Background:

In 2005 the City Council established a policy to reduce, over a period of five years,
citywide energy usage, adjusted for growth, by 30% and reduce the peak demand
load by 30%.
Current Proposal:
At this time we propose to add this policy as a goal with related policies and
programs to the general plan as delineated in the August 10, 2006 memo from Pat
Conlon (attached) and as shown in Exhibit A to the draft resolution.

Discussion:
The goal to reduce energy consumption and peak demand Toad by 30% is a
significant undertaking. The City has established the Office of Energy Management
to pursue achievement of the goal.
Considering the significance of the policy, it needs to be added as a goal to the
Energy and Mineral Resources Element along with related policies and programs
to attain the goal.
Concurrent with this general plan amendment, the Office of Energy Management
has been processing an ordinance to establish local energy efficiency standards
(copy of Draft Ordinance attached).
Planning Commission Action:
The Planning Commission at its September 5, 2006 meeting considered this
request and on a 5-0 vote recommended approval of the general plan amendment.
CEQA Review:
The project has been reviewed for compliance with CEQA. The Director of
Community Development has determined that the project is a Class 7 Categorical
Exemption "Actions for Protection of Natural Resources."

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A GENERAL PLAN
AMENDMENT RELATED TO REDUCTION OF ENERGY USE IN
THE CITY.
CASE NO. GPA 06-02
WHEREAS, the City Council of the City of Palm Desert, California, did on the 28th
day of September, 2006, hold a duly noticed public hearing to consider the above noted
general pian amendment; and
WHEREAS, the Planning Commission of the Gity of Palm Desert, Califomia, did by
its Resolution No. 2416 recommend approval of said amendment; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedures to Implement the Califomia Environmental Quality Act, Resolution No.
06-78", in that the Director of Community Development has determined that the project
is a Class 7 Categorical Exemption; and
WHEREAS, at said public hearing, upon hearing and considering alf testimony and
arguments, if any, of all persons desiring to be heard, said City Council did find the
following facts and reasons to justify its actions:
Adoption of the proposed amendment will allow the City to establish energy
conservation measures needed to achieve the City's goal of reducing energy
use over a five-year period.

FUTURE DIRECTIONS
Since the onset of the industrial revolution, energy and mineral resource production and use have
become essential components of infrastructure and technology development, and have greatly
enhanced our quality of life. Retrieving, harnessing and using these resources have also been one
of the majar causes of environmental degradation, impacting wildlife habitat, affecting water and
air quality, and being directly and indirectly associated with a wide range of adverse public
health effects.
The economic and environmental costs associated with conventional and frequently
indiscriminate mineral and energy production and use aze forcing communities and countries to
develop new policies and programs. The various constraints that have emerged can also be
viewed as opportunities for economic and environmental enhancement. Materials recycling, and
lowering or shifting energy demand will help to control costs and require mineral and energy
providers to operate more efficiently and to price their products more competitively.
Encouraging conservation and the development and use of alternative and renewable energy will
also expand economic opportunity. Issues of local and national economic security will also be
addressed by the development and implementation of enlightened energy policies. Developing
energy policies with an emphasis on conservation, local control, greater use of renewable
resources and community-scale technologies, will help assure a secure and environmentally
friendly energy future.

EXECUTIVE SUMMARY
This proposed Energy Conservation Ordinance affects all new residential and
commercia! buildings in the City oi Palm Desert. This Ordinance will result in an energy
savings of at teast 10% above the minimum State standards, with farge homes (over
4,000 square feet) attaining ene�gy sa�ings of at least 15%. The cost to developers far
implementing these requirements range from approximately $2,200 to $4,200 per home,
depending on design and the options selected by the designer. The exception to this
cost would be on mode{ homes where a small 2kW photovo{taic (PV) solar system is
mandatory for each model. The cost for this photovoltaic {P� system would be
approximately $8,000 to $9,000 per madel, after California and Federal rebates.
As required by State {aw, this Ordinance wi11 appear before the Califomia Energy
Commission for review and approval in July and August. Staff will bring this Ordinance

