REQUEST: Approve changes to the City of Palm Desert Salary/Benefits Package.

Resolution No. 06-34, revised Salary Resolution and Salary Schedule
Resolution No. 06-33, Amendment to Resolution #99-60 establishing the
City's Section 125 Cafeteria Plan

Recommendation:
Waive Further Reading and pass to second reading Ordinance # 1112 , amending the
City's Personnel Ordinance.
Waive Further Reading and adopt Resolution No. 06-34 , rescinding and replacing
Resolution No. 05-49, a Resolution of the City of Palm Desert Salary Schedule, Salary
Ranges, and allocated Classifications for the period March 6, 2006 through June 30, 2006.
Waive Further Reading and adopt Resolution No. 06-35 , amending Resolution No. 99-60,
establishing an Employees' Cafeteria Benefits Program.
Discussion:
In September of last year, with Council approval, staff began a review of the City's existing
salary/benefits package and entered into negotiations with the Palm Desert Employees
Organization (PDEO). This effort was necessary because of the following:
➢ Survey of staff showed that a large percentage of management staff were currently
eligible to retire;
➢ Tremendous difficulty in recruiting for management and professional positions;
➢ Market survey data, including the Indian Wells Salary Survey, indicated we were
behind the market in many key positions;
The City Manager's negotiating team has been meeting with the PDEO Board of Directors in
a good faith effort to adjust our compensation package both in terms of market equity and the

benefits structure, specifically the cafeteria plan. These negotiations produced an agreement
which is presented to you as follows:
1. Adopt and implement the 7-step Compensation Plan, effective March 6, 2006.
2. Redesign the cafeteria plan by eliminating any excess "cash out" based on plan
choice or family size.
3. Increase the salary for all positions that receive a salary by $500/month.
4. Set and annually adjust the maximum City paid health plan coverage for
employees and dependents at the PersChoice rate.
5. Provide a flat $50.00/month as a flex plan credit component of the cafeteria plan.
6. Provide a flat $150/month additional flex plan credit to employees who "opt out" in
lieu of coverage.
7. Newly hired employees are required to serve a minimum of 6-months in
probationary status with the provisions described in City of Palm Desert Municipal
Code Section 2.52.305. However, merit step increase eligibility will be on the one-
year anniversary of hire rather than current 6-month eligibility.
The PDEO membership voted and the ballots were counted Monday, February 27, 2006, with
a 93% vote in favor of the agreement. Staff has met with non -represented personnel over the
course of these negotiations and these meetings have resulted in positive concurrence. Staff
will be available to answer any questions the City Council may have.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, RESCINDS RESOLUTION NO.05-49, "EXHIBIT
A" SALARY SCHEDULE, SALARY RANGES, AND ALLOCATED
CLASSIFICATIONS FOR THE PERIOD OF MARCH 6, 2006 THROUGH
JUNE 30, 2006.
WHEREAS, the City of Palm Desert has met and conferred in good faith with the
Palm Desert Employees Organization (PDEO) in accordance with the Meyers-Milias-Brown
Act and the City employer - employee relations Resolution No. 81-89; and
WHEREAS, the City of Palm Desert has reached agreement with the employees
represented by the Palm Desert Employees Organization, for the period July 1, 2001
through June 30, 2006.
WHEREAS, the modification to "EXHIBIT A" does not change the MOU/Agreement
previously entered in between the Palm Desert Employees Organization and the City of
Palm Desert.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PALM DESERT AS FOLLOWS:
SECTION I - SALARY SCHEDULE, RANGES & ALLOCATED CLASSIFICATIONS
All employees shall be classified and shall receive compensation for services performed.
This compensation shall be in accordance with the established salary schedule and salary
ranges for their respective classification as shown below.
This schedule of allocated positions supersedes the schedule of allocated positions in the
2005/2006 approved budget.
The City of Palm Desert's Personnel System, Section 2.52 of the Palm Desert Municipal
Code prescribes specific terms for appointment and tenure of all City employees.

