting in January (January 18, 2005)
and in that event there would be no decisions taking place tonight or discussion by the
Planning Commission. He just wanted to advise those in the audience out of fairness,
because he didn't want anyone waiting an hour, or two hours, or however long it took
to get to that item and then have them finding out they were intending to continue the
matter. He asked if the commission had any comments on that. There were no
comments.

Mr. Smith reviewed the salient points of the staff report, explaining that
this matter was a recommendation to the City Council for approval of the
requested height exception. He recommended approval, subject to the
conditions of approval contained within the Draft Resolution.
Commissioner Lopez asked about the condition regarding the sidewalk
running along Dinah Shore. For another case on the agenda, the
requirement called for a meandering sidewalk. On the plans, it appeared
to just be a straight sidewalk along the curb. He asked for clarification.
Mr. Joy believed the sidewalk would be installed as part of the
subdivision itself. This was just another case where it would be installed
by this project. On this type of street they were calling for a meandering
sidewalk; not so much meandering, what they were trying to achieve
was no so much the curve, but the gap between the sidewalk and the
curb itself so there was a little bit of break for landscaping.
Commissioner Lopez noted that the landscaping did have a bit of a
meandering sidewalk, but the actual plan just had it straight and in the
condition it didn't specify meandering, it just said eight -foot sidewalk. Mr.
Joy thought he was talking about a curbside sidewalk and they could
make sure it wasn't curbside and a little more decorative with a little
more landscaping. He said they could add that condition in there.
Commissioner Lopez suggested adding an eight -foot meandering sidewalk
meandering along Dinah Shore. Chairperson Jonathan stated that would
be Public Works Condition No. 12 and they would just insert the word
meandering. Commissioner Lopez concurred.
Chairperson Jonathan asked for confirmation that the driveway access
on each end of the project was designed to be a future shared driveway
access with the adjacent projects to the west and east. Mr. Smith said
that was correct.
Chairperson Jonathan opened the public hearing and asked the applicant
to address the commission.
MR. BROCK GRAYSON, with Ware Malcolm Architects, informed
commission that they were the architects of record for the project,
said he was asked by Larry Bedrosian of Bedrosian Tile to

represent him, and was present to answer any questions. He
indicated that Mr. Bedrosian reviewed the conditions of approval
and accepted all the conditions with the exception of two. The
first was a clarification in the Coachella Valley Water District letter
dated October 18, the third paragraph, in discussion of the
drainage from this area to the Mid Valley Storm Water Project, it
said the City shall require mitigation measures to be incorporated
into the development to prevent flooding of this site or
downstream properties. These measures shall include on -site
retention of water from the 100-year storm, dedication of right-of-
way for regional flood control facilities, or other participation in the
financing of regional flood control facilities.
He said it was the owner's understanding that flood control is
handled throughout the park and they would be draining to that
back area, so it wasn't on -site, but was within the business park.
So it wasn't technically draining on -site. He just wanted that
clarification.
Mr. Smith stated that was what the channel on the north end of the
property would serve.
Mr. Grayson concurred.
Chairperson Jonathan didn't think there was a formal condition of
approval that required that.
Mr. Grayson indicated that the second item he wanted to address
was Public Works Condition No. 15. That addressed the depth of
the throat of the two drive entrances into the project. Public
Works asked them to provide a 75-foot throat to the drive entry.
Their current site plan showed a 50-foot throat. He thought the 75
feet would make sure that cars didn't stack in the driveways. The
owner of this property would have a dozen employees working
there and anticipated no more than six to eight people there at
anyone time in the showroom. They weren't anticipating a high
traffic use in this building, so he wanted to see if it was possible
to have that 50-foot throat instead of 75 feet. A 75-foot throat

