RECOMMENDATION:
By Minute Motion, concur with the action taken by the Legislative Review Committee at its
Meeting of February 28, 2006, and direct staff to prepare a letter of support for the Mayor's
signature with regard to AB 1875 (Daucher) relative to landscape services.
EXECUTIVE SUMMARY:
Passage of AB 1875 would authorize local agencies to contract with private entities for
landscape services on segments of State highways within their jurisdictions and would require
the Department of Transportation to provide funds to those agencies up to the amount that
would have been expended if it had completed the landscape services.
BACKGROUND:
Existing law provides that the Department of Transportation (DOT) has full possession and
control of all state highways and all property and rights in property acquired for State highway
purposes. Existing law requires the DOT to improve and maintain these state highways and
also provides that when the California Transportation Commission or any other public entity has
allocated any funds for the construction, improvement, or maintenance of any portion of a State
highway within a city or county, the DOT is authorized to enter into a cooperative agreement
with the city or county or other public entity for the performance of the work by the DOT or by
the city of county or other public entity or for apportionment of the expense of the work between
these parties. AB 1875 would authorize local agencies to contract with private entities for
landscape services on any segment of a state highway within its jurisdiction. The bill would
require the DOT to provide funds to the city or county up to the amount that would have been
expended by DOT if it completed landscape services on those segments of the state highway.

Passage of this legislation would allow the City of Palm Desert to contract for services so that
landscaping on State highways, particularly those that are entryways to the City, will be in
keeping with the flavor of the community and will allow it to be reimbursed for costs expended.
Therefore, the Legislative Review Committee recommends that the City Council support AB
1875 and direct staff to prepare a letter stating that position to appropriate legislators for the
Mayor's signature.

An act to add Section 114.1 to the Streets and Highways Code,
relating tc transportation.
LEGISLATIVE COUNSEL'S DIGEST
AB 1875, as introduced, Daucher State highways: landscape
services.
Existing law provides that the Department of Transportation has

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 114.1 is added to the Streets and Highways
Code, to read:
114.1. A city or county may contract with private entities for
landscape services on any segment of a state highway within the city
or county. If a city or county contracts with a private entity for
landscape services under this section, the department shall provide
funds to the city or county up to the amount that would have been
expended by the department if it completed landscape services on
those segments of the state highway.
