Recommendation:
By minute motion, approve Amendment No. 2 to Contract C22310 with RBF
Consulting, Inc. in the amount of $135,990.00 for additional engineering
services to complete Project Approval Reports and Environmental
Documentation for the Ramp Modifications at the Monterey Avenue
Interchange on Interstate 10.
Discussion:
On February 12, 2004, City Council approved Contract C22310 with RBF Consulting, Inc. in
the amount of $199,030.00 for engineering services to prepare the project approval report
and environmental documentation for the proposed westbound on- and off -ramp
modifications at the Monterey Interchange on Interstate 10 (1-10). The ramp modifications
consist of realigning the westbound 1-10 off -ramp to Varner Road and inserting either a loop
or hook on -ramp from northbound Monterey Avenue to westbound 1-10. This will eliminate
the congestion and queuing experienced on north bound Monterey Avenue for vehicles
entering the westbound 1-10 on -ramp. On October 28, 2004, City Council approved
Amendment 1 to Contract C22310 in the amount of $50,070.00 for additional services to
meet Caltrans and FHWA requirements including CEQA compliance, a Natural
Environmental Study, Biological Assessment, Acoustical Study, and for other direct costs.
The contract between the City and RBF was originally negotiated with the aim of obtaining
gaining project and environmental approval on more simplified and fast -track basis.
Generally, a Project Study Report (PSR) is prepared and approved as a programming
document then following by the preparation and approval of a Project Report (PR) and
environmental document. The scope of work and associated fee was based upon a

combined PR and PSR. However, the fast -track scenario has not been achieved because
of the following reasons:
• Changes to the consultant, Caltrans, and City project managers caused discontinuity
and loss of time for new project managers to become familiar with the project and
deal with issues.
• Caltrans has taken more time to perform reviews of documents than originally
scheduled.
• Changes in Caltrans and FHWA requirements for preparation and processing of
reports and environmental studies.
• The combined PR/PSR has precipitated Caltrans procedural hurdles that have
delayed its approval.
Because of the above reasons, the impact upon the project approval process and schedule
has been significant. The original schedule specified a 22-month period to gain project and
environmental approval. According to the current schedule, this process will take 36 to 40
months to complete. After project approval and environmental clearance is obtained, RBF
can proceed with preparation of plans, specifications and estimate (PS&E). Staff has been
aggressively communicating and meeting with Caltrans to obtain their commitment to 1)
adhere to the agreed document review times and 2) strategize and establish a schedule to
complete the environmental process and PS&E. The communications and meetings with
Caltrans have been elevated to the District 8 Director, Michael Perovich. See attached
letter.
The following is the current draft schedule for completion of project that may possible be
reduced as the result of the meetings taking place with Caltrans:

Staff has prepared Amendment 2 to Contract C22310 resulting from negotiations with RBF
for the additional services to complete the project approval and environmental process. The
additional services includes the following:
• Studying a spread diamond interchange so that it could be eliminated from future
consideration.
• Performing additional traffic analysis to include the future Portola Interchange and
the eastbound ramps at Monterey Avenue.
• Performing a field survey for the Coachella Mild Vetch.
• Preparing a Visual Assessment Report.
• Preparing a Cooperative Agreement Report and Fact Sheet.
• Updating the topographic mapping and noise study.

• Updating the topographic mapping and noise study.
• Preparing advance planning studies for the propose retaining wall.
• Preparing Modified Access Report that meets new FHWA requirements.
• Conducting additional project meetings and providing additional project management
services for the extended duration to gain project and environmental approval.
Staff has determined that the negotiated cost for these additional services is equitable and
recommends that City Council, by minute motion, approve Amendment 2 to Contract
C22310 with RBF, Inc. in the amount of $135,990.00. Funds for this amendment are
available in Project Account No. 213-4389-433-4001.

Dear Mr. Perovich:
In March 2004, the City of Palm Desert hired RBF Consulting to complete the Project
Approval/Environmental Documentation Phase and PS&E for the subject project. The
modification of the westbound Monterey Avenue on and off ramps is of extreme
importance to the City of Palm Desert. Monterey Avenue is a major street that serves
as the major access for business, residential, and visitor traffic to the City. Also, traffic
volumes have greatly increased due to the recent commercial development adjacent to
the interchange including Home Depot, Sam's Club, and the Super Wal-Mart. This
project will provide needed relief to the congestion on Monterey Avenue caused by
traffic wishing to enter and exit westbound Interstate 10.
Since inception, various delays caused primarily by changes in Caltrans, consultant,
and City staff, changes in Caltrans requirements, and the extended review times by
Caltrans of the various submittals have all plagued the delivery of this project. I have
recently learned of a possible change again in the assignment of the Caltrans project
manager. The PR/PSR document, approved by Caltrans to facilitate and expedite the
project approval process, continues to be questioned and we receive conflicting and late
comments on the review of the PANED documents. For instance, the Administrative
Draft Initial study was submitted to Caltrans for review in early December 2005. To date,
we have not received any comments from Caltrans.

