Discussion: Concurrently with this request, staff is recommending the award of Contract No. C22870B, the construction contract for the Portola Avenue Bridge over the Whitewater Channel. Staff is addressing any additional funding issues within the request for the construction of the bridge, and for the purposes of this award will be considering the available balance for the fiscal year 2005/2006. On April 28, 2005, staff advertised a Request for Proposals for the construction management services for the project. Seven proposals were received on May 17, 2005, and evaluated by staff. Staff then held oral interviews with the top three firms. Based upon the scoring of both the proposals and interviews the firms are ranked as follows: 1. Berg & Associates, Inc. La Quinta, California 2. Vali Cooper, Inc. Riverside, California 3. Lim and Nacimento San Bernardino, California Staff Report -Award Construction Management for Portola Avenue Bridge Page 2 of 2 July 14, 2005 Based upon the submitted proposals and the oral interviews, staff is recommending that Berg & Associates, Inc., be awarded the contract. As part of the 2005/2006 budget, $4,000,000 was appropriated from Fund 400, and $4,000,000 was appropriated from RDA for the construction and construction management of the Portola Avenue Bridge over the Whitewater channel. The City set up reimbursement agreements with CVAG and the RDA. The way the agreement is currently written, the City will pay for the construction and construction management up front, and be reimbursed 50% by CVAG up to $4.25 million. The RDA will then reimburse the other 50%. Public Works has contacted CVAG about increasing their participation to a maximum of $6.25 million (50% of the total cost of the bridge) instead of $4.25 million. The staff at CVAG has recommended to the CVAG Board (Technical Advisory Committee) that they increase the funding for the Portola Bridge by $2 million, and decrease the funding for the Cook Street widening, another City project with CVAG funding, by the same amount. The Deputy Executive Director of CVAG has, in fact, moved the $2 million from the Cook Street Project to the Portola Bridge Project in order to accommodate this request. The RDA has identified funds available to cover their 50% of the increased cost of the project. Fund 400 will require an additional appropriation of $7.9 million to pay for the improvements up front, and then be reimbursed by CVAG and RDA. Therefore, staff recommends that City Council, by minute motion, award contract No. C22870C to Berg & Associates, Inc., of La Quinta, California, for construction management services for the Portola Avenue Bridge over the Whitewater Channel, in the amount of $761,171, plus a 10% contingency. AGREEMENT THIS AGREEMENT, made and entered into this 14t' day of July, 2005, by and between THE CITY OF PALM DESERT, a municipal corporation, hereinafter referred to as "CITY" and Bera and Associates, Inc., hereinafter referred to as "CONSULTANT". WITNESSETH: WHEREAS, CONSULTANT is a corporation, the principal members of which are Professional CONSTRUCTION MANAGEMENT CONSULTANTS and WHEREAS, CITY desires to engage CONSULTANT to render certain technical and professional CONSTRUCTION MANAGEMENT services as set forth in Exhibit "A" (CONSULTANT'S Proposal of Services) in connection with the Construction Management of Proiect: Portola Avenue Bridae over the Whitewater Channel - Protect 647-04 NOW, THEREFORE, the parties hereto agree as follows: (1) CITY hereby agrees to engage CONSULTANT to perform the technical and/or professional services as hereinafter set forth. (2) CONSULTANT shall perform all work necessary within the schedules provided herein to complete the services set forth in Exhibit "A" attached hereto and by reference incorporated herein and made a part hereof. (3) All information, data, reports and records and maps as are existing and available from the CITY and necessary for the carryings out of the work outlined in Exhibit "A" hereof shall be furnished to CONSULTANT without charge by CITY and CITY shall cooperate in every way reasonable in the carrying out of the work without delay. (4) CONSULTANT represents that, it employs or will employ at its own expense, all personnel required in performing the services under this Agreement. (5) All of the services required hereunder will be performed by CONSULTANT or under its direct supervision, and all personnel engaged in the work shall be qualified and shall be authorized or permitted under state and local law to perform such services. (6) The execution of this Agreement by the parties hereto does not constitute an authorization to proceed. CITY'S Director of Public Works has not authorized CONSULTANT to proceed. (7) The CONSULTANT shall work closely with the CITY's Director of Public Works, or his designated representative, who shall be the principal officer of the CITY. The CONSULTANT shall review and receive the Director of Public Works approval of the details of work as it progresses. The Construction Manager designated by the CONSULTANT as its representative for supervision of the work required by this Agreement is Thomas Ben P.E.RCE# 28449. (8) The CONSULTANT warrants that he has not employed or retained any company or person, other than a bona fide employee working solely for the consultant, to solicit or secure this Agreement, and that he has not paid or agreed to 2 G 1PuDWorkMPROJECTS\647-04 Portola Bndge Q WW ChanneltContractMAGREEMENT CONSTRUCTION MANAGEMENT CONSULTANT.doc CONTRACT NO. pay any company or person, other than a bona fide employee working solely for the consultant, any fee, commission, percentage, brokerage fee, gifts, or any other consideration, contingent upon or resulting from the award or making of