Executive Summary:
CMC White Cap is requesting approval to construct a 31,679 square foot
industrial building, includ�ng a 2,500 square foot mezzanine, a height exception
to allow a buifding height up to 34'-6", and aflow the outdoor storage of building
materials on a 3.43-acre site located at 73-600 Dinah Shore Drive, east of Leilani
Way. The main building parapet height is 29'-6"', which is necessary to
accommodate two-story office space over first floor officelwarehouse space. The

raised parapets, 31'-8", 32'-9" and 34'- 6" tall, enhance the building's design and
break up the boxy look.
Department of Public Works condition of approval no. 11 requires the property
owner to dedicate and improve Dinah Shore Drive to a half-street width of up to
51 feet on 75 feet of right-of-way in accordance with the General Plan Circu{ation
Element arterial street section (copy attached). This street section provides for a
median, six 12-foot wide travel lanes, a 6-foot wide bike lane on each side, and a
24-foot wide landscaped parkway on each side with an 8-foot wide sidewafk.
On March 22, 2005, the Architectural Review Commission unanimously granted
prefiminary approval of the building architecture. On May 17, 2005, the Planning
Commission recommended approval (3-0-1-1, Commissioner Lopez absent,
Commissioner Jonathan abstained) of the precise plan design, including the
height exception.
Discussion:
I. BACKGROUND:
The 3.43-acre vacant site is focated on the north side of Dinah Shore Drive east
of Leilani Way. Access to the site from Dinah Shore Drive will be via two
reciprocal access driveways on the southwest and southeast corners of the
property. On January 13, 2005 the City Council approved Precise Plan 04-30 for
a 52,164 showroom / warehouse for Bedrosian Tiie on a 3.3-acre parcel to the
west.
A. ADJACENT ZONING AND LAND USE:
The site is located on the north side of Dinah Shore Drive east of Leilani
Way. The property is zoned SI (Service Industrial) and is designated
Industrial-Business Park on the City's General Plan Land Use Map.

II. PROJEGT DESCRIPTION:
The precise plan proposes the construction of one 31,679 square foot industrial
building that will include a 2,500 square foot mezzanine. The building will be
used for offices (16.1 % of total floor area) and storage of building products. A
corrugated metal canopy on the east and north sides of the building will shade
some of the building materials stored outdoors as well as company trucks.
Outdoor storage of building materials is proposed at the rear of the site and will
be screened by a 12-foot high wall constructed of 8-foot high masonry block with
4-foot high metal lattice panels on top. The screen wall along the northerly
boundary will be staggered by three feet in 35-foot length sections to provide
enhanced project aesthetics, as the site is visible to motorists traveling along the
Interstate 10 Freeway.
The project complies with the SI zone development standards as outlined in the
following table, except for the building height for which an exception is being
sought.

Site Plan and Parking:
Site Plan: Access to the site will be via two 40-foot wide shared access
driveways on Dinah Shore Drive. The project is conditioned to provide a
deceleration lane on Dinah Shore Drive. The proposed 31,679 square
foot building is plotted on the 3.43-acre site to create a 43-foot to 60-foot
front yard landscaped setback along Dinah Shore Drive. The site plan
provides a 175-foot rear yard setback and 45-foot and 75-foot interior side
yard setbacks.
Parkinq: Based on Zoning Ordinance off-street parking requirements for
industrial uses of one parking space per 500 square feet of floor area, the
building requires 66 parking spaces. The site plan provides 77 parking
spaces.
Architecture:
The industrial building has a"contemporary" architectural style with strong
emphasis of rectangular shapes and rooflines at varying heights. The
building will have tilt-up concrete exterior walls that incorporate scoring
lines and contrasting colors. There will be seven exteriar colors that
include beige, finro shades of off white, two shades of brown, light
lavender, and purple.
The building generally has a height of 29'-6". Some architectural
projections (tilt up concrete panels and parapet walls) will have heights
above the 30-foot SI zone height limit. The heights of these architectural
projections will be from 32'-6" to 34'-6" to create added architectural
interest in the roofline. Since the height limit in the SI zone is 30 feet,
these projections require approval of a height exception by the City
Council.
The Architectural Review Commission granted preliminary approval (5-0-
1-1) of the project on March 22, 2005.
III. ANALYSIS:
The project complies with SI zone development standards except for the heights
of some architectural projections, which require approval by the City Council.
The project as designed will result in an attractive architectural appearance that
will complement other buildings approved in the area. Therefore, the findings for
approving a precise plan can be affirmed. These findings are included in the
draft resolution attached to this staff report.

IV. ENVIRONMENTAL REVIEW:
For purposes of CEQA, the Director of Community Development has determined
that the proposed project is a Class 32 categorical exemption per Section 15332
(In-fill Development Projects) of CEQA Guidelines and �no further documentation
is necessary.

