Recommendation:
That the City Council adopt the findings and adopt Resolution No. 06-120
approving PP 05-26, including building height exception, subject to conditions.
Executive Summary:
Promontory Development is requesting approval to construct a 86,000 square
foot, two-story medical and general office building with a height exception to
allow architectural projections up to 38'-10" high to provide variation in building
height and enhanced architecture. A two level parking structure is proposed at
the rear of the site. The office building generally has a height of 28'-8".
Architectural projections such as the lobby's clerestory vaulted roof, metal
canopies, metal trellises and louvered metal screen walls will have heights (33'-

4" to 38'-10") above the SI zone's 30-foot height limit.
On June 13, 2006, the Architectural Review Commission granted preliminary
approval (5-0-1-1 with Commissioner Vuksic abstaining and Commissioner
Hansen Absent). On August 1, 2006, the Planning Commission recommended
approval (5-0-0-0) to the City Council of the precise plan, including the height
exception. The Planning Commission thought the project's superior site plan
design and architecture justified granting a height exception.
Discussion:
I. BACKGROUND:
The 4.53-acre vacant site is located on the north side of Dinah Shore Drive east
of Gateway Drive. On April 6, 2004 the Planning Commission approved Precise
Plan 03-21 for 16 light industrial buildings with a total of 174,550 square feet on a
10.21-acre parcel to the south. Construction of these buildings is nearing
completion. On June 5, 2005 the City Council approved Precise Plan 04-33 to
allow four general office/warehouse buildings totaling 65,892 square feet for
Venture Corporation on a 4.53-acre parcel to the east. Construction of these
buildings is nearing completion. On June 23, 2005 the City Council approved
Precise Plan 05-02 for a 31,679 square foot industrial building for CMC White
Cap, a building materials retailer, on a 3.43-acre parcel to the west. Construction
of this building is nearing construction.
A. Adjacent Zoning and Land Use:
The property is zoned SI (Service Industrial) and is designated Industrial -
Business Park on the City's General Plan Land Use Map.

II. PROJECT DESCRIPTION:
The precise plan proposes the construction of an 86,000 square foot two-
story office building with a two -level parking structure in rear. The building will
be used for medical offices (32,500 square feet) and general professional

offices (53,500 square feet). Since the height limit in the SI zone is 30 feet,
the applicant is requesting approval of a height exception to allow
architectural projections at heights varying from 33'-4" to 38'-10". The purpose
of the height exception is to enhance the architectural design of the building
by allowing variation in roof height through architectural projections such as
towers, metal trellises, and louvered metal screen walls to shield roof -
mounted mechanical equipment. The majority of parking spaces in the rear
surface parking lot and on the parking structure's second level will have
carports with vaulted standing seam metal and tension fabric roofs.

Access to the site will be via two 40-foot wide shared access driveways
from Dinah Shore Drive located at the southwest and southeast corners of

the site. These driveways will lead directly to a surface parking lot and the
two -level parking structure in the rear. The primary entrance to the office
building will be from the north where the most of the off-street parking is
located. Secondary entrances are located on the east and west sides of
the building. The building is plotted on the site to create a minimum 20-
foot front yard landscaped setback along Dinah Shore Drive. The front
yard setback increases from 20 feet to 70 feet in the middle of the lot to
accommodate a garden that will be bordered on three sides by the
building. The garden and staggered front yard building setbacks will
enhance the site's appearance from Dinah Shore Drive. Employees will be
able to take breaks or have their lunch in the garden.
C. Architecture:
The Architectural Review Commission granted preliminary approval (5-0-
1-1) of the project on June 13, 2006.
The office building has a contemporary architectural style. The building
will have tilt -up concrete exterior walls with recessed windows on all four
sides that will be shaded by vaulted standing seam metal awning
canopies. The majority of the building's walls will be painted in five colors
ranging from beige and brown shades to terra cotta. Architectural
elements such as steel vault beams, metal trellises, decorative metal grille
frames, and louvered metal screen walls on the roof will be painted in five
shades of green, from light to dark green.
The building generally has a height of 28 feet. Some architectural
projections such as the lobby's clerestory vaulted roof, metal canopies,
metal trellises and louvered metal screen walls will have heights (33'-4" to
38'-10") above the SI zone's 30-foot height limit. While most of the
building will have a flat roof, the middle part of the building will have a 38'-
10" high, 20-foot wide by 110-foot long clerestory vaulted standing seam
metal roof painted in a copper color.
The building's four elevations will have 24 to 30-foot high columns. The
lower 10 feet of the columns will have a stone veneer finish. The upper
part of these columns will have a combination of plaster and metal
finishes.
The four elevations of the two -level parking structure will have 4'-6' x 19'-
6" rectangular pre -cast concrete panels attached to columns at a height of
13'-8". Most panels will have decorative cross -braced metal grillwork
patterns similar to those the shown on the office building's elevations
between the first and second floors. The middle area of the parking