caused problems, because they would have to extend the
landscape fingers and the radius around those fingers to create an
"S" because they would have to go back down to the parking
stalls adjacent to the street.
Mr. Joy said this was discussed quite thoroughly between Public Works
and Planning and they envisioned that this could be accomplished by
extending those fingers a little bit. The applicant originally requested a
100-foot throat and they compromised with 75-feet. Mr. Drell stated that
it was his understanding that originally these projects didn't have all
shared driveways and when the design of the shared driveways came
out, that was the design approved by the Public Works Department. He
wasn't sure if this condition dated back before that redesign occurred. He
recommended adding to the condition "or as approved by the City
Engineer." They could work this out with the City Engineer. He thought
the project had been redesigned after that condition was first developed
and the shared design made that throat kind of difficult to achieve.
Mr. Grayson thought there was a discussion about the deceleration
lane that also came in after. He said they accepted putting in that
deceleration lane and that might also accommodate any stacking
that could occur on the site.
Chairperson Jonathan asked if the language suggested by Mr. Drell would
accommodate Mr. Grayson's requirements.
He replied yes and said they were willing to work with staff to
come to an agreement.
Mr. Drell stated that if for some reason there was an impasse, the matter
would be brought back to the Planning Commission.
Mr. Grayson concurred. Regarding the meandering sidewalk, it was
their understanding that all that sidewalk is part of the off-street
improvement plans and weren't typically part of their project.
Mr. Drell said those sidewalks were being installed right now, probably
by Mr. Noble. So that plan was already approved by Public Works.

Mr. Grayson noted that the architectural plan was inaccurate by
showing the straight sidewalk.
Chairperson Jonathan asked if the entire building would be occupied by
Bedrosian Tile.
Mr. Grayson said yes. Originally they anticipated having another
tenant, but because the business was doing so well, he anticipated
being the only occupant.
Chairperson Jonathan asked if anyone wished to speak in FAVOR or
OPPOSITION to the proposed project. There was no one and the public
hearing was closed. Chairperson Jonathan asked for commission
comments.
Commissioner Campbell thought it looked like a great project and moved
for approval. Commissioner Tschopp seconded the motion. Commissioner
Finerty indicated that would include amendment to Public Works
Condition No. 12 inserting the word "meandering"; and to Condition
No.15 adding "or as approved by the City Engineer." Chairperson
Jonathan asked if the motion reflected those amendments.
Commissioners Campbell and Tschopp concurred. Chairperson Jonathan
added that he really appreciated the creative design. It would be on a
very visible thoroughfare, Dinah Shore, and he thought they continued to
set the bar for service industrial buildings at a standard that they wanted.
He thanked the applicant and called for the vote.
Action:
It was moved by Commissioner Campbell, seconded by Commissioner
Tschopp, approving the findings as presented by staff. Motion carried 5-
0.

A. ARCHITECTURE:
The contemporary project architecture includes raised parapets to vary the roof
line, architectural projections, raised entry areas, cobalt blue inset ceramic tile,
copper map color slate panels, and gold harvest slate which when combined
create an interesting and acceptable architectural statement.
The raised entry areas (36 feet maximum) create architectural interest in the
roof line. The main building height remains at 30 feet which is needed to
accommodate interior movement of large panels. The 36-foot high entry
parapet elements will require specific approval by City Council.
November 9, 2004 ARC unanimously granted preliminary approval to the
building architecture.
B. ACCESS AND PARKING:
The site plan has been designed to provide two shared access points to Dinah
Shore Drive. Two-way traffic will circulate around the perimeter of the site.
Parking for 137 vehicles is provided on all four sides of the building.
Code requires a minimum of 98 + 13 = 111 parking spaces (i.e., 49,017
square feet @ 2 spaces per 1,000 square feet, plus the 3,147 square feet of
retail in excess of 20% @ 4/1,000 square feet).

WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 7th day of December, 2004, hold a duly noticed public hearing to consider a request by
DEVELOPMENT RESOURCE CONSULTANTS ON BEHALF OF BEDROSIAN CERAMIC TILE
AND STONE for approval of the above noted project; and
WHEREAS, said application has complied with the requirements of the "City of Palm

1. The development of the property shall conform substantially with exhibits on file with the
Department of Community Development, as modified by the following conditions:

of final approval unless an extension of time is granted; otherwise, said approval shall
become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the restrictions and
limitations set forth herein which are in addition to all municipal ordinances and state and
federal statues now in force, or which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use contemplated by this
approval, the applicant shall first obtain permit and/or clearance from the following

Evidence of said permit or clearance from the above agencies shall be presented to the

Community Development and shall include a recycling program.
6. Applicant agrees to maintain the landscaping required to be installed pursuant to these
conditions. Applicant will enter into an agreement to maintain said landscaping for the life
of the project, which agreement shall be notarized and which agreement shall be
recorded. It is the specific intent of the parties that this condition and agreement run with
the land and bind successors and assigns. The final landscape plan shall include a long-
term maintenance program specifying among other matters appropriate watering times,
fertilization and pruning for various times of the year for the specific materials to be

planted, as well as periodic replacement of materials. All to be consistent with the

lighting engineer.
8. That the applicant obtain approval of the City Council of the roof elements in excess
of 30 feet in height.
Department of Public Works:
1. Project shall retain nuisance waters on -site.
2. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79-
55, shall be paid prior to issuance of a grading permit.

for checking and approval prior to the issuance of any permits. Preliminary landscape
plans shall be submitted for review concurrently with grading plans.
11. Proposed building pad elevations are subject to review and modification in accordance
with Chapter 27 of the Palm Desert Municipal Code.
12. Full public improvements, as required by Sections 26.40 and 26.44 of the Palm Desert
Municipal Code, shall be installed in accordance with applicable City standards and the
City's Circulation Network, including the following:
• Deceleration lane required on Dinah Shore Drive at the westerly driveway.
• 8' sidewalk required on Dinah Shore Drive.
Rights -of -way necessary for the installation of the above referenced improvements shall
be conveyed to the City prior to the issuance of any permits associated with this project.
13. Size, number and location of driveways shall be to the specifications of the Department
of Public Works with two driveway approaches permitted to serve this property.
Westernmost driveway shall be moved west to be shared with the property to the west.
14. Reciprocal access easements required with properties to the east and west.
15. Driveway throats, with no openings at least 75' as measured from the curbline of Dinah
Shore Drive, are required for the driveways providing access to the project.
16. Where adjacent, the project shall line the sides of the mid valley channel with cement in
accordance with specifications from PM 24255, or as approved by the City Engineer.
Riverside County Fire Department:
1 . With respect to the conditions of approval regarding the above referenced project, the
Fire Department recommends the following fire protection measures be provided in
accordance with City Municipal Codes, appropriate NFPA Standards, CFC, and CBC
and/or recognized fire protection standards.

The Fire Department is required to set a minimum fire flow for the remodel or
construction of all commercial buildings per UFC article 87.
2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual operating pressure
must be available before any combustible material is placed on the job site.
3. Provide, or show there exists, a water system capable of providing a gpm flow of
3,000 gpm for commercial buildings.
4. The required fire flow shall be available from a wet barrel Super Hydrant(s) (4"x2-
1 /2"x2-1 /2"), located not less than 25' nor more than 150' from any portion of a
commercial building measured via vehicular travelway.
5. Water plans must be approved by the Fire Marshal and include verification that the
water system will produce the required fire flow.
6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings with a 3000
square foot total cumulative floor area. The fire Marshal shall approve the locations of
all post indicator valves and fire department connections. All valves and connections
shall not be Tess than 25' from the building within 50' of an approved hydrant. Exempted
are one and two family dwellings.
7. All valves controlling the water supply for automatic sprinkler systems and Water -flow
switches shall be monitored and alarmed per UBC chapter 9.
8. Install a fire alarm system as required by the UBC Chapter 3.
9. Install portable fire extinguishers per NFPA 10, but not less than one 2A1OBC
extinguisher per 3,000 square feet and not over 75' walking distance. A "K" type fire
extinguisher is required in all commercial kitchens.
10. All buildings shall be accessible by an all-weather roadway extending to within 150'
of all portions of the exterior walls of the first story. The roadway shall be not less
than 24' of unobstructed width and 13'6" of vertical clearance. Where parallel
parking is required on both sides of the street, the roadway must be 36' wide and
32' wide with parking on one side. Dead-end roads in excess of 150' shall be
provided with a minimum 45' radius turn -around 55' in industrial developments.
11. Whenever access into private property is controlled through use of gates, barriers or
other means, provisions shall be made to install a "Knox Box" key over -ride system

