1. Resolution No. 06-79 initiating the proceedings for the levy and collection
of annual assessments for the Palm Desert Consolidated Landscape and
Lighting District for Fiscal Year 2006/2007.
2. Resolution No. 06-80 declaring the intent to levy and collect annual
assessments for the Palm Desert Consolidated Landscape and Lighting
District, and granting preliminary approval of the Engineer's Report for
Fiscal Year 2006/2007.
Executive Summary:
The attached resolutions initiate the process to levy and collect annual assessments for
35 existing landscape and lighting districts, and grants preliminary approval of the
Engineer's Report. The Engineer's Report establishes and details the annual budgets
and method of appropriation for each district for Fiscal Year 2006/2007. The maximum
allowed three percent cost of living adjustment has been applied to each district's
budget.
If the attached resolutions are approved, a public hearing will be scheduled for June 22,
2006, to allow public testimony, approve the Final Engineer's Report, and to order the
levy and collection of assessments for Fiscal Year 2006/2007.

Discussion:
The City of Palm Desert administers 33 individual landscape and lighting districts,
referred to as the Palm Desert Consolidated Landscape and Lighting District. These
districts were established to pay for the maintenance of perimeter landscaping and
streetlighting benefiting individual residential subdivisions.
Each year the City must initiate proceedings to levy and collect annual assessments
from each district. An Engineer's Report must be prepared detailing the proposed
budget for each district and the method of appropriation. The attached Engineer's
Report includes a budget for each district, and attached Table 1 summarizes each
district's levy. This year's maximum allowed cost of living adjustment of three percent
has been applied to each district.
In July of 2004, fifteen districts approved an increase to their annual levy to cover the
new maintenance cost of City installed water efficient landscaping and irrigation. In
February of 2006, these renovations were completed. The proposed budgets and
levies are sufficient to cover the cost of maintenance for the new landscaping. Table 1
indicates which districts approved and received the renovations.
Staff recommends that the City Council approve the attached resolutions to initiate the
levy and collection of annual assessment for all districts. If approved, a public hearing
will be scheduled for June 22, 2006, to take public testimony, approve the Final
Engineer's Report and order the levy and collection of assessments for FY 2006/2007.
Staff recommends approval of the resolutions.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, INITIATING PROCEEDINGS FOR THE LEVY
AND COLLECTION OF ASSESSMENTS FOR THE CONSOLIDATED
PALM DESERT LANDSCAPING AND LIGHTING DISTRICT FOR
FISCAL YEAR 2006/07
The City Council of the City of Palm Desert (hereafter referred to as the "City Council")
does resolve as follows:
WHEREAS, The City Council through previous resolutions has formed and levied
annual assessments for the Consolidated Palm Desert Landscaping and Lighting
District (hereafter referred to as the "District"), pursuant to the provisions of the
Landscaping and Lighting Act of 1972, Part 2, Division 15 of the California Streets and
Highways Code (commencing with section 22500) (hereafter referred to as the "Act") that
provides for the collection of assessments by the County of Riverside on behalf of the City
of Palm Desert to pay the maintenance and services of improvements related thereto; and,
WHEREAS, The City Council desires to initiate proceedings for the levy and
collection of annual assessments for the fiscal year 2006/07 for the landscape and lighting
improvements and services that provide benefit to the properties within the District
pursuant to the provisions of the Act; and,
WHEREAS, The City has retained MuniFinancial for the purpose of assisting with
the Annual Levy of the District, including the preparation and filing of an Engineer's Report
with the City Clerk in accordance with the Act.
NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY THE
CITY COUNCIL FOR THE DISTRICT, PURSUANT TO CHAPTER 3, SECTION 22624
OF THE ACT, AS FOLLOWS:
Section 1 The above recitals are true and correct.
Section 2 The City Council hereby orders MuniFinancial to prepare and file with the
City Clerk the Engineer's Report concerning the levy of assessments for the District for the
fiscal year commencing July 1, 2006 and ending June 30, 2007 in accordance with
Chapter 3, Section 22622 of the Act.
Section 3 The improvements within the District include but are not limited to: turf,
ground cover, shrubs and trees, irrigation systems, street lighting, water features, entry
monuments, drainage systems and all appurtenant facilities and operations related thereto.
The Engineer's Report shall provide a more detailed description of the improvements and
services provided by the District and describes any new improvements or substantial
changes of the improvements for which properties are assessed.
Section 4 The City Council hereby determines that to provide the improvements
generally described in Section 3 of this resolution and to be detailed in the Engineer's

Report, it is necessary to levy and collect assessments within the District for fiscal year
2006/07 and said assessments shall be outlined and described in the Engineer's Reports
and imposed pursuant to the provisions of the Act and the Califomia Constitution Article
XIIID.

