DEVELOPER'S APPLICATION AND REQUEST FOR REFUND OF AIPP FEES Recommendation: By Minute Motion, authorize the reimbursement of the Art in Public Places fee, in the amount of $10,043 for the Gateway project located at 34-220 and 34-500 Monterey Avenue. Funds are availabfe in Account No. 436-0000-312-2700. Executive Summary: At its meeting of November 16, 2005, the Art in Public Places Commission approved the proposed design by artist Heath Satow for the art component for the Gateway project located at Monterey Avenue and Dinah Shore. The art component has been completed and RJ Ventures, LLC is asking for a refund in the amount of $83,543.00. Council has approved the amount of $73,500.00 at its meeting of December 8, 2005; however, #he amount of $10,043 for the additional fee paid into the AIPP fund needs to be approved. Discussion: The site is dominated by the two massive power poles that face Monterey, making it prob(ematic for an artwork; however, the proposed sculptural entry sign is 32' long, 11' tall and 6'-8" deep, because of the scale of the artwork it could successfully compete with the power poles. The Right of Way agent for Southern California Edison has indicated to the developer that Edison would grant them an easement in its right of way for installation of the sculpture. The Art in Public Places Commission identified this location as one of the most r important sites in the City of Palm Desert for the placement of an entrance sign artwork. Currently, there is a Rancho Mirage entrance sign on the west side of Monterey and Dinah Shore, but nothing to indicate that the east side of Monterey and Dinah Shore is Palm Desert. The developer should be commended for willingly wanting to incorporate the name of Palm Desert into the design of the sculpture, as it is not a requirement of the public art guidelines.