to allow for emergency vehicle access. Minimum gate width shall be 1 6" with a
minimum vertical clearance of 13'6".
12. This project may require licensing by a state or county agency; to facilitate plan
review the applicant shall prepare and submit to the Fire Marshal a letter of intent
detailing the proposed usage and occupancy type.
13. All buildings shall have illuminated addresses of a size approved by the City.
14. All fire sprinkler systems, fixed fire suppression systems and alarm plans must be
submitted separately to the Fire Marshal for approval prior to construction.

With respect to the conditions of approval regarding the above
referenced project, the fire department recommends the following fire
protection measures be provided in accordance with City Municipal
Code, NFPA, CFC, and CBC or any recognized Fire Protection
Standards:
The Fire Department is required to set a minimum lire flow for the
remodel or construction of all buildings per UFC article 87.
A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual
pressure must be available before any combustible material is placed
on the iob site.
Provide or show there exists a water system capable of providing a
gpm flow of:

The required fire flow shall be available from a wet barrel Super

10. Please be advised the proposed project may not be feasible since the
existing water mains will not meet the required fire flow.
Install a complete NFPA 13 fire sprinkler system. This applies to all
buildings with a 3000 square foot total cumulative floor area. The Fire
Marshal shall approved the locations of all post indicator valves and
fire department connections. All valves and connections shall not be
less than 25' from the building and within 50' of an approved
hydrant. Exempted are one and two family dwellings.
Alt valves controlling the water supply for automatic sprinkler
systems and Water -flow switches shall be monitored and alarmed per
CBC Chapter 9.
Install a fire alarm system as required by the UBC Chanter 3.
Install portable fire extinguishers per NFPA 10, but not less than one
2A1OBC extinguisher per 3000 square feet and not over 75' walking
distance. A "K" type fire extinguisher is required in all commercial
kitchens.
15. Install a Hood/Duct automatic fire extinguishing system per NFPA 96
in all public and private cooking operations except single-family
residential usage.
16. Install a dust collecting system per CFC Chapter 76 if conducting an
operation that produces airborne particles.
All building shall be accessible by an all-weather roadway extending
to within 150' of all portions of the exterior walls of the first story.
The roadway shall not be less than 24' of unobstructed width and
13' 6" of vertical clearance. Where parallel parking is required on
both sides of the street the roadway must be 36' wide and 32' wide
with parking on one side. Dead-end roads in excess of 150' shall be
provided with a minimum 45' radius turn -around 55' in industrial
developments.
/67/ Whenever access into private property is controlled through use of
gates, barriers or other means provisions shall be made to install a
"Knox Box" key over -ride system to allow for emergency vehicle
access. Minimum gate width shall be 16" with a minimum vertical
clearance of 13'6".
19. A dead end single access over 500' will require a secondary access,
sprinklers or other mitigative measures approved by the Fire
Marshal. Under no circumstance shall a dead end over 1300' be
accepted.
20. A second access is required. This can be accomplished by two main
access points from a main roadway or an emergency gate from an
adjoining development.
This project may require licensing by a state or county agency, to
facilitate plan review the applicant shall prepare and submit to the
Fire Marshal a letter of intent detailing the proposed usage and
occupancy type.
All buildings shall have illuminated addresses of a size approved by
the city.
All fire sprinkler systems, fixed fire suppression systems and alarm
plans must be submitted separately to the Fire Marshal for approval
prior to construction.
. Conditions subject to change with adoption of new codes, ordinances,
laws, or when building permits are not obtained within twelve
months.
All elevators shall be minimum Eurnev size.