structure's second level will have carports with 23'-6" high vaulted metal
seam roofs.
A 26'-4" high canopy (17'-6" x 15'-6") with vaulted standing seam metal
roof will be located over the pedestrian stairway in the middle of the
parking structure's south elevation. In addition to providing shade, the
canopy will provide an architectural design element on the parking
structure that is similar in design to the office building's vaulted standing
seam metal roof and metal window shade canopies. The perimeter of the
parking structure's second level will have 20'-7" high beige tension fabric
carport shade canopies.
III. ANALYSIS:
The project complies with SI zone development standards except for the heights
of some architectural projections, which require approval by the City Council.
The architectural projections and varied roofs heights enhance the design of the
building. The project as designed will result in an attractive architectural
appearance that will complement other buildings approved in the area.
Therefore, the findings for approving a precise plan can be affirmed. The
findings are included in the City Council resolution attached to this staff report.
IV. ENVIRONMENTAL REVIEW:
For purposes of CEQA, the Director of Community Development has determined
that the proposed project is a Class 32 categorical exemption per Section 15332
(In -fill Development Projects) of CEQA Guidelines and no further documentation
is necessary.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A PRECISE PLAN TO CONSTRUCT
A 86,000 SQUARE FOOT, TWO-STORY MEDICAL AND GENERAL
OFFICE BUILDING AND TWO -LEVEL PARKING STRUCTURE WITH A
HEIGHT EXCEPTION TO ALLOW ARCHITECTURAL PROJECTIONS UP
TO 38'-10" HIGH ON A 4.53-ACRE SITE LOCATED AT 73-650 DINAH
SHORE DRIVE.
CASE NO PP 05-26:
WHEREAS, the City Council of the City of Palm Desert, California, did on the 24th
day of August 24, 2006 hold a duly noticed public hearing to consider the request by
PROMONTORY DEVELOPMENT LLC for approval of the above noted; and
WHEREAS, the Planning Commission of the City of Palm Desert, California, by its
Resolution No. 2410 has recommended approval of Case No. PP 05-26; and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act",
Resolution No. 06-78, in that the Director of Community Development has determined
that the project is a Class 32 (In -fill Development Projects) Categorical Exemption; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said City Council
did find the following facts and reasons to exist to justify approval of the said request:
The precise plan is well designed with quality architecture.
2. The proposed location of the office/warehouse, as conditioned, is in
accord with the objectives and policies of the general plan and zoning
ordinance and the purpose of the district in which the site is located.
3. The proposed location of the office/warehouse and the conditions under
which it will be operated and maintained will not be detrimental to the
public health, safety or general welfare, or be materially injurious to
properties or improvements in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
That the above recitations are true and correct and constitute the findings of
the City Council case.
2. That Precise Plan 05-26 is hereby approved, subject to attached
conditions.

Department of Communitv Develooment:
The development of the property shall conform substantially with exhibits on file
with the Department of Community Development, as modified by the following
conditions.
2. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Coachella Valley Water District
Palm Desert Architectural Review Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall be presented
to the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Prior to the issuance of a building permit, the applicant shall submit a project site
plan to Waste Management of the Desert for approval of trash enclosure locations
and trash enclosure sizes and types. Trash enclosures shall be of a sufficient size
to allow for the collection of recyclable materials. A copy of written approval from
Waste Management of the Desert of trash/recycling enclosure locations shall be
submitted to the Community Development Department prior to the issuance of
building permits.
6. All future occupants of the buildings shall comply with off-street parking
requirements in Section 25.58 of the Zoning Ordinance.
7. Construction drawings shall include a detailed parking lot and exterior lighting plan
for the building that complies with the lighting standards in Chapter 24.16 of the
Palm Desert Municipal Code. The plan shall be prepared by a qualified lighting
engineer.

8. Final landscape plans shall comply with the City's Parking Lot and Tree Standards
per Ordinance 977 and Resolution 01-06.
9. Applicant agrees to maintain the landscaping required to be installed pursuant to
these conditions. Applicant will enter into an agreement to maintain said
landscaping for the life of the project, which agreement shall be notarized and
which agreement shall be recorded. It is the specific intent of the parties that this
condition and agreement run with the land and bind successors and assigns. The
final landscape plan shall include a long-term maintenance program specifying
among other matters appropriate watering times, fertilization and pruning for
various times of the year for the specific materials to be planted, as well as
periodic replacement of materials. All to be consistent with the Property
Maintenance Ordinance (Ordinance No. 801) and the approved landscape plan.
10. The project shall be subject to all applicable fees at time of issuance of building
permits including, but not limited to, Art in Public Places, TUMF, School Mitigation
and Housing Mitigation fees.
11. The project's setbacks shall conform to standards in Section 25.34 (Service
Industrial District) of the City's Zoning Ordinance.
12. All roof -mounted mechanical equipment shall be screened by a parapet / screen
wall around the perimeter of the building that is at least as high as the highest
piece of mechanical equipment, or as otherwise approved by the Architectural
Review Commission. Construction drawings submitted for plan check shall include
a roof plan showing locations of roof -mounted mechanical equipment and cross-
section drawings shall be provided for all proposed buildings showing parapet wall
heights and roof -mounted mechanical equipment.
13. Prior to the issuance of a building permit, the applicant shall submit a project site
plan to Waste Management of the Desert for approval of trash enclosure locations
and trash enclosure types. Waste Management of the Desert may require the
applicant to provide trash enclosures of a sufficient size to allow for the collection
of recyclable materials. A copy of written approval from Waste Management of the
Desert of trash/recycling container locations shall be submitted to the Planning
Department prior to the issuance of building permits.
Department of Public Works:
1. All landscape maintenance shall be performed by the property owner and the
applicant shall enter into a landscape maintenance agreement with the city for
the life of the project, consistent with the Property Maintenance Ordinance (Ord.
801) and the approved landscaped plan.

