Rall Date of Loss: September 15, 2006 Location: Ave 50 intersection at Jefferson St., City of La Quinta, County of Riverside, California Dear Gentlepersons: Please be advised that the Law Offices of Caronna, Johnson &Hoddick, L.L.P. represents the interests of Gregg E. Rall , • in the presentation of Mr. Rall's claims for damages for personal injuries, physical pain and suffering, emotional distress, loss of earnings, and property damage, as a result of a serious motor vehicle accident which took place on October 20, 2006, at approximately 6:59 a.m., at the intersection of Monterey Ave. and Sagewood Dr. in the City of Palm Desert, California. At the time of the subject accident, Mr. Rall was driving his 2005 Harley Davidson motorcycle in the#2 of 3 northbound lanes on Monterey Ave. approaching the intersection at Sagewood Dr. To Mr. Ralls' immediate left, also headed northbound on Monterey Ave. was a 2003 Buell motorcycle driven by Joseph Funkey. As the motorcycles approached the intersection at Sagewood Dr., a 2004 Jeep Cherokee driven by Barbara Ann Gardner entered the intersection from the"Stop" sign controlling westbound travel on Sagewood Ave. Ms. Gardner's entry into the intersection was a substantial factor in causing a serious traf�"ic collision between Ms. Gazdner's Jeep, Mr. Rall's motorcycle, and Mr. Funkey's motorcycle. Our investigation of the subject traffic accident has revealed that the City of Palm Desert is responsible for the negligent design, maintenance, management, and control of the subject intersection and traffic control devices located at the subject intersection; and that the City of Palm Desert had actual and/or constructive notice of a dangerous condition of public property, the 3 northbound and 2 southbound lanes of travel on Monterey Ave. separated by a single "Stop" sign City of Palm Desert March 13, 2007 Page 2 for westbound traffic on Sagewood Ave., where City of Palm Desert failed to install a traffic light system located at the sub,ject intersection to adequate regulate motorists, which created a reasonably foreseeable risk of the kind of incident which occurred, and which was a substantial factor in causing harm to Gregg E. Rall. Enclosed for your review is a copy of Traffic Collision Report#T06293008 prepared with respect to this matter. As a result of the subject accident, Gregg E. Rall sustained serious personal injuries requiring hospitalization, together with continued and ongoing pain and suffering, and loss of income. Injuries and Treatment As a result of the subject collision between Mr. Rall's motorcycle and Gardner's Jeep, Mr. Rall was ejected from his motorcycle and crashed to the ground. Paramedics arrived and transported Mr. Rall by ambulance to Desert Regional Medical Center where Mr. Rall underwent extensive emergency examination for complaints of pain, primarily centered azound the cervical spine, left elbow, and right ankle. Mr. Rall was provided emergency treatment and released. Cervical Spine• Desert Medical Imaging MRI of the cervical spine dated 12/15/06 demonstrated: C4-5: 3 mm central disc protrusion, uncinate arthropathy and mild degenerative changes of facet joints manifesting as mild central spinal canal stenosis as well as mild/moderate right and mild left neural foraminal encroachment. CS-6: 4mm posterior disc protrusion resulting in moderate/severe central spinal canal stenosis as well as moderate/severe right and severe left neural foraminal encroachment. C6-7: Minimal right asymmetric posterior annular bulge, degenerative changes of the facet joints and mild uncinate arthropathy resulting in mild left neural foraminal encroachment. Right Ankle: Desert Medical Imaging MRI of the right ankle dated 1/20/07 demonstrated: Compazed with 11/1/06, there is some interval healing of the avulsion fracture involving the talus posteromediallly at the attachment of the tibiotalar component of the deltoid ligament. The fracture line remains identifiable, however, and is therefore not yet completely healed. There is complete healing of the bone contusion involving the talaz head and neck medially. There is resolution of ihe right ankle joint effusion and subtalar joint effusion. Left Elbow• Truly Open MRI Impression dated October 31, 2006 consisted of mild to moderate subcutaneous soft tissue edema to the posterolateral aspect of the left elbow, suggesting post- traumatic subcutaneous contusion/inflamrtiation. Mild edema noted over the medial left elbow. No evidence of left elbow fracture. Steinberg, M.D., Dr. Andrew R. Rothstein, D.P.M., and Hathaway Chiropractic, whose billings and/or reports are yet to be received. Mr. Rall's prognosis remains guarded. Loss of Earnines Mr. Rall was employed by Golden Valley Products 49-570 Highway 111 Coachella, CA. 92236 (760) 391-5300 in sales, earning approximately$1,500.00 per week. Mr. Rall estimates a loss of earnings of approximately$8,000.00 as a result of the injuries sustained in the subject accident. Property Damage The 2005 Harley Davidson motorcycle owned and driven by Mr. Rall was "totalled" following the incident, the actual cash value of the motorcycle plus sales tax, license fees, DMV fees, at$22,915.34, less Mr. Rall's $500 insurance deductible. All times, speeds and distances are approximate. 4 Measurements were made with a roll tape. 5 6 STATEMENTS: 7 D-1 (Gardner) Refer to Cpl. D. Devinny's supplemental report for Gardner's statemets. 