ENGINEER'S REPORT
The City Council of the City of Palm Desert (hereafter referred to as the "City Council")
does resolve as follows:
WHEREAS, The City Council pursuant to provisions of the Landscaping and Lighting
Act of 1972, Part 2, Division 15 of the California Streets and Highways Code (commencing
with section 22500) (hereafter referred to as the "Act") did by previous resolution, order the
preparation of an Engineer's Report (hereafter referred to as the "Report") for the District
known and designated as the Consolidated Palm Desert Landscaping and Lighting District
(hereafter referred to as the "District"); and,
WHEREAS, The City Council pursuant to provisions of the Act proposes to levy and
collect assessments against Tots and parcels of land within the various Zones of the District
for the fiscal year 2006/07, to pay the maintenance, servicing and operation of the
improvements related thereto; and,
WHEREAS, MuniFinancial has prepared and filed a Report with the City Clerk
pursuant to Section 22623 of the Act, and said Report has been presented to City Council
and is hereby incorporated by reference; and,
WHEREAS, The City Council has examined and reviewed the Report as
presented, and is preliminarily satisfied with the description of the District, the Zones
and improvements identified therein, each of the budget items and documents as set
forth therein, and is satisfied that the proposed assessments contained therein, have
been spread in accordance with the special benefits received from the improvements,
operation, maintenance and services to be performed within the District, as set forth in
said Report or as modified by City Council action and incorporated herein.
NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY THE
CITY COUNCIL FOR THE DISTRICT, PURSUANT TO CHAPTER 3, SECTION 22624
OF THE ACT, AS FOLLOWS:

Intention: The City Council hereby declares its intention to order the annual
levy and collection of assessments within the District pursuant to the Act,
over and including the land within the District boundary, and to levy and
collect assessments on such land to pay the annual costs and expenses of

the improvements and services described in Section 5 of this resolution, for
fiscal year 2006/07.
The Report has been prepared and filed with the City Clerk. The City Clerk
has presented to the City Council, a Report in connection with the proposed
improvements, assessments, the levy and collection of assessments for
fiscal year 2006/07 in accordance with Chapter 1, Article 4 of the Act, and is
hereby approved, as required by Section 22623 of the Act, on a preliminary
basis.
Boundaries and Designation: The description of the District boundary and the
Zones therein are outlined in the Report and by reference is made part of this
resolution. The District includes thirty-three (33) Benefit Zones and Sub -
zones: Canyon Cove (Zone 2); Vineyards (Zone 3); Parkview Estates (Zone
4); Cook and Country Club (Zone 5) Sub -zones are Desert Mirage,
Sandcastles, and Primrose 2; Hovley Lane (Zone 6) Sub -zones are
Monterey Meadows, The Glen, Hovley Estates, Sonata I, Sonata II, Hovley
Collection, La Paloma I, La Paloma II, La Paloma III, Sandpiper Court,
Sandpiper West, Hovley Court West, Diamondback and Palm Court; Waring
Court (Zone 7); Palm Gate (Zone 8); The Grove (Zone 9); Portola Place
(Zone 11); Palm Desert Country Club (Zone 13); K & B at Palm Desert (Zone
14); Canyon Crest (Zone 15); and, Shepard Lane (Zone 16) Sub -Zones are
College View Estates I, College View Estates II, Sundance East, Sundance
West, Petunia I and Boulders. The District is designated as "Consolidated
Palm Desert Landscaping and Lighting District."
Description of Improvements: Reference is hereby made to the Report for a
detailed description of the improvements. The improvements within the
District include but are not limited to: turf, ground cover, shrubs and trees,
irrigation systems, street lighting, water features, entry monuments, drainage
systems and all appurtenant facilities and operations related thereto.
Proposed Assessment Amounts: The proposed assessments are outlined
in the Report. District Assessments are calculated in accordance with the
method of apportionment established for the District and do not exceed
the assessment rates and annual inflationary adjustment previously
authorized by City Council and approved by the property owners in
accordance with the provisions of the California State Constitution, Article
XIIID.
Notice Of Public Hearing: The City Council hereby declares its intention to
conduct a Public Hearing concerning the District, improvements, and the
levy of assessments, in accordance with Chapter 3 of the Act. Notice is
hereby given that a Public Hearing on these matters will be held by the
City Council on June 22, 2006 at 4:00 P.M., or as soon thereafter as

feasible in the City Hall (Council Chambers), located at 73-510 Fred
Waring Drive, Palm Desert, California. At the Public Hearing, all interested
persons shall be afforded the opportunity to hear and be heard.
Section 8 Notice: The City shall give notice of the time and place of the Public
Hearing to all property owners within the District by causing the publishing
of this resolution once in the local newspaper not less than ten (10) days
before the date of the public hearing, and by posting a copy of this
resolution on the official bulletin board customarily used by the City
Council for the posting of notices pursuant to the Act. For fiscal year
2006/07, no new or increased assessments are proposed and a mailing of
a notice and ballot to property owners is not required.
Section 9 The City Clerk is hereby authorized and directed to give notice of such
hearing as provided by law.

A. Introduction
1'he City of I'alm llesert (hereafter referred to as "Cin-") annuall�� le��ies and collects special
asscssmcnts in order to pro�ride and maintain impro��ements «-ithin the Consolidated ]'alm
llesert Landscaping and Lighting I��faintenance �ssessment District (hereafter referred to as
the "District"). The District �vas formed in 1�93, through the consolidation of se��eral
inciividual landscaping and lighting maintenance districts that pre� iou�1�- existed �tizthin the
C:itj�. The original districts and subsequent annexations of i�arious territories and
developments to the Consolidated District are identified as separate lones and/or Sub-
rones (hereafter referred to jointl�- as "'Lones"). The District and the Lones therein ha� e
been established and are le��ied annual assessments pursuant to the Land.rcaping �nd I1gl�tirrg

as the "1972 �ct").
This Engineer's <�nnual Le��y� Report (hereafter referred to as the "Report") describes thc
District and impro��ements, an� proposed changes to the District or impro��ements and the
proposed budgets and assessments for Piscal I'ear 2006/07. The proposed assessments are
based on the Cin-'s cstimated cost to maintain the unpro�ements that pro�ide spccial benefit
to properties �i�ithin the District. The ��arious impro�ements ���ithin the District and the costs
of those improvements are identified and budgeted separatel�- for each 7one, including the
cYpenditures, deficits, surpluses, rei-enues, and rescr��es.