this Agreement. For breach or violation of this warranty, CITY shall have the right to annul this Agreement without liability, or in its discretion to deduct from the contract price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee. (9) The right is reserved by the CITY to terminate the Agreement at any time upon seven (7) days written notice, in the event the project is to be abandoned or indefinitely postponed, or in the event the CONSULTANT'S services, in the sole judgment of CITY, are unsatisfactory or because of the CONSULTANT'S failure to prosecute the work with diligence or within the time limits specified or because of his disability or death. In any such case, the CONSULTANT shall be paid the reasonable value of the services rendered, based upon CONSULTANT'S standard hourly rates, up to the time of the termination. The CONSULTANT shall keep adequate records to substantiate costs and provide copies of original timecards in the event of termination or suspension. (10) All documents including tracings, drawings, estimates, reports, investigations, and computations shall be delivered to and become the property of the CITY. CITY acknowledges and agrees that all plans, specifications, reports and other Construction Management documents prepared by CONSULTANT pursuant to this agreement shall be used exclusively on this project and shall not be used for any other work without the written consent of CONSULTANT. CONSULTANT permit the re -use or other use of the plans, specifications, reports or other Construction Management documents, CITY shall require the party using them to indemnify and hold harmless CITY and CONSULTANT regarding such re -use or other use, and CITY shall require the party using them to eliminate any and all references to CONSULTANT from the plans, specifications, reports and other Construction Management documents. (11) The CONSULTANT shall comply with all federal, state and local laws, ordinances and regulations applicable to work. (12) No change in the character or extent of the work to be performed by the CONSULTANT shall be made except by supplemental authority in writing between CITY and the CONSULTANT. The supplemental authority shall set forth the changes of work, extension of time and adjustment of the fee to be paid by CITY to the CONSULTANT, if any. (13) In connection with the execution of this Agreement, the CONSULTANT shall not discriminate against any employee or applicant for employment because of race, religion, color, sex or national origin. The CONSULTANT shall take affirmative actions to insure equal employment opportunity and that employees are treated during their employment without regard to their race, religion, color, sex or national origin. Such actions shall include, but not limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay, or other forms of compensation and selection for training, including apprenticeship. (14) The CITY agrees to pay the CONSULTANT for the work required by this Agreement on the following basis: CONSULTANT shall submit invoices monthly for services performed in the previous month not to exceed the total contract amount of: $761,171.00 JSeven Hundred Sixtv-one Thousand One Hundred and Seventv-one Dollars: no/100 ONLY). CITY agrees to pay all undisputed invoices within thirty (30) days of receipt of invoice. CITY agrees to notify CONSULTANT of disputed invoices within fifteen (15) days of receipt of said invoice. Exhibit "A". (15) The CONSULTANT agrees to complete the work as displayed in (16) In the event that any judgment is entered in any action upon this Agreement, the party hereto against whom such judgment is rendered agrees to pay the other party an amount equal to the reasonable value of the legal services performed in his or its behalf in such action and that such amount may be added to and made a part of such judgment. (17) This Agreement shall be binding on the successors and assigns of the parties, but it shall not be assigned by the CONSULTANT without written consent of the CITY. (18) The CONSULTANT shall be an independent contractor, not an employee of the CITY. The parties hereto covenant and agree that to their knowledge no member of the City Council, officer or employee of the CITY has any interest, whether contractual, non -contractual, financial or otherwise, in this transaction, or in business of the contracting party other than the CITY, and that if any such interest comes to the knowledge of either party at any time a full and complete disclosure of all such information will be made in writing to the other party or parties, even if such interest would not be considered a conflict of interest under applicable laws. The CONSULTANT hereby covenants that he has, at the time of this Agreement, no interest, and that he shall not acquire any interest in the future, direct or indirect, which would conflict in any manner or degree with the performance of services required to be performed pursuant to this Agreement. The CONSULTANT further covenants that in the performance of this work no person having any such interest shall be employed by the CONSULTANT. (20) The CONSULTANT shall indemnify and save harmless the CITY, its officers and employees from and against any liability, loss, cost or expense resulting from any injury or damage to persons or property caused by the negligent acts or omission of the CONSULTANT, its agents or employees, while engaged in the performance of this Agreement. The CONSULTANT shall submit to CITY, prior to the issuance of the Notice to Proceed is, certification of adequate coverage for "errors and omission" insurance in amounts approved by the City Attorney. Any such insurance shall not be canceled prior to written notice to and approval from the CITY. Project is to be staffed during normal construction business hours. The typical shift is eight hours, forty hours per week. Overtime is not authorized unless approved in advance by the City. 2. Weekend work is not authorized unless approved by the City. 3. Night work is not authorized unless approved by the City. 4. Field office shall be provided and furnished by others to include fax, telephone, Internet access, photocopier, workspace and file cabinets. Consultant may provide off site project office at no charge. 