Recommendation:
By Minute Motion, that the Agency Board:
1. Approve use of Universal Field Services, Inc., Spectrum Land Services, and
Overland Pacific & Cutler, Inc. for right-of-way acquisition services for the City of
Palm Desert and the Palm Desert Redevelopment Agency;
2. No set -aside necessary.
Executive Summary:
By approving the staff recommendation, the Agency Board will authorize the
professional services needed to manage various right-of-way acquisition projects over
the next three years. This will minimize the potential for changing firms and associated
costs.

Discussion:
The City of Palm Desert and the Palm Desert Redevelopment Agency have periodic need for
professional services from right of way (ROW) acquisition firms. These services may be limited
in scope and quantity such as for the acquisition of a single residential parcel, or maybe as
comprehensive, such as acquiring portions of a large number of properties owned by diverse
groups with conflicting interests for a road widening. The City and the Agency are interested in
retaining three well qualified firms who will augment staff and assume responsibility as an agent
of the City/Agency in the acquisition of property.
Because a single property transaction routinely takes six months or more, the City/ Agency
desire three-year agreements with the selected firms in order to minimize the potential for
changing firms during transaction.
Both the City of Palm Desert and the Palm Desert Redevelopment Agency jointly issued a
Request for Statements of Qualifications for Right -of -Way Acquisition Services. A panel,
comprised of representatives from Planning, Public Works and the Redevelopment Agency,
were asked to review and evaluate the six proposals received on the following criteria: firm
history and resources, key personnel, previous experience, rates, and special considerations,
i.e. a local office. Through the review process, staff selected three firms that will be held on file
and utilized as needed. Depending on the project, the best certified firm would be selected to
complete the tasks involving right -of- way acquisition. A purchase order for these services will
be opened on a case -by -case basis.

Dear Ms. Aylaian:
Universal is pleased to provide our qualifications for consulting right of way and real property acquisition
services. We have been providing right of way and acquisition services to government clients for over four
decades. Universal has the skills and demonstrated ability to deliver right of way acquisition services in a
timely and cost effective manner. In all the years of offering our services, we have never had to decline or
not complete a project on time and within budget due to lack of qualified personnel resources.
All work is preformed in full conformance with Federal and State laws, Caltrans' procedures, and the
Uniform Relocation Assistance and Real Property Acquisition Policies Act.
The Federal regulations which implement the Uniform Act have recently changed. The final rule is now
effective. Our right of way approach and procedures will reflect the new regulations.
Our team is fully familiar with these regulations. I have worked closely with the Federal agencies when the
current regulations were developed and he provided input and guidance. Subsequently, I co -developed a
series of workshops for the International Right of Way Association (IRWA) which briefed public agencies
on the new regulations.
Universal's commitment to quality is a constant and integral part of our ongoing effort to offer the best
service in the industry. We are proud that our team members and staff have worked on other
redevelopment projects in the area. This local experience is critical to understanding the project and the
challenges it presents.
