Approve Change Order No. 2 to Contract No. C25570 for the construction of the Section 29 Assessment District 2004-02 Phase I Sewer Installation with Jones Bros Construction Company in the amount of $2,563.13; 2. Move $14.09 from contingency to base; 3. Appropriate $2,549.04 from unobligated Fund 400 to the project account; and 4. Authorize the Mayor to execute the same. Discussion: On October 12, 2006, City Council approved Contract No. C25570 for the Phase I Sewer Improvements of Assessment District 29 2004-02, in the amount of $634,220.00 plus a 10% contingency. On January 11, 2007, City Council approved Change Order No. 1 in the amount of $63,407.91 for the removal of excessive earth material over the proposed pipe alignment. Phase I Sewer Installation was the first part of a cooperative effort for construction of improvements in the Section 29 Assessment District 2004-02. Staff Report Approve Change Order No. 2 to Contract C25570-Jones Bros (Project 627-S-05) Page 2 of 2 April 12, 2007 When the sewer portion was separated from the overall project and bid separately, the plans were modified accordingly. Those modifications failed to address the amount of excess dirt removal. This material would have been removed as part of the overall Assessment District construction project; however, to construct the sewer project the removal of the overburden was necessary. When the overburden was removed it left two manholes perched above the final street grade. These manholes will be at grade once the street improvements are constructed; however, the Coachella Valley Water District would not approve the sewer improvements to go on-line until the perched manholes had earthen material constructed around them. Therefore, staff recommends that City Council approve Change Order No. 2 to Contract No. C25570 for the construction of the Section 29 Assessment District 2004-02 Phase I Sewer Installation with Jones Bros Construction Company in the amount of $2,563.13, move $14.09 from contingency to base, appropriate $2,549.04 from unobligated Fund 400 to the project account, and authorize the Mayor to execute the same. The overburden was removed to final grade on the sewer project. Prior to CVWD 90% approval it was required to construct earthen material around Manholes No. 3 and 4 that were perched above final street grade. These manholes will be finalized as part of the overall Assessment District construction project; however, due to the time between Phase I and Phase II of the Assessment District the manholes could not be left perched above the street grade. Contract C25570 Change Order No. 2 Continued from front This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Change Order items for a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner. Contract Time Extension -0- Days Revised Contract Total 75 Days The undersigned Contractor approves the foregoing Change Order # 2 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Change Order # 2 . The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Change Order shall be effective when approved by the Owner. Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as any and all consequential damages.