2. A complete preliminary soils investigation, conducted by a registered soils
engineer, shall be submitted to, and approved by, the Department of Public
Works prior to the issuance of a grading permit.
BONDS AND FEES
3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17
and 79-55, shall be paid prior to issuance of grading permit.
4. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF).
Payment of said fees shall be at the time of building permit issuance.
5. A standard inspection fee shall be paid prior to issuance of grading permits.
6. Project shall contribute proportionately to the lining of the channel/retention basin
providing drainage for PM 24255.
DESIGN REQUIREMENTS
7. Storm drain design and construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by the
Department of Public Works prior to start of construction.
8. Driveways, drainage and pad heights shall be designed to serve this project in
accordance with PM 24255.
9. Complete grading and improvement plans and specifications on electronic files
shall be submitted to the Director of Public Works for checking and approval
prior to issuance of any permits. Conveyance of storm water into rear
channel shall be by underground pipe. Wall along channel shall have extra -
depth footings.
10. Any and all offsite improvements shall be preceded by the approval of plans and
the issuance of valid encroachment permits by the Department of Public Works.
11. Pad elevations are subject to review and modification in accordance with
Chapter 26 of the Palm Desert Municipal Code and PM 24255
12. Landscape installation shall be drought tolerant in nature and in accordance with
the City's Water Efficient Landscape Ordinance (24.04).
13. Landscape plans shall be submitted for review concurrently with grading plans.
14. Full public improvements, as required by Section 26 of the Palm Desert
Municipal Code, shall be installed in accordance with applicable City standards
including:

• Deceleration lane required for westerly driveway on Dinah Shore Drive.
• 8' sidewalk, minimum 4' from back of curb, on Dinah Shore Drive.
Rights -of -way necessary for the installation of the above referenced
improvements shall be dedicated to the city prior to the issuance of any permits
associated with this project.
CONSTRUCTION REQUIREMENTS
15. All public improvements shall be inspected by the Department of Public Works
and a standard inspection fee shall be paid prior to issuance of grading permits.
No occupancy permit shall be granted until public improvements have been
completed.
16. All public and private improvements shall be inspected by the Public Works
Department.
17. Applicant shall comply with provisions of Palm Desert Municipal Code Section
24.12, Fugitive Dust Control as well as Section 24.20, Storm water Management
and Discharge Control.
18. Prior to the start of construction, the applicant shall submit satisfactory evidence
to the Director of Public Works of intended compliance with the National
Pollutant Discharge Elimination System (NPDES) General Construction Permit
for storm water discharges associated with construction. Developer must
contact Riverside County Flood Control District for informational materials.
SPECIAL CONDITIONS
19. Reciprocal access agreement required with adjoining property to the east and
west.
Riverside County Fire Marshal:
1. With respect to the conditions of approval regarding the above referenced
project, the fire department recommends the following fire protection measures
be provided in accordance with City Municipal Code, NFPA, UFC, and UBC or
any recognized Fire Protection Standards:
The Fire Department is required to set a minimum fire flow for the remodel or
construction of all buildings per UFC article 87.
2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual pressure must be
available before any combustible material is placed on the job site.

3. Provide or show there exists a water system capable of providing a gpm flow of:
3000 gpm.
4. The required fire flow shall be available from a wet barrel Super Hydrant(s)
4"x2"-1/2" x2-1/2", located not less than 25 feet nor more than:
150' from any portion of a commercial building measured via vehicular travelway.
5. Water Plans must be approved by the Fire Marshal and include verification that
the water system will produce the required fire flow.
6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings
with a 3000 square foot total cumulative floor area. The Fire Marshal shall
approve the locations of all post indicator valves and fire department
connections. All valves and connections shall not be less than 25 feet from the
building and within 50 feet of an approved hydrant. Exempted are one and two
family dwellings.
7. All building shall be accessible by an all-weather roadway extending to within
150 feet of all portions of the exterior walls of the first story. The roadway shall
not be less than 24 feet of unobstructed width and 13'6" of vertical clearance.
Where parallel parking is required on both sides of the street the roadway must
be 36 feet wide, and 32 feet wide with parking on one side. Dead-end roads in
excess of 150 feet shall be provided with a minimum 45-foot radius turn -around,
55 foot in industrial developments.
8. Whenever access into private property is controlled through use of gates,
barriers or other means, provisions shall be made to install a "Knox Box" key or
over -ride system to allow for emergency vehicle access. Minimum gate width
shall be 16' with a minimum vertical clearance of 13'-6".
9. All dead end single access over 500 feet will require a secondary access,
sprinklers or other mitigative measures approved by the Fire Marshal. Under no
circumstances shall a dead end over 1300 feet be accepted.
10. A second access is required. This can be accomplished by two main access
points from a main roadway or an emergency gate from an adjoining
development.
11. All buildings shall have illuminated addresses of the size approved by the City.
12. Conditions subject to change with adoption of new codes, ordinances, laws, or
when building permits are not obtained with twelve months.
13. All elevators shall be minimum gurney size.

14. The applicant shall submit information to the Fire Department to verify what
commodities will be in storage so that it can be determined what density
sprinklers will be required.

Chamber at the Palm Desert Civic Center, 73-510 Fred Waring Drive, Palm Dese�t,

heard. Written comments conceming all items covered by this public hearing notice shall
be accepted up to the date of the hearing. Information conceming the proposed project
and/or negative declaration is available for review in the Department of Community

It was moved by Commissioner Campbe{{, seconded by Commissioner
Finerty, adopting Planning Commission Resolution No. 2409, approving
Case No. TPM 34898, subject to conditions. Motion carried 5-0.

to 34 feet 6 inches on a 4.53-acre site located at 73-650 Dinah
Shore Drive.
Mr. Urbina reviewed the staff report and recommended that Planning
Commission recommend to City Council approval of Case No. PP 05-26 with
the height exception, subject to the conditions.
Commissioner Campbell noted that the site grade falls five feet from the
beginning of Dinah Shore, so even though the building would be 38 feet with
the exception, the view would be five feet less. Mr. Urbina said that was
correct. The Mid Valley Storm Channel is located at the north end of the site.
Per a request for clarification by Commissioner Tschopp, Mr. Urbina showed
the Commission the east and west views. Mr. Drell stated that in reality the
middle structure would not be seen as prominently since it was such a
distance from the edge and may not be seen at all. Commissioner Tanner
said it would be seen from drivers along Interstate 10. Mr. Drell said that was
correct. It would be seen from a distance and from the front. They wou{d see
the narrow section from the front.
Chairperson Lopez o�ened the public hearing and asked the applicant to
address the Commission.
MR. JOHN HOLT of Holt Architects came forward. He stated that he
was representing Elliott Lander and Promitory Pointe LLP. He handed
out some detailed renderings of the building for the Commission to
review. Using a power point presentation, he showed various
elevations and views. He said the building was designed so that the
central areas regress away. He also said that the sign shown was not
included in this application. That would be reviewed at a different
time. He indicated that the difference between the parking lot on the

Chairperson Lopez complimented Mr. Holt on the great renderings. He asked
if anyone wished to address the Commission in FAVOR or OPPOSITION to
the proposed project. There was no one and the public hearing was closed.
Chairperson Lopez asked for Commission comments or action.
Commissioner Finerty stated that this was great architecture for the Service
Industrial zone and she really appreciated the quality work and moved for
approval.
Commissioner Campbell agreed. She thought it was outstanding architecture
and liked that the parking was on the north side and not facing the south
side. She seconded the motion.
Commissioner Tanner thought this was a great job and the type of
architecture wanted in the north sphere. He congratulated the applicant and
Holt Architects for putting together a great building. He said it was a job well
done.
Commissioner Tschopp said they were going to give Service Industrial a
good name. Chairperson Lopez concurred and called for the vote.
Action:
It was moved by Commissioner Finerty, seconded by Commissioner
Campbell, approving the findings as presented by staff. Motion carried 5-0.

WHEREAS, the Planning Commission of the City of Palm Desert, Califomia, did
on the 1 st day of August, 2006, hold a duly noticed public hearing, to consider a request
by ELLIOT LANDER for the above mentioned; and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the Califomia Environmental Quality Act,
Resolution No. 06-78," in that the Director of Community Development in that the Director
of Community Development has determined that the project is a Class 32 (In-fill
Development Projects) Categorical Exemption; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and

CONDITIONS OF APPROVAL
CASE NO. PP 05-26
Department of Community Development:
1. The development of the property shall conform substantially with exhibits on file
with the Department of Community Development, as mod�ed by the following
conditions.
2. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to afl municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the appticant shall first obtain permits and/or clearance from the
following agencies: -

Palm Desert Architectural Review Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance fcom the above agencies shall be presented
to the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Prior to the issuance of a building permit, the applicant shall submit a project site
plan to Waste Management of the Desert for approval of trash enclosure locations
and trash enc{osure sizes and types. Trash enclosures shall be of a sufficient size
to allow for the collection of recyclable materials. A copy of written approva{ from
Waste Management of the Desert of trash/recycling encfosure locations shalt be
submitted to the Community Development Department prior to the issuance of
building permits.
6. All future occupants of the buildings shall comply with off-street parking
requirements in Section 25.58 of the Zoning Ordinance.
7. Construction drawings shall include a detailed parking lot and exterior lighting plan
for the bui{ding that complies with the lighting standards in Chapter 24.16 of the

Palm Desert Municipal Code. The plan shali be prepared by a qualified lighting
engineer.
8. Final landscape plans shall comply with the City's Parking Lot and Tree Standards
per Ordinance 977 and Resolution 01-06.
9. Applicant agrees to maintain the landscaping required to be installed pursuant to
these conditions. Applicant will enter into an agreement to maintain said
landscaping for the life of the proje�t, which agreement shall be notarized and
which agreement shall be recorded. It is the specfic intent of the parties that this
condition and agreement run with the land and bind successors a�d assigns. The
final landscape plan shall include a long-term maintenance program specifying
among other matters appropriate watering times, fertilization and pruning for
various times of the year for the specific materials to be planted, as well as
periodic replacement of materials. All to be consistent with the Property
Maintenance Ordinance (Ordinance No. 801) and the approved landscape plan.
10. The project shall be subject to a11 app{icable fees at time of issuance of building
permits including, but not limited to, Art in Public Places, TUMF, School Mitigation
and Housing Mitigation fees.
11. The project's setbacks shall conform to standards in Section 25.34 (Service
Industrial District) of the City's Zoning Ordinance.
12. All roof-mounted mechanical equipment shall be screened by a parapet / screen
wall around the perimeter of the building that is at least as high as the highest
piece of inechanical equipment, or as otherwise approved by the Architectural
Review Commission. Construction drawings submitted for plan check shafl include
a roof plan showing locations of roof-mounted mechanical equipment and cross-
section drawings shall be provided for all proposed buildings showing parapet wall
heights and roof-mounted mechanical equipment.
13. Prior to the issuance of a building permit, the applicant shall submit a project site
plan to Waste Management of the Desert for approval of trash enclosure locations
and trash enclosure types. Waste Management of the Desert may require the
applicant to provide trash enclosures of a sufficient size to allow for the collection
of recyclable materials. A copy of written approval from Waste Management of the
Desert of trash/recycling container locations shall be submitted to the Planning
Department prior to the issuance of building permits.
Deaartment of Public Works:
All landscape maintenance sha{{ be performed by the property owner and the
applicant shall enter into a landscape maintenance agreement with the city for