CASE NO PP 05-02:
WHEREAS, the City Council of the City of Palm Desert, California, did on the 23rd
day of June 2005, hold a duly noticed public hearing to consider the request by CMC
WHITE CAP for approval of the above noted; and
WHEREAS, the Planning Commission of the City of Palm Desert, California, by its
Resolution No. 2332 has recommended approval of Case No. PP 05-02; and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act",
Resolution No. 04-106, in that the Director of Community Development has determined
that the project is a Class 32 Categorical Exemption; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said City Council
did find the following facts and reasons to exist to justify approval of the said request:
The precise plan is well designed with quality architecture.
2. The proposed location of the office/warehouse, as conditioned, is in
accord with the objectives and policies of the general plan and zoning
ordinance and the purpose of the district in which the site is located.
3. The proposed location of the office/warehouse and the conditions under
which it will be operated and maintained will not be detrimental to the
public health, safety or general welfare, or be materially injurious to
properties or improvements in the vicinity.
4. The height exception is necessary in order to maintain interior function
within the building and achieve high quality exterior architecture.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
That the above recitations are true and correct and constitute the findings of
the City Council case.

CONDITIONS OF APPROVAL

Deaartment of Communitv Develonment:
1. The development of the properly shall conform substantially with exhibits on file
with the Department of Community Development, as modified by the following
conditions.
2. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Coachella Valley Water District
Palm Desert Architectural Review Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall be presented
to the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Applicant shall participate in a commercial recycling program as determined by the
City and applicable Waste Disposal Company. Access to trash/service areas shall
be placed so as not to conflict with parking areas. Said placement shall be
approved by applicable trash company and Department of Community
Development.
6. All future occupants of the buildings shall comply with off-street parking
requirements in Section 25.58 of the Zoning Ordinance.
7. A detailed parking lot and building lighting plan shall be submitted to staff for
approval, subject to applicable lighting standards, plan to be prepared by a
qualified lighting engineer. If the outdoor storage area is to be illuminated, it shall
be included on the lighting plan.

8. Final landscape pians shall comply with the City's Parking Lot and Tree Standards
per Ordinance 977 and Resolution 01-06.
10. Applicant agrees to maintain the landscaping required to be installed pursuant to
these conditions. Applicant will enter into an agreement to maintain said
landscaping for the life of the project, which agreement shall be notarized and
which agreement shall be recorded. It is the specific intent of the parties that this
condition and agreement run with the land and bind successors and assigns. The
final landscape plan shall include a long-term maintenance program specifying
among other matters appropriate watering times, fertilization and pruning for
various times of the year for the specific materials to be planted, as well as
periodic replacement of materials. All to be consistent with the Property
Maintenance Ordinance (Ordinance No. 801) and the approved landscape plan.
11. The project shall be subject to all applicable fees at time of issuance of building
permits including, but not limited to, Art in Public Places, TUMF, School Mitigation
and Housing Mitigation fees.
12. The project's setbacks shall conform to standards in Section 25.34 (Service
Industrial District) of the City's Zoning Ordinance.
13. All roof-mounted mechanical equipment shall be screened by a parapet wall
around the perimeter of the building that is at least as high as the highest piece of
mechanical equipment, or as otherwise approved by the Architectural Review
Commission. Construction drawings submitted for plan check shall include a roof
plan showing locations of roof-mounted mechanical equipment and cross-section
drawings shall be provided for all proposed buildings showing parapet wall heights
and roof-mounted mechanical equipment.
14. Prior to the issuance of a building permit, the applicant shall submit a project site
plan to Waste Management of the Desert for approval of trash enclosure locations
and trash enclosure types. Waste Management of the Desert may require the
applicant to provide trash enclosures of a sufficient size to allow for the collection
of recyclable materials. A copy of written approval from Waste Management of the
Desert of trash/recycling container locations shall be submitted to the Planning
Department prior to the issuance of building permits.
15. Construction drawings shall include a design detail of the access gate on the east
side of the outdoor storage area.
16. The height of storage pallets and other building materials stored outdoors shall not
exceed the 12-foot height of the perimeter screen wall and shall not be visible from
a public street.