This area lies on the sandy area in the northern portion of Palm Desert and is considered safe
from regional stormwater flows except in rare instances.
This area is designated Zone C on Federal Flood Insurance rate maps which are in effect at
this time by the Federal Emergency Management Agency.
Drainage from this area is contributory to the Mid -Valley Stormwater Project. The city shall
require mitigation measures to be incorporated into the development to prevent flooding of
the site or downstream properties. These measures shall include on -site retention of water
from the 100-year storm, dedication of right-of-way for regional flood control facilities or
other participation in the financing of regional flood control facilities.
Since the stormwater issues of this development are local drainage, the District does not need
to review drainage design further.
The District will furnish domestic water and sanitation service to this area in accordance with
the current regulations of this District. These regulations provide for the payment of certain
fees and charges by the subdivider and said fees and charges are subject to change.
This area shall be annexed to Improvement District Nos. 58 and 81 of the District for
sanitation service.

The District requires detail, repair and lube auto shops and car washes to install an oil and
sand separator, including a sample box, sanitary tee and running trap with cleanout, prior to

Dear Mr. Smith,
Thank you for the opportunity to comment on the proposed construction of the 52,118 sq. ft. warehouse
building, located on Lot 35, PM 24255, 73-550 Dinah Shore Drive. The following issues of concern
related to public safety and law enforcement are presented:
1. Current Planned Design:
A. Exterior Building Security: The exterior doors should be of steel construction and secured
with a heavy-duty type lock to provide protection against forced entry. The roll up garage
style doors should have a heavy-duty pad lock on the exterior with a metal plate covering the
padlocks to prevent the locks from being cut.
B. Exterior Lighting Plan: All exterior lighting fixtures should be mounted to a height that
would reduce any tampering or damage. Metal halide type lighting can be used for reasons of
accurate color rendition and increased visibility. Each exterior door along the sides and rear of
the building should have a light above them that would illuminate the area at night.
C. Roof Access: Any roof top vents and hatches should be reinforced steel and locked to prevent
forced entry.
D. Alarm System: A security alarm system should be installed with sensors covering all exterior
doors/windows on the ground floor, along with interior motion and roof hatch sensors (if
applicable). The subscriber should provide the servicing alarm vendor with a contact person,
and/or responder in the event of alarm activation. The responder is usually a manager or
assistant manager with keys to all areas of the building that could meet with deputies in the
event the alarm activates when the business is closed. A Knox Box system should be mounted
near the front doors with a key to the building. In the event the business is closed and alarm
activation occurs without a responder available; deputies could enter the building and search
for intruders.

E. Business Numbering or Monument: The property address should be prominently displayed
and visible from Dinah Shore Drive. The numbers affixed to the building or monument
should be of contrasting color from the building facade and illuminated at night. This will
assist in emergency responses by the fire department or the Palm Desert Police Department.
2. Construction Site:
A. Exterior Fence: Prior to construction of any structure, a material storage area should be
established along the perimeter of the property and enclosed by a six (6) foot chain link fence
with locking gates to minimize theft of materials and/or equipment. "No Trespassing" signs
should be mounted on all four sides of the fencing.
B. Equipment, Staffing, and Supervision: It is recommended that a list of serial and/or license
numbers of equipment stored at the location be maintained both at the site and at any off -site
main office. The public and non -essential employees should have restricted access to the
construction areas. Current emergency contact information for the project and construction
supervisor should be kept on file with the Palm Desert Police Department. A list of
construction employee's names who are permitted to be on the construction site in the evening
hours should be kept with the construction supervisor in the event deputies check the site and
locate unauthorized personnel or trespassers at night.
C. Lighting and Storage: The developer and/or builder's name, address, and phone number
should be conspicuously posted at the construction site. Visibility into the construction site
should not be intentionally hampered by equipment or storage of construction materials. Any
stored construction material should be stored near as possible to the center of the site and
should be kept at a minimum height to allow view into the site from the roadway.
The construction site should be well lit during hours of darkness to prevent intruders and all
entrances and exits should be clearly marked and locked when not in use.