5. Mailings and FedEx or UPS deliveries are to be paid by the allowable budget of $2,500 including reasonable reproduction costs. 6. (BergCM) was established in 1980 to provide Resident Engineering and Inspection Services to public works agencies for capitol improvement projects. Portola Avenue Bridge City of Palm Desert Construction Management BergCM is Uniquely Qualified for this Project We will support the project from our desert communities' office located in La Quinta at 51-431 Avenida Navarro, near the old post office. Field staff is at work at the project site, often with the aid of a field office trailer. However, our desert -based office is planned to support the project for the duration of work unless the City requires otherwise. We've had the opportunity to study the Portola contract documents in detail after over 40 hours of constructability review. Our PM understands the important design constraints and project features, and truly seeks the opportunity to officially join the construction "team" to bring this project to completion. Project Manager / Resident Engineer, Tom Berg has worked extensively with: A. CVWD and is conversant and aware of their encroachment permit requirements. From past and on -going projects he openly and frequently communicates with both their Engineering and Construction staff. This i familiarity will assist the City in maintaining good relations with this vital permit authority and should contribute to the success of project completion. B. The Design team of Moffatt & Nichol on a variety of past projects including 3 the Eisenhower Drive Bridge widening in the City of La Quinta and the Alameda Corridor Projects. C. Two additional grade separations and extended segments of civil work were added to our contract. Subsequently, BergCM was awarded a new contract for a micro - tunnelled storm drain, pump station and sound wall projects UPRR Storaae Track Bridge at Dominauez Channel BergCM provided Construction Management to the Alameda Corridor Transportation Authority for the UPRR "Filler" Bridge over Dominguez Channel in Carson, CA. This structure was constructed ` u utilizing a trestle system for crane support over this r >r. r :7 prominent flood control channel. The structure consisted of 6-spans, for a total length of 202 ft. and total width of 40ft. Construction was sandwiched between 2 active main line tracks requiring extensive flagman communication and coordination. The project was finished one month ahead of schedule and under original bid price with no claims. The project recorded no lost time accidents or the need for first aid attention. The Compton Creek Bridge A four -span, steel through girder 3-track bridge replacing the single-track existing structure over the Compton Creek. Construction was constrained by the location of existing columns supporting SR 91 and the freeway on -ramp. A two -stage project: Stage 1 consisted of building a shoofly bridge west of the existing bridge. Stage 2 included demolition of existing bridge and I Mi '" ` construction of a new two -track bridge. When completed, the two bridges joined together to form a four -span steel through girder three -track bridge. Work was in channel subject to flooding. Lona Beach Lead Rail Bridge over Dominquez Channel A six -span precast, prestressed concrete double box girder, ballasted deck bridge. The bridge is 10.7m (35 ft.) wide with railing projecting beyond the edges of the deck. The bridge superstructure provides space under the walkways and openings at the abutment backwalls for existing product lines, electrical conduits, train control conduits, and other utilities as required. Provides connection of the ACTA main line. ACTA Bridge over Dominguez Channel A multi -span four -track bridge over the Dominguez Channel. The program includes the mapping and inspection of the stormwater infrastructure for the City of Los Angeles. Assessments require entering both open channel and closed conduit storm drains and other stormwater structures to inspect the condition of these facilities. The work involves entering maintenance holes located within the street as well as accessing channels through natural terrain, brush, etc. Specific project safety issues include confined space entry, exposure to public vehicular traffic, work conducted in a maintenance hole or other underground location, storm water open channels and numerous biological hazards and controls. Construction Management City of Palm Desert Portola Avenue Bridge Section 5 — Project Approach The BergCM specific approach successful project completion requires we: • Develop a full understanding of the project during the pre -construction phase • Establish an effective relationship with City, Design, the Construction Contractor, CVWD and all other stakeholders with an active interest in the project. • Be involved and proactive while documenting daily activities relevant to progress • Remain sensitive and responsive to impacted community surrounding the project A. Management The following represent a description of our specific approach to the construction management tasks: Pre -bid Process Continuing Constructability Analysis: This task has already been initiated and is a key feature of our plan to complete