DISCUSSION
The intent behind this proposed O�dinance is to get aU new construction in compliance
with Palm Desert's stated energy conservation goafs of 30% reduction citywide,
adjusted for growth, and 30% reduction of our on-peak demand loads within � years. To
measure our achievement, the base year for our citywide energy usage was established

i� 2005. Effecbive November of 2005, the State of Califomia adopted more stringent
energy conser�ation standards for new construction. These new State energy standards
increased effiaency requirements by 12% to 15% in ali new construction.
This proposed Ordinance before you tonight wilt raise that standard by an additional
10°!o to 15°!o above the new 2005 Cafifornia Energy Standards, thus meeting the City's
energy goals. It is designed to be flexible in allowing the designer to choose two paths
to compliance: prescriDtive or c�erformance, with the exception of the mandatory
reguirements set forth in Section 22.30.030.
The prescrintive approach is simple and easy: incorporate the six items listed in Section
22.30.040 into the buitding design, atong with the other requi�ements cunent4y listed tt�e
State law, and the buiWing is deemed to be in compliance with this Ordinance.
If the building designer does not wani to incorporate all of the six prescriptive
requi�ements, they may computer model the building using the qertormance approach.
However, the computer maief must show that the building's energy budget exceeds the
minimum 2005 Califomia Energy Standards by 10%.
For large homes over 4,000 square feet in conditioned area, the building must
incorporate alt of the prescriptive requirements and exceed the 2005 Califomia Energy
Standards by a rninimum of 159�0.
lf the designer cannot get the large home to exceed the 2405 California Energy
Standards by 15%, then the {arge home must use a photovoltaic {P� solar system,
sized pe� Table A in Section 22.3Q.050, along with the prescriptive requirements in this
proposed Ordinance.
Why are large homes treated differently? Large homes are allowed by the 2005
Califomia Energy Standards to use more energy than smaller homes. The State allows
a higher Energy Budget in cases equivatent to severai smaller homes.
The effective date shown in Section 22.30.070 for this Ordinance is approximate. It is
unknown exactty when the Ca�ifamia E�ecgy Comm�ssson (CEC) wi14 review and
approve this Ordinance for {ocal adoption. The day that happens, staff will schedule the
second reading of this Ordinance for the next City Councii meeting. The effective date
of this ordinance will be, as customary, 30 days after the second reading. It is the
recommendation of the Ciry Attarney that, after the CEC actions, we bring ta the Council
a second identical ordinance which will be adopted on an urgency basis and thus will be
effective immediately.
The Cal'rfomia Energy Commission requires tfiat this Iocai Ordinance have an expiration
date, which is the same date that the new 2008 California Energy Standards become
effective statewide, tentatively scheduled far November 2008. At that time, staff wifl

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALAA
DESERT, CALIFORNIA, ADOPTfNG LOCAL ENERGY EFFICIENCY
STANDARDS FOR BUILDINGS COVERED BY THE 2005 CALIFORNIA
BUILDING ENERGY EFFICIENCY STANDARDS
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, DDES HEREBY ORDAIN AS FOLLOWS:
Section 1. Chapter 24.30 be and the same is hereby added to the Code of the
City of Palm Desert, Califomia, as follows:
"Section 24.30.010 Title, Purqose and Intent. This ordinance sets forth minimum
energy efficiency standards within the City of Palm Desert for all new construction,
including remode{s, additions, alterations and tenant improvements.
(a� Background. All residential and nonresidential development must meet or exceed
the energy requirements contained in the 2005 California Building Energy Efficiency
Standards, including California Code of Regulations, Title 24, Parts 1 and 6(the
"Standards"). The ordinance codified in this chapter requires the application of the
Standards, including but not limited to the definitions, procedures, forms, manuals and
alternative calculations methods {uACMs") associated with the Standards. !n addition,
this ordinance amends the Standards as described herein.
(b) Buildings Covered. The provisions of this ordinance shall apply to all new residential
construction, remodels, additions and alterations, and to all new nonresidential
construction, remodels, additions, alterations and tenant improvements for which a
building permit has been applied for and accepted as complete by the building
department on or after the effective date of this ordinance.
Section 24.30.015 Enforcement. The Building Official for the City of Palm
Desert shal! be charged with enforcing the provisions of this ordinance.
Section 24.30.020 Definitions.
PRODUCTtON HOME means a dwelling constructed as part of a residential
development of at least five homes per project that is intended or offered for sale.
RESIDENTIAL DEVELOPMENT is to include but not be limited to attached and
detached single-family dwellings, condominiums, apartments and time-share dwellings,
and not including hotels and motels as defined in the 2005 California Building Energy
Efficiency Standards.
SOLAR PV ENERGY SYSTEM means a photovoltaic solar collector or other
photovoltaic solar energy device that has a primary purpose of providing for the
collection and distribution of solar energy for the generation of alternating current rated
peak electricity. The instaflation of any solar PV energy system must meet all