the life of the project, consistent with the Property Maintenance Ordinance (Ord.
801) and the approved landscaped plan.
2. A complete preliminary soils investigation, conducted by a registered soils
engineer, shall be submitted to, and approved by, the Department of Pub�ic
Works prior to the issuance of a grading permit.
BONDS AND FEES
3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17
and 79-55, shall be paid prior to issuance of grading permit.
4. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF).
Payment of said fees shall be at the time of building permit issuance.
5. A standard inspection fee shall be paid prior to issuance of grading permits.
6. Project shall contribute proportionately to the lining of the channel/retention basin
providing drainage for PM 24255.
DESIGN REQUIREMENTS
7. Storm drain design and construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by the
Department of Public Works prior to start of construction.
8. Driveways, drainage and pad heights shall be designed to serve this project in
accordance with PM 24255.
9. Complete grading and improvement plans and specifications on electronic files
shall be submitted to the Director of Public Worics for checking and approval
prior to issuance of any permits. Conveyance of storm water into rear
channel shall be by underground pipe. Wall along channel shall have extra-
depth footings.
10. Any and all offsite improvements shall be preceded by the approval of plans and
the issuance of valid encroachment permits by the Department of Public Works.
11. Pad elevations are subje�t to review and modification in accordance with
Chapter 26 of the Palm Desert Municipal Code and PM 24255
12. Landscape installation shall be drought tolerant in nature and in accordance with
the City's Water Efficient Landscape Ordinance (24.04).
13. Landscape pfans shall be submitted for review concurrently with grading plans.

14. Full public improvements, as required by Section 26 of the Palm Desert
Municipai Code, shall be installed in accordance with applicable City standards
including:
• Deceleration lane required for westerly driveway on Dinah Shore Drive.
• 8' sidewalk, minimum 4' from back of curb, on Dinah Shore Drive.
Rights-of-way necessary for the installation of the above referenced
improvements shall be dedicated to the city prior to the issuance of any permits
associated with this project.
CONSTRUCTION REQUIREMENTS
15. All public improvements shall be inspected by the Department of Public Works
and a standard inspection fee shall be paid prior to issuance of grading permits.
No occupancy permit shall be granted until public improvements have been
completed.
16. All public and private improvements shall be inspected by the Public Works
Department.
17. Applicant shall comply with provisions of Palm Desert Municipal Code Section
24.12, Fugitive Dust Control as well as Section 24.20, Storm water Management
and Discharge Control.
18. Prior to the start of construction, the applicant shall submit satisfactory evidence
to the Direetor of Public Works of intended compliance with the National
Pollutant Discharge Elimination System (NPDES) General Construction Permit
for storm water discharges associated with construction. Developer must
contact Riverside County Flood Control District for informational materials.
SPECIAL CONDITIONS
19. Reciprocal access agreement required with adjoining property to the east and
west.
Riverside Countv Fire Marshal:
1. With respect to the conditions of approval regarding the above referenced
project, the fire department recommends the following fire protection measures
be provided in accordance with City Municipal Code, NFPA, UFC, and UBC or
any recognized Fire Protection Standards:
The Fire Department is required to set a minimum fire flow for the remodel or
construction of all buildings per UFC article 87.

2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual pressure must be
available before any combustible material is placed on the job site.
3. Provide or show there exists a water system capable of providing a gpm flow of:
3000 gpm.
4. The required fire f{ow shall be available from a wet barrel Super Hydrant(s)
4°x2"-1/2" x2-112", located not less than 25 feet nor more than:
150' from any portion of a commercial building measured via vehicular travelway.
5. Water Plans must be approved by the Fire Marshal and include verification that
the water system will produce the required fire flow.
6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings
with a 3000 square foot total cumulative floor area. The Fire Marshal shaN
approve the locations of all post indicator valves and fire department
connections. All valves and connections shall not be less than 25 feet from the
building and within 50 feet of an approved hydrant. Exempted are one and two
family dwellings.
7. All building shall be accessible by an all-weather roadway extending to within
150 feet of alf portions of the exterior walls of the first story. The roadway shall
not be less than 24 feet of unobstructed width and 13'6" of vertical clearance.
Where parallel parking is required on both sides of the street the roadway must
be 36 feet wide, and 32 feet wide with parking on one side. Dead-end roads in
excess of 150 feet shall be provided with a minimum 45-foot radius turn-around,
55 foot in industrial developments.
8. Whenever access into private property is controlled through use of gates,
barriers or othe� means, provisions shall be made to install a"Knox Box" key or
over-ride system to allow for emergency vehicle access. Minimum gate width
shall be 16' with a minimum vertical clearance of 13'-6".
9. All dead end single access over 500 feet will require a secondary access,
sprinklers or other mitigative measures approved by the Fire Marshal. Under no
circumstances shall a dead end over 1300 feet be accepted.
10. A second access is required. This can be accomplished by finro main access
points from a main roadway or an emergency gate from an adjoining
development.
11. All buildings sha{I have illuminated addresses of the size approved by the City.