the work on time and on budget. The review process provides the basis for understanding the design issues originally presented to the engineer of record. To date our PM, Tom Berg, has participated in a review of March 2005 contract documents for the Portola Avenue Bridge. During a previous constructability review for the Port of Los Angeles, BergCM identified significant savings for the Seaside Avenue Grade Separation and the New Dock Grade Separation projects. Resultant net savings were documented to be over $5 million. (Please contact Ms. Stacey Jones or Mr. Bruce Seaton at POLA (310) 732-3526 for a reference to this work.) 1. Bid Process Pre -Bid Meeting: A key component for successful completion is the pre -bid conference. The Resident Engineer shall co-chair this conference to assist in the public review obvious and non -apparent features of the project work. This conference allows prospective bidders to question project elements identified or often only alluded to in the contract documents. Such conference generates and answers key questions. Such questions must receive an official response during the bid period by issuance of addenda or minutes to the conference, as may be necessary. Ideally, prospective bidders will gain a level of confidence by hearing a discussion of project work between the actual participants of the project. Evaluation of Contractor's Bid: Upon receipt of bid documents, the CM team shall assist the City to evaluate the bidders' responses to contract requirements. Project Approach 19 Berg & Associates, Inc. Construction Management City of Palm Desert Portola Avenue Bridge 2. Pre -construction Meeting and 3. Progress Meetings Conferences and Meetings: Upon award of contract the Project Manager/RE conducts a pre -construction conference with the Contractor, notable subcontractors, utilities, etc. Typically, CVWD also requires a pre -construction conference after issuance of their permit rider. This meeting is also is documented by the PM. The PM_ shall chair all weekly meetings and conferences necessary for the work to progress. Formal meetings are typically held weekly (not bi-weekly) with the Contractor, and all concerned parties will be encouraged to attend. Meeting proceedings are to be documented, and the topics of discussion will have the responsible party identified with any action item. Resolution of issues shall be reported as well as issues of continuing and ongoing discussion. The list of meetings includes the pre -bid conference, the pre -construction conference, a partnering conference, pre -construction meetings, weekly safety meetings and third -party coordination meetings. All meetings are documented with a written summary of proceedings and attendance list with distribution to all concerned parities. 4. Schedule Tracking Schedule: The Contractor must have control of schedule within the confines of the contract. The role of the CM is to remain informed about any undocumented obstacles encountered during the course of construction. Daily reports are to be supportive to the continual effort required to monitor schedule and timely completion of work. The issue of schedule degeneration is important with regard to "acceleration" this being the possible topic of claim issues by the Contractor at a later date. Given the busy commuter contingency wherein all roads must be kept operational, the project could be a serious candidate for claims related to insufficient "work windows." S. Accounting Progress Payments: The PM and key assistants shall review and process monthly progress payments submitted by the Contractor. A schedule of values is to be agreed upon prior to start of any work by the Contractor for Lump Sum bid items. This process assists in the forecast of future payments to accommodate the City's budget and cash flow program. Account Tracking: Often an Agency requires certain pay items be tracked separately for future reimbursement to the City from outside sources. Our team is ready to perform this task if identified by the City. 6. Submittals Submittals: Each Contractor submittal will be date stamped, logged in and tracked to maintain control of the process. Primavera Expedition can be utilized to perform this function. Submittals are received and initially reviewed by the Resident Engineer for completeness. If acceptable, the document is forwarded to the party responsible for review, typically the record engineer of design, with a notation of the required time for completion of review. The use of express mail will expedite the entire process. Submittals should be timely to facilitate schedule. Onsite staff will daily coordinate the submittal process. Filing System and Record Keeping Reports and Records: BergCM shal monthly reports, description of work Construction Management Portola Avenue Bridge 1 maintain daily job dairies, drawing registers, completed, work forecast cost forecast, change orders completed and pending, et cetera, during the course of project work. Project records require photo records of safety concerns, coordination activities, extra work account activity and matters involving adjacent property and right-of-way issues. Each member of the team will be responsible on a daily basis for reporting his or her work assignments to the project. A photo log will supplement the weekly progress report of construction activities. B. Inspection Typically, we adhere to the guidelines in the Local Assistance Manual and details for construction as required by the Caltrans Construction Manual. The items enumerated and specifically detailed in the City's RFP are elaborated and further defined in the Caltrans Construction Manual to which we adhere. Daily Project Report: Inspection and the PM/RE generated daily project reports of