("SJB"), the purpose of this letter is to request that the City waive a mere inconsequential irregularity in a certain bid proposal made by SJB to the City of Palm Desert ("City") for the project known Section 29 Assessment District 2004-002, Contract No. C25570A, Project No. 627-OS ("Project"). This matter is coming up on the agenda for the City Council on Apri126, 2007. SJB had become aware of a minor administrative oversight on its part made in the course of the bid submission. We made this error known to the Public Works Director, Mark Greenwood immediately after the submission. This administrative oversight was a mere failure to include Page C-1-5 in the bid package for the Project, although the bid included the pricing and work scope for that portion of the Project. Even though we made timely this request, Mr. Greenwood informed us that his office will be recommending that the project be awarded to Yeager Skanska, Inc., of Riverside even though SJB is the responsible low bidder for the Project. The pages originally delivered to the City as part of the SJB bid package contained all items and quantities called for in each Addendum. Therefore, in form and substance, SJB bid to the City the construction of the Project in accordance with the .Contract Documents, including Addenda Nos. 1-5 for the amount stated in the bid proposal. It is our view that SJB is bound to cortstruct the Project in accordance therewith. More specifically, SJB's failure to include Page C-1-5 did not make its bid materially different than what SJB intended it to be, and therefore would not provide to SJB a basis for bid rescission under the Public Contract Code. 115 W La Cadena#200 Riverside, CA 92501 Tel: (951) 369-8800 Fax: (951) 369-8803 To substantiate our position, I directed our Project Manager to prepare a Memorandum that identifies where in the bid proposal the changes in items and quantities are located as mandated by Addenda Nos. 1-5. I am enclosing this Memorandum for your review and consideration. Upon your review, I believe that the City will find that for all intents and purposes, each Addendum is in substance referenced in the SJB bid package. Based on the foregoing, SJB believes that it is the lowest responsible bidder for the Project, and that this minor administrative oversight of a late delivery of Page C-1-5 to the City is nothing more than an inconsequential deviation that did not render to SJB an unfair competitive advantage over other bidders. Numbered Paragraph 2 of Page C-1-5 states: "The Owner has the right to reject any or all Proposals and to waive any irregularities or informalities contained in a Proposal." All bidders are required to acknowledge that provision, and SJB has done so as well. SJB, at this time, respectfully requests the City accept the late delivery of Page C-1-5 based on the foregoing and that the City confirm the awarding of the contract for the Project to SJB. Under Public Contact Code, Section 5103, the City has the power and legal authority to waive irregularities that do not render tha bid materially different than it was intended to be. Here, the City will save thousands of doltars ($38,318.00)by waiving the i�regularity and awarding the contract to SJB. I am enclosing for your consideration our original bid, our November 7, 2006 correspondence with the City Engineer Joe Gaugash and the Public Works Director Mr. Greenwood (with enclosures), and Mr. Greenwood's letter of November 8, 2006 to SJB announcing that the contract was being awarded to Yeager Skanska, Inc. and not to SJB. You will note that Mr. Greenwood did not indicate any reason for unwillingness to waive the irregularity. Please note that it is my intention to speak at the upcoming City Council meeting on April 26, 2007 when this matter comes up on the agenda. Thank you for your due consideration. ("SJB") has become aware of a minor administrative oversight on our part made in the course of the submission to the City of Palm Desert ("City") of the SJB bid proposal for Section 29 Assessment District 2004-002, Contract No. C25570A, Project No. 627-OS ("Project"). This administrative oversight was our failure to include Page C-1-5 in the bid package for the Project, although that Page was delivered to you earlier today. The purpose of this letter is to request that the City waive what SJB believes is a mere inconsequential irregularity in the bid proposal. Page C-1-5 is the face page for the bid proposal, and required that SJB reference the Addenda therein. For this Project, the City issued Addenda Nos. 1 through 5. Although the City did not receive SJB's Page C-1-5 with the original bid package, the pages originally delivered to the City as part of the bid package contained all items and quantities called for in each Addendum. Therefore, in form and substance, SJB bid to the City the construction of the Project in accordance with the Contract Documents, including Addenda Nos. 1-5 for the amount stated in the bid proposal. It is our view that SJB is bound to construct the Project in accordance therewith. More specifically, SJB's failure to include Page C-1-5 did not make its bid materially different than what SJB intended it to be, and therefore would not provide to SJB a basis for bid rescission under the Public Contract Code. To substantiate our position, I have directed our Project Manager to prepare a Memorandum that identifies where in the bid proposal the changes in items and quantities are located as mandated by Addenda Nos. 1-5. I am enclosing this Memorandum for your review and consideration.