12. Conditions subject to change with adoption of new codes, ordinances, laws, or
when building permits are not obtained with twelve months.
13. All elevators shall be minimum gurney size.
14. The applicant shall submit information to the Fire Department to verify what
commodities will be in storage so that it can be determined what density
sprinklers will be required.

I. BACKGROUND:
The 4.53-acre vacant site is located on the north side of Dinah Shore Drive east of
Gateway Drive. From the southerly boundary on Dinah Shore Drive to the northerly
boundary, the site's grade falls five feet over a distance of 473 feet. From west to east,
the site falls two feet over a distance of 417 feet.
The property is zoned SI (service Industriaf) and is designated Industrial-Business Park
on the City's General Plan Land Use Map.
On April 6, 2004 the Planning Commission approved Precise Plan 03-21 for 16 light
industrial buildings with a total of 174,550 square feet on a 10.21-acre parcel to the
south. Construction of these buildings is nearing completion. On June 5, 2005 the City
Council approved Precise Plan 04-33 to allow four general office/warehouse buildings
totaling 65,892 square feet for Venture Corporation on a 4.53-acre parcel to the east.
Construction of these buildings is nearing completion. On June 23, 2005 the City
Council approved Precise P1an 05-02 for a 31,679 square foot industrial building for
CMC White Cap, a building materials retailer, on a 3.43-acre parcel to the west.
Construction of this building is nearing construction.

II. PROJECT DESCRIPTION:
The precise plan proposes the construction of an 86,000 square foot two-story office
building with a two-levef parking structure in rear. The building will be used for medical
offices (32,500 square feet) and general professional offices (53,500 square feet). Since
the height limit in the SI zone is 30 feet, the applicant is requesting approval of a height
exception to allow architecturaf projections at heights varying from 33'-4" to 38'-10". The
purpose of the height exception is to allow variation in roof height, to accommodate
architectural projections such as towers and metat trellises, to allow louvered metal
screen walls to shield roof-mounted mechanical equipment, and to provide more
appealing architecture on site visible from Dinah Shore Drive and the Interstate 10
Freeway.

Access to the site will be via finro 40-foot wide shared access driveways from
Dinah Shore Drive located at the southwest and southeast corners of the site.
These driveways will lead directly to a surface parking lot and the two-level
parking structure in the rear. The primary entrance to the office building will be
from the north where the most of the off-street parking is located. Secondary
entrances are located on the east and west sides of the building. The building is
plotted on the site to create a minimum 20-foot front yard landscaped setback
along Dinah Shore Drive. The front yard setback increases from 20 feet to 70
feet in the middle of the lot to accommodate a garden that wiil be bordered on
three sides by the building. The garden and staggered front yard building
setbacks will enhance the site's appearance from Dinah Shore Drive.
Employees will be able to take breaks or have their lunch in the garden.
Architecture:
The Architectural Review Commission granted preliminary approval (5-0-1-1) of
the project on June 13, 2006.
The office building has a contemporary architectural style. The building will
have tilt-up concrete exterior walls with recessed windows on all four sides that
will be shaded by vaulted standing seam metal awning canopies. The majority
of the building's walls will be painted in five colors ranging from beige and
brown shades to terra cotta. Architectural elements such as steel vault beams,
metal trellises, decorative metal grille frames, and louvered metal screen walls
on the roof will be painted in five shades of green, from light to dark green.
The building generally has a height of 28 feet. Some architectural projections
such as the lobby's clerestory vaulted roof, metal canopies, metal trel{ises and
louvered metal screen walls will have heights (33'-4" to 38'-10") above the SI
zone's 30-foot height limit. Whi{e most of the buifding will have a flat roof, the

middle part of the building will have a 38'-10" high, 20-foot wide by 110-foot
long clerestory vaulted standing seam metal roof painted in a copper color.
The building's four elevations will have 24 to 30-foot high columns. The lower
10 feet of the co{umns will have a stone veneer finish. The upper part of these
columns will have a combination of plaster and metal finishes.
The four elevations of the two-level parking structure will have 7' x 27'
rectangular pre-cast concrete panels attached to cotumns at a height of 13'-10".
The middle part of most panels will have decorative rectangles framed by
scoring lines. The middle of other panels will have design patterns similar to the
cross-braced metal grillwork shown on the office building's elevations between
the first and second floors. The middle area of the parking structure's second
level will have carports with metal seam roofs and metal trellises. These
carports have heights varying from 21'-8" to 24'-S".
A 28-foot high canopy (28' x 48') with vaulted standing seam metal roof will be
located in the middle of the parking structure's second level. In addition to
providing shade, another purpose of this canopy is to provide an architectural
design element on the parking structure that is similar in design to the office
building's vaulted standing seam metal roof and metal window shade canopies.
The perimeter of the parking structure's second level will have beige tension
fabric shade canopies at heights of 25'-6".

ANALYSIS:
The project complies with SI zone development standards except for the heights of
some architectural projections, which require approval by the City Council. The
architectural projections and varied roofs heights enhance the design of the building.
The project as designed wil! result in an attractive architectural appearance that will
complement other buildings approved in the area. Therefore, the findings for
approving a precise plan can be affirmed. These findings are included in the draft
Planning Commission resolution attached to this staff report.

