HomeMy WebLinkAboutOrd 1117 CZ 05-04 - 2nd ReadingORDINANCE NO. 1117 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING ORDINANCE NO. 107, THE PALM DESERT ZONING MAP BY CHANGING THE ZONE FROM P.C.2 (PLANNED COMMERCIAL DISTRICT) TO P.R.9 (PLANNED RESIDENTIAL 9 UNITS PER ACRE) FOR THE PROPERTY LOCATED AT THE SOUTHWEST CORNER OF FRANK SINATRA DRIVE AND PORTOLA AVENUE, EXHIBIT "A" ATTACHED. CASE NO. C/Z 05-04 The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN, as follows: SECTION 1: That a portion of Ordinance No. 107 referencing Section 25.46.1 of the Zoning Ordinance, the Zoning Map (Chapter 35.46 of the Palm Desert Municipal Code) is hereby amended to read as shown on the attached Exhibit "A". SECTION 2: That a Negative Declaration of Environmental Impact is hereby certified as shown on the attached Exhibit "13". SECTION 3: That the City Clerk of the City of Palm Desert, California, is hereby directed to publish this ordinance in the Desert Sun, a newspaper of general circulation, published and circulated in the City of Palm Desert, California, and shall be in full force and effect thirty (30) days after its adoption. GPA 05-03, C/Z 05-04, PP 05-25 and TT 33719) In reference to the question regarding the perimeter walls surrounding the residential project on Portola Avenue, the walls are designed with offsets that vary between 4 feet and 13 feet (see attached exhibit). Wrought iron fencing was proposed as the fence connection material between the offsets. There is concern that wrought iron fencing will not mitigate noise from the traffic along Portola Avenue and Frank Sinatra Drive. Although appropriate for golf course development, wrought iron is not appropriate for residential projects adjacent to a major thoroughfare. The offsets can be designed with masonry instead of wrought iron fencing for noise mitigation while providing a high quality decorative perimeter wall along Portola Avenue and Frank Sinatra.
