HomeMy WebLinkAboutC24860 Legislative Tracking Services - Statenet ServicesREQUEST: DATE: CONTENTS: Recommendation: CITY OF PALM DESERT COMMUNITY SERVICES DEPARTMENT STAFF REPORT APPROVAL OF CONTRACT FOR STATENET SERVICES February 9, 2006 PROPOSED CONTRACT By Minute Motion, approve Contract # 24860 with StateNet in the amount of $1,740 to provide legislative and regulatory reporting services and authorize the Mayor to execute the same. Executive Summary: Various sources are used to assist staff in facilitating thorough analyses and research of bills of interest to Palm Desert that are before the California Legislature and United States Congress. StateNet, located in Sacramento, California, is recommended by Joe A. Gonsalves & Sons as being the most effective company to provide this service. Background: The City of Palm Desert endeavors to remain current in obtaining information to analyze pending legislation on both the state and national level. StateNet, located in Sacramento, California, provides a legislative and regulatory reporting service, as well as information and intelligence gathering, on these types of issues throughout the 50 states. This service has provided worthwhile information in the past year and has become a vital tool in analyzing pending legislation. Staff recommends that Contract # 24860 in the amount of $1,740 be approved. Funds are available in account 110-4112-410-3060 and no appropriation is requested or required. State Net® will provide Client with the State Net® services described in the Service Elements section which are incorporated and made a part of this agreement. Fees, payment schedule and terms and conditions are included as part of the Service Elements listed on the front side of this document. Q. RESPONSIBILITY. It is agreed that State Nets will provide the services described herein as quickly and accurately as possible, and make any necessary corrections promptly upon notification. It is further agreed that State Netns will not be liable for any delays, omissions, or errors that may occur in providing such services, and Client will hold State Nett harmless against any claims or legal action arising from Client's utilization of or reliance on the services provided under this agreement. III. STATE AND FOCAL TAXES. The fees provided for in this agreement are exclusive of any state or local sales, use or personal property taxes or taxes of a similar nature. Any such taxes that may be applicable are the obligation of, and shall be paid by, the Client. IV. USE OF INFORMATION. Information supplied to Client by State Net@ is protected by copyright, all rights reserved. The Client agrees that information supplied by State Neta shall be for Client's use only and shall not be provided in any form or by any means to any other person, firm or corporation unless mutually agreed in writing in advance by the Client and State Nett. It is the Client's responsibility to maintain the confidentiality of Client's login and password Client shall be fully liable for any unauthorized use of Client's login and password V. APPLICABLE LAW This agreement shall be construed according to the law of the State of California. VI.CONFIDENTTALIIY OF In fulfilling this service agreement, State Net® may CLIENT INFORMATION receive from the Client certain legislative, regulatory and public policy related business information. State Nett+ treats all such information as confidential and uses such information solely for the purpose of providing the contracted service.
