Recommendation:
Concur with staff recommendation and adopt Ordinance No. ili5 repealing
Ordinance No. 741 and Ordinance No. 761, thereby revoking the prohibition of
through commercial vehicles on Fred Waring Drive from Monterey Avenue to
Cook Street between the hours of 9:00 PM and 9:00 AM, and designating
Washington Street and Dinah Shore Drive as Truck Routes in the City of Palm
Desert.
Background:
Fred Waring Drive is designated as a truck route in Palm Desert. In 1994, the City
Council passed Ordinance No. 741 and Ordinance No. 761, establishing a prohibition of
through commercial vehicles on Fred Waring Drive from Monterey Avenue to Cook
Street between the hours of 9:00 PM and 9:00 AM. The ordinances were enacted in
response to concerns of Fred Waring Drive residents who lived between Portola
Avenue and Deep Canyon Road and complained about the noise generated by
commercial vehicle traffic.
Over the past few years, substantial improvements have been constructed on Fred
Waring Drive from Monterey Avenue to east of Cook Street. Measures to mitigate traffic
noise were incorporated into the Fred Waring Drive improvements including the
construction of sound walls and the use of rubberized asphalt pavement. Additionally,
Baja Park has replaced the row of residential homes that previously fronted the north
side of Fred Waring Drive between Portola Avenue and Deep Canyon Road.
The construction of traffic noise mitigation measures and the removal of fronting
residential homes has changed the character of Fred Waring Drive between Monterey
Avenue and Cook Street. The conditions on Fred Waring Drive that were in effect when
the through commercial vehicle restrictions were enacted no longer exist.
In a letter addressed to City Manager Carlos Ortega, dated October 10, 2005, Mr. Ken
Wood, Chairman of the G.A.T.E. (Gaining Access for Trucking Efficiently) Committee of
the Desert Contractors' Association, requested that the City of Palm Desert remove the
restriction of through commercial traffic on Fred Waring Drive between the hours of 9:00
PM and 9:00 AM. In the response letter to Mr. Wood, staff agreed to bring this issue
before the City Council for consideration. (The other three concerns outlined in the
letter were addressed separately.)
Discussion:
Given that Fred Waring Drive is a designated truck route and that conditions along the
street have changed, staff concurs with Desert Contractors' Association's request and
recommends that the vehicle prohibition be revoked.

It should be noted that removing the 9:00 PM to 9:00 AM commercial vehicle restriction
in Palm Desert could affect the section of Fred Waring Drive within the City of Indian
Wells between Phyllis Jackson Lane and Cook Street. Indian Wells currently restricts
commercial traffic from 9:00 PM to 9:00 AM on Fred Waring Drive through their city.
However, Section 35702 of the California Vehicle Code requires exclusive jurisdiction of
the highway by a local authority to enact an ordinance restricting truck traffic. It is staffs
opinion that lifting the truck restriction in the City of Palm Desert will nullify the restriction
in the City of Indian Wells.
It is staffs opinion that Fred Waring Drive is a regional arterial roadway providing a vital
east -west link between Palm Desert and Indio. Fred Waring Drive is currently
designated as a truck route in Palm Desert and the truck restriction should be lifted.
During the course of review of this issue staff discovered that Washington Street is not
currently designated as a truck route in the City of Palm Desert. This is due to the
current truck route ordinance having been established prior to annexation of the eastern
portion of the city. Staff has contacted Riverside County Transportation Department
staff who indicated that all arterial roadways in the county are considered truck routes
unless specific prohibitions are enacted. County staff reported that Washington Street
is considered a truck route in the County's jurisdiction. Washington Street is designated
as a truck route in the City of La Quinta. Since Washington Street serves a major
commercial corridor in the City of Palm Desert and is the main access point to the City
of La Quinta from Interstate 10, staff is of the opinion that Washington Street should be
designated as a truck route in the City of Palm Desert.
Additionally, Staff recommends that Dinah Shore Drive be designated as a truck route
from the western city limits to Portola Avenue. Dinah Shore Drive is an arterial
roadway that serves the large commercial and service -industrial areas in the northwest
region of Palm Desert. Dinah Shore Drive will provide a vital east -west Zink between
Monterey Avenue and Portola Avenue when its extension is completed in the near
future. Dinah Shore Drive is designated as a truck route in the City of Ranch Mirage.
Staff is of the opinion that Dinah Shore Drive should be designated as a truck route in
the City of Palm Desert

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, REPEALING ORDINANCE NO. 741 AND
ORDINANCE NO. 761 THEREBY REVOKING THE THROUGH

The City Council of the City of Palm Desert, California, does hereby DETERMINE,
ORDER AND RESOLVE as follows:
WHEREAS, pursuant to Section 10.68.040, Truck routes, of the Palm Desert Municipal
Code, it is the intent of the City Council of the City of Palm Desert to designated streets
or portions of city streets as truck routes; and
WHEREAS, the City Council of the City of
February 13, 1986, designated Fred Waring
Limit as a truck route; and
Palm Desert adopted Resolution 86-20 on
Drive from Highway 111 to the Eastern City
WHEREAS, the City Council of the City of Palm Desert adopted Ordinance 741 on
March 24, 1994, designating Fred Waring Drive between Highway 111 and Cook Street
as a street to be prohibited from use by any through commercial vehicle between the
hours of 9:00 pm and 9:00 am; and
WHEREAS, the City Council of the City of Palm Desert adopted Ordinance 761 on
September 8, 1994, to further defined the limits of the vehicle prohibition on Fred
Waring Drive to be between Monterey Avenue and Cook Street; and
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Palm Desert,
California, AS FOLLOWS:
(1) Ordinance 741 and Ordinance 761 are repealed thereby revoking the through
commercial vehicle prohibition on Fred Waring Drive from Monterey Avenue to
Cook Street.
(2) Washington Street, from Fred Waring Drive to the Northern City Limit, is
designated as a truck route.
(3) Dinah Shore Drive, from Portola Avenue to the Western City Limit, is designated
as a truck route.
(4) The City Clerk of the City of Palm Desert, California, shall certify to the passage
and adoption of this Ordinance and shall cause the same to be published once in
the Desert Sun, a newspaper of general circulation, circulated within the City of
Palm Desert, and the same shall be in full force and effect thirty (30) days after
its adoption.

BACKGROUND:
Fred Waring Drive residents who live between Portola Avenue and Deep Canyon Road
have complained about the noise generated from commercial vehicle traffic. Instead
of restricting commercial vehicle traffic on Fred Waring Drive, City Council, at its
February 24, 1994 meeting, directed staff to modify the hours that commercial
vehicles are prohibited from using Fred Waring Drive. Previous restricted hours were
from midnight to 6:00 a.m. As a result of discussion at the February 24, meeting.
Council directed staff to draft an ordinance to restrict commercial vehicles on Fred
Waring Drive between the hours of 9:00 p.m. and 9:00 a.m.
Staff recommends that this ordinance be adopted restricting commercial vehicle hours
on Fred Waring Drive between Highway Ill and Cook Street from 9:00 p.m. to 9:00
a.m. The adoption of this ordinance will also provide the legal means necessary for
enforcement by the Sheriffs Department.

WHEREAS, the City Council of the City of Palm Desert adopted Ordinance 741
on March 24, 1994, designating Fred Waring Drive between Highway 111 and Cook
Street as a street to be prohibited from. use by any through commercial vehicle
between the hours of 9:00 p.m. and 9:00 a.m.; and
WHEREAS, the City Council of the City of Palm Desert approved the

which has a gross vehicle weight in excess of 8,000 pounds.

Desert Post, a newspaper of general circulation, published and
circulated in the City of Palm Desert, California, and shall be in full
force and effect thirty (30) days after its adoption.

