Background: Approval of the development of the northwest corner of Washington Street and Country Club Drive included an agreement for the developer to build the storm drain system and then be reimbursed by the City up to a maximum of $24,000.00. This work has now been completed to the City's satisfaction, and the developer has submitted the subcontractor's cost breakdown depicting an actual cost of $107,428.00. Funds are available in account 420-4291-433-4001. Therefore, staff recommends that City Council approve reimbursement to Fountainhead Development in the amount of $24,000.00 as the City's contribution toward construction of a storm drain system at the southeast corner of Washington Street and Country Club Drive. The City will agree to contribute to the cost of the storm drain system not to exceed $24,000. The City will not participate with the costs associated with the free right turn from Washington Street onto Country Club Drive. The City will agree to a conditional certificate of occupancy to allow Wendy's to open for business before the completion of your offsite improvements with a cash deposit, or certificate of deposit with the City named as beneficiary, in the amount of the improvements.
