HomeMy WebLinkAboutLegislative Review - AB 1248 (Umberg) - Restrict collection of booking fees by countiesCITY OF PALM DESERT Community Services Division Staff Report REQUEST: CONSIDERATION OF LEGISLATIVE REVIEW COMMITTEE ACTION ON AB 1248 (UMBERG) AT ITS MEETING OF MAY 24, 2005 SUBMITTED BY: Patricia Scully, CFEE, Senior Management Analyst DATE: June 9, 2005 CONTENTS: AB 1248 Language RECOMMENDATION: By Minute Motion, concur with the action taken by the Legislative Review Committee at Its Meeting of May 24, 2005, and direct staff to prepare a letter of support for the Mayor's signature with regard to AB 1248 (Umberg) relative to criminal procedure. EXECUTIVE SUMMARY: Passage of AB 1248 would restrict the collection of booking fees by counties to nonfelonious offenses and municipal code violations. BACKGROUND: Existing law authorizes counties to impose booking flees upon local agencies for costs incurred in processing or booking individuals arrested and booked into county facilities. AB 1248 would specify that counties shall be authorized to impose a booking fee only with respect to arrests for specified nonfelonious offenses and all municipal code violations. In the past, a portion of booking fees have been reimbursable to local agencies by the State of Califomia; however, that is no longer the case. Counties in the State of Califomia bear the onus for operating county jails, including booking arrestees, and are funded by local agencies within their jurisdiction to perform this function. Local agencies should not be expected to bear an additional financial burden when taking suspected criminals off the streets. Therefore, the Legislative Review Committee recommends that the City Council support AB 1248 and direct staff to prepare a letter staty'g that position to appropriate legislators for the Mayor's signature.
