Discussion: Community Development received a request for the vacation of a portion of a street right-of-way along the south side of New York Avenue between Virginia Avenue and the westerly dead-end of New York Avenue. At the City Council meeting of April 27, 2006 Council, by minute motion, set a public hearing for the meeting of May 25, 2006 to consider the subject street vacation. Staff has reviewed the request and finds that the fifteen feet of right-of-way is not needed. The vacation is requested to accommodate the design of the standard Habitat home. Government Code Section 65402 requires, in part, that the Planning Commission report to the City Council that the subject vacation is in conformity with the adopted General Plan. At their meeting of May 16, 2006 the Planning Commission determined that the vacation is in conformity and consistent with the General Plan. WHEREAS, the City Council initiated proceedings to vacate a portion of the public right-of-way, more particularly described in Exhibits "A" and uB", attached hereto, and the City Council finds that said notices of such vacation were published and posted, as required by law; and WHEREAS, the City Council on the 25 h day of May, 2006 held a public hearing as required by law, at which hearing all persons interested in or objecting to the proposed vacation were heard, and said public hearing was duly and regularly closed; and WHEREAS, the City Council of the City of Palm Desert considered such matter and finds from the evidence submitted that the right-of-way described as a portion of New York Avenue, more particularly described in Exhibits "A" and "B", attached hereto and made a part of, is unnecessary for present or prospective public purposes. NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES HEREBY RESOLVE AS FOLLOWS: (1) That the portion of right-of-way, known as New York, Avenue, be vacated as described and as set forth in Exhibits "A" and "B" attached hereto. (2) That the City Clerk of the City of Palm Desert, California, shall cause a certified copy of this resolution and order to be recorded in the Office of the County Recorder of Riverside County, California. The home as currently designed does not fit on the lot and will require the vacation of the southern portion of New York Avenue along the northern boundary of the parcel. New York Avenue is a dead end street that abuts the Toscana project in Indian Wells. The street has no general public use. There is one residential property located along the north side of New York that will continue to have access to the their property along the non -vacated northern half of New York Avenue. June 5-10 is Habitat International Blitz Build week. Our local chapter is attempting to participate in this event by building this home during that time frame. Our participation will provide the local chapter with many benefits, i.e. materials, publicity, etc. It our intent to build this home within a one week period. It is our understanding, after meeting with Phil Drell and Page Gardner, that the vacation process will take 6-8 weeks to complete. Given this, is there any way that this process can be expedited in order for Habitat to begin construction during the International building time frame? In addition, the vacation of the south side of New York Avenue will require Habitat to redesign the curb and street improvements along that portion of New York, unfortunately this was not anticipated and will be an additional unexpected cost to the project. Habitat is asking for your consideration in assisting with the expenses directly related to these improvements. It is anticipated that the cost will be between $10,00-$15,000 +/-. The housing unit will become a part of the City's affordable housing program production count will carry a 40 year resale restriction along with covenants regarding long term affordability as required by the City of Palm Desert. APPLICANT: Habitat for Humanity of the Coachella Valley, Inc. P.O. Box 11738 Palm Desert, CA 92255 1. BACKGROUND: The City is currently in the process of donating Lot 161 at the southwest corner of New York Avenue and Virginia Avenue to Habitat for Humanity. One hundred (100) feet to the west, New York dead -ends into Toscana Country Club. Only two lots side on this section of street. The existing home on the north uses this street to access a garage. The existing street section is 66 feet of right-of-way with 44 feet curb to curb. Habitat for Humanity would like to build a home on the lot June 5-10 during their International Blitz Build Week. Unfortunately, the existing lot width does not accommodate the standard Habitat home design. Since the existing 66 of right-of- way and 44 feet curb to curb section are far in excess of current city standards for a through traffic local street, a 15-foot street vacation is proposed on the vacant south side reducing the right-of-way to 51 feet with a curb to curb width of 32 feet. Although these dimensions are below the General Plan maximum widths, Policy 12.A of the General Plan calls for reduced pavement width where appropriate. Given the limited traffic demand on this short roadway section, the proposed 32 feet is adequate to provide access to a single driveway while still providing parking on both sides. 11. RECOMMENDATION: By minute motion find that the proposed street vacation is consistent with the General Plan.