B. Compliance with the Curtent Legislation
The Ciri� Council annuall�- conducts a public hearing to accept public comments and
testimon5-, to revicw the Report and adopt the annual assessments to be lcvied on the

Count}- tax roll for the fiscal �-ear. The assessments described in this Report and
subsequentl}� appro�red b}� the City- Council have been prepared in accordance w�ith the 1972
.�1ct and in compliance «7th the pro�risions of the Califonria Con.rtitulion. .�riicle XIIID
(hereafter reEerred to as the ` ��rticle XIIID"), �vhich �cas enacted b5- the passage of
Proposition 218 in �1o��ember 1996.
In compliance «zth the pro��isions of :=lrticle XIIID, in Fiscal Year 1997/98, the Cin-
conducted propernr o���ner ballot proceedings for the special benefit assessments applicable
to each of the existing Zones w-ithin the District. .�t that time, the assessments presented to
properh- o�zrners included the assessment range formula pre��ouslti• established for the
District and described in this Report. L''pon tabulation of the ballots returned, it �vas
determined that majorit�- protest did not exist and the CitF Council appro��ed and adopted
the assessments and assessment range formula balloted and appro��ed by the propert��
o�vners. Similar proceedings have been conducted for all new or increased assessments
including an� annea:ations to the District.
C. General Description of the District and Services
'1'he Cih� annually- lez-ies and collects assessments in order to maintain and sen�ice various
impro� ements within the District. For riscal Year 2006/07, the District is comprised of

impro� ements are identified and budgeted separately� for each Zone, including the
expenditures, deficits, surpluses, revenues, and reserves.
The improvements provided and for �vhich parcels are le�-ied special benefit assessments
�vithin the District can be categorized as three (3) impro�rement ry�pes.
1. Local street lighting (residential street lighting associated w-ith the properties ���thin the
Zone and specific subdi� isions).
2. I.ocal landscaping impro� ements including parkwa��s, perimeters, entry�vays, local
medians, and internal landscaped amenities.
3. Special "Lone senrices including tree trimming, graffiti and �veed abatement and
landscape maintenance of Elood control areas (retendon and detenrion basins).
The costs associated ���ith the improvements authorized b`� the provisions of the 1972 �ct
are equitabl�- spread among the benefiting parcels in proportion to the special benefit the�-
recei� e. Onl�� parcels that receive special benetits from the unpro�rements are assessed, and
each "Z.one consists of parcels that benefit fxom those specific impro� ements.
Landscape improvements maintained by� the Discrict and associated with each Zone ��ere
eitlier installed as a condition of development or �vere installed for the benefit of the
properties assessed. The landscape improeements associated with each Zone may� include,
but are not limited to: open space areas, medians, park�va}�s, slopes, retention or detenaon
basin areas, and public right-of-�vay�s or easements that provide special benetits to the
parcels. These improvements ma�� include, but are not limited to: turf, ground cover, shrubs
and trees, irrigation s}-stems, decorative lighdng, �vater features, entr5- monuments, drainage

II. SPECIFIC IMPRQVEMENTS AND SPECIAL BENEFIT ZONES
Z'he boundaries of each Zone, the location of improvements and special benefit recei� ed b}�
the properties and propert�- o�z�ners �L-ithin each 'Lone are described in this section of the
Report. In anj� given fiscal year, Cit� staff will deterrnine the scope of work for each Zone as
assessment revenues allo�a. l�nti� necessary� reductions in the scope of work �vill likel�� include,
but are not limited to; the frequency of mowzng and edging turf areas; the application of
fertilizers and aeration of turf; trimming and pruning of shrubs, trees and ground co��er;
trash pick-up in landscaping areas; and, �i�eed and litter control. The allocation of special
benefit and general benefit of the improvements pro�ided ��-ithin the District are
summarized in the n-fethod of %�pportionment section of this Report and are identified in the
budget for each 7.one. A description of the District improvements and the le� el of annual
service each Zone will receive are proeided in the following:
Zone #2 (Canyon Cove):
"Lone #2 includes Tracts 11G36-1, 2, 3, & 4 and Tract 23-�85, generallj- located South of
Deep Cany�on Tennis Club, North of Ha}�stack Road, ��'est of I��Iarrakesh Countr�- Club, and
East of High�vay 74. '1'he streets �uithin the Zone include Ambrosia Street, Sweetbrush Lane,
Deer Grass Drive, Lotus Court, Calliandra Street, Aber Street, and �lamo DriY,e.
These parcels benefit from the maintenance and operation of street lighring encompassing
the streets urithin the Zone, the landscaped parlc«�a�- along the East side of High�vay 74 and
the landscaped areas on the Ivorth side of Haystack Road, adjacent to the abo�-e mentioned
tracts and installed as part of these residential de�elopments.
The interior local street lighdng has been identified and allocated as 100°•'o special benefit
with no general benefit allocation. The parkwa�� landscaping along Highcvay� 74 has been
identified as 100°: o special benefit to the parcels �vichin the Zone. However, it has been
determined that the landscaped median on Ha�-stack Road (although installed as part of the
de� elopment) not on15� pro�-ides a special benefit to properties urithin Can�-on Cove, but also
pro�-ides a general benefit. The proportionate general benefit of this improvement has been
idenafied and eliminated from the Zone assessments. �lthough there is a general benefit
component, the majorit�� (83°'0) of the median landscaping on Ha�-stack Road is a flood
control channel and w�as required for de�-elopment of the homes within Can�;on Cove.
Therefore, pursuant to tlrticle XIIID Section �a (assessments used to fund flood control and
drainage s�stems) the majorit}� of the costs for this landscaped area could be considered
eaempt. Ho�uever, in recognition of the general benefit this improvement area provides and
the previous assessments applied to properaes �vithin the Zone, it was determined that the
Cin- �vould fund a large portion of the costs associated �vith this landscaped median area.
Refer to the budget section of this Report for details on the allocation of benefit and related
assessments.

Both the strcet lighang and landscape icnpro� ements identified for this "Lone �vere installed
as part of the residential de� elopment and the ongoing maintenance and operadon of these
impro�-emcnts pro��ide special benefits to propertics «7thin the 'I..one. It has further been
deterniined that these impro�-cments �vere installed and are maintained solel�- for the benetit
of properues �titithin the 'Lone and the impro�-ements pro��ide no measurable benefit to
properties outside the Zone. :�n}- benefit con� eyed to other properties or to the public at
large (general benefit) is incidental. Therefore, both the interiox tract stteet lighting and the
park�vaj� (perimeter) landscaping costs ha� e been identified and apporuoned 100°%o as a
special benefit to the parcels u�ithin the 'Lone.
Zoae #4 (Parkview Estates):
7.one #4 consists of the parcels in Tract 8237, 5outh of I�tagnesia ralls Dri�-e, I�orth of Fred

'1'hese parcels recei�re special benefits from the operation and maintenance of street lighang
along Primrose Dri��e, Desert Star Boule�-ard, �randa Circle, Palmilla Circle, ;�I��rsine :i�-enue,
Gazarua Place, Rutledge :��>enue, Button�vood Drive, Silktree Lane, Santolina Dri��e, Balsam
Lane, and �rin Street. The street lighring improvements �vere installed as part of thc
residential de��elopment and are considered a special benefit to the properties «7thin the
de�-elopment (i.e., "Lone). The ongoing operaaon and maintenance of interior residential
street lighdng provides no mcasurable general benefit to properties outside the Lone or to
the public at large. To the ettent that sonne streetlights associated �vith the Zone are located
on the perimeter of the residential development and pro�-ides direct illumination to parcels
outside the Zone, a portion of the maintenance costs has been identified as a general benefit.
This 7_one has t�ventt- interior streedights and five perimeter streetlights resulting in an
allocation of the "Lone costs as 90°�o special benefit and 10°'o general benefit.
Zone #5 (Cook and Country Club):
lonc #5 consists of three (3) separate residential subdirisions identified as Sub-zones. Thcse
three Sub-zones are kno�vn and identified as the Desert 1lirage (Tract 2563)), Sandcastles
(Tract 21338-1), and Primrose 2(Tract 2�=436). Each of these Sub-zones hay specitic local

These three subdivisions �vere originally part of a larger Zone l:no�vn as Cook and CountrS�
Club and �vere proportionatelt- assessed for median landscaping in the area as «�ell as their
local (tract specific) improvements. In fiscal y�ear 1997/98 it ��as determined that the median
landscaping in the Cook and Countr�- Club area �vas largel�� a general benefit and this portion
of the assessment u>as eliminated. Ho�vever, it t��as determined that the parcels u�ithin these
three (3) Sub-zones recei` e special benefit from tract specific unprovements maintained bti�
the District, and each parcel �vithin the respective Sub-zones should condnue to be assessed
proportionatel�- for the cost of sen-ices associated w7th those local unpro�ements.
Upon re��ie�v oE the specific street lighting unprovements associated with each of these Sub-
zones, the street lighting facilities ha� e been identified as interior tract streetlights. These
streetlights provide little or no direct illumination to parcels outside the Sub-zones and
therefore the costs of maintaining these improvements are allocated as 100°io special benetit
u�ith no general benefit.
L"pon re�ie�v, it has been determined that 15% of the unprovements uithin the Desert
I�firage Sub-Zonc are of a general benetit to those properties outside of the Sub-zone.
Therefore, this percentage of the costs of maintaining the Sub-zone has been remo�red from
the assessment and must be funded from other sources.
The propert�� o�tiners in Sub-zone known as Desert �Tirage ��ere balloted in Fiscal Year
2004/OS for an increase in their ma�imum assessment rates. The proposed le« increase
i��ould fund ne�v maintenance costs required after the Cin� of Palm Desert renovated the
improvements with �vater efficient landscaping and irrigation sy�stems. l��fajoritt- protest did
not ekist, therefore the CitF• will move fonvard w7th the plans to renoirate the improvements
in the Desert �iirage Sub-zone. Refer to the budget for Zone 5 in Section I�' of this Report

