Ordinance No. 1010 Recommendation: Waive further reading and pass Ordinance No. 1092 to second reading, dissolving the City's Technology Committee. Executive Summary: The Technology Committee was established in 2000 by Ordinance No. 935 to provide advice to the City Council on matters of technology as they relate both to residents of Palm Desert and to staff inside City Hall, and with particular attention to the City's cable television franchise agreement. The Committee provided valuable assistance in focusing the City's efforts, especially with adoption of the Information Technology Strategic Plan (ITSP) and launch of the City's first e-gov website. With such matters requiring little attention after ITSP's adoption, the Technology Committee has served its function well for the City. City Council and staff agree that it would be appropriate to dissolve the Committee at this time. Discussion: In 1998, City Council determined that with the rate of speed at which technological changes were impacting daily life, it would be in the City's best interest to form a committee to provide advice to the City Council on these issues. Ordinance No. 935 was adopted in February 2000 to establish the Committee, and Ordinance No. 1010 was adopted in February 2002, increasing its membership by two to a total of seven members. Ordinance to Dissolve Technology Committee March 10, 2005 One of the first matters to be considered by the Technology Committee was review of the renegotiation process for the City's cable television franchise agreement. It was anticipated that the Committee would have an important role in this process. However, after an in-depth examination of all regulations governing these transactions, it was revealed that the City's role and ability to sanction related activity is virtually nil. Most of the authority lies with the Federal Communications Commission (FCC). The Committee then undertook other matters. It reviewed proposals for a consultant who would help develop the City's Information Technology Strategic Plan. The Plan presented by The Gartner Group was approved in March 2001. Another 2001 achievement was forwarding a recommendation to the City Council to approve City Hall voice mail, pursuant to a strict policy for its implementation, which has served the City well —residents, City Councilmembers, the public generally, and staff —for the past four years. With the Committee's review and advice in 2002, the e-gov website was launched. In fact, because it was effective in dealing with the aforementioned issues, there is little other subject matter for it to review at this time. After giving serious consideration to its mission, the City Council, with staff's concurrence, has authorized the dissolution of the Technology Committee. Should future circumstances warrant reestablishment of this or a similar advisory body, staff will stand ready to provide the necessary organization and background it obtained by working with this group over the past five years. City Council has directed, instead, that staff work diligently to ensure internal technological needs are being met and maintained, to serve the needs both inside and outside City Hall. NOW, THEREFORE, BE IT ORDAINED that the City Council of the City of Palm Desert, California, does hereby determine that it is in the public interest that the Technology Committee be dissolved at this time, as follows: Section 1. That Chapter 2.72 of the Palm Desert Municipal Code is hereby repealed in its entirety. Section 2. The City Clerk of the City of Palm Desert, California, is hereby directed to publish this ordinance in the Desert Sun, a newspaper of general circulation, printed and published in the County of Riverside and circulated in the City of Palm Desert, and shall be in full force and effect thirty (30) days after its adoption. The purpose of the technologycommittee is to guide cit y policy and to serve as technology advisors to the city council. B. Committee Responsibilities. 1. Advocate for effective use of computer and telecommunications technology in myriad aspects of the city of Palm Desert and the lives of its citizens; 2. Advise the city of Palm Desert on issues relating to computer and telecommunications technology use and policy; 3. Develop recommendations to city council for all telecommunications regulatory and franchise matters, including, but not limited to, review of city Ordinance 318; 4. Serve as goodwill ambassadors to the community at large regarding telecommunications issues, especially those that require regional coordination. C. Recommendation and Action. All review and recommendations shall be made and forwarded to the city council, which shall be the final determining body of all actions recommended from the technology committee. (Ord. 935 § 1, 2000) 2.72.020 Membership. A. The technology committee shall consist of seven members appointed from the community at large, representing both residential and business interests. Membership may be comprised of people recognized as having expertise in computer or telecommunications technology, expertise in related regulatory and legal issues, or the management and application of telecommunications and information systems. Members of the committee or any other group or individual may recommend nominees for membership. Appointments shall be made by the city council. B. Nonvoting liaisons to the technology committee are appointed as follows: 1. The mayor shall appoint two members of the city council as nonvoting liaisons to the committee. 2. Four city staff members are appointed as nonvoting liaisons to the committee: (a) city clerk; (b) manager of the city information systems department; and (c) management analyst. 3. In addition, each telecommunications carrier using rights -of -way resources within the city may designate a nonvoting liaison representative. WHEREAS, the City of Palm Desert strives to attract business, institutions, and visitors to the City; and WHEREAS, the City is fast becoming the economic center of the Coachella Valley; and WHEREAS, the availability, cost, and quality of telecommunications infrastructure and services withing the City plays a critical role in City and Regional development and quality of life, and are matters of great importance to citizens, schools, institutions, and private businesses located within the City; and WHEREAS, the City last adopted a Telecommunications Ordinance, number 318, on January 27, 1983, and this Ordinance requires immediate revision in light of changes in Federal legislation; and WHEREAS, the City has a responsibility to establish sound procedures for the use of publicly owned right-of-way in order to enable a diversity of telecommunications services within the City; and WHEREAS, The City has the opportunity to utilize and leverage computer and telecommunications technologies generally, to enhance the quality and efficiency of City administrative operations and public outreach communications; NOW, THEREFORE, BE IT ORDAINED that the City Council of the City of Palm Desert, does hereby determine that it is in the public interest that a Technology Committee be formed, to advise the City Council with a view toward enhancing the social, educational, and economic life of the City.
