Discussion: The Public Works Department received a letter from the Advisory Board of the Foundation for the Retarded of the Desert, requesting that the City investigate the cause of the Foundation's sewer line failure. The letter suggests that the cause of the failure might be related to underground work performed by the City in that area in 2003. Staff agreed that this may be the case, and requested that the City Manager authorize the excavation and investigation of this failure on an emergency basis. The City Manager's memo of authorization is attached, along with backup documentation. Staff requests that City Council, by minute motion, ratify the City Manager's authorization to perform excavation and investigation of the sewer line at 73-255 Country Club Drive, in the amount of $5,400.00. As I mentioned, we have a video tape on the sewer line that indicates a sagging in the line that is creating the blockage on the +-3 month intervals. As an aside we have also suffered an underground refrigerant line failure and an irrigation controller line breakage. These are not significant issues but, none the less, they exist. Please recall in the summer of 2003 the city received our permission to run a storm drain line East/West across Foundation property and down the subject driveway area. This effort was done with your total cooperation and courtesies were extended to us by you and your vendors. The complex construction project went off without a hitch from our side and we continue to appreciate the efforts of you and the City. The above makes my request more difficult in as much as 1 believe the excavation which was required to accommodate your piping systems may have suffered a compaction failure. I suggest this based on the fact that all three utilities have suffered damage and in the same general area. Granted, there has been no evidence at the surface, but subterranean could be another matter. The only way to determine if my assumptions are correct is to excavate and test for compaction in the effected area. Obviously, we would take that as an opportunity to do the required repairs. In as much as the Foundation has limited funds, we are hard pressed to propose that if the City could undertake this investigation effort, and, if my suspicions are proven wrong, the Foundation for the Retarded would some how reimburse the City for the cost of investigation and repair. If my suspicions are correct, we would look to the City for the respective repairs and related costs. Please review the enclosed material and give me a call to discuss further at 760-861-9541. We have reviewed the materials you submitted and we agree that the problems you are experiencing may have been caused by the underground work previously done by the City; therefore, the City will hire a contractor to expose your sewer lateral and the City storm drain pipe to determine the exact cause of the problem and make appropriate repairs. We have taken the necessary steps to obtain quotes from contractors and hope to begin repair work on this line in about two weeks. Ortega, City Manager From: Mark Greenwood, P.E., Director of Public Works Date: August 10, 2006 Subject: Authorization of Emergency Work Assistant City Manager Justin McCarthy received a letter from the Foundation for the Retarded (copy attached), requesting that the City investigate the cause of a sewer line failure at their location. The letter suggests that the cause of the failure might lie with work performed by the City at that location In 2003. Staff agrees that the problems experienced by the Foundation may have been caused by the underground work previously done by the City. The Public Works Department solicited quotes to expose the sewer lateral and the City storm drain pipe to determine the exact cause of the problem and make appropriate repairs. The results of the bids solicited are as follows: Alms Underground Construction, Inc. $5,400 Tri-Star Contracting $6,450 NYPD Plumbing (the Foundation's plumber) Declined to bid The Foundation is currently experiencing plumbing problems (to the extent that toilets do not reliably flush) which professional plumbing interventions have not been able to reliably address; therefore, we believe this situation to be creating a potential health hazard. The Public Works Department requests that you authorize this work to be performed on an emergency basis by the lowest bidder (see list below) and that the normal bidding process be waived.