are located on the perimeter of the de�-elopment and pro�-ide direct illumination to parcels
outside the subdivision, a portion of the maintenance costs 15°�o have been identitied as a
general benefit component. 1-herefore, the cost of maintaining the street light impro��ements
is allocated as 85°'o special benetit to properties �t-ithin these Sub-zones.
Similarl�-, it has been determined that a portion of the park��-a} landscape improvements
associated «�ith the Glen, Sonata I and Fiovley� ��'est Sub-zones provide a general benefit to
properties outside of these Sub-zones. Therefore, 15°: o of the costs of maintaining these
landscaped areas has been remo�-ed from the assessments and �=ill be funded from other
sources. '1'he landscape impro�-ements associated with each of the remaining 5ub-zones
pro�-ide no measurable general benefit to properties outside the 7one or to the public at
large, and therefore, their spccific local landscaping impro� ements and the corresponding
assessments have been identified 100"'o as a special benefit to parcels �vithin the Sub-zones.
The properh� ou>ners in the nine (9) Sub-zones known as The Glen, Hovle�- Estates, Sonata
I, Sonata II, l.a Paloma I, Sandpiper Court, Sandpiper `�'est, IIovle�� ��'est and Ho�lc}-
Collection, �vere balloted in Fiscal Year 2004/2005 for an increase in their maYimum
a,sessment rates. In conjuncuon �t�th the assessment increase, the Cin' proposed to reno�-ate
the eyisting impro�-ements �i7th more �vater efficient landscaping and modifications to the
irrigation s��stem.
N'or se��en (7) of the nine (9) Sub-zones balloted, majorit�- protest did not exist and the Cin-

to properties outside the Zone or to the public at large. Therefore, both the tract street

and apportioned 100°'o as a special benefit to the parcels �Lnthin the "Z.one.
:1s part of the orerall landscaping costs for this Lone, specialized maintenance (palm tree
trimming) is budgeted separatel�- as this sen-ice is not co��ered under the regular maintenance

imposed prior to Jul�� 1, 1997 �verc exempt from the requirements of ��rticle XIID.
Although the assessments for these impro��ements �vere identified as exempt in fiscal Year
1997/98 and not subject to the procedural requirements of a protest balloting procedure, the
impro�-ements and the related assessments for this Zone ��ere identified as 100°'o special
benetlt. It has been determined that the ongoing operation and maintenance of the
unpro� ements pro�-ide no measurable general benefit to other properties outside the Zone

The parcels within this Zone recei� e special benefits from the ser�-icing and maintenance of
entr��vay� landscaping on State Street and ��'ashington A� enue, parkzvay� landscaping along
Fred ��'aring Drive and local residential street lighting �ti7thin the 7one.
Parcels �vithin Zone 13 �vere annexed into the City in Fiscal Year 199�/95. Prior to Cin-
annesation the local impro�-ements �vithin this 7one were assessed and collected b� the
County through a County Service Area (CS �). ��'hen the properties were annexed to the
Cit�, the Cit�� established this territorF as Zone 13 �vithin the District and the CSA fund
balance �vas transferred to the Zone 13 account. For the first two }�ears, the Cin� used the
fund balance to fully cover the annual cost of pro�-iding the impro� ements. In Fiscal Year
1996/97 the remaining fund balance was designated as reserves and the District le��ied its
first annual assessment for the Zone. Because the resen-e fund balance �vas greater than the
amount nrpically held in reserves, the City Council determined that a portion of the resenes
�vould be used each y ear to offset the annual expenditures thereb�� allowing the annual
assessments to remain fairlv constant and also gradually reduce the reser�-e fund to normal
le��els. In Fiscal Year 1997/98, in compliance �vith Article XIIID, a property� o�vner ballot
proceeding was conducted to appro�-e the e�:isting annual assessment. At that time, the
propertt� owners appro�red the proposed assessment amount plus an annual inflation
adjustment. The assessment amount approved by� the properry• owners was based on the
continued policv of utilizing reser� e fund contributions to offset the actual expenses for the
Zone.
In Fiscal Year 1999/00, property� owners �vithin Zone 13 �vere re-balloted for an increased
assessment to cover the maintenance costs associated with the ne�v landscaping
improirements to be installed on Fred ��'aring Drive. Propertt- owners were balloted for an
amount sufficient to coi�er the acrual "Lone expenses, although a portion of the existing