Department of Public Works:
GENERAL REQUIREMENTS
1. Landscaping maintenance of the entire property including all frantages shall be
provided by the property owner pursuant to the city approved landscape plan.
Landscape treatment shall be water efficient in nature and shall be in
accordance with the City of Palm Desert Water Efficient Landscape Ordinance
and applicable design standards. The property owner shall enter into a
Landscape Maintenance Agreement with the city of Palm Desert for the
maintenance of the aforementioned landscape. Landscape plans shall include
proposed contours and be submitted for review simultaneously with grading
plans
2. A complete preliminary soils investigation, conducted by a registered soils
engineer, shall be submitted to, and approved by, the Department of Public
Works prior to the issuance of a grading permit.
BONDS AND FEES
3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17
and 79-55, shall be paid prior to issuance of grading permit.
4. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF).
Payment of said fees shall be at the time of building permit issuance.
5. A standard inspection fee shall be paid prior to issuance of grading permits.
DESIGN REQUIREMENTS
6. Storm drain design and construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by the
Department of Public Works prior to start of construction.
7. Complete grading and improvement plans and specifications on electronic files
shall be submitted to the Director of Public Works for checking and approval
prior to issuance of any permits.
8. Any and all offsite improvements shall be preceded by the approval of plans and
the issuance of valid encroachment permits by the Department of Public Works.
9. Pad elevations are subject to review and modification in accordance with

RESOLUTION NO. 05-�55.
Chapter 26 of the Palm Desert Municipal Code.
10. Project shall retain nuisance waters on-site.
11. Full public improvements, as required by Section 26 of the Palm Desert
Municipal Code, shall be installed in accordance with applicable City standards.
The property owner shall dedicate and improve Dinah Shore Drive to a half-
street width of up to 51 feet on 75 feet of right-of-way.
CONSTRUCTION REQUIREMENTS
12. All public improvements shall be inspected by the Department of Public Works
and a standard inspection fee shall be paid prior to issuance of grading permits.
No occupancy permit shall be granted until public improvements have been
completed.
13. All public and private improvements shall be inspected by the Public Works
Department.
14. Prior to the start of construction, the applicant shall submit satisfactory evidence
to the Director of Public Works of intended compliance with the National
Pollutant Discharge Elimination System (NPDES) General Construction Permit
for storm water discharges associated with construction. Developer must
contact Riverside County Flood Control District for informational materials.
OTHER REQUIREMENTS
15. Reciprocal access easement required with properiy to the east and west.
16. Project shall line the sides of the Mid-Valley Channel, where adjacent, to the
satisfaction of the City Engineer.
17. Driveway throats shall be modified with no openings at least 75' as measured
from the curb line of Dinah Shore Drive, are required for the driveways providing
access to the project, as depicted on the attached exhibit prepared for PP 4-30.
18. Project shall provide wall opening for maintenance of area adjacent to Mid-Valley
Channel.
Riverside Countv Fire Marshal:
1. With respect to the conditions of approval regarding the above referenced
project, the fire department recommends the following fire protection measures

be provided in accordance with City Municipal Code, NFPA, UFC, and UBC or
any recognized Fire Protection Standards:
The Fire Department is required to set a minimum fire flow for the remodel or
construction of all buildings per UFC article 87.
2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual pressure must be
available before any combustible material is placed on the job site.
3. Provide or show there exists a water system capable of providing a gpm flow of:
3000 gpm.
4. The required fire flow shall be available from a wet barrel Super Hydrant(s)
4"x2"-1/2" x2-1/2", located not less than 25 feet nor more than:
150' from any portion of a commercial building measured via vehicular travelway.
5. Water Plans must be approved by the Fire Marshal and include verification that
the water system will produce the required fire flow.
6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings
with a 3000 square foot total cumulative floor area. The Fire Marshal shall
approve the locations of all post indicator valves and fire department
connections. All valves and connections shall not be less than 25 feet from the
building and within 50 feet of an approved hydrant. Exempted are one and two
family dwellings.
7. All building shall be accessible by an all-weather roadway extending to within
150 feet of all portions of the exterior walls of the first story. The roadway shall
not be less than 24 feet of unobstructed width and 13'6" of vertical clearance.
Where parallel parking is required on both sides of the street the roadway must
be 36 feet wide, and 32 feet wide with parking on one side. Dead-end roads in
excess of 150 feet shall be provided with a minimum 45-foot radius turn-around,
55 foot in industrial developments.
8. Whenever access into private property is controlled through use of gates,
barriers or other means, provisions shall be made to install a"Knox Box" key or
over-ride system to allow for emergency vehicle access. Minimum gate width
shall be 16' with a minimum vertical clearance of 13'-6".
9. All dead end single access over 500 feet will require a secondary access,
sprinklers or other mitigative measures approved by the Fire Marshal. Under no
circumstances shall a dead end over 1300 feet be accepted.

10. A second access is required. This can be accomplished by two main access
points from a main roadway or an emergency gate from an adjoining
development.
11. All buildings shall have illuminated addresses of the size approved by the City.
12. Conditions subject to change with adoption of new codes, ordinances, laws, or
when building permits are not obtained with twelve months.
13. All elevators shall be mir�imum gurney size.
14. The applicant shall submit information to the Fire Department to verify
what commodities will be in storage so that it can be determined what
density sprinklers will be required.

