Drive and Dinah Shore Drive and Authorize the Necessary
Funding and Agreements

Recommendation:
In order to expedite the widening of Monterey Avenue between Gerald Ford Drive
and Dinah Shore Drive, in accordance with City of Palm Desert Municipal Code
Section 3.30.070, by a four -fifths vote adopt a resolution declaring that in the public
interest and necessity demand immediate expenditure of public money to safeguard
life health and property and delegating to the City Manager the authority to:
(1) Negotiate a construction contract up to $500,000.00 for
construction of the water line and widening of the road;
(2) Enter into the necessary agreements with Southern California
Edison and pay the associated fees and costs for relocation of the
transmission lines;
(3) Enter into construction contracts as necessary.
Background and Discussion:
The Lowe's Home Improvement Center and Wal-Mart/Sam's Club projects are
nearing completion. These projects will provide for the widening of Monterey
Avenue to its ultimate width along their project frontages. However, a gap of
approximately'/4 mile of unwidened road will exist between these two projects. Staff
has been working with a group of developers to form an assessment district that
would construct a variety of improvements, including widening of the portion of
Monterey Avenue left unwidened between these two points.

Progress on the assessment district has fallen behind the other projects; therefore,
staff has explored the possibility of performing the widening on the remaining part of
Monterey Avenue outside of the assessment district. Such a project would entail
relocating Southern California Edison transmission lines, constructing a dual 18-inch
water line, and widening of the road. Discussion of each of these points follows.
SCE relocation: SCE crews are currently on -site performing the
preliminary work to relocate the existing power poles on the Lowe's and
Walmart/Sam's Club projects. Representatives from SCE have informally indicated
a willingness to cooperate in the relocation of the five remaining poles that exist in
the gap between Lowe's and Wal-Mart. Before relocation of the lines, dedication of
an easement must be completed and fees paid to SCE. Relocation of this circuit can
only be performed during the non -summer months due to high demand on the
circuit; therefore the work must be completed by mid -June or be delayed until
October. The cost to relocate these poles is estimated at $200,000.00.
Water line: CVWD is requiring installation of a double 18-inch water
line on Monterey Avenue to serve the adjacent developments. Design of the water
line is included in the assessment district plans and is approximately 90% complete.
Staff has contacted CVWD about the possibility of expediting construction of this
water line. Their preliminary indication is that they might agree to allow construction
of this portion of the water line and cap it off prior to the road improvements;
however, should the line fail after it is tied into the water line improvements for the
entire assessment district, as well as Lowe's and Wal-Mart, the City would bear the
expense associated with correcting it. Therefore, expediting the widening of
Monterey Avenue, including construction of the water line, could result in costs to the
City above and beyond the costs normally associated with a street widening project.
Cost for this water line is estimated at up to $200,000.
Street improvements: Widening of Monterey Avenue to three northbound
lanes could occur after completion of the utility pole relocation and water line
installation. Actual street improvement work is estimated to cost up to $300,000.00.
Under the best of circumstances, the SCE poles could be relocated by mid -June.
The water line construction could then commence and be completed by the end of
July, with the street improvements completed by the end of September. The
assessment district schedule currently indicates construction could begin in October
2006. However, this schedule has slipped significantly through the process.
The net estimated cost for expediting the improvements on Monterey Avenue is
$700,000.00. If the work is allowed to proceed through the assessment district
process, the City bears none of this cost. If we are to expedite the work, the City
could be responsible for all of the cost. There are funds available for this work in
Measure A accounts 213-4378-433-4001 and 213-4386-433-4001.
The City of Palm Desert Municipal Code Section 3.30.070 provides guidance for
deviating from the usual construction contract bidding and award process. The City

Council may, by resolution, declare that the public interest and necessity demand
the immediate expenditure of public money to safeguard life, health or property and
authorize the City Manager to take appropriate action.
It is noted that Lowe's and Wal-Mart/Sam's Club are using the same contractor for
their required water line installations and street improvements. It is recommended
that if the improvements are to be expedited, we negotiate a construction contract
with that contractor (Dateland Construction). The City has had successful contracts
with this contractor in the past and staff believes they are capable of performing this
work.

RESOLUTION NO. 06-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, DECLARING THAT THE PUBLIC INTEREST AND NECESSITY
DEMAND THE IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO SAFEGUARD
LIFE, HEALTH OR PROPERTY AND AUTHORIZING THE CITY MANAGER TO
EXPEDITE THE MONTEREY AVENUE WIDENING BETWEEN GERALD FORD AND
DINAH SHORE DRIVE
WHEREAS, properties adjacent to Monterey Avenue north of Gerald Ford
Drive are experiencing significant land development activity and
WHEREAS, certain street improvements are being provided by
developers in disconnected segments and
WHEREAS, the City Council determines that if allowed to continue this
condition would threaten life, health and/or property,
NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES
HEREBY RESOLVE AS FOLLOWS:
I That the City Manager of the shall be authorized to expedite widening of
the remaining portions of Monterey Avenue between Gerald Ford Drive and Dinah
Shore Drive
II That the City Manager shall be authorized to: A. Negotiate a construction
contract and B. Enter into the necessary agreements with Southern California Edison
and pay the associated fees and costs for relocation of the transmission lines and C.
Enter into construction contracts as necessary.
PASSED, APPROVED, and ADOPTED by the City Council of the City of Palm
Desert, California, on this 23rd day of February 2006, by the following vote:
