Funds are available for this project in account number 240-4650-454-3372 Executive Summary: Desert Dessert is located in the Civic Center Park and was the City's first piece of art for the City's public art program. It is currently in need of restoration. Background: Staff published a legal notice inviting bids for the restoration of Desert Dessert and received two proposals. Staff also notified Maaco, Cathedral City and Sculpture Conservation Studio, Los Angeles but no bids were received. 1. Michael Volpone, Cathedral City, California, in the amount of $17,000. 2. Conservation Studios, Washington, DC in the amount of $49,233. Communi Approval: Carlos Orte' -, City Manager Paul §on, Dir of Finance Michael Volpone jculpture installation/ Maintenance 39192 gel Air Drive, Cathedral City, CA 92234 760-324-+106 cell 760-z 19-1347 E,-mail: volponesilver@aol.com PROJECT BID November 16, 2006 TO: Debbie Thompson Public Arts Technician City of Palm Desert Project: Restoration of Desert Dessert an artwork in the City of Palm Desert's Public Art Collection at Civic Center Park • Restoration will consist of removing all rust & oxidized paint. • Paint with automobile paint to match existing colors of black, teal green, light blue and light pink • Final finish will be clear coat of auto paint to inhibit fading • I will be responsible for all expenses for materials, rentals and supplies • I will carry all insurances and licenses required by the city of Palm Desert • Fencing will be set up around work area during restoration period • All debris and equipment will be removed at completion of project Total for paint, supplies, rentals and labor $17,000 CITY OF PALM DESERT NOTICE INVITING REQUEST FOR PROPOSALS FOR RESTORATION OF DESERT DESSERT AN ARTWORK IN THE CITY OF PALM DESERT'S PUBLIC ART COLLECTION PUBLIC NOTICE IS HEREBY GIVEN that the City of Palm Desert, as Agency, invites Request for Proposals for restoration of Desert Dessert, an artwork in the City of Palm Desert's Public Art Collection and will receive bids in the office of the City Clerk up to the hour of 4:30 p.m. on Friday, the 17th of November 2006. DESCRIPTION OF DESERT DESSERT. Desert Dessert is a geometric metal sculpture that consists of several large pieces. It is twenty feet high by sixty-four feet long. It is located in the Civic Center Park facing the parking lot off of San Pablo Avenue near Fred Waring Drive. SCOPE OF WORK: Desert Dessert is in need of complete restoration. • There is corrosion that will need to be removed before painting. • Repainted its current colors of black, teal green, light blue, and light pink using fade resistant paint. INSURANCE REQUIREMENTS: Prior to the beginning of and throughout the duration of the work, Contractor will maintain insurance with the requirements set forth below. Contractor will use existing coverage to comply with these requirements. If that existing coverage does not meet the requirements set forth here, it will be amended to do so. Contractor acknowledges that the insurance coverage and policy limits set forth in this section constitute the minimum amount of coverage required. Any insurance proceeds available to City in excess of the limits and coverage required in this agreement and which is applicable to a given loss, will be available to the City. Contractor shall provide the following types and amounts of insurance. Commercial General Liabilitv Insurance. A policy of commercial general liability insurance written on a per occurrence basis with a combined single limit of at least $1,000,000 bodily injury and property damage including coverages for contractual liability, personal injury, independent contractors, broad from property damage, products and completed operations. The General Liability Policy shall name the City of Palm Desert as an additional insured in accordance with standard ISO additional insured endorsement form CG2010(1185) or equivalent language. Worker's Compensation Insurance. A policy of worker's compensation insurance in such amount as will fully comply with the laws of the State of California and which will include $1,000,000 employer's liability. Business Automobile Insurance. A policy of business automobile liability insurance written on a per occurrence basis with single limit ability in the amount of $1,000,000 bodily injury and property damage. Said policy shall include coverage of owned, nonowned, leased, and rented cars. Additional Insurance. Policies of such other insurance, including professional liability insurance in a minimal amount of $1,000,000 if contract has professional liability exposure, as may be required in the Special Requirements. All of the above policies of insurance shall be primary insurance and shall name the City, its officers, employees, and agents as additional insured. The insurer shall waive all rights of subrogation and contribution it may have against the City, its officers, employees and agents, and their respective insurers. In the event any of said policies of insurance are cancelled, the Contractor shall, prior to the cancellation date, submit new evidence of insurance in conformance with this Section 4.1 to the Contract Officer. No work or services under this Agreement shall commence until the Contractor has provided the City with Certificates of Insurance or appropriate insurance binders evidencing the above insurance coverages and said Certificates of Insurance or binders are approved by the City. TERM: Termination Prior to Expiration of Term. Either party may terminate this Agreement at any time, with or without cause, upon thirty (30) days' written notice to the' other party. Upon receipt of the notice of termination, the Contractor shall immediately cease all work or services hereunder except as may be specifically approved by the Public Arts Manager. In the event of termination by the City, Contractor shall be entitled to compensation for all services rendered prior to the effectiveness of the notice of termination and for such additional services specifically authorized by the Public Arts Manager and City shall be entitled to reimbursement for any compensation paid in excess of the services rendered. LICENSES: Licenses, Permits, Fees, and Assessments. Contractor shall obtain at its sole cost and expense such licenses, permits, as well as a City of Palm Desert business license and approvals as may be required by law for the performances of the services required. RFP DEADLINE: Friday, November 17, 2006, by 4:30 p.m. Bids must be submitted in a sealed envelope plainly marked on the outside "SEALED BID FOR the City of Palm Desert Desert Dessert restoration".