It seems that the longer it takes to complete PA/ED and PS&E, the greater chance for
changes in Caltrans procedures and requirements. For example, the geometric
approval drawings and other reports are being prepared in metric and we are concerned
that the March 2007 Caltrans deadline for accepting a PS&E in metric will precipitate a
change and cost impact to our consultant design contract with RBF. This ramp
modification project is relatively straightforward and does not have any substantial
environmental impacts that cannot be easily mitigated.
I attended a local American Public Works Association meeting recently, at which you
were a guest speaker. At this meeting, you stated that you and Caltrans were
committed to working with local agencies to facilitate the delivery of their projects.
would like to meet with your key staff and RBF to discuss in detail the status and
schedule of the project and explore ways we could make up some of the lost time so we
can deliver this important project.

Re: Monterey Avenue Interchange at Interstate 10 — Additional Work Request for
PANED Phase
Dear Mr. Garcia:
RBF is submitting this additional work request for the Monterey Avenue and 1-10 interchange
Improvement project. As the project progresses through the Environmental Approval phase of
work, new work plan items pertaining to the document format, environmental studies, and
retaining wall tasks have been added to the project work items.
The following tasks are related to our Phase I work plan for the PSR/PR and Environmental
Document processing:
Task 1: Proiect Report / Proiect Studv Report
Through the progress of the combined project initiation and project approval phase, the
following several additional task items required work effort to prepare this task item:
a) The Spread Diamond Alternative was an additional alternative that was requested by
Caltrans and FHWA to include into the study. This alternative analysis required
preparation of plans and cost estimates depicting the impacts to surrounding
communities, and roadway systems.
b1) Due to the proposed Portola Avenue Interchange, additional traffic analysis were
required by Caltrans that were not a part of the original traffic scope such as merge /
diverge analysis and construction completion year analysis with and without the Portola
Avenue interchange for all the alternatives. Caltrans personnel have also requested
RBF prepare and submit traffic Synchro analysis of each proposed alternative.
b2) Caltrans staff has requested that the traffic analysis be updated to include alternatives
for an ultimate interchange configuration for year 2030. This process involves
analyzing improvements to eastbound ramps for LOS or better. The ultimate
improvements must also consider improvements to the mainline to maintain an
adequate level -of -service.

c) Caltrans has requested the project approval document be changed from a PSR/PR to a
PR/PSR. Caltrans, district personnel, approved the original scope of work in 2004. Per
the Caltrans Project Development Procedures Manual (PDPM), Article 12 of chapter 9,
the purpose of a combined Project Study Report / Project Report is to streamline the
project development process by providing for the preparation of a single engineering
report for noncomplex, noncontroversial State Highway projects. Due to environmental
concerns by Caltrans staff, the document has been altered to a 2 step approval
document. This requires the PR/PSR several more submittals and reviews by Caltrans.
A formal "Draft PR/PSR" is required to be signed by the District Director of Caltrans.
After the Draft PR/PSR is approved, the document is modified and re -submitted as a
"PR/PSR" for signature. Similar to the process of a Draft PR signature, and a PR
signature as outlined in Chapter 10 of the PDPM.
Task 2: Focused Survev for the Coachella Vallev Milk -Vetch
Our environmental sub consultant performed a site -specific survey in Spring 2005, for the
existence of the Coachella Valley Milk -Vetch plant. The months of March and April are the
appropriate timing for this survey, and can only be accomplished per protocol during the
springtime blooming period.
As agreed upon by the project team last year, a preliminary field reconnaissance was
performed last summer. It was known last year and has been verified by Caltrans that this field
reconnaissance in 2004 was not performed according to protocol, for it was the end of the
survey season and the survey season was more of an assessment of suitable habitat, which
happened to find one remaining plant. Since time has lapsed since the last reconnaissance
survey, it is necessary to perform an updated survey, according to established protocols. This
task item was not anticipated and is not a part of RBF's original work plan and is therefore
being submitted as an additional work request. This task was approved by the City of Palm
Desert before work was performed.
Task 3: Visual Impact Assessment Report
The County of Riverside is currently in the process of completing a landscape project that will
be impacted by the proposed interchange modifications in the north-east quadrant of the
Monterey Avenue / 1-10 Interchange. The current landscape project has been approved by
Caltrans and is in the construction phase by the County of Riverside.
A Visual Impact Assessment describing the existing visual character of the project and future
landscape improvements will be provided for the north side of the Interstate 10 Monterey
Interchange. The visual character will focus on the vehicular lights impact from the off ramp
towards adjacent housing and the west freeway view driving towards Los Angeles. This
information will be utilized to determine the requirement to perform a formal Visual Impact
Assessment (VIA) consistent with the FHWA's Visual Impact Assessment for Highway
Projects.