City Council to consider a request by CMC WHITE CAP for approval of a precise plan of

Chamber at the Palm Desert Civic Center, 73-510 Fred Waring Drive, Palm Desert,
California, at which time and place all interested persons are invited to attend and be
heard. Written comments concerning all items covered by this public hearing notice shall
be accepted up to the date of the hearing. Information concerning the proposed project
and/or negative declaration is available for review in the Department of Community
Development at the above address between the hours of 8:00 a.m. and 5:00 p.m.

hearing, then they would open the public hearing and recommend a
continuance to June 7, 2005.
Commissioner Jonathan asked if they could open the public hearing, if they
could also take action. Mr. Hargreaves said yes, they could go ahead and
act, but someone in the future could challenge it based on the inadequacy
of the notice. In an abundance of caution, they would continue the matter. He
noted that there was no one present. Either way, it was just a formality at this
point.
Chairperson Tschopp opened the public hearing, noted there was no one
present to speak in FAVOR or OPPOSITION, and asked for Commission
comments.
Action:
It was moved by Commissioner Finerty, seconded by Commissioner
Jonathan, continuing Case No. TPM 33646 to June 7, 2005. Motion carried
4-0.
B. Case No. PP 05-02 - CMC WHITE CAP, Applicant
Request for a recommendation to City Council of approval of
a precise plan of design to allow construction of a 13,696
square foot industrial building, including a 2,500 square foot
mezzanine, a height exception up to 34'6", and outdoor
storage of building materials on a 3.43-acre site located on the
north side of Dinah Shore Drive, east of Leilani Way at 73-600
Dinah Shore Drive.
Commissioner Jonathan informed the Commission that he has an ownership
interest in property that he believed was greater than 500 feet away from this
particular application, but in an abundance of caution he would abstain and
left the room.
Mr. Francisco Urbina reviewed the staff report. He also noted that the City
Council wanted staff to look into making Dinah Shore six lanes versus four
lanes between Portola and Monterey. As a result of that directive from
Council, staff was recommending the addition of a sentence to Public Works
Department Condition No. 11, "The property owner shall dedicate and

improve Dinah Shore Drive to a half -street width of up to 51 feet on 75 feet
of right-of-way." This would allow staff the flexibility to require the property
owner to make half -street improvements to facilitate six lanes if that was
what the Council decided in the future. With the amendment to that
condition, staff recommended that Planning Commission recommend to City
Council approval of Case No. PP 05-02 based on the findings and conditions
in the draft resolution.
Commissioner Campbell asked what kinds of construction materials would
be stored outdoors. Mr. Urbina explained it would include lumber and
masonry materials; stone products. He said the current business is located
in an industrial park in Thousand Palms and wanted to relocate into this area
of Palm Desert.
Given the possibility of going to six lanes, Chairperson Tschopp asked for
the number of feet that would be dedicated. The reason he asked was
because the front setback only varied from 43 feet to 60 feet from curb to
building right now. Mr. Urbina said that right now it is a 50-foot half street.
The recorded industrial parcel map for this area that created the project site
parcel had a width of 31 feet of pavement from the curb on the median to the
outside curb 31 feet. That could only accommodate two travel lanes. To
accommodate three travel lanes, the Public Works Department was looking
at increasing that 31 feet to 42 feet which would allow for three 12-foot wide
travel lanes plus a six-foot wide bike lane. Mr. Drell said the answer was it
would be widened 11 feet. Fortunately with this project, that 40-60 foot
existing setback was still quite adequate to absorb that 11 feet.
Commissioner Campbell noted that the setback would still be about 22 feet
minimum if the third lane was added. Mr. Drell thought the landscaping would
be more than 30 feet and confirmed it was still adequate.
There were no other questions for staff and Chairperson Tschopp opened
the public hearing and asked the applicant to address the Commission.
MR. THOMAS SUN, Ware Malcomb Architects on behalf of CMC
Incorporated, informed Commission that they are the architects of
record for this project. At this time they had no objections to the
conditions as stated.

Department of Community Devefopment:
The development of the property shall conform substantiaily with exhibits on file
with the Department of Community Development, as modified by the following
conditions.
2. Construction of a portion of said project shail commence within one year from the
date of fina! approval unless an extension of time is granted; otherwise said
approval shall become nuli, void and of no effect whatsoever.
3. The development of the property described herein shafl be subject to the
restrictions and limitations set forth herein which are in addition to ail municipal
ordinances and state and federaf statutes now in force, or which hereafter may be
in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the

