DISCUSSION: The City of Palm Desert has received a letter from the Bureau of Land Management (BLM) requesting that the City consider providing graffiti and trash removal services to the BLM on the area adjacent to Highway 74 from City limits to the Sugarloaf Cafe, a distance of approximately seven miles. Staff has evaluated the request and determined that the service would require an average of 16 man-hours per week in the form of a two -person crew one day per week, and would include the use of the graffiti removal truck and supplies. The cost of the two workers and the truck combined is estimated at $189.00 per hour, or $78,624.00 per year. In addition, some of the graffiti and trash is located in inaccessible areas that may require specialized equipment, such as climbing gear, to access. This would require additional specialized training for this crew and was not factored into the cost assessment. Providing these services will impact our operations within the City of Palm Desert by occupying an average of 20% of this crew's time. It follows, then, that there would be an approximately 20% decrease in the amount of work performed for the City by these Reimbursement Agreement Hwy 74 Graffiti and Trash Removal Page 2 of 2 June 8, 2006 maintenance workers. The benefit to entering into this agreement would be an enhanced image of the City as the Highway 74 route is one of the "gateways" to the City of Palm Desert. Therefore, staff recommends that City Council authorize the City Manager to enter into an agreement with the Bureau of Land Management to provide graffiti and trash removal services in the area adjacent to Highway 74 from the City of Palm Desert limits to Sugarloaf. Buford Crites, City Councilman, originated the concept of the City being on "retainer" to expedite graffiti removal in hopes of minimizing occurrences of copycat acts. I fully support this approach of coopmtively addressing graffiti removal to enhance public enjoyment of the National Monument and, at the same time, ensure that natural features along this key portal to tho City remain as pristine as possible. During the month of May, I will draft a cooperative agreement that, if approved, will allow the allocation of funds to the City for covered projects. As we discussed, the City will be reimbursed for funds expended for the removal of gmf5ti to date along plighway 74. I would also like to address the issue of trash removal at Vista Point through the cooperative agreement. As you know, considerable trash accumulates on a regular basis on the hillside just below the parking area. Although Vista Point is within a CalTrans right -cif -way, the underlying lands are under jurisdiction of the BLM. It is my desire to regularly schedule volunteer clean-up efforts at the site. I would like to include the collection of trash bags -from these volunteer efforts as part of the "retainer" with the City. This element of the cooperative agreement could also extend to trash collection efforts at the Art Smith Trailhead. Forest Service (USFS)/Santa Rosa and San Jacinto Mountains National Monument (Monument) whereupon funds would be provided to the City for removal of s 'affiti on an as -needed basis along Highway 74 within the Monument Collection of trash at specific locations along Highway 74 was also briefly touched upon in the letter. On May 23, 2006,1 received a letter from Mr. Ortega requesting a draft of the Cooperative Agreement as soon as possible in order to place the hero on the City Council agenda either June 8 or June 22, On June 1,1 received a copy of the Public Works Department's Staff Report recommending the City Manager to enter into a reimbursement agreement with BLM to provide graffiti and trash removal services along Highway 74 from the City of Palm Desert to the Sugarloaf Cale, Based on an evaluation of labor and equipment required to perform the duties, the estimated cost of two workers, the graffiti removal truck, and supplies is $189 00 per hour, or $78,624,00 per year, On June 3, 2006, I discussed the matter with Buford Crites, City Councilman, to determine how our mutual objectives of graffiti removal along Highway 74 and trash collection at Vista Point could best be addressed within current budgetary limitations of BLMfUSFS/Monument Terns of the proposed Cooperative Agreement, which reflect my discussion with Mr Crites, are described below, i have provided specificity for purposes of clarity.. Jun: 6. 2006 1:12Ptt1 PALM SPRINGS SOUTH COAST F,0 No.8292 P. 3/3 Rcauest The Bureau of Land Management requests the City of Palm Desert to consider entering into a Cooperative Agreement between the two parties to address graffiti removal along Highway 74 within the Santa Rosa and San Jacinto Mountains National Monument, and trash collection at Vista Point, also on Highway 74 within the Monument Proposed terms of the Cooperative Agreement are as follows. ® The City would continue to remove graffiti and collect trash at Vista Point on a weekly basis. Costs for these actions would be borne by the City. • On a weekly basis, BLM would determine the need for graffiti removal along Highway 74 within the boundaries of the Monument, except at Vista Point, and request graffiti removal on an as - needed basis. Requests would include specific locations relative to posted road mileages. + Upon receipt of a request for graffiti removal on Highway 74 at 1o9ations other than Vista Point, the City would undertake such removal on the same day that graffiti removal and trash collection occur at Vista Point. + Costs for graffiti removal along Highway 74 at locations other than Vista Point would be borne by BLM. BLM would provide no more than .$ 10,000.00 for the remainder of the current federal fiscal year, which ends on September 30, 2006, for this project. These funds would be provided as a lump sum amount to the City against which the City may draw funds as needed as reimbursement for costs of graffiti removal at locations other than Vista Point, and in accordance with the terms established in the Cooperative Agreement. • The City would draw funds from this account at the rate of $189.00 per hour, which covers the cost of two City employees, one truck equipped for removing graffiti, and graffiti removal supplies. • Hourly charges against the BLM funds for graffiti removal at locations south/uphill of Vista Point would commence when the City workers and truck depart Vista Point, and would stop when the workers and truck reach Vista Point on the return trip. Hourly charges for driving to and from Vista Point would not be incurred by BLM. • Hourly charges against the BLM funds for graffiti removal at locations north/downhill of Vista Point would be for graffiti removal only. Hourly charges for driving to and from these locations would not be incurred by BLM as the City would have normally incurred these costs for its weekly scheduled actions at Vista Point - • Any funds remaining in the account at the end of the federal fiscal year may be carried over by the City for use during the subsequent federal fiscal year which begins on October 1. + When BLM funds are used for graffiti removal, the City would provide the following information to BLM within one week of occurrence: (1) date of action; (2) location of action; (3) hours required to complete graffiti removal; (4) reimbursement amount from BLM funds; and (5) balance of BLM funds in the account Funding to the City from BLM for the graffiti removal project is contingent on approval of a Statement of Programmatic involvement, the Cooperative Agreement, and the related Assistance Agreement Currently, funds in the amount of $10,000 are available for the project_ If you have any questions, please don't hesitate to call me at (760) 251-4836 cc: Buford Crites
