Recommendation:
By minute motion, waive further reading and adopt Resolution No. 05-84 setting a public
hearing to consider the abandonment of an excess public utility easement.
Discussion:
The Pubic Works Department has received a request for the abandonment of a portion of a public
utility easement located over 74769 and 74791 Sheryl Avenue, lots 122 and 123 of the Country Club
Village No. 1 subdivision. The area is designated as a public utility easement on the subject map,
filed with the Riverside County Recorder's office in Book 40 on Pages 9 through 11.
Staff has reviewed the request and finds that the applicant has granted new easements to the
impacted utilities and paid for the utilities to be relocated. The Director of Community Development
has found no General Plan -related issues associated with this proposed action.
Therefore, staff requests and recommends that City Council waive further reading and adopt the
attached resolution setting a public hearing for November 10, 2005.

RESOLUTION NO. 05-84
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, INITIATING PROCEEDINGS TO ABANDON A
PORTION OF PUBLIC UTILITY EASEMENT AFFECTING LOTS 122 & 123,
DESCRIBED AS A PUBLIC UTILITY EASEMENT AS SHOWN ON THE
COUNTRY CLUB VILLAGE NO. 1 SUBDIVISION MAP UNDER
PROVISIONS OF PART 3, DIVISION 9, OF THE STREETS & HIGHWAYS
CODE, AND FIXING A TIME AND PLACE FOR HEARING ALL PERSONS
INTERESTED IN OR OBJECTING TO THE PROPOSED ABANDONMENT.
The City Council of the City of Palm Desert, California, does hereby DETERMINE,
ORDER, and RESOLVE as follows:
I
That it intends to, and by this resolution does, initiate proceeding under the
provisions of Part 3, Division 9, of the Streets and Highways Code, to abandon a portion
of that public utility easement affecting Lots 122 & 123 described as a public utility
easement as shown on the Country Club Village No. 1 Subdivision Map as filed in Book
40 of Maps, Pages 9 through 11, Official Records of Riverside County, California and

That the hour of 4:00 p.m. on the 10th day of November, 2005, in the Council
Chambers, 73-510 Fred Waring Drive, Palm Desert, California, is hereby fixed as the
time and place of hearing all persons interested in or objecting to the proposed vacation
of said street and

That the City Clerk is hereby directed to publish a notice of said hearing in the
Desert Sun, a newspaper of general circulation, circulated in the City of Palm Desert,
California, two (2) weeks before the date of the hearing, and the City officials of the City
of Palm Desert are hereby instructed to post notice of such vacation, as required by law,
at least two (2) weeks before the day set for the hearing.

Desert City Council held on this 13th day of October, 2005 by the following vote, to wit:
