Discussion: The Lowe's Building Center project, Precise Plan 04-13 is located along the northeast corner of Monterey Avenue and Gerald Ford Drive. As a condition of approval, the project is required to be designed to retain a 100-year storm and to retain nuisance water on-site. The project is also required to pay traffic signal modification fees. Municipal Code section 25.56.080 supports reduction or offsetting of drainage fees, at the discretion of the City Council. Resolutions 79-17 and 79-55 support reduction or offsetting of signalization fees, at the discretion of the City Council. The basis for this request lies in their assertion that the drainage facility construction is a portion of the master plan of drainage for this area, and that the traffic signal modification fee should be offset by the cost of installing and modifying signals which is already a part of the Lowe's development budget. While it is true that the Lowe's drainage facility will act to offset storm water run- off, the traffic signal modification required is solely due to the street widening needed to accommodate the project and provides no public benefit. Therefore, staff recommends that the City Council, by minute motion, approve the request to provide a credit against the drainage fee and deny the request for credit against the traffic signalization fees for Precise Plan 04-13 Lowe's Building Center.
