RECOMMENDATION
By Minute Motion:
1. Ratify the City Manager's approval of this proposal dated 5/10/06
and proposal amendment dated 11/21/06 to Gabel and Associates
in the amount of $33,000 for technical analysis, California Energy
Commission (CEC) application, follow-up analysis requested by the
Building Industry Association (BIA), and training for the
implementation of the Palm Desert Energy Ordinance #1124.
DISCUSSION
The work provided by Gabel and Associates as outlined in the original proposal dated
5/10/06 has been completed. This work was necessary for the City's application to the
California Energy Commission, which was approved by that State Agency on 10/30/06.
The work outlined in this revised proposal is necessary to address the Building Industry
concerns regarding cost effectiveness of this ordinance, as well as providing two
training seminars in early 2007 for architects, builders, and Building Department staff on
the provisions of Ordinance #1124.
No additional appropriation is needed. Funds are available in account # 110-4130-411-
3090 and # 110-4511-442-3090 for these expenditures.

City of Palm Desert Energy Efficiency Standards
Dear Mr. Conlon:
Per my telephone discussion with your concerning Palm Desert's proposed local energy
ordinance, and after careful review of the Draft Palm Desert Energy Efficiency Standards
and the Aspen Accord Palm Desert Partnership Demonstration Project,
I have developed the following proposal by Gabel Associates to assist the City with
the required energy analysis, documentation and application to the California Energy
Commission, and the effective implementation of the City's ordinance.
Please note that I have a few questions about how specific aspects of the proposed
ordinance is structured; and how we (or anyone working on behalf of the City of Palm
Design in their efforts to meet state requirements for CEC approval) will demonstrate cost-
effectiveness of a few of the proposed Mandatory Measures. However, I am presenting
this initial proposal with the understanding that we can address these issues in further
discussion, and that this proposal can be revised in response to additional clarification and
decisions. My understanding is that Section 24.30.010 Title, Purpose and Intent applies
only to Section 22.30.040 Mandatory Measures when it references new Residential and
Nonresidential construction including remodels, additions, alterations and tenant
improvements; and that the increased performance requirement of Section 22.30.030
applies only to single family dwellings of 4,000 SF or greater (and no other building
occupancy types).
Task 1. Detailed Discussions on the Proposed Ordinance, and Refinement of the
Other Tasks. Before proceeding with Tasks 2 through 5, it's important to spend some
time going through all the proposed language in the ordinance and consider (a) whether
some revisions may be necessary for clarity and/or for the implementation and/or for the
approval by the California Energy Commission. While I don't necessarily envision major
changes, I strongly suggest we consider each Section from several different perspectives
before plowing ahead with the analysis and documentation. We can keep this task to
several long phone calls, or have a meeting in -person in Palm Desert. Option A: up to 10
hours for telephone meetings only; Total Fee for Task 1 Not to Exceed $1,000. Option B:
in -person meeting in Palm Desert; Total Fee for Task 1 Not to Exceed $1,500.

Task 2. Calculation of Standard Design Adjustment Factors for Climate Zone 15.
A major effort and time-consuming part of our work is calculating the Standard Design
Adjustment Factors for Climate 15 under the 2005 Building Energy Efficiency Standards.
Although we can use the four House Size categories in the proposed ordinance, we
strongly recommend modifying Table A to include smaller square footage increments:
4000 — 4999 SF, 5000 — 5999 SF, etc. up to and including 12000+ SF. The reason is that
the smaller increments more accurately reflect the intent of the ordinance that increasingly
larger homes use no more energy for space conditioning and water heating than an
equivalent 4,000 square foot house. This task may also require recalibration of the TDV
energy (kBtu/sf-yr) assigned to solar photovoltaic (PV) systems based on the TDV factors
for Climate Zone 15. In discussion with CEC staff, it may be acceptable to use the TDV
energy credit per 1.0 KW of PV system capacity that was calculated for Climate Zone 2
under the Marin County Energy Ordinance. Up to 45 hours; Total Fee for Task 2 Not to
Exceed $4,500.
Task 3. Cost -Effectiveness of Performance Energy Measures in Climate Zone 15.
The state law requires that any local energy ordinance be submitted to and approved by
the California Energy Commission; and that a "cost-effectiveness" study be done as part
of the application and supporting documentation. This task demonstrates that it is cost-
effective for single family dwelling to exceed the 2005 energy standards according to the
performance requirements in Section 24.30.020 Table A. Up to 20 hours; Total Fee for
Task 3 Not to Exceed $2,000.
Task 4. Cost -Effectiveness of Mandatory Measures in Climate Zone 15.
This task will likely be difficult and time-consuming if the CEC requires that each and every
proposed Mandatory Measure have a cost-effectiveness evaluation documented for
Climate Zone 15. My initial comments on this task with are summarized as follows:
Section 22.30.040
Item #1: There is simply no practical way to determine cost-effectiveness of this
requirement. However, since item #2 is an alternative path, item #1 probably need not
demonstrate cost-effectiveness.
Item #2: This analysis is do -able if limited to residential buildings; it gets more
complicated and time-consuming if one includes a large number of nonresidential building
occupancy types.
Item #3: This is feasible also for residential buildings, and more time-consuming for
nonresidential building occupancy types.
Item #4: Proving cost-effectiveness for residential buildings is also the simplest approach.