7. A detailed parking lot and building lighting plan sha(I be submitted to staff for
approval, subject to applicable lighting standards, plan to be prepared by a
qualified lighting engineer. If the outdoor storage area is to be illuminated, it shall
be included on the lighting plan.
8. Final landscape plans shall comply with the City's Parking Lot and Tree Standards
per Ordinance 977 and Resolution 01-06.
9. Applicant agrees to maintain the landscaping required to be installed pursuant to
these conditions. Applicant will enter into an agreement to maintain said
landscaping for the life of the project, which agreement shall be notarized and
which agreement shall be recorded. It is the specific intent of the parties that this
condition and agreement run with the land and bind successors and assigns. The
final landscape plan shall include a long-term maintenance program specifying
among other matters appropriate watering times, fertilization and pruning for
various times of the year for the specific materials to be planted, as well as periodic
replacement of materials. All to be consistent with the Property Maintenance
Ordinance (Ordinance No. 801) and the approved landscape plan.
10. The project shall be subject to all applicable fees at time of issuance of building
permits including, but not limited to, Art in Public Places, TUMF, School Mitigation
and Housing Mitigation fees.
11. The project's setbacks shall conform to standards in Section 25.34 (Senrice
Industrial District) of the City's Zoning Ordinance.
12. All roof-mounted mechanical equipment shall be screened by a parapet wall
around the perimeter of the building that is at least as high as the highest piece of
mechanical equipment, or as otherwise approved by the Architectural Review
Commission. Construction drawings submitted for plan check shall include a roof
plan showing locations of roof-mounted mechanical equipment and cross-section
drawings shall be provided for all proposed buildings showing parapet wall heights
and roof-mounted mechanical equipment.
13. Prior to the issuance of a building permit, the applicant shall submit a project site
plan to Waste Management of the Desert for approval of trash enclosure locations
and trash enclosure types. Waste Management of the Desert may require the
applicant to provide trash enclosures of a sufficient size to allow for the collection
of recyclable materials. A copy of written approval from Waste Management of the
Desert of trash/recycling container locations shatl be submitted to the Planning
Department prior to the issuance of building permits.

Department of Public Works:
GENERAL REQUIREMENTS
1. Landscaping maintenance of the entire property including all frontages shall be
provided by the property owner pursuant to the city approved landscape plan.
Landscape treatment shall be water efficient in nature and shall be in
accordance with the City of Palm Desert Water. Efficient Landscape Ordinance
and applicable design standards. The property owner shalf enter into a
Landscape Maintenance Agreement with the city of Palm Desert for the
maintenance of the aforementioned landscape. Landscape plans shall include
proposed contours and be submitted for review simultaneously with grading
plans
2. A complete preiiminary soils investigation, conducted by a registered soils
engineer, shall be submitted to, and approved by, the Department of Public
Works prior to the issuance of a grading permit. '
BONDS AND FEES
3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17
and 79-55, shall be paid prior to issuance of grading permit.
4. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF}.
Payment of said fees shall be at the time of building permit issuance.
5. A standard inspection fee shall be paid prior to issuance of grading permits.
DESIGN REQUIREMENTS
6. Storm drain design and construction shall be contingent upon a drainage study
prepared by a registered civii engineer that is reviewed and approved by the
Department of Public Works prior to start of construction.

7. Complete grading and improvement plans and specifications on electronic files
shali be submitted to the Director of Public Works for checking and approval prior
to issuance of any permits.
8. Any and all offsite improvements shall be preceded by the approval of plans and
the issuance of valid encroachment permits by the Department of Pubiic Works.
9. Pad elevations are subject to review and modification in accordance with
Chapter 26 of the Palm Desert Municipal Code.
10. Project shall retain nuisance waters on-site.
11. Full public improvements, as required by Section 26 of the Palm Desert
Municipal Code, shall be installed in accordance with appficable City standards.
The property owner shaN dedicate and improve Dinah Shore Drive to a half-
street width of up to 51 feet on 75 feet of right-of-way.
CONSTRUCTION REQUIREMENTS
12. AIt public improvements shall be inspected by the Department of Public Works
and a standard inspection fee shail be paid prior to issuance of grading permits.
No occupancy permit shall be granted until public improvements have been
completed.
13. All public and private improvements shall be inspected by the Public Works
Department.
14. Prior to the start of construction, the applicant shall submit satisfactory evidence
to the Director of Public Works of intended compliance with the National
Po(lutant Discharge Elimination System (NPDES) General Construction Permit
for storm water discharges associated with construction. Developer must
contact Riverside County Flood Control District for informational materiais.
OTHER REQUIREMENTS
15. Reciprocal access easement required with property to the east and west.