SECTION V - OTHER COMPENSATION
While this resolution establishes the ranges and gross salary for certain positions in the
classified service for the City of Palm Desert, there are other benefits both tangible and
intangible that are not addressed in this document. Unless referenced otherwise, all
benefits in place on March 6, 2006, will continue as constituted.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA AMENDING RESOLUTION NO. 99-60,
ADOPTING PROVISIONS CONTAINED IN THE ATTACHED FLEX
CREDITS AMENDMENT DOCUMENT "EXHIBIT A".
WHEREAS, the City of Palm Desert has met and conferred in good faith with the
Palm Desert Employees Organization (PDEO) in accordance with the Meyers-Milias-
Brown Act and the City employer - employee relations Resolution No. 81-89; and
WHEREAS, the City of Palm Desert has reached agreement with the employees
represented by the Palm Desert Employees Organization, for the period July 1, 2001
through June 30, 2006.
WHEREAS, the modification to the Cities Cafeteria Benefit Program "EXHIBIT A"
has been agreed to between the Palm Desert Employees Organization and the City of
Palm Desert.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Palm
Desert, California, adopt the attached amendment to it's cafeteria plan document in
accordance with the Internal Revenue Code Section 125.

EXHIBIT A
CITY OF PALM DESERT
FLEX CREDITS ADDENDUM
DEFINITIONS
1.211 Flex Credits or "Nonelective Contribution(s)"— Those dollar amounts which an Employee
may allocate to obtain benefits.
1.212 Flex Plan Credit Allocation Worksheet — An agreement between an Employee and the
Employer under which the Employer reduces the Employee's current salary and the Employer
contributes the amount of the reduction to the plan on behalf of the Employee, as a before -tax
contribution.
The Flex Plan Credit Allocation Worksheet will be in a form which permits the Employer to reduce the
Employee's current salary and contribute the amount of the reduction to the Plan on behalf of the
Employee. The Flex Plan Credit Allocation Worksheet will apply only to the amounts of the
Employee's pay that have not been actually or constructively received as of the date the worksheet is
completed. Any amounts so elected will not become currently available to the Employee. The
amount of the salary reduction elected by the Employee will be deemed to be an Employer
contribution for purposes of the Code.
ELECTION OF BENEFITS
1.213 The benefits available under the Plan for a give Plan Year are as listed on the Plan Sponsor's
"Flex Plan Schedule of Mandatory And Optional Benefits" form which is prepared by the Plan
Sponsor prior to the beginning of each Plan Year. Each Employee who elects to participate
completes his elections for a Plan Year on a Flex Plan Credit Allocation Worksheet form.
The maximum Flex Credits will be determined at the discretion of the Plan Sponsor prior to the
commencement of each Plan Year and will be uniformly applicable to all Employees. All such
amounts will be subject to review and final approval by the City's Council members. The Employer
reserves the right to reduce the amount of the Employee's Flex Plan Credit Allocation Worksheet in
order to assure compliance with the requirements of the Internal Revenue Code for favorable tax
treatment.
NOTE: If a Employee enrolls other than at the beginning of a new Plan Year, his Flex Plan Credit
Allocation Worksheet election maximums will be prorated based on the number of months he is
actually participating in the Plan.
BENEFITS
1.214 To the Extent allowed by the Plan Sponsor's "Flex Plan Schedule of Monthly Credits By
Family Size" for a given Plan Year, an Employee may apply his Flex Credits toward any of the
benefits listed in the Plan Document.
Flex Credits will be used for premium payments for coverage during the Plan Year under the
Employer's welfare benefit plans (i.e., medical, dental, and vision coverages). Premium payments
will be made directly by the Employer to the plan(s). Benefits will be payable pursuant to the terms of
the respective coverages (policies, etc.).
NOTE: Only the costs of coverages of such type which the Plan Sponsor offers pursuant to this Plan
will be eligible for this benefit.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, AMENDING CHAPTER 2.52 OF THE PALM
DESERT MUNICIPAL CODE BY AMENDING SECTIONS 2.52.420,
2.52.425, AND 2.52.430 RELATIVE TO ADVANCEMENTS WITHIN
SALARY SCHEDULES
WHEREAS, the City of Palm Desert has met and conferred in good faith with the Palm
Desert Employees Organization (PDEO) in accordance with the Meyers-Milias-Brown Act
and the City employer - employee relations Resolution No. 81-89; and
WHEREAS, the City of Palm Desert has reached agreement with the employees
represented by the Palm Desert Employees Organization, for the period July 1, 2001
through June 30, 2006.
WHEREAS, the modification to Section 2.52.420 does not change the MOU/Agreement
previously entered in between the Palm Desert Employees Organization and the City of
Palm Desert and both parties have reached agreement on the modification.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Section 2.52.420 of the Palm Desert Municipal Code is hereby amended
to read as follows:
Employees may be advanced within their respective salary schedules in accordance with
the following schedule of minimum length of service:
Step 2: 5% increase after 12 months of satisfactory service in Step 1;
Step 3: 5% increase after 12 months of satisfactory service in Step 2;
Step 4: 5% increase after 12 months of satisfactory service in Step 3;
Step 5: 5% increase after 12 months of satisfactory service in Step 4;
Step 6: 5% increase after 12 months of satisfactory service in Step 5;
Step 7: 7.5% increase after 12 months of satisfactory service in Step 6;
Section 2. Section 2.52.425 of the Palm Desert Municipal Code is hereby amended
to read as follows:

2.52.425 Advancement in salary.
All advancements require the approval of the city manager in order to become effective.
Advancement to the higher steps shall be granted only as a result of a written evaluation of
continued satisfactory performance of the duties of the position held.
Promotional Advancement. When an employee is promoted to a position with a higher
salary range, such employee shall be assigned to Step 1 of the higher classification;
provided, however, that if such employee is already being paid at a rate equal to or higher
than Step 1, he or she shall be placed in the step of the higher classification as will grant
such employee a salary increase of not Tess than five percent.
If the percentage difference between the ranges will not grant the promoted employee a
minimum of five percent salary increase, the promoted employee shall be granted the next
highest step in the new salary range.
When the effective date of a promotion is within sixty days before an employee's merit step
increase eligibility date, any merit step increase which would have been granted to become
effective on that merit step increase date, shall become effective on the effective date of
promotion and shall be in addition to the promotional increase. (Ord. 1072 (part), 2004)
Section 3. Section 2.52.430 of the Palm Desert Municipal Code is hereby amended
to read as follows:
2.52.430 Adjustment in salary —Reclassification.
The salary of an employee in a position which is reclassified, shall be determined as
follows:
A. Same Range. If the position is reclassified to a class that is allocated to the
same salary range, the salary shall not change.
B. Higher Range. If the position is reclassified to a class which is allocated to a
higher salary range, such employee shall be assigned to Step 1 of the higher
classification; provided, however, that if such employee is already being paid at
a rate equal to or higher than Step 1, he or she shall be placed in the step of
the higher classification that will grant such employee a salary increase of not
less than five percent.
When the effective date of a reclassification is within sixty days before an
employee's merit step increase eligibility date, any merit step increase which
would have been granted on that merit step increase eligibility date shall
become effective on the effective date of the reclassification and shall be in
addition to the reclassification increase.

C. Lower Range Y-rating. If a position is reclassified to a class that is allocated
to a lower salary range, the position shall be Y-rated.
The salary of a Y-rated position will remain at the rate of pay received
immediately before the reclassification until a step in the new (lower) salary
range assigned to the reclassified position equals or exceeds the employee's
rate of pay. Step advancements in the new (lower) range may be made
without increases to the employee's rate of pay.
COLA (cost -of -living adjustment) increase will not be given to Y-rated
employees until the employee's step in the new (lower) salary range equals
or exceeds the employee's rate of pay. (Ord. 1072 (part), 2004)