Item #5a: Given the current utility rate structures, this may not be provable. Energy Star
efficient heat pumps may now be more cost-effective than forced -air furnaces for heating.
The analysis might possibly cause the City of Palm Desert to scrap this measure.
Items #5b, c and d: Probably illegal because it violates the Federal NAECA standards.
No state or local energy code can require minimum appliance efficiencies higher than the
federal standards.
Items #5e and f: These are fairly simple to show cost-effectiveness for residential
buildings, and more complicated for nonresidential buildings.
Item #6: The question here is the assumption as to have often, and for how long, the
manual -on sensor shuts off lights. I doubt that the CEC or Lawrence Berkeley National
Laboratory has much data on this. I'm not sure how one demonstrates cost-effectiveness
for this one.
Item #7: Similar to item #6 in that I don't know where you get data on the hours of
operation or typical natural gas energy usage for common area public pools and spas.
Item #8: One could make a case that this initial installation, by including it in a new home,
significantly reduces the cost of a solar PV system in the future.
Section 22.30.050
Items (a) and (b): Need not explicitly be shown to be cost-effective.
Item (c): There probably is data referenced online which proves that Energy Star
Appliances are cost-effective.
With approval from the City of Palm Desert, Gabel Associates may choose to sub -contract
all or some of the work in Task 4 to another energy consulting firm such as Heschong
Mahone Group in order to fast -track this task while work on Tasks 2 and 3 is proceeding.
Because the high degree of uncertainty in performing this task, we are unable to propose
a simple definitive fee for it. Depending of several variables, including the specific criteria
used by the CEC to approve the Mandatory Measures, the Total Fee for Task 4 might
range as low as $4,000 uD to $8.000.
Task 5. Preparation of Application and Report to the California Energy Commssion.
This task includes coordination with CEC staff, tracking the Commission approval,
addressing particular issues and questions that may emerge, and any revisions needed
for approval. Up to 20 hours; Total Fee for Task 5 Not to Exceed $2,000.

Note that this is a dense and fast schedule, and it may slip if the California Energy
Commission has issues with the Mandatory Measures and/or the cost-effectiveness study
done in support of those measures.

Dear Pat:
Per your request, here is a revised proposal for our services which encompasses all additional
work that is being done and is scheduled to be done outside the scope of work included in the
original contract proposal (dated 5/10/06) for $18,000 which has now been completed.
Task 6. Continued analysis of comments and input from BIA and their consultant, Con Sol, to
evaluate the computer model and assumptions used to demonstrate cost-effectiveness; and
pinpoint where specific differences remain. This will be a crucial aspect of the discussion at
the First Reading on November 16t. Up to 35 hours, $3,500.
Meeting in Palm Desert with the Council Committee, Pat Conlon and BIA representatives to
discuss the cost-effectiveness of the Ordinance, and implementation issues. Meeting with Pat
Conlon to plan for implementation including training. Nov. 29 — 30: $2,000. [Fee includes
airfare, rental car, hotel, meals, etc.]
Task 7. Preparation of a brief presentation at the First Reading for the Palm Desert City
Council explaining the basic approach used in the performance method by builders who meet
and exceed Title 24 requirements; and additional preparation to address BIA's and other
comments at the First Reading in support of the Ordinance. Up to 10 hours, $1,000.
Task 8. Meeting in person before and presence at the Palm Desert City Council Meeting on
December 14th for the First Reading of the Ordinance; and to answer any questions posed at
that meeting in support of the Ordinance. $2,000 [Fee includes airfare, rental car, hotel,
meals, etc.].
Task 9 (if requested). Being present at the Second Reading in support of the approval of the
Ordinance, tentatively scheduled for January, 2007. $1500 [Fee includes airfare, meals, etc.].
Task 10. Preparation for training seminars for the building industry, energy consultants and
the building department (if requested), in support of the new Ordinance. Up to 15 hours,
$1,500.
Task 11. A total of two (2) training seminars in Palm Desert (e.g., in two separate months)
conducted for the building industry, energy consultants and/or the building department in
support of the new Ordinance. $3,500 [Fee includes airfare, rental car, hotel, meals, etc.