RECOMMENDATION:
Adopt Ordinance No. 761 amending Ordinance 741 specifying weight and
restriction limits associated with truck restrictions on Fred Waring Drive between
Monterey Avenue and Cook Street.
BACKGROUND:
After numerous meetings between citizens, staff, and City Council, Ordinance 741
was adopted on March 24, 1994. Ordinance 741 placed commercial vehicle restrictions
on Fred Waring Drive between the hours of 9:00 p.m. and 9:00 a.m. Since the
adoption of the subject ordinance, staff has met with representatives of the
Sheriff's Department regarding problems of enforcement associated with this
ordinance.
As written, the Sheriff's Department has the authority to cite any non -passenger
vehicle. This would include smaller pick up trucks, passenger vans, and other
obvious non-commercial vehicles. Naturally the Sheriff's Department has concerns
regarding this type of activity since the intent of the ordinance was to limit the
larger class of vehicle (trucks).
In order to provide proper enforcement direction for the Sheriff's Department, staff
is recommending that Ordinance 741 be amended to specify a weight limit of 8,000
pounds gross vehicle weight. In addition, due to the extensive commercial activity
on Fred Waring Drive between Highway III and Monterey Avenue, this area should
not be subject to the restrictions. By specifying these weight and restriction limits,
the Sheriff's Department feels they will be able to enforce what is believed to be the
intent of the previously -adopted ordinance.
Staff recommends the City Council adopt Ordinance No. 761 amending Ordinance
741 by adding a weight limit restriction of 8, 000 pounds gross vehicle weight on Fred
Waring Drive between Monterey Avenue and Cook Street.

Dear Mr. Ortega:
It was a pleasure to meet you at the meeting the Desert Contractors' Association held on
Thursday, September 15, 2005 at the Desert Willow Golf Course wherein you and other
important civic dignitaries assembled to address various concerns and issues that we as
contractors encounter within the Coachella Valley.
As we briefly discussed, there are certain issues pertaining to trucking that we wish to be
addressed in the City of Palm Desert and sincerely hope that you will be able to see the
virtues of correcting these issues:
Fred Waring Drive is currently restricted wherein trucks exceeding 5 tons
are not allowed to travel between the hours of 9:00 pm and 9:00 am. This
is such an important "through route" for commerce traveling from Indio
into and through Palm Desert which gives access to parts of Rancho
Mirage as well. We wish for direct access to move our goods and services
along this route so as to eliminate long re-routing and the resulting impacts
on the environment (most importantly air quality —we are all keenly aware
of the impact of exhaust fumes as our valley struggles to become
compliant on PM-10 requirements). Years ago, this restriction did not
exist. But with residents along Fred Waring who had direct ingress and
egress via their driveways having to deal with increasing traffic, the City
decided to post the time restrictions due to obvious safety issues due to the
fact that these sections of the road clearly met the definition of
"residential" as found in the California Vehicle Code, section 515. Since
these residences no longer exist, we contend that the safety issue is no
longer valid.
2. As a result of our GAME. (Gaining Access for Trucking Efficiently)
Committee meetings and in consultation with Greg Dineen of Greg
RECEIVES Dineen & Associates, an efficient plan has been developed for cities to
identify truck routes in such a way that by using a tool already in place