As requested, I have reviewed the landscape plans for the aforementioned project.
Following are my comments for the preliminary landscape plans:
• The use of native and water conserving plants as mentioned in your water
conservation notes is contrary to the plant palette where you have a majority
of moderate to high water use plants.
• Do you plan on separating all the plants based on hydrozone onto its own
valve?
• Mulch should be 3/8" minus (11 % fines), wetted and rolled and compacted,
you call out 3" but in the legend you call out for 2". Which is it?
• Soil amendments: what are you basing your water holding capacity
amendment on? Please specify.
• How will you guarantee specific watering times as noted (between 10 p.m.
and 6 a.m.)?
• The irrigation system design based on watering needs. Of what? Based on
what? Wind? Air temperature? Soil Temperature? Sun exposure?
• Why are you calling out for rain sensors? Coachella Valley gets on average 2"
of rain annually.
• In the plant palette include water use of plants.
• Expand the tree palette and the shrub palette.
• The Parking lot tree ordinance requires 4 different types of trees to be used in
the parking lot. Acacia stenophylla is not a shade tree. No Schinus molle to
be used or Prosopis. Keep in mind this is in the wind belt.
• Change your plant spacing as noted on the plan.
• No mass planting. No hedges. Use the bougainvillea as an accent not as the
anchor for the landscape.
• Increase your shrub palette; add accents, vines, and emphatics.

• Dinah Shore Dr. is an arterial street. This requires a meandering sidewalk, not
curb adjacent as shown on your plan (needs to be shown correctly on Civil
plan).
• No planting of shrubs in the root zone of trees.
• Do not mass plant. No hedges.
• Show any retention areas or proposed walls.
• Plan does not meet the City of Palm Desert Parking Lot Tree ordinance.
• Keep trees a minimum of 5'/2' away from buildings and hardscapes.
• Keep shrubs a minimum of 3'/2' away from buildings and hardscapes.

Mr. Smith displayed the site plan for the proposal to the west of this
project. The proposed site plan will be changing due to conditions from
Public Works since they don't want any parking in the front 100'. The
matter is before the commission for their review of the architecture.
The building height is at the maximum of 35'. The service industrial
zone can have a 30' building height, however, height exceptions can be
processed through the City Council. On the plan to the west, they have
provided for a shared access driveway.
Commissioner Vuksic asked the project architect if he wanted to
present the project before comments are given by the commission.
Edward Olmedo, architect for Ware-Malcomb Architects, was present to
address the commission. Larry Bedrosian and Tom Noble were also
present. The building is going to be used as a tile distribution center
and will be 52,000+ square feet on about 3.3 acres of land. We gave
the building a retail look even though it's an industrial complex. I was
told by staff members that tower elements are permitted, with 55' being