8 9 D-2 (Rall) related he was north on Monterey in the # 1 or#2 lane, approaching Sagewood and 0 traveling about 50 —55 mph, While driving V-2 (Harley Davidson). Rall said the other motorcyclist, 1 D-3 (Funkey) was traveling on his left side. Rall told me he heard Funkey's motorcycte squeal his 2 brakes and realized that a car had pulled out in front of them. Rall said he also put on his brakes 3 and that he could not swerve #o #he left because Funkey was there. Ral! said he saw the car 4 continue to roll into the roadway and when it got halfway across Monterey and in front of him in his �5 lane, he hit the car on its right side, fell and slid. Rall told me that immediately after he stopped :6 sliding, he got up for a moment but then fell back down. 17 18 D-3 (Funkey) related he was north on Monterey Ave. in the# 1 lane approaching Sagewood at 19 about 60 mph while driving V-3 (BueN). Funkey said he was traveling just left of Rall and a bit ?0 ahead of his motorcycle. Funkey him and Rall were traveling about the same speed when `all of a ?1 sudden' he saw a car pull out from Sagewood in front of them. Funkey told me the car did not stop ?2 when it entered onto Monterey. Funkey said he just 'slammed' on his brakes and went down. ?3 Funkey told me he did not know if Rall's motorcycle had hit the car or not. Funkey cor�firmed that ?4 he did not collide with Rall prior to the car pulling out. ?5 ?6 W-1 (Bisbas) related he was north on Monterey Ave. in the center lane approaching Sagewood ?7 and traveling about 35 mph. Bisbas said he was traveling behind the two motorcycles. Bisbas told ?8 me the motorcycles did not appear to be speeding and were traveling at a 'regulaP speed. He said ?9 the yellow bike was traveling next to and on the right side of the other one. Bisbas said he saw a 30 silver car pull out from Sagewood onto Monterey and then the car pulled out again farther and 31 onto Monterey. Bisbas told me he saw the yellow motorcycle hit the silver car and the other 32 motorcycle slid across the pavement. Bisbas added that the silver car was in the middle of the 33 road when it stopped. 34 35 W-3 (Kolbeck) related he was north on Monterey riding a motorcycle and behind both the Harley 36 Davidson and the Buell Motorcycles. Kolbeck said as he approached Sagewood, he saw the silver 37 car pulling out from Sagewood onto Monterey. Kolbeck told me he thought the car was intending 38 to make a left turn and when it entered Monterey, it continued and struck the Harley Davidson 39 causing the Harley Davidson to swerve into the other motorcycle —V-3 (Buell). Both were traveling 4 about 50�0 mph. D-2 (Rall) was driving the Harley Davidson and D-3 (Funkey)was driving the 5 Buell. V-1 (Jeep) was west on Sagewood approaching Monterey at a slow speed and driven by D- 6 1 (Gardner). 7 8 As both motorcycles approached Sagewood, Gardner entered Montery Ave. from Sagewood in 9 the path of V-2 (Harley Davidson) causing D-2 (Ral!) to brake. The Harfey Davidson and V-1 10 (Jeep) collided in the #2 northbound lane of Monterey causing the Harley Davidson to veer to the 11 left, fall down and skid across the pavement. As the Buell approached, Funkey also braked and 12 swerved to the left in an attempt to avoid the Jeep. NUMBER 10/20/2006 0659 3300 1802 T - 06 293 008 1 SUPPLEMENTAL REPORT 2 3 PURPOSE: 4 The purpose of this supplemental report is to provide the following: 1) Notification, 2) 5 Statements, 3) Evidence. 6 7 NOTIFICATION: 8 I was advised of this injury traffic collision at about 0659 hours by Motor 71 (Deputy Rod 9 LaBrecque). I responded from Fred Waring and San Pablo and arrived on scene at about 0706 10 hours. When I arrived I observed a white female adult, later determined to be D-1 (Gardner) 11 standing in front of V-1 (Jeep). The vehicle was on Sagewood Drive, just east of the limit line with 12 Monterey facing west. I observed a fluid trail that led from V-1 westbound out into the number two 13 northbound lane of Monterey. At the end of the fluid trail in the number two lane was a skid mark 14 that began south of Sagewood. That skid continued north until the location of the fluid trail and 15 then veered to the left and continued north. Refer to photographs for further. 1fi 17 STATEMENTs: 18 D-1 (Gardner): The following is a summary of her statement to me. I asked D-1 if she was injured 19 and she told me she was not. I asked her if she moved her vehicle after the collision and she told 20 me she backed it up to the location it was now. I pointed to the AOI where I observed a skid mark 21 that deviated to the left and to where I observed a fluid trail that led from the AO! to V-9 and asked 22 D-1 if that is where she backed her vehicle from. D-1 told me that it was. I asked D-1 to tell me 23 what she remembered. D-1 told me she was preparing to make a right turn from Sagewood at 24 Monterey. D-1 told me she observed finro northbound motorcycles with one in the middle (number 25 2 lane) and the other in the far right lane (number 3 lane). D-1 told me she watched as the two 26 motorcycles collided into each other. D-1 told me after the two collided, "The force banged them 27 into me". 28 Z9 I asked D-1 to show me where she thought she was when she was looking at the two motorcycles 30 colliding. She walked to the area of the limit line for westbound Sagewood at Monterey. The 31 location she showed me was about ten feet north of the area of impact in the number two lane. 32 The location �r�e showed me was also north of where her vehicle was currently stopped. The 33 location where V-1 was currently stopped is directly east of the AOI. The fluid trail goes from the 34 AOI, east to V-1's location, which is south of where D-1 was describing as the location she was 35 when she observed the collision of the finro motorcycles. 36 37 I asked D-1 why she thought the two motorcycles collided and she told me, "I guess they were 38 startled there was a car here (me). I guess they thought I was going to pull out". D-1 told me she 39 also saw a group of motorcyclists a short distance behind where the two collided.