conditions encountered, discussions, and manpower and equipment inventories associated wit the work. Our daily project reports conform to the standards utilized and described in the current Caltrans Construction Manual. Monthly Project Reports: The PM/RE is responsible for generation of accurate monthly report complete with progress reports from the previous months activities as well as look ahead activities. Photos are included in such reports, which can be made available electronically for multiple uses by the City, if desired. C. Project Support 1. Construction Surveys — Per Clarification No. 1 to the City's RFP, and according to the specifications for the project, the Construction Contractor is responsible for survey, i.e.: construction staking, including horizontal and vertical control. Consultant shall assist the City in identifying independent surveyor to provide checks, if needed. It is understood Design will adequately identify control monumentation on project documents. Z Materials Testing and Geotechnical Services: BergCM has elected to utilize the services of MACTEC whose offices are in Cathedral City for quality assurance testing of project material. The standard and frequency of testing is typically listed in contract documents and is listed in the current Caltrans Construction Manual as a reference for this contract. These services will be directed by the PM/RE who will monitor MACTEC's activities for cost and budget control. Re -testing expenses that are attributed to the Contractor will be separately accounted on a monthly basis and identified to the Contractor for reimbursement. Project Approach 21 Berg & Associates, Inc. Construction Management City of Palm Desert Portola Avenue Bridge 3. Permits: Several project permits will be required such as the: CVWD Encroachment permit. The City should apply for this permit and the Contractor subsequently obtains a rider to participate together with the City in its fulfillment. This permit requires a Storm Water Pollution Prevention (SWPPP) Notice of Intent (NOI) if the project area exceeds five (5) acres. The City is responsive for such an NOI to be received from the local Region Water Quality Control Board. Storm Water Pollution Prevention Permit (SWPPP) Plan: See discussion noted above. The actual plan, which is required before application for an NOI is often a first requirement of the Contractor. It is strongly advised the City provide the SWPPP plan and make the application for the NOI rather than waiting for the Contractor to come on board after award of contract, developing an acceptable Plan then application by the City. This would consume too much project time and judged to be wasteful. Necessary construction easements from local property owners shall be kept at the project office and followed as agreed upon between City and property owner(s) D. Project Schedule The Contractor is required to generate a base line schedule that includes all of the project constraints for successful and timely completion of work. The PM/RE shall receive, review and approve this document, which is critical for time and contract management. For this particular project several specific constraints are imbedded in the contract language such as a one -month settlement period at each abutment before pile construction may commence. Given that this is a two -staged contract, this requirement will have significant importance for schedule review. The incentive program associated with construction of Quicksilver Drive will also generate much attention/interest. E. Project Administration 1. Project Management Contract Administration / Compliance: The CM shall ensure the City is kept fully aware of the project status and given ample notification of required support. Our CM team takes a proactive role during construction to fully understand the operations and the intent of the Contractor's activities on a daily basis. It is inappropriate to allow the Contractor to proceed on a questionable course of operations. The CM must monitor and maintain contract compliance on a constant basis. The PM/RE and assistants understand this cardinal principal. 2. CostAccounting Cost Engineering / Estimating: The CM staff will assist with timely discussion of extra cost issues encountered during the course of construction. Our team has experienced a variety of aggressive contractors, and this issue is well understood by the PM and his key staff, each of whom are fully familiar with current estimating procedures and utilization of the Means cost catalogues, et cetera. Project Approach 22 Berg & Associates, Inc. Construction Management City of Palm Desert Portola Avenue Bridge 3. Scheduling The consultant shall review the contractor's baseline schedule upon submittal. The CM schedule of milestones and major activities is correlated to the contractor's progress of work and is a function of time for which personnel is actively engaged in monitoring contractor activities. A detailed project schedule will be provided to the City "at the time of interview." BergCM shall commence preparation of this submittal upon notice of interview. 