The strect lighting and landscape impro��ements assessed «�thin this "Lone clearl�- pro�ide
special benefits to properties �ti�ithin the 7one. It has been determined that the
impro�-ements �vere installed and are maintained solel�- for the benefit of properties �t7thin
the Zone and the impro��ements pro��ide no measurable benefit to properdes outside the
"Lone or to the public at large. Therefore, both the street lighting and the landscaping costs
(park�va}-s and interior landscaping) ha�-e been identified and apportioned 100°'� as a special
benefit to parcels �vithin the lone.
Zone #14 (K & B at Palm Desert):
%one 1� is locatcd generall�� North of Frank Sinatra Drivc, ��-est of Portola :i�-enue, East of
1lontere�- ��-enue and South of Gerald Ford Dri��e. "I'he 7,one includes the parcels in "lracts
28258 and 28258-1.
The properties �vithin the boundaries of Zone 1� benefit from street lighting �ti7thin the
de�-elopment located on Drexell Dri�-e, Iicather�vood Dri��e, �merson Dri�-e and jamerson
Road, and Colebridge Street, as well as landscaping associated �vith the retention basin area
located on Hcathens,00d Dri�-e and drF� �i-ell areas within the subdi�risions installed b} the
developer as part of the residential de�relopment.
In conjunction ��nth a proposed reno��ation and upgrade of the existing landscapc
impro�ements, the propert� o��ners in Zone 1-� �vere balloted in Piscal Ycar 200�/0� for an
increase in their maximum assessment rates. I�-fajoritc protest did not e.r•ist, and based on the
appro�-a1 of the ne�v assessment rate, the Cin- w-ill mo��e for�vard �t7th the plans to renovate
the impro�-ements «tith more �vater efticient landscaping and moditications to the irrigation
s�•stem. Refer to the budget for Zone 14 in Section I`' of this Report for specifics regarding
the proposed assessment for the current �scal }-ear and the marimum assessment.
It has been deternzined that fifteen percent (1 �°'o) of the impro` ements ��ithin the K& B
Sub-Zone are of a general benefit to those properties outside of the Sub-zone. Therefore,
this percentage of the costs of maintaining the Sub-zone has been removed from the
assessment and inust be funded from other Cit}- i:unding sources.
Zone #15 (Canyon Crest):

has been determined that the ongoing operation and maintenance of the landscape
improvements pro�ide no measurable general benefit to other properties outside the Zone
or to the public at large. Therefore, the local landscaping improvements associated �Lrith this
%one and the associated annual costs ha�-e been identified as 100°% special benefit to parcels
���ithin Zone 15. Refer to the budget for Zone 1 � in Section IV of this Report for specifics
regarding the proposed assessment for the current fiscal }�ear and the maximum assessment.
Zone #16 (Shepard Lane):
Zone #16 consists of six (6) separate residential subdivisions identified as Sub-zones. These
sia Sub-zones are kno�vn and identified as College View Estates I(Tract 294�4), College
�'iew Estates II (Tract 30087), Sundance ��'est (Tract 30216), Sundance East (lract 30503),
Petunia l(Tract 30025), and Boulders ('I'ract 30030). Each of these Sub-zones has specific
local improvements maintained b�- the District that �vere installed as part of these residential
de�-elopments.
There are se��eral residential subdi�isions within the area known as Shepherd Lane. The
parcels w-ithin each of the six (6) Sub-zones of Zone 16 (Shepard Lane) receive benefit from
various impro��ements that were installed as part of the separate residential developments
and are specific to each tract and subdiirision. Perimeter landscaping for the Shepherd Lane
residential de�relopments includes park�va��/perimeter landscaping on the �vest side of
Portola :��-enue bet��een Frank Sinatra Di� e and Gerald Ford Drive, as well as landscaping
on the north side of Frank Sinatra Drive and the south side of Gerald Ford Dri�e on either

III. Method of Apportionment
A. General
The 1972 :�ct permits the establishment of assessment districts b�- agencies for the purpose of
pro�iding certain public impro�rements ���hich include the construction, maintenance and
ser��icing of public lights, landscaping and appurtenant facilities. The 1972 :1ct further requires
that the cost of these improvements be le�-ied according to benefit rather than assessed value:

The Formula used for calculating assessments in each Ione of the District therefore retlects the
composition of �he parcels, and the impro� ements and sen-ices pro�7ded, to fairl� apportion the
costs based on estimated benefit to each parcel.
In addition, pursuant to <�rticle �iIIID Section � a parcel's assessment may� not exceed the
reasonable cost of the proportional special benefit conferred on that parcel and pro�ides that
on1�- special benefits are assessable and the District must separate the general benefits from the
special benefits. Therefore, in compliance wtith the ne�t- assessment requirements onl}�
assessments that are identified as either "EYempt Assessments" or "Special Benefit
�ssessments" are assessed. The costs of any unprovements considered to be "General Benefit"
ha��e been eliminated from the District assessments.
B. Benefit Analysis
r.ach of the proposed impro��ements, the associated costs and assessments has been carefull��
re�rie��ed b�- the City and has been identified and allocated based on benefit pursuant to the
pro�-isions of the 1972 :�ct and _-�rticle �iIIID of the California Constitution. Each impro�-ement
and the associated costs ha� c been identified as either "general benefits" or "special benefits".
,�lthough some exisdng assessments �vithin the Disrrict qualified as etempt assessments
pursuant to �rticle �iIIID, Section � of the Consritution and did not require a ballot proceeciing
under the pro�>isions of Section 4, the impro� ements associated ��nth these assessments are
considered a special benefit to the assessed properties and are in compliance «�ith the substanti�-e
requirements of :lrticle XIIID Section �. The maximum assessment rates sho«�n in this report

health}�, vigorous, and satisfactor}- condition.
The special benefits associated w7th the local landscaping improvements are specificall�-:

properties in the District through �vell-maintained surroundings and amenities including

temperatures, pro�riding oxygenation and attenuating noise.
'I'he special benefits of street lighting are the con�enience, safett�, and securit�• of propern-,