16. Project shali line the sides of the Mid-Valley Channel, where adjacent, to the
satisfaction of the City Engineer.
17. Driveway throats shall be modified with no openings at least 75' as measured
from the curb line of Dinah Shore Drive, are required for the driveways providing
access to the project, as depicted on the attached exhibit prepared for PP 4-30.
18. Project shall provide wall opening for maintenance of area adjacent to Mid-Valley
Channel.
Riverside Countv Fire Marshal:
1. With respect to the conditions of approval regarding the above referenced
project, the fire department recorramends the following fire protection measures
be provided in accordance with City Municipal Code, NFPA, UFC, and UBC or
any recognized Fire Protection Standards:
The Fire Department is required to set a minimum fire flow for the remodel or
construction of all buildings per UFC article 87.
2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual pressure must be
available before any combustible material is placed on the job site.
3. Provide or show there exists a wat�r system capable of providing a gpm flow of:
3000 gpm.
4. The required fire flow shall be available from a wet barrel Super Hydrant(s) 4" x
2-112" x 2-1/2", located not less than 25 feet nor more than:
150' from any portion of a commercial building measured via vehicular travelway.
5. Water Plans must be approved by the Fire Marshal and include verification that
the water system will produce the required fire flow.
6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings
with a 3000 square foot total cumulative floor area. The Fire Marshal shall
approve the locations of all post indicator valves and fire department
connections. All valves and connections shall not be less than 25 feet from the
building and within 50 feet of an approved hydrant. Exempted are one and two
family dwellings.

7. All building shall be accessible by an all-weather roadway extending to within
150 feet of ail portions of the exterior walls of the first story. The roadway shall
not be less than 24 feet of unobstructed width and 13'6" of vertical clearance.
Where parallel parking is required on both sides of the street the roadway must
be 36 feet wide, and 32 feet wide with parking on one side. Dead-end roads in
excess of 150 feet shall be provided with a minimum 45-foot radius turn-around,
55 foot in industrial developments.
8. Whenever access into private property is controlled through use of gates,
barriers or other means, provisions shall be made to install a"Knox Box" key or
over-ride system to allow for emergency vehicle access. Minimum gate width
shall be 16' with a minimum vertical clearance of 13'-6".
9. All dead end single access over 500 feet will require a secondary access,
sprinklers or other mitigative measures approved by the Fire Marshal. Under no
circumstances shall a dead end over 1300 feet be accepted.
10. A second access is required. This can be accomplished by two main access
points from a main roadway or an emergency gate from an adjoining
development.
11. All buildings shall have illuminated addresses of the size approved by the City.
12. Conditions subject to change with adoption of new codes, ordinances, laws, or
when building permits are not obtained with twelve months.
13. All elevators shall be minimum gumey size.
14. The applicant shall submit information to the Fire Department to verify what
commodities will be in storage so that it can be determined what density
sprinklers will be required.

The precise pian proposes the construction of one 31,679 square foot industrial
buiiding that will include a 2,500 square foot meuanine. The building will be used for
offices (1fi.1% of total floor area) and storage of buiiding products. A corrugated metai
canopy on the east and north sides of the building wilf shade some of the buiiding
materials stored outdoors as well as company trucks. Outdoor storage of building
materials is proposed at the rear of the site and wi11 be screened by a 12-foot high wall
constructed of 8-foot high masonry block with 4-foot high metal lattice panels on top.
The screen wall along the northerly boundary wili be staggered by three feet in 35-foot
length sections to provide enhanced project aesthetics, as the site is visibfe to
motorists traveling along the Interstate 10 Freeway.

A. Site Plan and Parking:

Site Plan: Access to the site wi11 be via two 40-foot wide shared access
driveways on Dinah Shore Drive. The project is conditioned to provide a
deceferation lane on Dinah Shore Drive. The proposed 31,679 square foot
building is plotted on the 3.43-acre site to create a 43-foot to 60-foot front yard
landscaped setback along Dinah Shore Drive. The site plan provides a 175-foot
rear yard setback and 45-foot and 75-foot interior side yard setbacks.
Parkinq: Based on Zoning Ordinance ofif-street parking requirements for
industrial uses of one parking space per 500 square feet of floor area, the
building requires 66 parking spaces. The site plan provides 77 parking spaces.
B. Architecture:
The industrial building has a"contemporary" architectural style with strong
emphasis of rectangular shapes and rooflines at varying heights. The building
will have tift-up concrete exterior walls that incorporate scoring lines and
contrasting colors. There will be seven exterior colors that include beige, two
shades of off white, two shades of brown, light iavender, and purple.
The buifding generaliy has a height of 29'-6". Some architectural projections
(tilt up concrete panels and parapet walls) will have heights above the 30-foot
SI zone height fimit. The heights of these architectural projections will be from
32'-6" to 34'-6" to create added architectural interest in the roof line. Since the
height fimit in the Sf zone is 30 feet, these projeciions will require approval of a
height exception by the City Council.
The Architectural Review Commission granted preliminary approval (5-0-1-1) of
the project on March 22, 2005.
III. ANALYS{S:
The project complies with SI zone development standards except for the heights of
some architectural projections, which require approval by the City Council. The
project as designed will result in an attractive architectural appearance that will
comp{ement other buifdings approved in the area. Therefore, the findings for
approving a precise plan can be affirmed. These findings are included in the draft
Planning Commission resofution attached to this staff report.
IV: ENVIRONMENTAL REV{EW:
For purposes of CEQA, the Director of Community Development has determined that
the proposed project is a Class 32 categorical exemption per Section 15332 (In-fill

