Discussion: The Pubic Works Department has received a request for the abandonment of a portion of a public utility easement located over 74769 and 74791 Sheryl Avenue, lots 122 and 123 of the Country Club Village No. 1 subdivision. The area is designated as a public utility easement on the subject map, filed with the Riverside County Recorder's office in Book 40 on Pages 9 through 11. Staff has reviewed the request and finds that the applicant has granted new easements to the impacted utilities and paid for the utilities to be relocated. The Director of Community Development has found no General Plan -related issues associated with this proposed action. Staff has posted notice at the location and a legal notice was published in the local newspaper. Therefore, staff recommends that City Council waive further reading and adopt Resolution No.05-101 abandoning a portion of a public utility easement located over 74769 and 74791 Sheryl Avenue, Tots 122 and 123 of the Country Club Village No. 1 subdivision. WHEREAS the City of Palm Desert has received a request for the abandonment of a portion of a public utility easement located over 74769 and 74791 Sheryl Avenue, lots 122 and 123 of the Country Club Village No. 1 subdivision; and WHEREAS the area is designated as a public utility easement on the subject map, filed with the Riverside County Recorder’s office in Book 40 on Pages 9 through 11; and WHEREAS the City Council initiated proceedings to abandon said public utility easement, and the City Council finds that notices of such closure were published and posted, as required by law; and th WHEREAS the City Council on the 10 day of November, 2005 held a public hearing as required by law, at which hearing all persons interested in or objecting to the proposed abandonment were heard, and said public hearing was duly and regularly closed; and WHEREAS the City Council considered such matter and finds from the evidence submitted that it justifiable and desirable to abandon said public utility easement, NOW, THEREFORE, BE IT RESOLVED that: 1. A portion of a public utility easement located over 74769 and 74791 Sheryl Avenue, lots 122 and 123 of the Country Club Village No. 1 subdivision shall be abandoned. 2. The City Clerk of the City of Palm Desert, California shall cause a certified copy of this resolution and order to be recorded in the Office of the County Recorder of Riverside County, California.
