SUBMITTED BY: Mark Greenwood, P.E., Director of Public Works DATE: April 13, 2006 CONTENTS: Agreement (2 Copies) Copy of Cover Letter Vicinity Map Recommendation: Authorize the Mayor to execute the Cost Distribution Agreement with the State of California Department of Transportation for maintenance of the Route 74 at Shadow Mountain Drive traffic signal. Discussion: The City of Palm Desert will be installing a traffic signal at the intersection of State Route 74 and Shadow Mountain Drive. Once the installation is completed, a cost -sharing agreement is required between the City of Palm Desert and the State of California for the maintenance and operation of the traffic signal. A Cost Distribution Agreement has been prepared and signed by the State of California. The agreement with the State outlines the responsibilities of each party for the costs to maintain and operate the traffic signal installation. A summary of the agreement is as follows: 1. Palm Desert will install the traffic signals and safety lighting on Route 74 at Shadow Mountain Drive. 2. Palm Desert will be responsible for 50% of the maintenance and electrical energy costs to operate the traffic signals and safety lighting. The State will be responsible for the remaining 50%. 3. The State will own and operate the traffic signal and lighting system and will pay 100% of the operating costs. Palm Desert will be responsible for 100°/0 of the costs to maintain, repair and replace the Emergency Vehicle Pre-emption System. 5. Palm Desert will be responsible for 100% of the costs to maintain, repair and replace the internally illuminated street name signs. Cost to the City is anticipated to be approximately $5,000.00 per year. Funding for the maintenance of the traffic signal and safety lighting system will come from Account No. 110- 4250-433-3325. The attached agreement has been signed by the State of California. After execution, one copy of the agreement will be returned to the State. The Encroachment Permit to construct the traffic signal will be issued by the State upon receipt of the executed agreement. Therefore, staff recommends that City Council, by minute motion, authorize the Mayor to execute the subject agreement. Submitted By: M Greenwood, P.E. Caltrans has received an application for an Encroachment Permit to install traffic signals and safety lighting on Route 74 at Shadow Mountain Drive in City of Palm Desert. We have prepared the enclosed Cost Distribution Agreement for Traffic Signals and Lighting. Please sign both copies of the enclosed Agreement. Keep one copy for City's records. Return one copy to me at the Caltrans Electrical Maintenance Office, 175 W. Cluster Street, San Bernardino, CA 92408. City and State agree to cost distribution stated below. Maintenance and Electrical Energy Costs Commencing upon construction and continuing until determined otherwise by mutual agreement, City of Palm Desert agrees to pay Caltrans for City's proportionate share of the ongoing monthly maintenance and electrical energy costs for the traffic signals and safety lighting at the intersection. City's share is 50% of maintenance and electrical energy costs. Caltrans will pay 50% of maintenance and electrical energy costs. Caltrans will own and operate the traffic signal and lighting system and pay 100% of the operating costs. Maintenance, Repair and Replacement of Emergency Vehicle Preemption System If installed, all costs for the maintenance, repair and replacement of an Emergency Vehicle Preemption System are the responsibility of City of Palm Desert. When necessary for repair or replacement, Caltrans will test, remove and reinstall Preemption System upon notification by City. Maintenance and Materials for Internally Illuminated Street Name Signs If installed, City of Palm Desert agrees to purchase all materials for installation and ongoing maintenance of the internally illuminated street name signs, including signs, sign panels and all hardware. Caltrans agrees to maintain the internally illuminated street name signs. Caltrans will notify City of Palm Desert when materials are required for repair and maintenance of the signs. At any time City of Palm Desert wishes to terminate this agreement, the signs will be replaced with signs of reflective sheeting.