installation criteria of the current edition of the California Electricai Code, and must
include PV panels and inverters, which are listed by the California Energy Commission.
PV CREDIT is the energy credit applicable to the Proposed Design for a solar PV
energy system that is capable of generating electricity from sunlight and supplying it
directly to the building; and is connected, through a reversible meter, to the utility grid.
For buildings permitted before January 15, 2007: The methodology used to
calculate the PV credit shafl be the Clean Power Estimator at http://www.clean-
power.com/ceGdefault.asp for the 92260 zip code. The Annual Total TDV energy, in
KBtu/sf-yr, shall be the total annual KWh of the solar PV energy system multiplied by
3413 multiplied by 4.22 and divided by the total conditioned floor area of the building.
For buildings permitted on or after January 15, 2007: The amount of PV credit is
defined as the annual total TDV KBtu/sf-yr of the solar PV energy system as calculated
in accordance with the implementation rules and methodology of the California New
Sofar Homes Partnership as posted on the Internet web site
http://www.newsolarhomes.ca.vov/; multiplied by 1000 and divided by the total
conditioned floor area of the building. Note: this method of calculating PV credit may be
used whenever it is available on a publicly accessible Intemet web site.
REVISED STANDARD DESIGN TOTAL is the performance energy budget, in TDV
KBtu/sf-yr, which this ordinance establishes for all buildings to which it applies. lt is
defined as the Standard Design Total (TDV KBtu/sf-yr) from any state-approved
alternative cafculation method (ACM) multiplied times the Standard Design Adjustment
Factor listed in Table A.
STANDARD DESIGN ADJUSTMENT FACTOR is the arithmetic factor listed in Table A
which, when multiplied by the standard design energy budget from a state-approved
ACM, produces the Revised Standard Design Total.

Section 24.30.030 Mandatory Requirements. All buildings covered by this
ordinance shall include the following mandatory energy measures as applicable and
limited to the permitted scope of work:

1. Liahtinq. Lighting in a11 laundry rooms, utility rooms, mechanical rooms, closets
and garages shall be fluorescent and controlled by a Manual-ON, Automatic-OFF
occupancy sensor. AI{ common area landscape lighting shall be fluorescent.
2. Swimmina Pools and Spas. All public and private swimming pools, spas,
fountains and water features shall incorporate the following energy conservation
features:
(a) All pool and spa natural gas heaters shall have a minimum AFUE of 90°!0 or
higher; and,
(b) All circulating pump motors and filtration pump motors with a nominal rating of
0.75 horsepower (i.e., g/. HP) or greater shall be two-speed or variable speed motors.
The installation of all two-speed and variable speed motors shall include the instal{ation
of a controller which shall be time-based and shall be programmed to altemate the
speed of the motor between low and high to make effective use of the energy savings
potential of the unit's multi-speed capability. EXCEPTION: Dedicated pump motors
serving only spa jets.
3. Provisions for Future Solar PV Enerav Svstems. A 1-inch diameter electrical
conduit shall be provided for installation of future solar PV energy systems. The 1-inch
diameter electrical conduit sha{I extend from a point on the exterior wall located under
the southem roof exposure, to the exterior wall location adjacent to the main electrical
service panel. At each location, the conduit shall terminate at a finro gang exterior wet
location rated electric junction box.

