Recommendation:
By minute motion, waive further reading and adopt
Resolution No. 07-30 vacating excess public utility
easements in Lot "C" and a portion of Lot "K", and the
Emergency Vehicular Access Easement (EVAE) in Lot "C",
Tract 25296-6 in the Canyons at Bighorn.
Discussion:
The subject public utility easements (PUE) are located within all of Lot "C", Canyon
Crest, currently a short, private cul-de-sac and also within Lot "K", a designated
landscape lot, both of Tract No. 25296-6 in the Canyons at Bighorn development. As is
true for all private street lots in Bighorn, there is also an emergency vehicular access
easement over Lot "C", in which a private driveway will be constructed; therefore, an
emergency access easement will no longer be necessary there.
The owner/developer, B-16 Development, Inc., plans to merge Lots 12, 13, "C" and a
portion of Lot "K" to construct a main house, guest house, pools and tennis court as
shown on the attached grading plan. Lot 12 has already been merged with a triangular
portion of Lot "J" of the aforementioned map as approved by the Planning Commission
as a public hearing item (P.M.W. 05-12) on September 12, 2006.

All utility companies that had any live facilities within Lot "C", Canyon Crest, have
abandoned and relocated their facilities. Lot "C" is no longer useful or necessary for
private street or public utility purposes as access and utility services will come off of
Andreas Canyon Drive as shown per said map. Only a smaller portion of the public
utility easement within Lot "K" is being vacated and there are no public utility facilities
within it.
This particular case meets the requirements of a "summary vacation" pursuant to the
California Streets and Highways Code, Division 9, Part 3, Chapter 4, whereby the
vacation procedure does not involve an evaluation from the Planning Commission nor
the scheduling of a public hearing.
Therefore, staff requests that City Council waive further reading and adopt resolution
No. 07- , vacating excess public utility easements in Lot "C" and a portion of Lot "K",
and the emergency vehicular access easement in Lot "C", all in Tract No. 25296-6 in
Canyons at Bighorn.