(the Thomas Bros. Map Cnzide which is almost universally used by the
California trucking industry) the industry will be able to navigate for
deliveries in the most direct fashion possible. This plan has been adopted
by the cities of Indio, La Quinta, and Cathedral City. In the Map Guide,
"Primary Roads" are identified as green with black outlines. This plan is
on the verge of acceptance by . the Riverside County Department of
Transportation and we are striving for acceptance by all, not only in this
valley but throughout the State of California as well.
The Cities of Desert Hot Springs, Palm Springs, Cathedral City, Rancho
Mirage, Indio and, very recently, La Quints are now issuing annual
permits for the movement of "extralegal loads" (those which exceed legal
dimensions and do not exceed maximum Caltrans weights) to those
companies which have the need. 'These permits identify the dimensions
allowed, the routes and restrictions which are also identified. Currently,
whenever we have such a load, we must take the time to fill out one of the
forms furnished by the City wherein we must identify the exact piece of
the load, the dimensions, weights of the loads and the trucks doing the
hauling and the requested routes through the City. We then fax this form
to the Public Works Department who must take the time to review and
approve and then return fax with a signature. With all of the workloads
we and the city staff have to do, all of us could use some relief and we feel
that this is one small way of doing just that.
4. Currently, once we receive the "trip permit" (as identified in paragraph 3
above), there may be a box at the bottom of the form which tells us -that
we are required to furnish an "Escort Vehicle" if the load exceeds 10-feet
in width. We have asked for a definition of what that is and we are not
able to receive any, whatsoever. There was a need to inove a piece of
equipment into the City which exceeded 10-feet in width and since I could
not get a definition of what that is, I decided to dress my pick-up truck as a
"Pilot Car" which is required by Caltrans to be used for escorting load in
excess of 12-feet in width (among other instances). The City Code
Enforcement offioer pulled us over, wanting to Imow why I was a Pilot
Car (he knew they were not required unless the load was 12-feet in width).
Once he realized there was no definition in the California Vehicle Code for
"Escort Vehicle" he let us go. We are asking the City to comply with
definitions that exist within the Califomia Vehicle Code. Enclosed is a
sample of effective Pilot Car regulations (which is being adopted by many
municipalities) for your consideration.
Because of issues like as these which we encounter regularly that really need to be
addressed not only within the Coachella Valley, but, as mentioned above, the entire State
of California, we met last year with our State Assemblywoman, Bonnie Garcia and
discussed possible solutions. She became a champion for our causes and brought
together ACR23 (.Assembly Concurrent Resolution 23) which recognizes the true need to
draw together all of the various agencies throughout the State (including cities and
counties) to work together with Caltrans to resolve these issues so as to allow the
movement of goods and services throughout the State in the most effective fashion

possible. ACR23 flowed through both the Assembly and the Senate with unanimous
approvals and has been Chaptered by the Secretary of the State of California.
We therefore urge you to also be a ehampion for the City of Palm Desert to taste the steps
necessary to meet the intent of the law established by the State of California.
We offer our services to you to provide any further information you might need to help
get this done.

Subject: Trucking Issues in the City of Palm Desert
Dear Mr. Wood:
I wish to acknowledge receipt of your letter dated October 10, 2005 to City Manager Carlos
Ortega regarding certain issues pertaining to trucking in the City of Palm Desert. Your letter has
been forwarded to me for response.
In your letter you presented four issues regarding trucking in Palm Desert that you wished
addressed. Each issue is discussed below.
Truck Restrictions on Fred Waring Drive — In 1994, the City adopted ordinances that
prohibited any through commercial vehicles on Fred Waring Drive from Monterey
Avenue to Cook Street between the hours of 9:00 PM and 9:00 AM. The ordinances
were adopted in answer to complaints about noise generated from commercial vehicles
by the Fred Waring Drive residents who live between Portola Avenue and Deep
Canyon Road. Since that time, the roadway has been widened and residents no longer
front directly onto Fred Waring Drive. Within 60 days, a formal request will be prepared
by City staffand presented to our City Council to begin the process to lift the time
restrictions on Fred Waring Drive for commercial vehicles.
2. Use of Thomas Bros. Map Guide to Identify Truck Routes — Palm Desert Public
Works staff is opposed to the use of the Thomas Bros. Map Guide as a means of
identifying truck routes within the city. The "primary roads" identified in Palm Desert on
the Map Guide does not mirror the designated truck routes established in the city. As
an example, Hovley Lane East is shown in the Map Guide as a primary road but we do
not encourage commercial traffic on this roadway. Hovley Lane East is not a regional
travel way and residential development abuts a large majority of the street within Palm
Desert. The width, color and line type shown on the Map Guide Is not intended by
Thomas Bros. to indicate trucks routes. I would suggest that the trucking industry
contact the publisher to request that truck routes be shown per adopted city plans. In
our opinion, if the Thomas Bros. Map Guide is to be used to identify commercial truck
routes, then the maps should accurately depict established routes and the commercial
routes should be identified separately from "primary roads" on the maps.