the tallest tower that the City would approve and we're definitely below
that. Mr. Drell commented that there will be another layer of approval
and will take more time.
Tom Noble stated that he had met with Mike Errante, Page Garner and
Mark Greenwood. Mr. Greenwood stated that he was concerned about
the access to the large parcels along Dinah Shore and asked where
they could have shared driveways. They sat down and went through
the property lines where they did not have water service coming in and
they identified where they could have shared driveways. I notified the
buyers so that they could work around this issue. I'm really dismayed
that the issue of a shared driveway would come up after all these
discussions. Is this site plan a concern to the Architectural Review
Commission? Mr. Drell stated that this is not a concern of this
commission and it will be discussed at the Planning Commission.
We're here today to discuss architecture.
Commissioner Vuksic stated that the main building is 30' high. I have
some problems with the sides of the building and there's not enough
depth on the front for the size of the building. I studied the plans for the
building that's going in next door and there's a lot going on in that
building. There are all kinds of things to break up the huge mass with
differences in plane, color and material. I can appreciate the simplicity
of the south elevation, but as soon as you start putting openings in it, it
then needs to be responsive to the forms. The openings shouldn't be
arbitrarily stuck in the walls. You definitely need more happening on
both sides. You can see the sides from the street on the north and
south. On the west elevation you need more. You're close but the
area in between the two reddish masses looks like there's something
happening but it's really very flat. You use paint colors, but I don't think
that's enough for this massive building. I think you need some depth
there. The glass needs to be set in. It's only set in a few inches, if that.
The red columns are just paint colors. There needs to be more
happening. There could be more variation in height. The base height
is 30' and then there are two equally high elements and they could be a
little bit more playful than that. Commissioner Vuksic wanted to know
about the parapet height. Mr. Olmedo stated that they generally start at
1' from the ridge and then it goes down about 4' or 5'. On the main
tower elements there's an additional 5'. The roof -mounted equipment
will be screened. Commissioner Vuksic stated that the equipment has
to be below the low parapet. Mr. Olmedo volunteered to provide a line
of sight exhibit. Commissioner Vuksic commented that if you're
heading east on Dinah Shore, you're above the pad height by quite a

bit. The mechanical equipment needs to be below the level of the
parapet. Mr. Olmedo stated that he can provide an exhibit that can
address this issue.
Commissioner Vuksic stated that after reviewing the roof plans, he
noticed that the towers go back some distance on the main roof about
6' or 8'. They should be carried back further. Mr. Olmedo stated that
they're not metal frame. The structure is concrete and at one point they
are cantilevering it about 5'-6'. Commissioner Vuksic asked if they
could add some metal frame to that to extend those. You're going to
see those. Mr. Olmedo stated that he didn't want to use a change of
material because it might look different once you actually see it. On
paper it might look nice, but once it's constructed it might not look so
nice. Commissioner Vuksic stated that seeing something end too
abruptly and maybe even see the back side of that would be a lot worse
looking than seeing two things painted the same color that happen to
be different materials. He asked about the finish on the concrete. Mr.
Olmedo stated that it'll be smooth. Commissioner Vuksic suggested
using smooth plaster, which would look pretty much identical to the
concrete. How reflective is the glass? Mr. Olmedo showed the
commission a sample of the glass and stated that the reflective side of
the film will be on the inside of the building. I wanted to use a tinted
glass and get away from the reflective glass, but due to the Title 24
conditions and the heat that occurs in the desert, I was told that I had to
use this reflective glass. Commissioner Vuksic asked Mr. Olmedo who
told him that he had to do that. Mr. Olmedo stated that his vendor gave
him this information. Commissioner Van Viiet suggested that he check
his facts again. This glass looks very reflective. Mr. Olmedo stated
that the reflective film will be on the inside so it won't be visible to the
public. Commissioner Gregory asked if it would work as well with the
film on the inside. Mr. Olmedo stated that he understood through his
dialogue with the vendors, that it does work.
Commissioner Vuksic asked about the location of the roof access. Mr.
Olmedo stated that the roof access will be located internally through the
warehouse and not visible on the outside of the building.
Mr. Olmedo stated that he wanted to address some of the concerns of
the commission and explain why they've used certain elements. Our
purpose was to create a retail look, but we wanted to make sure that
there were major showroom areas and tried to draw attention to these.
We're going to be using some of the owner's products along the
columns and some of the wainscot. We would love to have used a lot