Genera! Bene&ts
Prior to the passage of Proposition 218, some of the District assessments included maintenancc
of landscaped meciians on � arious arterial streets within the Cin-. Ho�vever, since the
maintenance of most arterial medians w�ithin the Cit�� were funded b�� the Cin's General Fund, it
uuas determined that the existing assessments for these unpro�ements �vere not a special benefit
and in Piscal Year 1997/98 the District a�sessments related to arterial meciians ��•ere eliminated.
In addition, an}� impro��ement and the associated costs that are considered a general benetit to
properties outside the respecti� e 7_.ones or to the public at large ha�•e been identified and
climinated from the annual assessments. In making this determination it should be noted that
park��a��, perimeter landscaping and interior landscaping �i7thin the Cin- is either funded and
maintained b5- indi��idual propern� ow�ners or through some t�pe of association, e�:cept those

C. Assessment Methodology
Pursuant to the 1972 :1ct, the costs of the I�istrict ma� be apportioned b}- an�- formula or
method that fairl�� distributes the net amount to be assessed, among assessable parcels in
propordon to the estimated benefits to be recei��ed b}� each such parcel from the impro� ements.
The apportionment of costs used for each lone should reflect the composition of the parcels,
and the unpro�-ements and sen�ices provided based on each parcel's estimated special benefit.
Equivalent Benefit Units: To assess bencfits equitablr, it is necessar} to relate the different
ty-pe of parcel improvements to each other. The Equi�-alent Benefit � nit method of assessment
apportionment uses the single-familS� home as the basic unit of assessment. �1 single famil�- home
equals one Equivalent Benefit L nit (�13U). Ever�- othcr land use is com-erted to �BUs based on
an assessment formula that equates the properh-'s specific de�relopment status, n-pe oE
development (land use), and sire of the propert��, as compared to a single-family hoine (SFR).
The EBL� method of apportioning benefit is h-picall�- seen as the most appropriate and equitable
assessment methodologv for districts formed under the 1972 :�ct, as the benefit to each parcel

D. Assessment Range Formula

These certain conditions included "an�� assessment that does not exceed an assessment formula

���here the assessment is imposed." This definiaon u-as later confirmed by Senate Bill 919 (the
Proposition 218 implementing legislation).
�n assessment range formula for the District assessments has been contirmed through propert��
o�vner ballot proceedings in compliance �vith �rticle �iIIID, except those esisting assessments
�vithin the District �chich qualified as exempt assessments pursuant to .�rticle XIIID, Section �
of the Constitution and did not require a ballot proceeding under the provisions of Section �.
The assessment range formula shall be applied to the future assessments within the District. The

establishing an assessment range formula is to provide for reasonable increases and
inflationar}' adjusunent to the assessment amounts unthout requiring costl}- noticing and
mailing procedures, �vhich �vould be added to the District costs and assessments.
If the proposed assessment is less than the ma.r-imum assessment appro�ed in thc
pre��ious fiscal ��ear adjusted b�- a percentage no greater than three percent (3.0°-0), or the
annual percentage increase of the Consumer Price Indet (CPI), �vhiche� er is the lesser of
the t�vo, the assessment shall not be considered as an increase.
Each ��ear the Cin' shall compute the percentage difference behveen the CPI on Januar��
1, of cach }-ear and the CPI for the pre��ious januar�- 1, or a similar time period, as
determined b�� the Bureau of Labor Statistics for all urban consumers for the Los
_�ngeles, Anaheim, and Ri��erside �rea. This percentage difference shall then establish
thc range of increased assessments allo�ved based on CPI. Should the Bureau of Labor
Statistics re�rise such index or discontinue the preparation of such index, the Cire- shall
use the re�•ised inde�: or comparable s�-stem as approved b}' the Cit�- Council for
detcrmining tluctuations in the cost of living.
If CPI is less than three percent (3.0°io), then the allo��-able adjustment to the maximum
assessment for each %one ma�- be b}� CPI, or a lesser percentagc. If CPI is greater than
three percent (3.0°'0), then the allo�vable adjustment to the proposed assessment for each
'Lone may� be three percent (3.0°�0), or a lesser percentage. The fact that an assessment
range formula is adopted for Di;trict assessments does not require that the adjustment
be applied each ti�ear, nor does it restrict the assessments to the adjustment amount. If
the budget and assessments for a gi�-en .7,one do not require an increase or the increase is
less than the allo«-able adjustment then the required budgct and assessment shall be
applied. If the budget and assessments for a gi�-en Lone require an increase greater than
the allo�vable adjustment then the proposed assessment is considered an increased
assessment and mailed notices, as �vell as propert� o�vner protest ballots are required b�-
:�rticle XIIII� to impose the assessment increase.
For Fiscal Year 2006/07, the Bureau of Labor Statistics has established CPI at �.4°•o for the
�anuar�- 200� to Januar�- 200( period. "I'herefore, the pre�-ious maximum assessment for each
Zone �vithin the District has been adjusted by 3.0°'o to establish the current maaimum
assessment allo«,�ed.