4. Contract Change Orders and Claims Changes: During construction the City or the Contractor will identify changes. Such changes involve either a credit or a cost to the Agency, and it is fully understood all Contractors will not readily identify issues involving credits. The process for identifying changes is documented through the Request for Information (RFI) and the Request for Change (RFC) process initiated by either the Contractor or the RE. If the Agency institutes a change, typically it will be done through the Request for Quote (RFQ) process wherein the proposed change is identified. The Contractor then responds with the proposed cost impact. The CM team understands this established process. Upon discussion and agreement, the PM initiates the necessary Change Order (CO) that will a detail any changes to the contract. No changes are allowed, sanctioned, condoned or permitted without adhering to this process. All RFC's, RFI's, CO's are kept in "logs" for ready reference and quick retrieval, and stored electronically. Disputes: Should the PM/RE and the Contractor not agree to a change issue, the matter is identified as a dispute. The PM is to resolve disputes, and the resolution process is, typically, greatly facilitated by both parties having been active participants in the partnering program. Claims: Claims develop when changes or perceived changes have not been satisfactorily answered monetarily or by reference to contract. The PM's task is to resolve contract issues before dispute issues mature to be identified as "claims." Key staff understands many potential disputes can be resolved during the pre -construction phase of the contract. S. Safety Construction Safety: The PM will ensure all work is conducted in accordance with the Caltrans Local Assistance Manuals and Procedures. Our field personnel are obliged to participate in mandatory safety training classes and will assist in the daily monitoring of project operations. The CM shall enforce the safety program of the Contractor and communicate directly with their safety representatives. The Contractor will be expected to provide an approved safety program that incorporates a safety program per OSHA standards. There are two dimensions to this topic, i.e.: both Public and Worker safety. It is the responsibility of the PM/ RE to monitor and report all unsafe conditions in an expeditious manner. Project Approach 23 Berg & Associates, Inc. Construction Management City of Palm Desert Portola Avenue Bridge 6. Project Closeout Contract Closeout: Closeout proceedings require completion of all punch list items or work remaining, agreement on all issues of payment,.final payment processing, validation of document submittals, and receipt of an affidavit to accepting all closeout issues, including issues of dispute. Our closeout procedures are modeled after those identified in the Caltrans current Construction Manual. 7. Deliverables There are multiple deliverables for the project: all hard copy files, submittals, RFI, RFQ and correspondence logs, daily project reports, monthly project reports, quality assurance reports, closed —out non-conformance reports, change orders. As Built Drawings: the CM will verify the Contractor's efforts at this task monthly during payment preparation. Since all contract changes (which includes contract drawings) must be made by the change order process, the task of current as built drawings will be relatively simple. All changes to the contract plans must be by the change order process. 8. Equipment and Materials to be provided by Consultant: Presently the City's RFP does not identify if a project field office is to be supplied thus our local office at Avenida Navarro, La Quinta can be made available to this end. Inspection staff is outfitted with cell phones, vehicles, and necessary safety equipment. Details of office expenses are illustrated in our attached cost proposal, which are negotiable with the City. 9. Standards Quality Assurance and Testing: All materials testing shall be performed in accordance with the City's contract standards. Typically for City improvements, these are identified in the current "Green Book." The frequency of testing to be used is that identified in the Caltrans Construction Manual. Quality Control: The Quality Assurance program for this project shall be that identified by the current Caltrans Construction Manual. 10. Limitations to Authority It is understood the Construction Management serves at the pleasure of the City. Contract documents for construction include the limits of the City's representatives for this work. Typically, the Construction Manager can only directly shut down work due to project conditions nudged to be unsafe and of immanent danger to workers or the public. Project Approach 24 Berg & Associates, Inc. City of Palm Desert Construction Management Portola Avenue Bridge Section 6 — Project Controls a The BergCM Team is known for taking a pro -active approach to project management. We do not see our role as mere observers and reporters. Rather, we see ourselves as full partners with the City and the Construction Contractor in the success of the project. Management Approach Our management team is dedicated to providing service to the client. We are genuinely honored to be entrusted with the Client's projects and shall perform at our highest level of excellence to deliver the quality product desired by the City in a timely, efficient, cost- effective manner. The Project Manager / Resident Engineer (or PM/RE) is the field site manager and as such is the primary contact for both the City and the Contractor. The PM/RE is responsible for assigning staff, assuring that the tasks assigned are completed properly, and arranges schedule adjustments for illness or vacations. The PM/RE maintains a staffing schedule, approved by the City, commensurate with the Construction Contractor's operations. Time sheets, approved by the PM/RE, are submitted to the Principal Administrator (PA) for review and payment monthly. With monthly payment requests, the PA provides a status report with graphic illustration of anticipated versus actual staffing levels and labor costs. Invoices are concise yet detailed in accounting for time spent and staff allocated. Management of Subconsultant Contracts The PA generates, negotiates and maintains in force the subconsultant contract and reviews any subconsultant