Spencer Knight, Landscape Manager APPLICANT: Cora Constructors 74-885 Joni Drive Palm Desert, CA 92260 DATE: October 27, 2005 CONTENTS: Letter from Contractor Vicinity Map Recommendation: By minute motion, reduce the progress payment retention from ten to five percent for the construction of the new irrigation pump station for the well site at Civic Center Park. Executive Summary: Construction of the new Civic Center well pump project is over 90% complete. The contractor, Cora Constructors, has requested a reduction in the progress payment retention from ten to five percent as a result of delays in the progress of the project. These delays are due to City action and the action of those contracted by the City. The two significant changes are: - The City requested redesign of the pump house roof for aesthetic reasons. - The omission of the control system design and specifications for the new pump system by the design engineer. Both of these changes have and will require additional plans and specifications to be completed by the engineer, bid by the contractor and approved by the City Council — thus causing a significant delay in the completion of the project. At this time the contractor is cooperating with City staff in this delay. Contract No. C23090 Reduce Payment Retention on Civic Center Well Site Project Page 2 of 2 October 27, 2005 Both the Standard Specifications for Public Works Construction and the Public Contracts Code do allow for a reduction to five percent retention. Although somewhat unusual in Palm Desert, staff believes that a reduction in retention is appropriate in this situation. Therefore, staff recommends a reduction in the progress payment retention, from ten to five percent, for the Well Site at Civic Center Park, Project No. 720-01.