IV. DISTRICT BUDGETS
A. Description of Budget Items
The follo«-ing describes the ser�ices and costs that are funded through the District, sho�vn in
the District Budgets.
DIRECT COSTS:
Maintenance Costs — Includes contracted labor, material and equipment required to
properl� maintain the landscaping, irrigation s}-stems, drainage systems, fencing, and entrS�
monuments �inthin the Zone.
Landscape Utilitie� Includes utilit�- costs for water required to irrigate landscaped areas
and the urilitt� costs for electriciry required to run irrigation s}�stems and ornamental lighting
for landscaped areas.
Landscape Extras — Includes the replacement of an�- materials and equipment needed to
make repairs to irrigation s�stems.
Tree Pruning — Includes the cost of trimming and pruning trees located �vithin the
landscaped area.
Street Lighting— L'tilit�- costs for electricit� required to operate streetlights, as well as the
maintenance of the streetlights.
Special Distrlct Services — These are ser� ices provided to a specific Zone that are outside
the normal maintenance ser��ices provided b�- the District. These costs and ser�-ices may�
include, but are not limited to the following:
• Specialized maintenance and equipment necessar� for landscaped areas and appurtenant
facilities associated «rith dr}- �vells, retention basins and detention basins ��-ithin the Zone.
� The additional cost of contracted labor, material and equipment required for trirruning
trees in the public right of �vay and landscaped areas.
Maitltenance Repalts — This item includes repairs that are generall}- unforeseen and not
normall}- included in the yearly maintenance contract costs. This ma}- include repair of
damaged amenities due to vandalism, storms, frost, etc. Also included may be planned
upgrades that pro� ide a direct benefit to the Zone. These upgrades could include replacing
plant materials and/or renovation of irrigation or lighting s}�stems.

ADMINISTRATION COSTS:
Disttict Administration —"I'he cost to particular deparunents and staff of the Cit}', for
providing the coordination of District scr�-ices and operations, response to public concerns
and educaaon, as �vell as procedures associated «rith the le�-�• and collection of assessments.
"I'his item also includes the costs of contracting «-ith professionals to provide administrati��e,
legal or engineering sen�ices specific to the District including required notices, mailings or
propertt� ou�ncr protest ballot proceedings.
County Admtnistration Fee — This is the cost to the Lone for the Counn� to collect
llistrict assessments on the propert�- tas Uills.
Coutttv Pet Parcel Fee —"1'his is the cost to each Zone for the Count� to collect
assessments on the propert�- tax bills. This charge is on a per assessment basis and is
currendy� estimated at $0.16 per assessment. This cost is in addition to the Counn-
:ldministration F'ee.

LEVY BREAKDOWN:
Reserve Collection/(Transfet� The Reser�-e :�ccount item is provided for collection bS�
thc District of funds to operate the 'Lone from the time period of Jul� 1(beginning of the
fiscal �-ear) through appro.r-imatel�- Januar�� when the CountS- pro�-ides the Cit�- ���ith the first
installment of assessments collected from thc propern- tax bills. Negati�-e amounts sho«�n
for these budget items are transfers from the reser�-e tund that are used to rcduce the
Balance to I.e��y. "1'he Reser��e Fund eliminates the need for the Cit�- to transfer funds from
non-District accounts.
Other Revenues /General Fund Contribution — This item includes additional funds
designated for the %one that are not from District assessments. These funds are added to the
lone account to reduce assessments, and ma} be from either non-District or District
sources including Cin- General Fund Contributions and interest earnings.
Balance to Levy — This is the total amount to be collected for the current fiscal �-ear
through assessments (for special benefits) or from other revenue sources (for general
benefits). 'I'he Balance to I.e�-�- represents the sum of '1'otal Direct and �dministration Costs,
the Reser�re :lccount/Other Re�-enue Source, the Beginning I3alance, and the Contribution
Replenishment. Only- those costs related to the impro�•ements identitied as special benefits
are levied and collected on the tas roll.

DISTRICT STATISTICS:
TotaJParcels—The total number of parcels within the Zone boundar�-.
Total Patcels Levted — The total number of parcels within the Zone that are assessed.
Non-assessable lots or parcels may include parcels of land principallS- encumbered b�- public
right-of-�>a�-s, easements, common areas, and/or parcels �vithin the boundaries of the Zone
that currendy do not benefit from the impro��ements due possibl�- to de�>elopment
restrictions.
Total Equivalertt Betieftt U�tits (EBU) — Equi�•alent Benefit Unit (EBL') is a numeric
�ralue calculated for each parcel based on the parcel's land use and size. The EBL: shown in
the Zone budget, (Section IV B), represents the sum total of the parcel EBUs that receive
special benefits from the improvements.
Levy per EBU— This amount represents the rate being applied to each parcel's individual
EBU. The I.e�-�- per Equivalent Benefit Unit is the result of dividing the total Balance to
Le�-��, by the sum of the Zone EBL's, for the fiscal }�ear.

appro�•ed le�-�� and collecuon of assessments for the fiscal S�ear. 'I'he parcels and the amount of
assessment to bc le�ied shall be submitted to the Count�� �uditor/Controller and included on the
propern' ta:c roll for the fiscal �-ear.
If an}- parcel submitted for collecdon is idendfied bt• the Count� :�uditor/Controller to be an in� alid
parcel number for the current fiscal year, a corrected parcel number and/or ne�v parcel numbers �vill
be identified and resubmitted to the Counn• ��uditor/Controller. The assessment amount to be le�•ied
and collected for the resubmitted parcel or parcels shall be based on the method of apportionment
and assessment ratc approved in this Report. Therefore, if a single parcel has changed to multiple
parcels, the assessment amount applied to each of the new� parcels shall be recalculated and applied
according to che appro�-ed method of apportionment and assessment rate rather than a proportionate
share of the original assessment.