budget. The PM/RE reviews cost estimates and issues task orders. Field requests for work, such as testing, are written on pre-printed forms, and kept on file for reference and review. When required, certified payroll is received, reviewed for compliance and kept on file with records of subconsultant agreements and insurance. Subconsultant invoices are scrutinized for accuracy, compliance and completeness of backup documentation before submittal to the Client. Budgets established at the outset of the project are strictly respected. Reoortinv_ Roles and Relationships The Principal Administrator and PM/RE work with the City, to clarify the decision making process, define procedures and continually assess the effectiveness of the Construction Management team. One of the first tasks the CM undertakes is to outline the roles and responsibilities of the CM Staff in relation to City staff and the work. Berg & Associates, Inc. maintains a draft employee handbook that identifies expected behaviors and corporate policies. J Project Controls 25 Berg & Associates, Inc. 0 City of Palm Desert Construction Management Portola Avenue Bridge The decision process must also be identified. We recommend a partnering session with the City, the Contractor and the CM's staff to establish hierarchy and levels of decision. This will reduce misunderstandings, which could lead to dispute and will facilitate resolution of potential disputes. Quality Assurance Quality assurance is to conform to the City contract requirements and other listed agencies with jurisdiction. The Office Engineer is responsible to maintain all contact information, and maintenance of project logs for documentation as well as non- conformance reports, citizen complaints, weather reports, etc. and all activities related to project work and safety. The Office Engineer's work is monitored by the PM/RE. The PM/RE reviews test results, technical reports and work performed by all CM related field staff including materials tester and surveyors. The PA is to visit the field site monthly and the client monthly to assure that employees are performing, that the PM/RE has the support and resources necessary and to assure that established procedures are being followed. Assessment of individual BergCM staff is on a rotation basis. Interviews and performance reports are kept on file and include recommendations for further training, promotion, or other topics discussed. Pro -Active Inspection In weekly meetings, we insist the Contractor provide look-aheads so that inspection forces can be properly planned. We understand it is difficult for a contractor to accurately predict all activities. Staff must therefore remain available to stay with the work. If work is going on, we expect our staff to be "there". To maintain project budget and timeframe, it is essential to monitor the construction contractor's schedule of work and clearly identify the controlling item of work once the base line schedule is established. Incidental, preparatory work or required maintenance of project features can be costly if not properly managed by the construction superintendent. An example of this would be compliance with Storm Water Pollution regulations vigorously enforced by Caltrans on Local Assistance projects. The Storm Water Pollution Prevention Program. or Plan, is developed utilizing Caltrans dictated Best Management Practices (BMPs). This plan must be followed scrupulously to be fulfilled. Reporting and recording requirements are strict. Non-compliance wastes budget for both the contractor and the CM. Heavy rains, such as those we experienced in Southern California this year, can create the need for extra protective measures. Therefore, the PM/RE communicates continuously with the Contractor, addresses issues such as SWPPP at every weekly meeting, and field inspectors report any issues or non -compliant work immediately to avoid costly delays and extra work. Project Controls 26 Berg & Associates, Inc. 0 City of Palm Desert Construction Management Portola Avenue Bridge Safe Our inspection staff are Hazwhoper and OSHA safety trained, understand, and enforce a safe work environment at all times. Typically, we participate with the Contractor to host safety luncheons as reward for a good safety record. All personnel are issued personal safety gear. A safe project saves lives, saves money is boosts moral. Communication The Resident's Engineer Manual includes contact information for all parties concerned with project work. In addition to emergency and 24-hour contacts for the City, the Contractor and the CM is utility and agency representatives contact information. Email is utilized extensively for daily updates and communications, for transfer of information to designer of record or to the City for review. To enhance project communications, we can set up a project webmail system or project intranet, if desired. In addition, we have the capability to set up a project website where photos, video streams, project information, newsletters, bulletin boards, notifications and project progress can be stored and made accessible to the City. Accessibilitv As all BergCM staff are equipped with cell phones, the City has complete access to the management and inspection staff at all times. As a locally based team, we can be on site within minutes should there ever be a need or an emergency. Meetines & Renortins Weekly meetings are an important venue for communications. Our PM/RE typically discusses with the Contractor's superintendent prior to the weekly meeting important agenda items. Again, pro -active partnering with the Contractor to flesh out potential issues and to discuss options allow for a congenial and positive work environment. All such discussions are documented, distributed