application for the Used Oil Recycling Block Grant, FY 2005/06
(11 th Cycle).

Recommendation:
By Minute Motion, approve the following: (1) Authorize Sheila R. Gilligan, Assistant City
Manager of Community Services to sign and submit application for the Used Oil
Recycling Block Grant, FY 2005/06 (111n Cycle); (2) authorize the appropriation and
expenditure of funds in the amount of $11,833 from the Recycling Fund, Account No.
236-4195-454-3090; and (3) increase estimated revenue by $11,833.
Discussion:
The City will continue the collection of used oil as part of the HHW Facility and curbside.
Funds will be directed to the City's Permanent Household Hazardous Waste Facility in
the full amount of $11,833. The curbside collection program is provided for within the
contract between the City and Waste Management of the Desert. The facility now
accepts used oil, household hazardous waste, E-Waste, U-Waste, and Sharps
materials. Funds will be used for packing and transporting of materials, public
education, and personnel costs. California Integrated Waste Management Board will
advance 90% of the funds and hold 10% on a reimbursement basis until proof that all
grant/program conditions have been met.

the appropriation and expenditure funds.

Environmental Justice
Entities that receive grant funding from CIWMB for this grant program must comply with the following principles of
Environmental Justice. Environmental Justice is defined in Government Code Section 65040.12(c) as: "...the fair
treatment of people of all races, cultures, and incomes with respect to the development, adoption, implementation, and
enforcement of environmental laws, regulations, and policies." Public Resources Code Sections 72000(a) & 72001
broadly require all California Environmental Protection Agency boards, departments, and offices to conduct their
"programs, policies, and activities that substantially affect human health or the environment in a manner that ensures the
fair treatment of people of all races, cultures, and income levels, including minority populations and low-income
populations of the state."

RESOLUTION OF THE CITY COUNCIL OF THE �
CITY OF PALM DESERT AUTHORIZING USED
OIL AND HOUSEHOLD HAZARDOUS WASTE
GRANT APPLICATTONS TO THE CALIFORI�TIA
INTEGRATED WAS'TE MANAGEMENT
BOARD.
WEiEREAS, the people of the State of California have enacted the California Oil
Recycling Enhancement Act that provides funds to cities and counties for establishing and
maintaining local used oil collection programs that encourage recycling or appropriate
disposal of used oil; and
WFiEREAS, the people of the State of Califomia have enacted Assembly Bill 1220
(Eastin, 1993) that provides grants to local govemments to establish and implement waste
diversion and separation programs to prevent disposal of hazardous waste, including
household hazardous waste (HHV� in solid waste landfills; and
WHEREAS, The California lntegrated Waste Management Board has been
delegated the responsibility for the administration of these programs within the State,
setting up necessary procedures governing application by cities and counties under these
programs; and
WHEREAS, the City of Palm Desert intends to apply for used oil and household
hazardous waste grants to fund various waste diversion projects in the future; and
WHEREAS, The City of Palm Desert will enter into agreements with the State of
California for development of the projects.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Palm Desert, California authorizes the following:
1. Authorizes the submittal of grant applications to the California lntegrated
Waste Management Board for all available grants under the California Oil Recycling
Enhancement Act and all available HHW grants under the California lntegrated Waste
Management Act for the period of June 1, 2006 through March 31, 2011; and

2. The Assistant City Manger of Community Services Sheila R. Gilligan, or a
designee, is hereby authorized and empowered to execute in the name of the City of Palm
Desert all necessary applications, contracts, payment requests, agreements, and
amendments hereto for the purposes of securing grant funds and to implement and carry
out the purposes specified in the grant application.
