Discussion: Parcel Map 31515 is located at the southwest corner of Cook Street and Gerald Ford Drive. As a condition of approval, the parcel map is required to improve and/or modify the traffic signals at Technology and Gerald Ford Drive, at Cook Street and Gerald Ford Drive, and at University Park Drive and Cook Street. Costs associated with the conditioned improvements/modifications total approximately $330,000. Included in the precise plan was a statement that allows the developer to request a waiver of the normal traffic signalization fees, estimated at $165,000, in recognition of the fact that they are responsible for the more costly major traffic signalization improvements (see Resolution No. 04-26). Therefore, staff recommends that City Council, by minute motion, approve the request to waive traffic signalization fees (estimated at $165,000) in light of the developer's responsibility for conditioned improvements and modifications (estimated at $330,000) to existing facilities for Parcel Map 31515. CITY OF PAL1I DESERT PUBLIC WORKS OEPA R1 HENI i On April 6, 2004, the City Council of the City of Palm Desert approved the precise plan for the Village at University Park at the corner of Cook Street and Gerald Ford Drive. As a condition of that approval, the project is required to improve and/or modify the traffic signals at Technology and Gerald Ford Drive, at Cook Street and Gerald Ford Drive, and at University Park Drive and Cook Street. Included in the precise plan was a statement that we could request a waiver of traffic signalization fees since we are responsible for major traffic signalization improvements (Resolution No. 04-26, as approved on April 8, 2004. It stated that "Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79-55, shall be paid prior to issuance of any permits associated with this project. Modification of existing signals at Gerald Ford and Technology Drive, and at Cook and Berger Circle West, may be used as credit against these fees, at the discretion of the City Council"). We are requesting that the City Council waive the signalization fees for the above referenced project. The basis for this request is as follows: • The project is conditioned to do these improvements • We are part of a CFD being contemplated that would actually execute these improvements. • Understanding that the CFD has not been fully approved by the City, we remain responsible to complete the improvements described above in order to obtain our certificate of occupancy. • Attached is an estimate of that cost of signalization from RBF (see enclosed copy). The total estimated cost is $330,000. • The estimated fees are approximately $165,000. We are requesting that this subject be added to the Sept 8, 2005 City Council meeting. In addition to the Conditions of Approval, this estimate also included activities that Palm Desert City Staff would require the University Village development complete prior to occupancy of Phase 2. - The following are items which were either excluded from the previously mentioned Conditions or were listed incorrectly in the Conditions. * Signal Modification at Cook & Gerald Ford - not listed in the conditions * New Signal Gerald Ford and Technology - listed as a modification in the conditions. - The above unit bid prices for each bid item are the same unit costs used in the full CFD Estimate. - The Pedestrian Bridge was assessed on a basis of total frontage adjacent to University Village -vs- frontage for the entire project. - Traffic Control is based on total frontage along Cook Street, 53.7%. Traffic Control is assumed to be daily temporary lane closures. The above quoted cost may be reduced between 20-30% if City Staff will allow a permanent lane closure for the duration of the widening along Cook Street. - Landscaping - On -Site slopes inlcudes the cut slope along College Drive across from University Village. Cost based on landscaping 121,550 square feet. - This estimate does not include dry utilities (phone, gas and cable TV) and may add between $150,000 to $200,000 to the overall cost.