to concerned parties and filed for reference. Also during weekly meetings, third party issues, schedule, safety and on -going progress of work is discussed. All concerned parties are invited to the weekly meetings. The meeting minutes are distributed to attendees and City staff. It is our policy the City be continuously updated and kept informed of all project activity through meetings notes, telephone conversations, email, and monthly status reports which include photos, description of work completed, cost analysis and progress assessment. We are particularly experienced with Primavera Expedition. We have also utilized Microsoft Project and have created in-house, custom databases to log and track project documents to conform to and mirror the Caltrans Local Assistance Procedures file index. Files are electronically transmitted daily to our server and a tape backup of all project record documents are retained as a safeguard against loss. Contractor submittals and other data received in hard copy can be scanned into the electronic filing system if required by the City. This usually takes the aid of additional office assistance presently not planned with this proposal. Rapid Review & Response (the 3Rs) The BergCM Team advocates Rapid Review and Response, an established policy of turnaround in three days of contract submittals whenever possible. This policy helps the Contractor and ultimately the City avoid costly delays or potential claims. Document Control The CM is responsible for maintaining all files of the required engineering and quality related submittals whether they are approved or disapproved. Our PM/RE is a strong advocate of enforcing document control on a daily basis. The office manager serves a key role in this effort. All project correspondence and reports must be logged in and distributed as directed by the PM. The CM team shall maintain a document control tracking system for submittals processing; shall maintain hard copy documents including correspondence, submittals, standard forms and reports. Electronic files are useful and can be arranged if required by the City. ' Proiect Procedures Our team leader shall provide a summary of the document control procedures, ! coordination summary and list of contacts along with the mission statement to follow the course of construction. These procedures: ■ Define the functions of key personnel, the relationships of staff, and define the chain i of command. MACTEC currently has one of the industry's largest groups of geotechnical professionals housed at its Los Angeles office. Even more significant is the length of service of many of our employees. The average years of service for our professionals is 22 years. Our retention record allows MACTEC to offer a field exploration team that has worked together on thousands of projects over a period of decades. Our engineers have successfully managed geotechnical services for a wide range of projects, including bridges, highways, and other transportation engineering assignments (such as at -grade, aerial, and below - grade structures, many involving deep trenching and tunneling). Since, 1954, MACTEC has performed over 35,000 geotechnical engineering/investigation projects in Southern California. Waggle, Deputy Executive Director SUBJECT: Consider Amendment of Bond Funded Project Agreements with the City of Palm Desert to Transfer Funds between Projects STAFF RECOMMENDED MOTION: That the Technical Advisory Committee Recommend Approval of Amendments to the Agreements with the City of Palm Desert for the Bond Funded Projects for the Portola Avenue Bridge and for the Cook Street Widening to Allow the Transfer of Funds between those Projects. BACKGROUND: At their meeting of October 25, 2004, the Executive Committee approved a list of Regional Transportation Projects and specific amounts for funding through the RCTC bond sale process in the aggregate amount of $28,275,000. By executed agreement, CVAG and the City of Palm Desert have agreed to proceed with a project known as the Portola Avenue Bridge at the W hitewater Channel. The agreed upon amount of the contract agreement was set as $8,500,000. Under CVAG's customary method of funding eligible projects with member jurisdictions, this contract agreement was structured to provide that the City of Palm Desert was to pay one-half of the applicable project costs ($4,250,000), and CVAG was to pay the other one-half ($4,250,000). CVAG's share of project costs was not -to -exceed $4,250,000. Likewise for the Palm Desert project known as the Cook Street Widening to Six Lanes, from Fred Waring Drive to Frank Sinatra Drive, the estimated cost of that project is $9,500,000. A CVAG/ City of Palm Desert contract was entered to provide an equal sharing of project costs at $4,750,000 per agency. By the attached letter the City of Palm Desert now indicates the Portola Avenue Bridge Project bids came in significantly over estimates ($12.5 Million) and is therefore requesting that the agreement for this project be amended to add $2 Million of bond funds to the CVAG share of project costs. This action will have the net affect of reducing the agreement for the Cook Street Widening Project by the same $2.0 Million, since the aggregate total of bonded funds cannot change. The Riverside County Transportation Commission (RCTC) has also approved the project list and the listed amounts. Any amendments approved by CVAG must also be approved by RCTC before they are fully authorized. FISCAL ANALYSIS: Since the bond funded projects for the City of Palm Desert were approved for a fixed amount, it should not matter how the funds are distributed for the approved projects, just that the total of CVAG's commitment of bonded funds does not exceed the agreed amount.