The Visual Impact Assessment report will include existing site photo images, photo
composition, a written project landscape development description, and a preliminary
conceptual landscape plans with a plant palette and plant images for the three (3) alternatives.
A maximum of six (6) pages will be prepared for the Visual Impact Assessment Report.
Consultant will prepare the VIA based on the visual effects of the project. Consultant will
respond to one comprehensive set of comments submitted by the City and the Caltrans.
Task Item 4: Cooperative Agreement Resort and Cooperative Aareement Fact Sheet
The City has requested RBF to prepare a Cooperative Agreement Report (CAR) and CAR Fact
Sheet. The CAR is prepared to provide supporting information for the preparation of the
Cooperative Agreement between the City and Caltrans to define the responsibilities regarding
the design and construction of the proposed project. The CAR Fact Sheet is the summary of
the CAR for quick reference of the details of the project. Both of these documents were
prepared in accordance to Caltrans standard CAR formats. Per latest Caltrans requirements,
the CAR and CAR fact sheets are stand alone documents that do not require the Department
personnel to reference other documents.
Task Item 5: Existing Topoaraphv Map Update
A privately owned self -storage facility is currently being built north of Varner Road and east of
Monterey Avenue. The self -storage facility was not a part of the existing topography during the
compilation of the original ground topography and will require effort to update the topography
map with the facility. Construction documents will need to be acquired from the County of
Riverside and converted from English to metric units before incorporation into the project
topography.
Task Item 6: Additional Noise Studv
In conjunction with the construction of the self -storage facility, the noise report will require
additional analysis to include the effects of noise to the adjacent residences by the proposed
traffic with the self -storage facility to the north of the proposed freeway ramps. The noise
model will need to be updated to include the self -storage facility and the effects of the
proposed buildings will need to be analyzed in contrast to the existing conditions. Alternate
soundwall locations and/or wall heights will need to be re-evaluated to assess the change in
site topography.
Task Item 7: Advance Plannina Studv
In accordance with the Caltrans PDPM the PR/PSR will require advance planning study for the
proposed retaining wall adjacent to the westbound onramp under the Monterey Avenue
northbound bridge abutment. RBF will be required to prepare one for each of the three
alternatives.

Task Item 8: Modified Access Report
Due to the FHWA change in MAR criteria, additional work effort is required to prepare and
obtain approval of a Modified Access Report. RBF was originally scoped to prepare a
previously approved FHWA version. In January 2006, FHWA directed Caltrans to rescope the
MAR document. No longer is the MAR a synopsis of the project approval document with
information relative to FHWA summarized, but a stand alone document with all pertinent
information attached. In essence the MAR is a separate Project Study Report in FHWA format.
Proiect Schedule
RBF originally scoped this phase of the project to have duration of 12 months. Due to the
change of the document format, changes in Caltrans personnel, the schedule has extended 15
months. This change requires additional meeting time and project management activities.
Fee
In summary, RBF Consulting is requesting a net increase to our contract in the amount of
$135,990.00. This increase accounts for the original contract contingency as being included as
authorized and in place for the contract.

species, which can vary depending on rainfall and temperature. Therefore, reference populations
will be monitored to determine the appropriate survey time. Two separate surveys, early spring and
late spring, will be conducted to obtain an accurate number of plants on the project site. Plants
observed during the early spring survey will be tagged and photographed, and a geographic
positioning system (GPS) point shall be recorded. The focused surveys will be conducted using
meandering transects throughout the suitable habitat on the site. Field notes will be taken during
the survey.
Upon completion of the survey effort, a letter report and map will be prepared based on the survey
findings. The letter will include a methods and results section with location and descriptions of all
special status plant species found.

Subject: Budge Augment Request for Out -of -Scope Noise impact Study for Monterey Avenue/
I-10 Interchange Project
Dear Mr. Hart:
At your request, LSA Associates, Inc. (LSA) has conducted a noise impact analysis and responded to
Caltrans comments due to changes in the site plan for the Monterey Avenue/I-10 Interchange project.
Many tasks spent on the changes in the site plan were not included in our original scope of work and
require additional budget for the effort spent on the changes and revisions to the noise study report. The
following summarizes LSA's effort beyond the original scope and budget.
First Draft
1. LSA did not receive the correct CAD files (topo) for the project area. Jason Lui had to coordinate
with Tony Ng to get the correct files. LSA kept receiving CAD files that were obviously

outdated files. Time was also spent on verifying the CAD files provided by RBF-

1. LSA again spent time coordinating with Tony Ng to obtain the correct CAD files. The files first
received were not in the same projection as the previous version, and the files did not show the
correct layers.
LSA spent time coordinating with Tony Ng on getting the Monterey Self -Storage Facility plans.
The plans received were hard copies. Jason Lui had to model the Monterey Self -Storage Facility.
with the hard copy. LSA requested plans in a digital format, which would make it easier to
incorporate into the noise model. having the digital copy of the storage facility would have taken
less time.
3. Because the revised CAD files were in a different projection from the previous version, Jason
Lui had to spend time coordinating with LSA GiS stiff and RBF to get a workable set of files to
use for the figures in the noise report. As these.files were problematic, Jason Lui had to review
the report figures multiple times and coordinate with LSA GIS staff to get them revised.

In order to keep the project moving and not delay the schedule, LSA revised the noise impact analysis to
reflect the changes in the site plan. In addition, LSA revised the noise study report to incorporate these
changes into the noise impacts and their associated discussions. LSA has completed the noise impact
analysis revision tasks with an additional cost of$2,500. Therefore, ),SA is requesting a budget augment