CONDITIONS OF APPROVAL

Department of Communitv Development:
1. The deve{opment of the property shall conform substantially with exhibits on file
with the Department of Community Development, as modified by the following
conditions.
2. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Coachella Valley Water District
Palm Desert Architectural Review Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall be presented
to the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Prior to the issuance of a building permit, the applicant shall submit a project site
plan to Waste Management of the Desert for approval of trash enclosure locations
and trash enclosure sizes and types. Trash enclosures shall be of a sufficient size
to altow for the collection of recyclable materials. A copy of written approval from
Waste Management of the Desert of trash/recycling enclosure locations shall be
submitted to the Community Development Department prior to the issuance of
building permits.
6. All future occupants of the buildings shall comply with off-street parking
requirements in Section 25.58 of the Zoning Ordinance.
7. Construction drawings shall include a detailed parking lot and exterior lighting plan
for the building that complies with the lighting standards in Chapter 24.16 of the

Palm Desert Municipal Code. The plan shall be prepared by a qualified lighting
engineer.
8. Final landscape plans shall comply with the City's Parking Lot and Tree Standards
per Ordinance 977 and Resolution 01-06.
9. Applicant agrees to maintain the landscaping required to be installed pursuant to
these conditions. Applicant will enter into an agreement to maintain said
landscaping for the life of the project, which agreement shall be notarized and
which agreement shall be recorded. It is the specific intent of the parties that this
condition and agreement run with the land and bind successors and assigns. The
final landscape plan shall include a long-term maintenance program specifying
among other matters appropriate watering times, fertilization and pruning for
various times of the year for the specific materials to be planted, as well as
periodic replacement of materials. All to be consistent with the Property
Maintenance Ordinance (Ordinance No. 801) and the approved landscape plan.
10. The project shall be subject to all applicable fees at time of issuance of building
permits including, but not limited to, Art in Public Places, TUMF, School Mitigation
and Housing Mitigation fees.
11. The project's setbacks shall conform to standards in Section 25.34 (Service
Industrial District) of the City's Zoning Ordinance.
12. All roof-mounted mechanical equipment shall be screened by a parapet / screen
wall around the perimeter of the building that is at least as high as the highest
piece of inechanical equipment, or as otherwise approved by the Architectural
Review Commission. Construction drawings submitted for plan check sha11 include
a roof plan showing locations of roof-mounted mechanical equipment and cross-
section drawings shall be provided for all proposed buildings showing parapet wall
heights and roof-mounted mechanical equipment.
13. Prior to the issuance of a building permit, the applicant shall submit a project site
plan to Waste Management of the Desert for approval of trash enclosure locations
and trash enclosure types. Waste Management of the Desert may require the
applicant to provide trash enclosures of a sufficient size to allow for the collection
of recyclable materials. A copy of written approval from Waste Management of the
Desert of trash/recycling container locations shall be submitted to the Planning
Department prior to the issuance of building permits.
Department of Public Works:
1. All landscape maintenance shall be performed by the property owner and the
applicant shall enter into a iandscape maintenance agreement with the city for

the life of the project, consistent with the Property Maintenance Ordinance (Ord.
801) and the approved landscaped plan.
2. A complete preliminary soils investigation, conducted by a registered soils
engineer, shall be submitted to, and approved by, the Department of Public
Works prior to the issuance of a grading permit.
BONDS AND FEES
3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17
and 79-55, shall be paid prior to issuance of grading permit. .
4. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF).
Payment of said fees shall be at the time of building permit issuance.
5. A standard inspection fee shall be paid prior to issuance of grading permits.
6. Project shalf contribute proportionately to the fining of the channeUretention basin
providing drainage for PM 24255.
DESIGN REQUIREMENTS
7. Storm drain design and construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by the
Department of Public Works prior to start of construction.
8. Driveways, drainage and pad heights shall be designed to serve this project in
accordance with PM 24255.
9. Complete grading and improvement plans and specifications on electronic files
shall be submitted to the Director of Public Works for checking and approval
prior to issuance of any permits. Conveyance of storm water into rear
channel shall be by underground pipe. Wall along channel shall have extra-
depth footings.
10. Any and all offsite improvements shall be preceded by the approval of plans and
the issuance of valid encroachment permits by the Department of Public Works.
11. Pad elevations are subject to review and modification in accordance with
Chapter 26 of the Palm Desert Municipal Code and PM 24255
12. Landscape installation shall be drought tolerant in nature and in accordance with
the City _ s Water Efficient Landscape Ordinance (24.04).
13. Landscape plans shall be submitted for review concurrently with grading plans.

14. Full public improvements, as required by Section 26 of the Palm Desert
Municipal Code, shall be installed in accordance with applicable City standards
including:
• Deceleration lane required for westerly driveway on Dinah Shore Drive.
• 8' sidewalk, minimum 4' from back of curb, on Dinah Shore Drive.
Rights-of-way necessary for the installation of the above referenced
improvements shall be dedicated to the city prior to the issuance of any permits
associated with this project.
CONSTRUCTION REQUIREMENTS
15. All public improvements shall be inspected by the Department of Public Works
and a standard inspection fee shall be paid prior to issuance of grading permits.
No occupancy permit shall be granted until public improvements have been
completed.
16. All public and private improvements shall be inspected by the Public Works
Department.
17. Applicant shall comply with provisions of Palm Desert Municipal Code Section
24.12, Fugitive Dust Control as well as Section 24.20, Storm water Management
and Discharge Control.
18. Prior to the start of construction, the applicant shall submit satisfactory evidence
to the Director of Public Works of intended compliance with the National
Pollutant Discharge Elimination System (NPDES) General Construction Permit
for storm water discharges associated with construction. Developer must
contact Riverside County Flood Control District for informational materials.
SPECIAL CONDITIONS
19. Reciprocal access agreement required with adjoining property to the east and
west.