The following additional requirements apply using the Prescriptive Approach to meet the
2005 Standards.
1. ENVELOPE. The Overall Envelope Approach in Section 143(b) of the 2005
Standards shall be used to demonst�ate that the overall heat loss of the
proposed building is at least 10.00% less than the overail heat loss of the
standard building; and that the overall heat gain of the proposed building is at
least 10.00% less than the overall heat gain of the standard building.
2. INDOOR LIGHTING. The calculations of actual and allowed indoor lighting
power density (LPD) in Section 145(a) and (b) of the 2005 Standards shall be
used to demonstrate that the Actual LPD is at least 10.00% less than the

Allowed LPD. Exception: Display lighting instaHed wattage is exempt from the
calcufation which demonstrates compliance with this requirement.
3. MECHANICAL. In addition to meeting all the requirements of Section 144 of
the 2005 Standards, all fan motors and pump motors which are single-speed,
polyphase, 1 to 500 horsepower, 2-, 4-, and 6-pole, squirrel cage induction,
NEMA Design A or B, continuous rated motors must be NEMA Premium
motors by the National Electrical Manufacturers Association.
PERFORMANCE APPROACH
If the perFormance approach is used to demonstrate compliance with the 2005
Standards, PV Credit mav not be used for the buildinq to meet the Standards.
However, PV Credit may be used to exceed the Standards by the requisite percentage
defined below.
NONRESIDENTIAL, HIGH-RiSE RESIDENTIAL AND HOTEUMOTEL OCCUPANCIES
(EXCEPT ADDITlONS < 500 SQ.FT.): PERFORMANCE APPROACH
If a building utilizes the performance approach, the Proposed Design TDV KBtu/sf must
be at least 10.0% less than the Standard Design TDV KBtu/sf-yr. Additions of 500
square feet or larger may meet this requirement by using the Existing + Addition +
Alteration approach to exceed the Standard Design by the specified percent.
When determining the percent by which the Proposed Design energy performance
exceeds the Standard Design, Process and Recepiacle enerpv use are included in the
ACM simulation but are excluded in calculatinv the "% Better Than Standard" lf liahfincr

SQ.FT. AND SINGLE FAMILY HOMES > 4,000 SQ.FT.)
The performance approach must be used to meet and exceed the 2005 Standards as
follows: the Proposed Design TDV KBtu/sf must be at least 10.0% less than the
Standard Design TDV KBtu/sf-yr. Additions of 500 square feet or larger may meet this
requirement by using the Existing + Addition + Alteration approach to exceed the
Standard Design by the specified percent.

SINGLE FAMILY HOMES > 4,000 SQ.FT.
The performance approach must be used to meet and exceed the 2005 Standards as
follows: the Proposed Design TDV KBtu/sf must be at least 15.0% less than the
Standard Design TDV KBtu/sf-yr.
Section 24.30.060 Requirements for Production Homes in Residential
Developments. In addition to the requirements specified in Sections 24.30.020 through
24.30.040 of this ordinance, production homes sha11, as applicable, meet the following
additional requirements:
1. Model homes as part of a production homes development shall be equipped with
a Solar PV Energy System with a minimum nominal output of 2.0 kW.
2. A seller of production homes shall offer a solar PV energy system option to all
customers that enter into negotiations to purchase a new production home and disclose
the following:
(a) The total installed cost of the solar PV energy system option; and,
(b) The estimated cost savings associated with the solar energy system option as
determined by current and projected future utility costs.
3. Enerav Star Apqliances Required. If provided by the developer, all the following
installed appliances shall be Energy Star rated:
(a) Dishwashers
(b} Refrigerators
(c) Clothes Washers
(d) Clothes Dryers (Natura{ Gas only)
(e} Ceiling fans
(fl Exhaust fans
Section 24.30.070 Effective Date and Expiration Date. This ordinance shall be
and is hereby declared to be in full force and effect 30 days after the second reading
and when the implementation guidelines and calculation method for the California New
Sofar Homes Partnership are available to the public on the Internet.
This ordinance shall expire on the date that the 2008 Building Energy Efficiency
Standards take effect."
Section 2. The City Clerk shall certify to the passage and adoption of this
Ordinance and shall cause the same to be published once in the Desert Sun, a
newspaper of general circulation, printed and published in the County of Riverside and
circulated within the City of Palm Desert.
