REQUEST: Waive Reading and Adopt Resolution No. 05-Setting a
Public Hearing for the Creation of a Cul-de-Sac on the
Highway 74 Frontage Road at Shadow Mountain Drive

Recommendation:
Waive further reading and adopt Resolution No. 05-5 , setting the
time and place of a public hearing for the cul-de-sac closures of the
Highway 74 Frontage Road at Shadow Mountain Drive.
Discussion:
On October 14, 2004, staff recommended that the frontage road on Highway 74
at the Shadow Mountain Drive intersection become a closed cul-de-sac
intersection. Staff has made this recommendation based upon traffic safety and
traffic circulation patterns. The closures provide positive guidance to motorists
and improve the operation efficiency of the intersection.
At this meeting, on October 14, 2004, City Council approved the cul-de-sac
closure of the frontage road along Highway 74 at the Shadow Mountain Drive
intersection, in conjunction with the installation of the traffic signal at that location.
Development of this project has moved forward and staff is now prepared to hold
a Public Hearing on this issue.

Therefore, staff recommends that City Council waive further reading and adopt
Resolution No.05-5 . setting the time and place of a public hearing for the
creation of cul-de-sac closures of the Frontage Road along Highway 74 at
Shadow Mountain Drive.

RESOLUTION NO. 05-5
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, INITATING PROCEEDINGS TO CREATE CUL-DE-SAC.
CLOSURES ALONG HIGHWAY 74 FRONTAGE ROAD AT THE SHADOW
MOUNTAIN DRIVE TRAFFIC SIGNAL.
The City Council of the City of Palm Desert, California, does hereby DETERMINE,
ORDER AND RESOLVE as follows:
That it intends to, and by this resolution does, initiate proceedings under California
Vehicle Code section 21101, which authorizes local authorities to adopt rules and regulations closing
any highway to vehicular traffic when, in the opinion of the legislative body having jurisdiction, the
highway is no longer needed for vehicular traffic; and
II
That at the hour of 4:00 p.m. on the 10th day of February, 2005, in the Council
Chamber, 73-510 Fred Waring Drive, Palm Desert, California, is hereby fixed as the time and place
of hearing all persons interested in or objecting to the proposed cul-de-sac closure along Highway
74 Frontage Road at the Shadow Mountain Drive Traffic Signal, shown on Exhibit "A" and

That the City Clerk is hereby directed to publish notice of said hearing in the Desert
Sun, a newspaper of general circulation, circulated in the City of Palm Desert, California twice, the
first date of publication being two (2) weeks before the date of the hearing, and the City officials of
the City of Palm Desert are hereby instructed to post notice of such closure, as required by law, at
least two (2) weeks before the day set for the hearing

Recommendation:
By Minute Motion;
1. Approve the cul-de-sac closures of the frontage road
along Highway 74 at the Shadow Mountain Drive
intersection.
2. Authorize staff to proceed with the Caltrans approval
process.
Discussion:
On May 13 2004, City Council authorized staff to proceed with the design of a
traffic signal for the intersection of Highway 74 and Shadow Mountain Drive.
As a portion of this design, staff is recommending that the frontage road on
Highway 74 at the Shadow Mountain Drive intersection become a closed cul-de-
sac intersection. Staff is making this recommendation based upon traffic safety
and traffic circulation patterns. The closures provide positive guidance to
motorists and improve the operation efficiency of the intersection.
The proposed closures are depicted on the attached exhibit.

Upon approval of the plan to cul-de-sac the frontage road in question, staff will be
notifying residence directly affected by the modification on both the north and
south sides of Shadow Mountain Drive.
Therefore, staff recommends that City Council, by minute motion approve the
cul-de-sac closures of the frontage road along Highway 74 at the Shadow
Mountain Drive intersection, and authorize staff to proceed with the Caltrans
approval process.
