Application of Verna Smith By Minute Motion, appoint Verna Smith to the Housing Commission to fill the at -large position formerly held by Dr. Roger Dash (term 12/31 /09). Background: The Housing Commission currently has vacancies an at -large member and a resident member. Ms. Smith made application for Committee/Commission Service in February 2006 and has since been regularly attending the Commission's Meetings. She is interested in serving in this capacity, and Commissioners and City staff believe she will be a welcome addition to this body. Search # Print 2.64.010 Housing authority established. Pursuant to resolution adopted on December 11, 1997, the city council (the "city council") of the city of Palm Desert (the "city") established the Palm Desert housing authority (the "authority") and declared itself to be the commissioners of the authority pursuant to the Housing Authorities Law (California Health and Safety Code Section 34200 et seq.) (the "Law"). (Ord. 861 § 1, 1998) 2.64.020 Housing commission, created. Pursuant to Section 34291 of the Law, a governing body of a city which has declared itself to be the commissioners of a housing authority may, by ordinance, create a housing commission. A housing commission is created and established. Such housing commission may be known and referred to as the "Palm Desert housing commission" or the "housing commission". (Ord. 861 § 2, 1998) 2.64.030 Members. — The housing commission shall consist of seven members who shall be residents of the city. Two of the members shall be appointed as tenants of the authority and one of the tenant appointments shall be over sixty-two years of age if the authority has tenants over that age. If a tenant appointment to the housing commission ceases to be a tenant of the authority, he or she shall be disqualified from being a member and another tenant of the authority shall be appointed by the city council to the remainder of the unexpired term. The successor to a tenant appointment shall be a tenant of the authority. (Ord. 885 § 1, 1998: Ord. 861 § 3, 1998) 2.64.040 Appointments. Individual council members may recommend members for the collective nomination and ratification by the city council. Appointments shall be made at a regular city council meeting. (Ord. 861 § 4, 1998) 2.64.050 Term. Each member of the housing commission shall serve a four-year term and shall otherwise be subject to the terms of membership pursuant to Section 2.34.010. (Ord. 1017 § 5, 2003: Ord. 885 § 2, 1998: Ord. 861 § 5, 1998) 2.64.060 Vacancies. Vacancies on the housing commission shall be filled by appointment by the city council. (Ord. 861 § 6, 1998) 2.64.070 Absence from meetings. Absences from housing commission meetings shall be recorded pursuant to Sections 2.34.010(D) and 2.34.020. (Ord. 1017 § 6, 2003: Ord. 861 § 7, 1998) 2.64.080 Regular meetings. Regular meeting days of the housing commission shall be determined by resolution of the housing commission, except that the board shall meet at least once each month. (Ord. 861 § 8, 1998) 2.64.090 Duties. http://gcode.us/codes/palmdesert/view.php?topic=2-2_64&expand= 1 6/ 14/2006 Chapter 2.64 HOUSING COMMISSION Page 2 of 2 The housing commission shall have the power and be required to review and make recommendations on all matters to come before the authority prior to authority action, except emergency matters and matters which the housing commission, by resolution, excludes from the housing commission's review. (Ord. 861 § 9, 1998) 2.64.100 Procedures for review and recommendation —Further functions. Before a matter is acted upon by the authority, the matter shall be submitted to the housing commission for its review and recommendation. Within thirty days after a matter is submitted to the housing commission for its review and recommendation, the housing commission shall make and file its report thereon with the authority. If the housing commission does not report upon the matter within thirty days after its submission by the authority, the housing commission shall be deemed to have waived its review and recommendations concerning the matter and the authority may thereafter approve the matter without the report of the housing commission. From time to time, the city council may, by ordinance or resolution, amend the procedures set forth in this section or provide for additional procedures for review and recommendation, and for further functions of the housing commission. (Ord. 861 § 10, 1998) 2.64.110 Records. Accurate and permanent records of the acts of the housing commission shall be kept, and such records shall have the same status as records of other administrative departments of the city. (Ord. 861 § 11, 1998) 2.64.120 Organization. The housing commission shall elect one of its members as chairperson and such election shall be held as soon as practicable after each new term commences. The housing commission shall adopt such rules and regulations as it deems necessary to provide for its other officers and their method of selection, and for other matters relative to its work and administration. Minutes, resolutions and official records of the housing commission shall be filed with the city clerk. (Ord. 861 § 12, 1998) 2.64.130 Housing commission members appointed as relocation appeals board. A. Health and Safety Code Section 33417.5 provides that there is in each city having a redevelopment agency a relocation appeals board composed of five members appointed by the mayor of the city, subject to the approval of the legislative body. B. By prior resolution, the mayor of the city of Palm Desert appointed five members of the Palm Desert housing authority commission as the members of the relocation appeals board and the city council approved such appointment. C. Pursuant to Section 6152 of the Relocation Assistance and Real Property Acquisition Guidelines (Chapter 6 of Title 25 of the California Code of Regulations, commencing with Section 6000), the city council designates the relocation appeals board to hear the appeals of all persons who make a written request for formal review and reconsideration of the determinations of the city of Palm Desert (the "city") and the Palm Desert housing authority (the "authority") as to eligibility and the amount of payment, and to hear the appeals of all persons who make a written request for formal review and reconsideration regarding the city's or the authority's actions with respect to referrals to comparable permanent or adequate temporary replacement housing or the city's or authority's property management practices. (Ord. 926A §§ 1-3, 1999) 2.64.140 Compensation and reimbursement. Compensation shall be paid to each member of the Palm Desert housing authority in the amount of fifty dollars ($50.00) per member per meeting not to exceed four meetings per month and shall increase in the same amount as may be prescribed by Section 34274 of the Health and Safety Code of the State of California. Said compensation shall be in addition to reimbursement for actual and necessary expenses incurred in the discharge of their duties. This section shall be in full force and effect on September 1, 2003.