CONDITIONS OF APPROVAL

Deaartment of Communitv Develoament:
The development of the property shall conform substantially with exhibits on file
with the Department of Community Development, as modified by the following
conditions.
2. Construction of a portion of said pro)ect shaN commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:

Public Works Department
Evidence of said permit or clearance from the above agencies shall be presented

8. Final landscape plans shall comply with the City's Parking Lot and Tree Standards
per Ordinance 977 and Resolution 01-06.
10. Applicant agrees to maintain the landscaping required to be installed pursuant to
these conditions. Applicant will enter into an agreement to maintain said
landscaping for the life of the project, which agreement shall be notarized and
which agreement shall be recorded. It is the specific intent of the parties that this
condition and agreement run with the land and bind successors and assigns. The
final landscape plan shall include a long-term maintenance program specifying
among other matters appropriate watering times, fertilization and pruning for
various times of the year for the specific materials to be planted, as well as
periodic replacement of materials. All to be consistent with the Property
Maintenance Ordinance (Ordinance No. 801) and the approved landscape plan.
11. The project shall be subject to all applicable fees at time of issuance of building
permits including, but not limited to, Art in Public Places, TUMF, School Mitigation
and Housing Mitigation fees.
12. The project's setbacks shall conform to standards in Section 25.34 (Service
Industrial District) of the City's Zoning Ordinance.
13. All roof-mounted mechanical equipment shall be screened by a parapet wall
around the perimeter of the building that is at least as high as the highest piece of
mechanical equipment, or as otherwise approved by the Architectural Review
Commission. Construction drawings submitted for plan check shall include a roof
plan showing locations of roof-mounted mechanical equipment and cross-section
drawings shall be provided for all proposed buildings showing parapet wall heights
and roof-mounted mechanical equipment.
14. Prior to the issuance of a building permit, the applicant shall submit a project site
plan to Waste Management of the Desert for approval of trash enclosure locations
and trash enclosure types. Waste Management of the Desert may require the
applicant to provide trash enclosures of a sufficient size to allow for the collection
of recyclable materials. A copy of written approval from Waste Management of the
Desert of trash/recycling container locations shall be submitted to the Planning
Department prior to the issuance of building permits.
15. Construction drawings shall include a design detail of the access gate on the east
side of the outdoor storage area.
16. The height of storage pallets and other building materials stored outdoors shall not
exceed the 12-foot height of the perimeter screen wall and shall not be visible from
a public street.

1. Landscaping maintenance of the entire property including ali frontages shall be
provided by the property owner pursuant to the city approved landscape plan.
Landscape treatment shall be water efficient in nature and shall be in
accordance with the City of Palm Desert Water Efficient Landscape Ordinance
and applicable design standards. The properry owner shall enter into a
Landscape Maintenance Agreement with the city of Palm Desert for the
maintenance of the aforementioned landscape. Landscape plans shall include
proposed contours and be submitted for review simultaneously with grading
plans
2. A complete preliminary soils investigation, conducted by a registered soils
engineer, shall be submitted to, and approved by, the Department of Public
Works prior to the issuance of a grading permit.
BONDS AND FEES
3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17
and 79-55, shall be paid prior to issuance of grading permit.
4. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF).
Payment of said fees shall be at the time of building permit issuance.
5. A standard inspection fee shall be paid prior to issuance of grading permits.
DESIGN REQUIREMENTS
6. Storm drain design and construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by the
Department of Public Works prior to start of construction.
7. Complete grading and improvement plans and specifications on electronic files
shall be submitted to the Director of Public Works for checking and approval
prior to issuance of any permits.
8. Any and all offsite improvements shall be preceded by the approval of plans and

1. With respect to the conditions of approval regarding the above referenced
project, the fire department recommends the following fire protection measures
be provided in accordance with City Municipal Code, NFPA, UFC, and UBC or
any recognized Fire Protection Standards:

The Fire Department is required to set a minimum fire flow for the remodel or
construction of all buildings per UFC article 87.
2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual pressure must be
available before any combustible material is placed on the job site.
3. Provide or show there exists a water system capable of providing a gpm flow of:
3000 gpm.
4. The required fire flow shall be available from a wet barrel Super Hydrant(s)
4"x2"-1/2" x2-1/2", located not less than 25 feet nor more than:
150' from any portion of a commercial building measured via vehicular travelway.
5. Water Plans must be approved by the Fire Marshal and include verification that
the water system will produce the required fire flow.
6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings
with a 3000 square foot total cumulative floor area. The Fire Marshal shall
approve the locations of all post indicator valves and fire department
connections. All valves and connections shall not be less than 25 feet from the
building and within 50 feet of an approved hydrant. Exempted are one and two
family dwellings.
7. All building shall be accessible by an all-weather roadway extending to within
150 feet of all portions of the exterior walls of the first story. The roadway shall
not be less than 24 feet of unobstructed width and 13'6" of vertical clearance.
Where parallel parking is required on both sides of the street the roadway must
be 36 feet wide, and 32 feet wide with parking on one side. Dead-end roads in
excess of 150 feet shall be provided with a minimum 45-foot radius turn-around,
55 foot in industrial developments.
8. Whenever access into private properiy is controlled through use of gates,
barriers or other means, provisions shall be made to install a"Knox Box" key or
over-ride system to allow for emergency vehicle access. Minimum gate width
shall be 16' with a minimum vertical clearance of 13'-6".
9. All dead end single access over 500 feet will require a secondary access,
sprinklers or other mitigative measures approved by the Fire Marshal. Under no
circumstances shall a dead end over 1300 feet be accepted.
10. A second access is required. This can be accomplished by two main access
points from a main roadway or an emergency gate from an adjoining
development.

This area lies on the sandy area in the northern portion of Pa1m Desert and is considered safe
from regional stormwater flows exc�pt in rare instances.
This azea is designated Zone C on Federal Flood Insurance rate maps which are in effect at
this time by the Federal Emergency Management Agency.
Drainage from this area is contributory to the Mid-Va11sy Stormwater Project. The city sha11
require mitigation measures to be incorporated into the development to prevent flooding of
the site or downstream properties. These measures shall include on-site retention of water
from the 100-year storm, dedication of right-of-way for regional flood control facilities or
other participation in the financing of regional flood control facilities.
Since the stormwater issues of this development are local drainage, the District does not need
to review drainage design further.

Mr. Urbina stated that staff s concerns are that the north elevation
facing the freeway is not aesthetically pleasing and not what the City
Council expects. There are some tamarisk trees along the railroad
tracks and the site is level from the freeway. The cars on the freeway
will be able to see the rear elevation. I did receive, via e-mail, the
revised landscaping plans and there are some trees proposed along
the rear property line. If the trees are to be used as a visual screen,
there may not be enough of them. The species is Southern live oak.
Staff is recommending that the north (rear elevation) be revised to
incorporate some additional enhancements.
Commissioner Hanson suggested incorporating the reveal that's shown
on the front elevation into the rear elevation and add some articulation
along the top of the building.
Mr. Urbina stated that staff had recommended after the first
Architectural Review Commission meeting that the applicant consider
having a three-sided building along the rear property line to take care of
the outdoor storage. The applicant is proposing to have outdoor
storage with a height stacking limit of 8'. Based on staff s experiences
with other industrial projects that have outdoor storage, the pallets will
exceed 8', therefore, we'd like the commission to consider either
requiring a 12' high block wall along the rear or some other method to
address the stacking height issues of the outdoor storage area.
Commissioner Hanson asked about the height difference from the
freeway to the pad. Mr. Thomas Sun, applicant, was present and
stated that he believed that it was almost IeveJ. Commissioner Hanson
asked the applicant if he would have a problem raising the wall. Mr.
Sun stated that he would be willing to raise the wall to 10'-12'. Mr.

stated that he wili work with Diane Hollinger on the landscape plan.
Commissioner Lambeli stated that the revised plans are a huge step
forward compared to the previous submittal.
Mr. Urbina asked the commission to note the area in front of the
perimeter wall along the east elevation and wondered if there was
sufficient architectural treatment since it will be visible to westbound
traffic� along Dinah Shore. Commissioner Hanson stated that she's
okay with it. There will be landscaping in this area.
Commissioner Hanson suggested using Phoenix date palms in the
landscaping.
Commissioner Van Vliet asked about the 12' high rear wall. Mr. Sun
stated that he's thinking about keeping the wall at 8' high in the front
and stepping it up towards the back. Commissioner Van Vliet
commented that he was concerned about what it's going to look like if
it's 12' high. Commissioner Gregory asked if there would be any
berming at the base of the wall. Commissioner Van Vliet stated that
the site plan doesn't show that there's enough room for berming.
Commissioner Hanson suggested adding a metal grid to the top of the
8' wall for vines to grow on so that it isn't so solid. I wouldn't want to
see a 12' high wall all the way across the rear. I'd like it to be a little bit
more architecturally. Mr. Sun suggested varying the height of the wall.
Mr. Urbina asked the applicant about the sliding gates that provide
access to the outdoor storage area and asked if they would be solid
metal. Mr. Sun stated that they would be see through. There was a
letter that accompanied the re-submittal that says that if they intend to
use wrought iron, it must be see through. Commissioner Hanson
stated that the commission needs a detail on the gates. It was
suggested that the applicant consider how much you can see through
to the back storage area.
Action: Commissioner Hanson moved, seconded by Commissioner
Lambell for preliminary approval subject to (1) incorporating reveals into