3. Annual Permits — The City of Palm Desert issues wide load permits on a case -by -case
basis to maintain some level of control over the travel routes taken by "extralegal loads"
as they traverse through the city. Reviewing each permit gives us the opportunity to
redirect extralegal trucks to more direct routes as well as avoid temporarily congested
or constrained roadways. Our method of issuing wide load permits is relatively simple;
we do not charge a fee, and each permit request is addressed in a timely manner.
4. "Escort Vehicle" Designation — We are in the process of revising our wide load
permit form to eliminate the "escort vehicle" designation. Please note that we did
review the "HERO'S Recommended Pilot Car Requirements" attached to your letter. In
our opinion, these requirements are too lenient for the urban city -street environment.
We will maintain our previous thresholds requiring pilot cars for load heights greater
than 14 feet and widths greater than 10 feet. A copy of the revised wide load form is
attached for reference.
At the bottom of page two of your letter you referenced Assembly Concurrent Resolution 23
(ACR23). The gist of ACR23 is highlighted from text of the resolution below:
"That the Legislature strongly urges regional transportation planning agencies,
in consultation with the cities and counties of the state and the Department of
Transportation, to examine the flow of traffic to develop commercial
trucking routes that provide for the most direct movement through a city
and county in order to reduce the time that trucks are in city limits and county
areas and the level of pollution that is created, ..."
As currently established, truck routes within the City of Palm Desert provide commercial trucking
with the most direct movements through our city and, therefore, we are in compliance with intent
of ACR23. Removing the time restrictions on Fred Waring Drive and eliminating the use of
"escort vehicle" from our wide load permits will further enhance the benefits provided to the
trucking industry by the City of Palm Desert.

The City of Indian Wells would like to go on record that we oppose lifting the ban on
trucks on Fred Waring Drive where we share jurisdictional boundaries. This will have a
negative impact on the quality of life in both of our cities!
This matter was never discussed with Indian Wells, and in the spirit of being
neighborly, we ask that Council consider continuing this matter until we had an
opportunity to discuss it!

Dear Mayor and Members of the City Council,
We just learned today that the Palm Desert City Council is poised to allow big rig trucks
over 8,000 lbs. to travel on Fred Waring Drive between the hours of 9 AM to 9 PM. We are
strongly opposed to the removal of the current truck ban.
We called the Palm Desert County Club, Desert Horizons and Toscana Homeowners
Associations and no one was aware of the proposal to remove the truck ban. Additionally,
we talked to a sampling of homeowners in this area and again, no one knew of this
proposal.
Apparently, the residents who will be disturbed by the enormous increase of noise and
vibration have not been notified. It appears that this proposal has been a closed -door
agreement between the Desert Contractors Association and the City of Palm Desert Public
Works Department to remove the truck ban before the residents are aware of it and can
respond.
Besides the great increase of noise and vibration from the big rig trucks driving and
braking, the new configuration of lanes on Fred Waring between Washington and Cook
Streets are very narrow and drivers often drive up to the edge, and on, the lane lines. The
lanes are tightly packed between the center island that goes right up to the left lane line
and the edge of the right lane line that has no shoulder. This leaves little or no ability for
emergency maneuvers on either the north or south side of the driving lanes when the
driver in the next lane is right up to their lane line. Big rig trucks that are bigger and wider
than those currently allowed, would normally be driving very close to or, with the slightest
deviation in centering their truck between the lines, driving on their lane lines. Allowing big
rig trucks over 8,000 lbs. to use Fred Waring Drive, is a recipe for disaster.
Please vote NO to remove the truck ban on Fred Waring Drive.