With respect to the conditions of approval regarding the above referenced
project, the fire department recommends the following fire protection measures
be provided in accordance with City Municipal Code, NFPA, UFC, and UBC or
any recognized Fire Protection Standards:

The Fire Department is required to set a minimum fire flow for the remodel or
construction of all buildings per UFC article 87.
2. A fire flow of 1500 gpm for a 1-hour duration at 20 psi residual pressure must be
available before any combustible materiaf is placed on the job site.
3. Provide or show there exists a water system capable of providing a gpm flow of:
3000 gpm.
4. The required fire flow shall be available from a wet barrel Super Hydrant(s)
4°x2"-1/2" x2-1/2", located not less than 25 feet nor more than:
150' from any portion of a commercial building measured via vehicular travelway.
5. Water Plans must be approved by the Fire Marshal and include verification that
the water system will produce the required fire flow.
6. Install a complete NFPA 13 fire sprinkler system. This applies to all buildings
with a 3000 square foot total cumulative floor area. The Fire Marshal shall
approve the locations of all post indicator valves and fire department
connections. All valves and connections shall not be less than 25 feet from the
building and within 50 feet of an approved hydrant. Exempted are one and two
family dwellings.
7. All building shall be accessible by an all-weather roadway extending to within
150 feet of all portions of the exterior walls of the first story. The roadway shall
not be less than 24 feet of unobstructed width and 13'6" of vertical clearance.
Where parallel parking is required on both sides of the street the roadway must
be 36 feet wide, and 32 feet wide with parking on one side. Dead-end roads in
excess of 150 feet shall be provided with a minimum 45-foot radius turn-around,
55 foot in industrial developments.
8. Whenever access into private property is controlled through use of gates,
barriers or other means, provisions shall be made to install a"Knox Box" key or
over-ride system to allow for emergency vehicle access. Minimum gate width
shall be 16' with a minimum vertical clearance of 13'-6".
9. All dead end single access over 500 feet will require a secondary access,
sprinklers or other mitigative measures approved by the Fire Marshal. Under no
circumstances shall a dead end over 1300 feet be accepted.
10. A second access is required. This can be accomplished by two main access
points from a main roadway or an emergency gate from an adjoining
development.
11. All buildings shall have illuminated addresses of the size approved by the City.

12. Conditions subject to change with adoption of new codes, ordinances, laws, or
when building permits are not obtained with twelve months.

Mr. Smith outlined the proposed addition of five units to the 44-unit Vill e
Park complex. He stated that the project needed a change of e to
increase the density from seven to eight units per acre.
The project was a two-story, 24-foot high de contemporary
architectural style. The three westerly units connec the existing units to
the west and take their access from the north. e easterly two (2) units
would share a new driveway access from M nesia Falls Drive.
Commission reviewed the plans a iked the architectural concept, but
felt that the plans needed to ow additional detail to be complete.
Commission requested rail' and wail thickness details, as well as a

preliminary approval of revised elevations for a new two-story
office building totaling 86,000 square feet with a two-level parking
structure.

Mr. Urbina presented the revised building elevations that were prepared
by the new architect, Tim Holt of Holt Architecture. All windows would
have a vaulted standing seam metal roof shade canopy. The lower half of
support columns at bui{ding entrances would have cultured stone veneer
with ledgestone. The revised elevations showed decorative metal grille
frames between the first and second floors. Most of the building had

heights ranging from 29 feet to 30 feet. The height limit in the SI zone is
30 feet and the applicant was requesting a height exception to allow some
parts of the buiiding to exceerJ 30 feet up to a maximum height of 38'-10"
for the cferestory architectural element in the middle of the building with
vau{ted standing metai seam roof. Roof-mounted mechanical equipment
would be screened by metal louvered screen walls at a height of 33'-0".
Mr. Holt stated that on the revised site plan all of the off-street parking had
been moved to the rear of the site. The building's main entrance had also
been moved to the rear (north) elevation. A garden was created in the
front of the building. The building's revised front etevation incorporated
several off-sets and metal shade canopies over the windows improving
the bui{ding's appearance from Dinah Shore Drive. Exterior building walls
would consist of tilt-up concrete panels painted in five shades of colors
ranging from beige to rust brown. Metal architectural elements on exterior
walls such as steel beam tre{lises, steel vault beams, decorative metal
grille frames, and screen walls for roof-mounted mechanical equipment
would be painted in four shades of green, ranging from light green to dark
green. Mr. Holt stated that there would not be any signs on the two-fevel
parking structure.
Members of the Commission stated that the revised building elevations
were a substantial improvement over the previous elevations they
reviewed.
Action:
!t was moved by Commissioner Lambell, seconded by Commissioner
Oppenheim, granting preliminary approval of revised plans for Case No.
PP 05-2. Motion carried 5-0-1-1 with Commissioner Vuksic abstaining and
Commissioner Hanson absent.
