Authorize the low bidder, Hort Tech, Inc. of Bermuda Dunes, California to withdraw its bid; 2. Award Contract No. C24670 to Pink, Inc. of Palm Desert, California in the amount of $ 247,230.91 for Landscape Installation Services on Country Club Drive Median from Tamarisk Row Drive to Harris Lane; 3. Set aside a 10% contingency in the amount of $ 24,723.09; 4. Authorize the Mayor to execute the agreement. Executive Summary: Bids were called for in December, 2005 and opened on January, 2006 for the installation of median landscaping on Country Club Drive, between Harris Lane and Tamarisk Row Drive. The low bidder is requesting that its bid be withdrawn due to obvious mathematical errors. Staff is requesting that the City Council approve this request and that the award go to the next lowest bidder, Pink, Inc. of Palm Desert, California. Four (4) firms 2006: responded with the following bids on Thursday, January 9, Hort Tech, Inc., Palm Desert, Ca. Pink, Inc., Palm Desert, Ca. Vintage Landscape, Bermuda Dunes, CA. Sierra Landscape Company, Inc., Palm Desert, Ca. $ 148,578.68 $ 247,230.91 $ 305,279.61 $ 313,396.00 Staff reviewed bid documents. During this review, staff observed an apparent mathematical error in line item number 19, Irrigation system, in the Hort Tech, Inc. bid. The sum for that line item was listed as $ 249.00. This is an unreasonably low sum for the requested work. On January 20, 2006 the City received a faxed request from Jack Kerns of Hort Tech, Inc. requesting that his bid be withdrawn due to the aforementioned error as well as two (2) other significant errors. The next lowest, responsive bid was from Pink, Inc. of Palm Desert, California. Pink, Inc. has satisfactorily completed past landscape installation projects for the City. Funds for this work are available in Account 400-4614-433-4001. Therefore, staff recommends that City Council award the subject Landscape Installation Contract No.C24670 to Pink, Inc. of Palm Desert, California in the amount of $ 247,230.91, plus a 10% contingency in the amount of $ 24,723.09, and authorize the Mayor to execute the agreement. Any and all liability, claims, damages, losses or injuries to any person or other entity, including injury to Contractor's employees, and all claims which arise from or are connected with the negligent performance of or failure to perform the work or other obligations of this Agreement, or which are caused or which are claimed to be caused by the negligent or intentional acts or omissions of Contractor, its subcontractors, its agents or employees, and, all expenses of investigating and defending against same, b. Any and all liability, claims, damages, losses or injuries to any and all contractors, subcontractors, material -men, laborers, or any other person, firm or corporation furnishing or supplying work, services, materials or supplies in connection with the performance of the Agreement. c. Attention is directed to the General Specifications - Claims, Liability, and Indemnity Agreement/Hold Harmless sections, which specifications are made part of this Agreement as set forth in Agreement paragraph 1, above. d. Attention is directed to Section 6-9, "Liquidated Damages" of the Standard Specifications and is hereby amended to substitute the "City of Palm Desert" in place of "Agency." Liquidated damages shall be three hundred fifty dollars ($350.00) per calendar day of delay. 4. Should any litigation or arbitration be commenced between the parties concerning the works of improvements as referenced herein, the prevailing party in any such litigation, being the Owner or the Contractor, should be entitled to a reasonable sum for attorney's fees incurred in any such litigation relating to this Contract. 5. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 6. Contractor shall be paid in the manner set forth in the Contract Documents the amount of its Proposal as accepted by Owner, subject to such additions and deductions as may be made pursuant to the Contact Documents and applicable law. Satisfactory Performance The prime Contractor agrees to pay each Subcontractor under this prime contract for satisfactory performance of its contract no later than ten (10) days from the receipt of each payment the prime Contractor receives from City of Palm Desert. Any delay or postponement of payment from the above referenced time frame may occur only for good cause following written approval of the City of Palm Desert. Release of Retention The prime Contractor agrees further to release retention payments to each Subcontractor within thirty (30) days after the Subcontractor's work is satisfactorily completed. With these corrections you can see that my bid should have been $207,751.13. I am hanav for that new bid to be considered rnv final bid for this iob as you present the bids to the Council. However, 1 am requesting that my original bid, without these corrections, be withdrawn, and my earnest check in the place of surety bond be returned to me.