of glass, but obviously because of the conditions of the heat we couldn't
go to that extreme. This is some of the reasoning behind our design.
Commissioner Vuksic stated that it's funny to hear you say that
because sometimes because of the orientation of a site you have to
design buildings that are facing west and have to have a lot of glass just
because of the nature of the use. You have a relatively small amount
of glass on the building and I'm not quite sure that I understand. Mr.
Drell asked what was behind the middle portion of the building. Mr.
Olmedo stated that there will be some offices and showrooms.
Commissioner Vuksic commented that the amount of glass is okay, but
I don't understand why you say that you couldn't have more. Mr.
Olmedo stated that they're trying limit the glass use. We're trying to
meet the owner's needs for his warehousing of his products. There's
an internal crane that's going to be used to move slabs of granite. Mr.
Drell commented that there are four vertical windows in the middle.
Commissioner Vuksic stated that they're fine but they need to do
something more to get some depth there and create some shadow in
that area. You need to add some architectural features on the sides of
the building that have some three dimensional qualities and incorporate
the door openings so that they don't look like they're arbitrarily cut into
the panels. Incorporate the door openings into the architecture that you
create.
Commissioner Van Vliet concurred. They need to add a lot more
architecture because it's nothing more than a tilt -up box with plant-ons
added at different corners. The offsets are only 2' so you're not going
to see much of an offset at 30' in height. You need to do a lot more
even though it's going to be in an industrial area. Do something
creative.
Commissioner Lopez stated that there are some site plan issues. You
might have to have more islands in the parking lot to comply with the
parking lot shade tree ordinance. He recommended that the applicant
speak to Diane Hollinger, Landscape Specialist. The site plan shows a
curb adjacent sidewalk and the City is going to require a meandering
sidewalk in this area. He asked the applicant if they have on site
drainage. Mr. Drell stated that they drain into the channel. Mr. Smith
stated that the applicant has been provided with a copy of Ms.
Hollinger's written comments regarding the landscape plan.
Action: Commissioner Vuksic moved, seconded by Commissioner
Lambell to continue the request to allow the applicant to return with
revised plans. Motion carried 6-0-0-1 with Commissioner Hanson

that on a building where the architecture is the dominant element, I can
see some value to having some consistency in the signage. Mr. Drell

every tenant. Commissioner Hanson commented that in this case, it
seems like we have a sign for everyone. Mr. Lyle stated that not every
tenant has a sign. Coldwell Banker insists on having a blue sign and
Keller Williams insists on having a red sign. Mr. Drell stated that if it is
a federally trademarked sign, we have a procedure for reducing its size
below what the entitlement is. Commissioner Hanson commented that
in order to look at this more clearly, I want to see every building face
with all the signage on it to scale to make the determination.
Commissioner Gregory asked the commission if they could give the
applicant some direction on what would be acceptable. Commissioner
Hanson commented that it would benefit the applicant to retum with
accurate plans that give all the information required. Commissioner
Van Vliet commented that it's a nice building and he'd hate to see the
signs detract from the building. Commissioner Vuksic asked if Keller
Williams sign would be flexible with the color of red on the sign. Mr.
Bohmen stated that Coldwell Banker is not flexible in any way with the
color of their signage, but Keller Williams may be able to work with
them.
Action: Commissioner Hanson moved, seconded by Commissioner
Van Vliet to continue the request to allow the applicant to retum with
elevations showing all the signs to scale on the building. A suggestion
was made to reconsider the color red on the Keller Williams sign.
Motion carried 6-0-0-1 with Commissioner Oppenheim absent.

Mr.- Bagato stated that the commission received revised plans in their
packets. Edward Olmedo, applicant, was present and stated that
they're changing the paint colors and showed the commission a new
color/material board. They're going to keep the same stone and use it
above and below the windows as a wainscot. The building is a lot more
playful and there's a lot more activity going on. Per the previous
discussion when it was felt that there weren't enough recesses around
the building, it was pushed out and retumed a minimum of 5' in different
areas. The doors have been incorporated into the design of the
building.
Commissioner Vuksic asked Mr. Olmedo to tell him about the glass
that's being proposed. Mr. Olmedo showed him a sample of the glass,
which has a blue tint. Commissioner Vuksic stated that the building
looks great and he thanked Mr. Olmedo for his hard work and
responsiveness.
Action: Commissioner Vuksic moved, seconded by Commissioner
Hanson for approval subject to approval of the Landscape Manager.
Motion carried 6-0-0-1 with Commissioner Oppenheim absent.
